R-876 - 04/06/2004 - ELECTION - Resolutions..t - RESOLUTION 42004- EL- CR -EXI -R -876 I A RESOLUTION DECLARING THE RESULTS OF THE GENERAL PRIMARY ELECTION HELD IN THE VILLAGE OF OAK BROOK ON MARCH 16, 2004 WHEREAS, on March 16, 2004, there was held in and for the Village of Oak Brook, DuPage and Cook Counties, Illinois, an election for the purpose of passage �of the public question- Shall the Village of Oak Brook impose a Non -Home Rule Municipal Retailers' Occupation Tax, in the amount of % of the gross receipts of any sale of personal property, upon any person engaged in the business of selling tangible personal property at retail in the Village of Oak Brook; and shall the Village of Oak Brook impose a Non -Home Rule Muillicipal Service Occupation Tax, in the amount of 1/4% of the selling price of all tangible personal property transferred by a serviceman, either in the form of tangible personal property or in the form of real estate, as an incident to a sale of service, upon all persons engaged,i in the Village of Oak Brook, in the business of making sales of service, to be used by the Village for expenditure on public infrastructure? WHEREAS, the Illinois Election Code provides in relevant part that the Canvassing Board for a Village shall consist of the Village President, the Village j Clerk and one member of the Board of Trustees who has served the longest tenure on the Village Board ( "Canvassing Board "), and WHEREAS, the said election has been regularly called and held as provided by law, and the returns of said election, including the Certificate of Results for the General Primary Election of March 16, 2004 have been filed with the Village Clerk of the Village of Oak Brook, and { i WHEREAS, the results of the March 16, 2004 General Primary Election ar� now before the Canvassing Board of the Village of Oak Brook for the purpose of canvassing the votes cast at said election and the said Canvassing Board is familiar therewith, i NOW, THEREFORE, BE IT RESOLVED, by the Canvassing Board of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: SECTION ONE: That the election held on March 16, 2004 was held in all respects as provided by law. A Notice of said election was duly given by each of the County Clerks of DuPage and Cook by publishing Notices of Election in newspapers of general circulation within the Village of Oak Brook, not more than 30 nor less than 15 days in advance of the date of said election. The Judges appointed by the County Clerks of DuPage and Cook Counties were duly qualified to fill such offices in each of the precincts and were duly sworn to perform their duties before the commencement of said I election. The returns of said election have been duly tabulated by the County Clrks of DuPage and Cook Counties, and were filed with the Village of Oak Brook i SECTION TWO: The Canvassing Board of the Village of Oak Brook finds from its canvass of returns of said election that the votes as set forth in the tabuIlation attached hereto and labeled Exhibit A were cast in each of the precincts hereinafter designated in favor of the public question at said election. SECTION THREE: The Canvassing Board of the Village of Oak Brook finds that the public question: Shall the Village of Oak Brook impose a Non -Home Rule Municipal Retailers' Occupation Tax, in the amount of '/4 % of the gross receipts of any sale of personal property, upon any person engaged in the business of selling tangible personal property at retail in the Village of Oak Brook, and shall the YES 6 L436 Village of Oak Brook impose a Non -Home Rule Municipal Service Occupation Tax, in the amount of '/4% of the selling price of all tangible personal property transferred by a serviceman, either in the form of tangible personal property or in the form of real estate, as an incident to a sale of service, upon all persons engaged, in the Village of Oak Brook, in the business of making sales of service, to be used by the Village for expenditure on public NO 507 infrastructure? I SECTION FOUR: Therefore, this Canvassing Board of the Village off Oak Brook, DuPage and Cook Counties, Illinois, hereby proclaims and declares that proposition passed with 1,436 yes votes and 507 no votes SECTION FIVE: EFFECTIVE DATE. This Resolution shall be in full force and effect upon passage and approval. ROLL CALL VOTE: AYES: President Kevin Quinlan, Trustee George Caleel and Clerk I Linda Gonnella. NAYS: None.
