NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS as follows: That Roosevelt Road South Frontage Road from Salt Creek to• York Road will be included in the municipal street system of the Village of Oak Brook upon completion of the improvement, final field inspection by the State, acceptance by the Village and notification by the District Engineer. The width of said South Frontage Road transfer is defined as between the southerly and westerly right-of-way line and the northerly and easterly access control line, -said access control line being 8t feet northerly or easterly of the frontage road edge of pavement. That the Village Clerk is directed to forward a certified copy of this Resolution to the State of Illinois through its District Engineer's office at Schaumburg, Illinois. WITNESSETH: WHEREAS, the VILLAGE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving FAP Route 347 (South Frontage Road) south of Illinois Route 38 from the east abutment of the bridge carrying South Frontage Road over Salt Creek to the south edge of pavement of the York Road Connector including the Illinois Route 38 (Roosevelt Road) Slip Ramp and the York Road Connector, (State Section: (C&J) R&R-2-RS), in the Village of Oak Brook, DuPage County, Illinois by making the following improvements: A. FAP Route 347 (South Frontage Road) - from the east abutment of the bridge carrying South Frontage Road over Salt Creek to the south edge of pavement of the York Road Connector including the Illinois Route 38 (Roosevelt Road) Slip Ramp and the York Road Connector i Pavement patching and resurfacing to provide South Frontage Road with one il ' and variable width through traffic lane in each direction separated by thermoplastic pavement marking. Existing 5' and variable width gravel shoulder will be regraded. The chain link access control fence will be replaced along Illinois Route 36 (Roosevelt Road) and guardrail will be replaced as needed. The Illinois Route 38 slip ramp and the York Road Connector will be resurfaced and all other work necessary to complete the improvement in accordance with the approved plans and specifications. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 1. The VILLAGE agrees to make the surveys and prepare plans and V /R-, 511 0 2. The STATE agrees to receive bids and award the contract, furnish Ii engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications, and contract. The State will pay for all construction and construction j� engineering costs. 3. The VILLAGE and the STATE have agreed to a jurisdictional transfer of South Frontage Road as improved as part of this improvement (FAP Route 347 (South Frontage' Road) south of Illinois Route 38 from the east abutment of the bridge carrying South Frontage Road over Salt Creek to the south edge of pavement of the York Road Connector and including the York Road Connector). The width of said South Frontage Road transfer is defined as between the southerly and westerly right-of-way line and the northerly and easterly access control line, said access control line being 8 + feet northerly or easterly of the frontage road.edge of pavement (said transfer area is depicted in Addendum #1 to Exhibit A). A copy of the Jurisdictional transfer is attached hereto as Exhibit A (BLR 1600). Upon completion of the improvement and final field inspection by the STATE, acceptance by the VILLAGE, and notification by the District Engineer, the VILLAGE will assume jurisdiction of South Frontage Road. 6. The STATE will continue to have Jurisdiction and maintenance over the Il l inoi s'P.oute 38 (Roosevelt Road) slip ramp from the south Frontage Road to Illinois Route 38. 7. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. Where a municipal utility has been installed (1 ) on right of way acquired by the STATE or (2) within defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. NOW THEREFORE IT IS AGREED that the corporate authority of said municipality will pass an ordinance providing for the transfer of the above location and shall attach hereto and make a part hereof a copy of a location map as Addendum No. 1 and a copy of the ordinance as Addendum No.2,and Include for Counties Only WHEREAS.the authority to make changes to the County Highway System is granted to the County by Section 5-105 of the Illinois Highway Code.
