WHEREAS, the Village of Oak Brook is located almost entirely within
DuPage County, which has adopted a Countywide Stormwater and Flood Plain
Ordinance, (the "County Ordinance"), on September 24, 1991, in accordance with
Illinois Revised Statutes, Chapter 34, paragraph 5-1062; and
WHEREAS, said Ordinance requires the filing of a petition to the
Stormwater Committee for a complete waiver of enforcement of the Ordinance
within sixty (60) days of the enactment of the Countywide Ordinance; and
WHEREAS, the Village of Oak Brook has reviewed the obligations and
responsibilities of the three options available to municipalities for
administration and enforcement of the Countywide Ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAR BROOK, DU PAGE AND COOK COUNTIES, IMINOIS as follows:
Section 1: The Village of Oak Brook hereby petitions to be designated a
complete waiver community for the enforcement of the County Ordinance.
Section 2s The Village of Oak Brook will submit to the Stormwater
Committee its petition and required attachments to this effect in accordance
with Section 15-33 of the County Ordinance. The Village President and Village
Clerk are hereby authorised and directed to execute a Petition for Waiver
Community Status substantially in the form of petition attached hereto as
Exhibit A.
Section 3: The Village of Oak Brook agrees to adopt the provisions of
the County Ordinance, either by reference or by adopting its own equivalent
ordinance.
Section 4: The Village of Oak Brook agrees to include provisions in any
new annexation agreements to require compliance with standards and require-
meets of the County Ordinance whether adopted by reference or contained within
the Village of Oak Brook's own ordinance.
Section 5: The Village of Oak Brook agrees to the rules and procedures
governing its petition, including, without limitation, the Committee's
procedure for reasserting County jurisdiction over stormwater management
within waiver community boundaries.

Section 6: The Village of Oak Brook approve the Official List of Exempt
Developments which is attached hereto as Exhibit B and incorporated herein.
Sects 7: This Resolution *hall be in full force and effect immediately
upon its passage and approval in the manner provided by law.

Oak Brook, IL 60521, by a vote of its governing body on
November 12, 1991, hereby petitions for complete waiver
community status for the administration and enforcement of
the Countywide Stormmater and Flood Plain ordinance within
its corporate boundaries.
Said Petition is hereby filed with required attachments
pursuant to Section 15--33 of the County Stormwater and Flood
Plain Ordinance. The Village of Oak Brook agrees to enforce

DUPAGE COUNTYWIDE STORMWATER AND FLOODPLAIN ORDINANCE
November 8, 1991
1 . All building permits issued prior to February 15, 1992.
2. The McDonald' s Office Campus development. This is a phased 20
year ± development on Jorie Boulevard. Phase 1 constructed the
entire stormwater management system consisting of detention and
floodplain compensatory storage to account for full development.
Approvals to date include:

Phases 1 , 1-B, and 2 have been completed. Future phases remain to
be constructed.
3. York Lake Subdivision - Approved by Resolution R-520 on 2/26/91.
This eight (8) lot residential subdivision at 3416 York Road
remains to be constructed. Detention, erosion measures and
floodplain/wetland delineations have been approved.
4. Brush Hill Subdivision - Subdivision approved by Resolution R-503
on 8/14/90. Flood Plain Special Use approved by Ordinance S-701 on
8/14/90. This seven (7) lot residential subdivision at 3603 York
Road remains to be constructed. Detention, erosion measures,
compensatory storage, and floodplain/wetland delineations have been
approved.
5. FJS & BJS Resubdivision - Two (2) lot residential subdivision
approved by Resolution R-540 on 9/24/91 . This subdivision has one
( 1 ) existing house (318 Canterberry Lane) and a second house will
be constructed on the second lot through a building permit yet to
be applied for. Detention not required since area is less than 5
acres.

6. Ginger Creek Lagoons (Route - Accomplished b

the Oak Brook Park District to provide 40 acre feet ¢ in the early
1970's to provide sufficient detention for the northerly tributary
area to the East-West Tollway.
7. Oak Brook Park District Community Center (1425 Kensington Road) -
Flood Plain Special Use tabled by Village Board on 11/13/90.
Village Engineer has given approval of the stormwater mgnagement
design (compensatory storage and detention) prior to the tabling
date.
8. Lot 20-Merry Lane - Flood Plain Special Use approved by Ordinance
5-699 on 8/14/90 to allow one single family home on one lot at 811
Merry Lane with compensatory storage. Building permit has not been
applied for yet.
9. Andy's Steakhouse (22nd Street/Midwest Road) - Parking lot
improvements approved by Ordinance S-658 on 12/13/88 and by
Ordinance 5-713 on 6/11/91. Improvements are scheduled for early
1992. Detention was approved by Village Engineer.
10. Official Airline Guides (2000 Clearwater Drive) - Flood Plain
Special Use granted to allow construction of a parking structure
and additional surface parking within the floodplain by Ordinance
5-521 on 3/27/84. Applicant has not made application to construct
these improvements yet. Compensatory storage approved.
11 . Cantore ( 160 Forest Trail) - Flood Plain Special Use granted to
allow site grading. Site grading plan approved by Village Engineer
on 7/18/91 for compensatory storage. Site work has not yet taken
place.
12. Malloy (3823 York Road) - Flood Plain Special Use for building
addition to have less than three (3 ' ) foot of freeboard by
Ordinance S-590 on 7/08/86 and compensatory storage. Applicant has
not applied for building permit yet.
13. Bruce, (459 Forest Trail ) - Flood Plain Special Use to allow
floodproofing of building, compensatory storage, and some expansion
of building by Ordinance S-653 on 9/13/88. Applicant has not
followed through and is awaiting acquisition of her home as part of
the Salt Creek Flood Mitigation Plan.
14. Breakenridge Farm Unit III Subdivision-Approved by Resolution R-511
on 10/23/90. This two (2) lot residential subdivision at 82
Breakenridge Farm remains to be constructed. Detention and erosion
measures have been approved.

15. Mizen' s Subdivision-Approved by Resolution R-505 on 9/25/90 and by
Resolution R-519 on 2/26/91. This six (6) lot residential
subdivision at 407 Glendale Avenue remains to be constructed.
Detention and erosion measures have been approved.

16. Ginger Creek Subdivision-Curb and Gutter and Pavement Widening
Project - Flood Plain Special Use granted by Ordinance 5-686 on jl
4/10/90. This paving project was postponed by the Village Board
until a clear majority of the residents approved of it.
Compensatory storage has been approved.
17. Buck-Ernie Pyle Development (Route 83/16th Street)-Approved by
Resolution R-456 on 7/12/88 and Resolution R-474 on 4/25/89. This I!
three (3) lot commercial subdivision is under construction and will
provide all detention requirements for all future improvements.
