WHEREAS, the Village of Oak Brook (Village), is a municipal corporation, duly Incorporated tinder the laws of the State of Illinois in DuPage and Cook Counties; and WHEREAS, the Village has adopted and from time to time has reviewed and amended a Comprehensive Zoning Ordinance and a Comprehensive Community Plan encompassing the Village and its environs; and WHEREAS, the Village was represented at the DuPage County Zoning Board of Appeals public hearing on February 16, 1978, relative to Its Docket Nos. 2818 and 2919; and WHEREAS, the Village's geographical Omits are within one and one -half miles of the subject parcels of Docket Nos. 2818 and 2819, being on the south side of the 35th Street right -of -way abutting said parcels along 1840 feet of frontage; and WHEREAS, though the property is not within the fire protection area of the Village, the Village is providing temporary fire protection service to the subject parcel; and WHEREAS, access to the subject property is currently provided solely from 35th Street, a Village right -of -way: NOW, THEREFORE, be It resolvea by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois: 1. That the Village objects to a change of zoning from the R -1 Single Family Residence District with a Special Use to the R -3 Single•Famlly Residence District for the parcel of land legally described in DuPage County Zoning Board of Appeals Docket No. 2819, for the following reasons: (a) The petitioner has presented no evidence that the existing zoning is unreasonable; (b) The petitioner has presented no evidence Indicating that the proposed rezoning is In the public interest, would not have an adverse impact on surrounding properties or would not be solely for purposes of economic gain to the property owner; (c) The petitioner has indicated that the property owner has no plans to develop the property under the requested zoning classification; (d) Development under the proposed zoning reclassification would have an adverse Impact on the condition, capacity, and safety of 35th Street; and (e) The proposed zoning classification would have a depreciating effect on adjacent properties within the Village zoned for Single Family home sites on minimum 25,000 square foot lots. 2. That the VII °rage objects to a change of zoning from the R -I Single Family Residence District with a Special Use for the parcel of land legally described in DuPage County Zoning Board of Appp�eals Docket No. 2818 until the petitioner demonstrates to the satisfaction of tha County of DuPage and the Village that existing and the proposed facilities will have. adequate fire protection services. 3. That this resolution be filed with the DuPag^ County Clerk In accordance with Section Vill, Administration Paragraph G, Amendments, of the DuPage County Zoning Or naneeid -, l9 ,gas amended, and Chapter 34 Section 3138 of the Illinois Revised Statutes, 1973, as amended.
