R-101 - 02/10/1970 - TAX EXEMPT PROPERTY - ResolutionsIft RESOLUTION FiaFSfAr#OA) 4i Al SEE ' ALSO: Whereas, the President and Board of Trustees of the Village 6-148' of Oak Brook, DuPage County, Illinois, have determined that there &-L&4 is a public need for the acquisition of real property for the pur- pose of providing an additional fire station for the Village of Oak Brook, which real property is legally described as: Lot 16 in the Central Industrial Plaza Subdivision, a subdivision in part of the Southeast Quarter of Section 23, a part of the Southwest Quarter of Section 24, Town- ship 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded June 1,, 1965, as Document 6R65 -18254 in DuPage County, Illinois; and Whereas, the President and Board of Trustees are of the opinion that the fair market value of said real property, together with all improvements thereon is ONE AND SIXTY ONE HUNDREDTHS DOLLARS ($1.60) per square foot; and Whereas, it is the opinion of the President and Board of Trustees that an offer to purchase such real property for such amount should be made to the owners of said property prior to filing of a suit for condemnation; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois: Section 1. That the Village Administrator of the Village of Oak Broo , 1 nois, be and he is authorized and directed to con- vey to the owners of said property an official offer to purchase said property, together with all improvements thereon, for ONE AND SIXTY HUNDREDTHS DOLLARS ($1.60) per square foot; and, whereas, it appears that said tract contains 83,635 square feet, the sum of $133,816.00, subject to survey, which said offer shall include an invitation to the owners to appear before the President and Board of Trusties to further discuss the purchase of their property by the Village, if they so desire. Section 2. That in the event the owners of said property accept su o er, then in such event the President and village Clerk, together with the attorney for the Village, be and they are hereby authorized and directed to proceed with the preparation of the necessary documents and the President and Village Clerk are hereby authorized and directed to execute the same and to proceed with the acts necessary for the acquisition of such real property. Section 3. In the event that such offer to purchase is re- fused, or not accepted, within fifteen (15) days from the receipt thereof by the owners, then the Village Administrator is authorized and directed to convey such information to the attorney for the Village, who is hereby authorized and directed in such event to immediately file a condemnation suit in the Circuit Court of the 18th Judicial Circuit, DuPage County, County Division, for the acquisition of said property, together with all the improvements thereon, as by statute in such cases made and provided.
