R-90 - 03/25/1969 - REFUSE - Resolutions1` pis po so* L RESOLUTION PA O•TWXr Whereas, there has been introduced in the 76th General Assembly a bill identified as Senate Bill 186; and Whereas, said Bill, if adopted, would repeal Section 221a of "An Act To Revise The Law In Relation To Criminal Jurisprudence", designated Article 27, Chapter 100 -1/2 in the Illinois Revised Statutes; and Whereas, the Village of Oakbrook is opposed to S.B. 186, NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Oakbrook, DuPage County, Illinois: 1. That Article 27, Chapter 100 -1/2 of the Illinois Revised Statutes be allowed to remain in full force and effect until adequate experience has been obtained with enforce- ment of performance standards promulgated by the Illinois State Department of Health. 2. That S.B. 186 is unnecessary, because refuse disposal sites can be located more than a mile away from municipal borders. 3. That B.S. 186 further erodes municipal power and authority to control the immediately surrounding environment. it takes away an existing protection and substitutes a State authority with which we have had no experience. 4. That the present law (Art. 27, Chapter 100 -1/2) allows a municipality to dispose of its own refuse within a mile of its borders because a municipality can be relied upon to attend to its own interests. The proposed bill would allow anyone to dispose of any refuse on the borders of a municipality without that municipality's consent, on the un- proved assumption that such refuse disposal cannot possibly have a harmful effect. 5. That municipalities now have the right to prepare comprehen- sive plans for, and control subdivision within, a mile and a half of their borders. Municipalities should surely con- tinue to have the right to regulate refuse disposal within a mile of their borders. otherwise, planning for the orderly development of fringe areas is made a mockery. 6. That S.B. 196 should not be adopted. 7. That copies of this Resolution be forwarded to appropriate members of the Legislature.
