S-1439 - 10/13/2015 - LIBRARY - Ordinances ORDINANCE 2015-LY-CMPTR-EX1-S-1439 AN ORDINANCE ADOPTING A REVISION TO THE COMPUTER USE POLICY FOR THE OAK BROOK PUBLIC LIBRARY WHEREAS, on July 28, 1998, the Village Board passed Ordinance S-908 to adopt a Computer Use Policy("Policy's, which Policy was most recently amended by Ordinance 2015-LY-EX1-S-1416; and WHEREAS, the Library Commission and Library Director have reviewed the Policy and recommended that it be amended to prohibit patrons from: (i) moving library computers and equipment; (ii) unplugging computers and equipment; (iii) attaching equipment and devices to the library computers; and (iv)disconnecting library computers from the network; and WHEREAS, the President and Board of Trustees of the Village have determined that it will serve and be in the best interests of the Village and its residents to replace the current Policy with the Policy attached hereto as Exhibit A; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Amendment to Policy. The Policy is hereby amended with, and replaced by, the Policy attached hereto as Exhibit A. Section 3: Conflict. All ordinances, or parts thereof, in conflict with this Ordinance are hereby repealed to the extent of the conflict. Section 4: Severability. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. Section 5: Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Purpose The Oak Brook Public Library provides access to computers and the Internet as a source of information to meet its patrons' educational and recreational needs. This policy sets the conditions under which patrons may use the Library's public access computers. II. Goal Oak Brook Public Library's goal is to provide computers with high speed access to the Internet. III. Provisions A. The use of electronic resources is permitted in accordance with license agreements binding the Library. B. The Library does not monitor and has no control over information on the Internet. It makes no guarantees,either expressed or implied,with respect to the quality of the content of information available on the Internet since it is an unregulated information network. C. Information and images found on the Internet may be inappropriate or offensive to some individuals. The Library reserves the right to require individuals to discontinue the display of information and images that disrupt the orderly operation of the Library. D. The Library assumes no responsibility for any damages, direct or indirect, arising from its connections to the Internet. E. The Library reserves the right to filter Internet access in accordance with recommendations from the Village Administration,the Village of Oak Brook Board of Trustees and the Oak Brook Library Commission. IV. Access A. The Oak Brook Public Library provides its patrons with access to the Internet via public computers and its wireless network. B. Patrons using the Internet must agree to the conditions of the online Internet User Agreement each time they access the Internet from the Library's public computers or wireless network. C. Parents or legal guardians, not Library staff, are solely responsible for deciding which Internet resources are appropriate for their children. D. The Library subscribes to a public computer use and print management system. Ordinance 2015-LY-CMPTR-EX1-S-1439 Adopting Revision to the Library Computer Use Policy Page 4 of 4 E. Use of the public computers requires one of the following: 1) a current Oak Brook Library Card; 2)a registered card from another library; 3)a purchased Computer Use Card; or 4)a guest pass which is good for one hour.Guest passes can be extended for additional time for a $1 fee. F. Guest computers are available in the Lobby for any visitor; however, no printing is available from these computers. G. Patrons are prohibited from moving the Library's computer equipment from,and within,the Library. H. Patrons are prohibited from disconnecting any Library computer or computer equipment. I. Patrons are prohibited from connecting or attaching any equipment or devices to the Library's computers. J. Patrons are prohibited from disconnecting the Library's computers from the Library's network.
