A RESOLUTION CONCERNING TRUCK SAFETY AND
THE PROHIBITION OF LONGER COMBINATION VEHICLES
® WHEREAS, last year in the united States 100,000 people were injured
and 4,500 killed in traffic accidents involving trucks; and
WHEREAS, car passengers are 32 times more likely to the in a car-
truck collision than the driver of the rig; and
WHEREAS, 76% of the trucks in truck-related accidents had broken,
substandard or defective parts, and 41% of them were so poorly maintained
they were immediately ordered out of service; and
WHEREAS, longer combination vehicles, such as the "Twin 48" (one ` 1
truck carrying two 48 foot trailers) measuring more than one-third the size I
of a football field and weighing as much as 134,000 pounds have an accident
rate as much as 2-3 times that of standard trucks; and
WHEREAS, the violent whip-like actions which occurs when trucks
rapidly change lanes is 3 1/2 times stronger in triple trailer trucks; and
WHEREAS, highway traffic safety and the prevention of accidents
is of the utmost concern to all of us using the Illinois Interstate Highway
and Tollway System.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DARIEN, DU PAGE COUNTY, ILLINOIS, that the City of Darien
supports efforts that resist increasing the size and weight of commercial

trucks, and urge the Illinois General Assembly to consider passing legislation !I
that will prohibit these types of vehicles from the Illinois Interstate Highway
and Tollway systems.

Double 48s are currently legal in Indiana and Ohio, and western
states such as Kansas, Oklahoma, Utah, Idaho, and North and South Dakota.
Montana allows triple bogey trucks, according to the Chicago Tribune.
The Boara say wish to approve the Legislative Committee recommendation.
The Legislative Committee made this recommendation apart from its regular
Legislative Program because the City of Darien believes this issue will come
up during veto session.

SUBJECT: Long-Combination Vehicles
RECOMMENDATION: That the Village President and Board of Trustees direct the
Village Attorney to prepare a resolution opposing the
legalization of "long-combination vehicles" of lengths up
to 110 feet and weighing as much as 134,000 pounds on
Illinois highways, and send this resolution to our County,
State and Federal legislators.
All federal highway taxes must be reauthorized in 1991. While there is
interest across the country in highway tax increases, trucker and some
shippers in return favor increases in truck sizes and weights. This increase
would be to longer combination vehicles (L.C.V.$), triple trailers and twin
48-foot trailers with weights up to 134,000 pounds and lengths up to 110
feet. Truck size and weight increases of this scope would have a negative
impact because of safety issues, the damage these trucks would cause to the
highway system, increased pollution, energy consumption and congestion
generated by freight transportation. There is wide public opposition to the
L.C.V.s, ranging from grassroots citizen groups to the International
Teamsters organization.
Illinois currently allows double trailer combinations on Class I highways j
(primarily interstates with some five-mile access privileges) as long as each

easily disassembled. IDOT and the Illinois Railroad Association can be

they pose in traffic. DuPage County Mayors and Managers LegisLative
Committee opposes L.C.V.s citing both safet-y and cost concerns, and the Board
of Directors agreed with their recommendation to oppose.
The Village received a letter from Mr. Mel Kehr requesting that Oak Brook
adopt a resolution opposing L.C.V.s (see attached letter to President Cerne
dated October 3, 1990). The City of Darien has adopted such a resolution,

review a brochure from the Citizens for Reliable. and Safe Highways (CRASH)
opposing L.C.V.s and providing some valuable statistics and summary.

Audrey Muschler, President of the Oak Brook Historical Society,
introduced Mr. Howaed Decker, Consultant from Kemp Architecture
and Urban Design. Mr. Decker presented an overview of the
preservation of the Franciscan property. Mr. Decker suggested
a marketing feasibility of the site be completed for interested
organizations who could then enter into an intergovernmental
agreement for preservation of the site.
Kathleen Sievertsen, representative of the Oak Brook Catholics,
stated the Joliet Diocese is interested in speaking with a
consortium for the preservation of the site. �

Mrs. Muschler will assist in forming this consortium and the .
financial feasibility of this project. A preservation
ordinance was also presented to the Board.
President Cerne requested comments of major property owners
in the area be solicited +or their conception of this project.
The President indicated he would appoint a member to the
consortium when formally requested.
ISCUSSION ON FEDERAL HIGHWAY TAX FUND REAUTHORIZATION
POSSIBLE LEGALIZATION OF LONGER COMBINED TRUCKS WEIGHING AS
MUCH AS 134,000 POUNDS:
Mr. Mel Kehr, concerned citizen against L.C.V. 1s, presented
a short film to the Board on the Long-Combination Vehicles
manuevering problem. Discussion ensued relative to the concern +or
these vehicles.
It was the concensus o+ the Board to support a resolution
opposing the legalization of increasing the z and weight of |
Long-Combination Vehicles and forward said resolution to
appropriate County, State and Federal legislators. President

next Board meeting.

operating on Illinois roads. The Board also reviewed a resolution passed by
the City of Darien opposing these vehicles. The Board directed staff to
develop a resolution opposing longer combination vehicles for the Board to
review at our meeting of November 27, 1990.
The resolution has been prepared and approved by Attorney John Brechin. We
thus submit it for your review.

Thank you for letting me know of your opposition to trucking
industry proposals for Federal legislation to allow states to permit
the operation of longer, heavier commercial vehicles on certain
highways*
it has come to my attention that some misinformed individuals
are alleging that I am supportive of proposals to permit the longer
commercial vehicles. Let me set the record straight. I share your
concerns about tue longer combination Vehicles (LCV) , and I do not
support Federal preemption of the states' ability to lixdit the size,
weight and length of commercial vehicles over that which is
currently mandated under Federal law.
The Subcommittee on Surface Transportation is 'currently in the
process of holding hearings on reauthorization of the Federal-aid
highway programs and has heard from several groups on the issue of

Dear Mr. Berley:
Thank you for contacting me. I too am concerned about a possible
relaxation of the current size and weight limitations on heavy
trucks and the introduction of triple combination trucks even on
the Interstate Highways System.
Citizens in lighter more energy efficient autos and vans are
sharing the highways with a growing number of heavier, wider,
longer trucks authorized in 1982. Not only are the passengers of
these lighter autos and vans paying the largest share of the
costs of road damage, but they are 38 times more likely to be
killed in a tractor.-trailer crash than the driver of the truck.
If heavier trucks become an acceptable standard for local
deliveries, localities must accept the road damage and
deterioration in safety or suffer economic loss.
Last year I wrote to the Secretary of Transportation objecting
strongly to relaxation of rules of local access for the heavy
vehicles authorized in 1982. I also urged him to support rail
programs that would encourage the freight railroads to stay in
business instead of abandoning hundreds of miles of railroad
every year.
In reshaping national transportation policy, the Administration
had substantial support from state and local public officials and
citizens to turn this situation around. Instead, the President
has zeroed out every rail program in his current budget except
rail safety.
Again, thank you for contacting me. I look forward to your
support for a balanced transportation system that includes a
strong rail system as well as highways and airports, and you can
be certain I will oppose any increase in the size and weight of
trucks when the surface transportation act comes up for debate
next year.

Thank you for your letter regarding your opposition to an increase
in the current weight limit on trucks and the use of longer combination
vehicles (LCVs) for freight transport.
As part of -the 1987 Highway Reauthorization Act, Congress ordered
the National Academy of Sciences (NAS) to study the current status of
motor vehicle size and weight regulations. On July 2, 1990, NAS
completed the study and recommended elimination of the 80,000 pound
limit on truck weight, as well as the restrictions on LCVs. To date,
no legislation has been introduced to codify the recommendations of the p
NAS. The House Public Works Committee will take up reauthorization of
the highway program next spring.
Elimination of these regulations would have a number of serious
effects on our national highway system. I am concerned about safety
issues, traffic problems, and overall stress on the highway infrastruc-
ture as a result of allowing larger, heavier vehicles on the road.
When reauthorization of the highway program is debated on the House
floor, I will examine critically the proposals involved with your
suggestions in mind.

your resolution, and are in total agreement .with it. Though, please
note that in an attempt to get "monster trucks." passed last session, I
was the "do not pass" motion in the Senate Transportation Committee,
which, for all intents and purposes, killed off the bill at that time.
However, I expect that with the strong trucking lobby in Springfield
we will revisit this issue again. I intend to continue in my
objections to this proposal.

regulations regarding limits on the length and weight of
commercial trucks.
Each state sets its own commercial truck size limitations. There
is currently no legislation that would supersede state laws and
allow for larger trucks nationwide. However, you may be sure I

introduced and brought before the full Senate.
