A RESOLUTION APPROVING THE FINAL PLAT FOR THE KINST SUBDIVISION
AND CONFIRMING VARIATIONS AND WAIVERS FROM CERTAIN PROVISIONS OF
SECTION 14 -6 -3 ( "SUBDIVISION REGULATIONS ") OF THE VILLAGE
CODE OF THE VILLAGE OF OAK BROOK
37 and 38 Yorkshire Woods (P.I.N. 06 -24- 101 -014)
WHEREAS, at its meeting on February 16, 2009 the Plan Commission completed its review and
deliberations on an application from Thomas A. Kinst as executor of the estate of Arlene Kinst, the owner
of Lots 37 and 38 in the Yorkshire Woods Subdivision who was seeking approval for a 2 -lot final plat of
subdivision; and
WHEREAS, by a vote of 6 to 0, the Plan Commission recommended approval of the request for a
final plat of subdivision for the property; and
WHEREAS, on February 16, 2009, the Plan Commission reviewed the petition for subdivision,
variations and waivers and recommended approval of the plat, variations and waivers; and
WHEREAS, the property at 37 and 38 Yorkshire Woods is legally described as follows:
LOTS 37 AND 38 IN YORKSHIRE WOODS (EXCEPT THAT PART LYING
SOUTHEASTERLY OF A STRAIGHT LINE WHICH INTERSECTS THE EAST LINE OF
SAID LOT 37, 90.00 FEET NORTH OF THE SOUTHEAST CORNER THEREOF, AND
INTERSECTS THE SOUTH LINE OF LOT 37, 55.0 FEET WEST OF THE SOUTHEAST
CORNER THEREOF), A SUBDIVISION IN SECTION 24, TOWNSHIP 39 NORTH,
RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORDED NOVEMBER 14, 1947 AS DOCUMENT NUMBER 534056 AND
RERECORDED DECEMBER 11, 1947 AS DOCUMENT 535991, IN DUPAGE COUNTY,
ILLINOIS.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: The foregoing preambles are incorporated herein by reference as though fully set forth
herein.
Section 2: That the Final Plat of Subdivision known as the Kinst Subdivision, prepared by Intech
Consultants, Inc., last revised January 29, 2009 is hereby approved, subject to the following conditions:
A. The Village hereby approves a variation of Section 14 -6 -313 of the Village Code to delay
the extension and construction of water service lines for each lot until the issuance of a
building permit.
B. The Village hereby approves a variation of Section 14 -6 -3C of the Village Code to delay
the extension and construction of sanitary sewer service lines for each lot until the
issuance of a building permit.
C. The Village hereby waives the requirement for paved sidewalks in the Kinst subdivision
as otherwise required by Section 14 -6 -3E.

RECOMMENDED MOTION: I move to concur with the recommendation from the Plan
Commission and approve the requested Final Plat of Subdivision including Variations and
Waivers to the Subdivision Regulations for the Kinst Subdivision located at 37 and 38
Yorkshire Woods and authorize the.Village Attorney to prepare the necessary resolution for
final consideration at the March 24, 2009 Board of Trustees meeting.
Background/History:
At its meeting on February 16, 2009 the Plan Commission completed its review and deliberations
on an application from Thomas A. Kinst, as executor of the estate for Arlene E. Kinst, the owner
of lots 37 and 38 in the Yorkshire Woods Subdivision who is seeking approval of a two-lot final
plat of subdivision. The two existing lots will be reconfigured from a north-south orientation to
one that provides two lots with an east-west orientation. As part of this request, the applicant is
also seeking several variations and waivers to the subdivision regulations to include:
1. Variation to Section 14-6-3B — to delay the extension and construction of water service
lines until time of building permit.
2. Variation to Section 14-6-3C — to delay the extension and construction of sanitary service
lines until time of building permit.
3. Waiver to Section 14-6-3E—paved sidewalks.

Recommendation
By a vote of 6 to 0, the Plan Commission recommended approval of the proposed Kinst

Richard Johnson, Ice Miller LLP, 2300 Cabot Drive, Suite 455, Lisle, Illinois,
Attorney for the applicant who represents the estate of Arlene Kinst, reviewed the
background of the property. They have attempted to sell the property, but have been
unable to do so, primarily due to the configuration of the lots that run north and
south. The parcel had been improved with a single-family residence that was
located in the middle of the two lots, which has since been demolished and the
property leveled off. The request is to reconfigure the lots to run east and west,
which conforms to the rest of the lots in the subdivision and will allow the houses to
be built on each property with access to the forest preserve that would then back up
to each parcel. They are seeking the following variations and waivers to the
Subdivision Regulations.
• Variation to Section 14-6-313 - to delay the extension and construction of
water service lines until time of building permit.
• Variation to Section 14-6-3C - to delay the extension and construction of
sanitary service lines until time of building permit.
• Waiver to Section 14-6-3E - paved sidewalks because there a no sidewalks
in the subdivision.
• Waiver to Section 14-6-3F - street light requirements, because there are
none as it relates to this subdivision.
Member Knitter questioned whether there had been water and sewer on the site prior
to the demolition of the residence.
Mr. John responded that the previous residence used well and septic.
Director of Community Development Kallien said that the request is to change only
the orientation of the two existing lots.
Motion by Member Sharma, seconded by Member Iyer to recommend approval of a
final plat for a two-lot subdivision as revised on January 29, 2009, along with the
following conditions:
1. Variation to Section 14-6-3B - to delay the extension and construction of

Dear Mr. Kallien:
The Forest Preserve District of DuPage County recently received notice of the proposed
resubdivision of the Kinst property. We appreciate receiving timely notification of such projects that
may have an impact on our adjacent property, and thank you for the opportunity to comment.
District Staff has reviewed the public hearing notice and the proposed reconfiguration, and I
would like to share our comments. This property is adjacent to a high quality natural area, known as
York Woods Forest Preserve. Although we have no concerns with resubdivision of the property, the
future development of 2 residences may potentially impact the preserve. This area is considered
important habitat because it is made up of large oak and hickory trees. The root systems and
branches extend beyond the lot lines, and construction creates the potential for damage to and
subsequent mortality of these large native trees.
It also appears that a number of large trees may be removed from the Kinst property to
construct 2 new residences. We urge the Village to preserve as many trees as possible, as they
provide a valuable ecological benefit to the area, including protecting wildlife and aiding with carbon
sequestration. We also encourage the Village to ensure that the necessary protections are installed
during construction, such as fencing around the tree root zones, so that the remaining trees are not
damaged by soil compaction or stockpiling, or erosion from runoff.
We are hopeful that the Village will help foster the type of environment that is needed for the
success of the plants and wildlife at the adjacent forest preserve, and that the future development of
this property wi•II not cause any significant impacts to the preserve. With this in mind, we anticipate
that this preserve will continue to add to the quality of life for citizens of Oak Brook and DuPage
County residents alike. Please consider this as my request that this letter be read and entered into the
public record at the hearing on Monday, February 16, 2009.

Village Engineer Durfey has reviewed this submittal and has
summarized his comments in his February 2, 2009 memorandum (see
attached).
Please see the materials provided by the petitioner in the case file for a
more detailed description of this request.
RESPONSIBILITIES OF HEARING BODIES:
The Plan Commission has the responsibility to make a recommendation
on this request to approve a final plat of subdivision including the
requested variations and waivers to the subdivision regulations.
CONCLUSION: If the Plan Commission is of the opinion that the applicant has satisfied
the requirements for approval of a final plat of subdivision; and that the
variations and waivers to the Subdivision Regulations are found to be in
harmony with the intent and purpose of the official plan, a
recommendation would be in order to approve these requests as
presented. Also, the Plan Commission is authorized to recommend
additional changes and/or modifications as they see fit.

I have reviewed the Final Plats received on January 14 and January 30, 2009, and offer the
following comments:
A. FINAL PLAT
1. This is a resubdivision of 2 existing lots into 2 re-configured lots. The existing
configuration has 2 lots configured lengthwise in a north-south direction; the
proposed configuration has 2 lots in an east-west direction.
2. There are no drafting revisions that need to be made to the plat.
B. WAIVERS AND/OR VARIATIONS
1. Section 14-6-3B: The applicant has requested a variation of installing water service
lines to property line for each lot. Those installations can be accomplished if and
when home construction takes place on each lot.
2. Section 14-6-3C: The applicant has requested a variation of installing sanitary house
service sewer stubs to the property line for each lot. Those installations can be
accomplished if and when home construction takes place on each lot.
3. Section 14-6-3E: The applicant has requested a waiver (not a variation) of the
requirement to install sidewalks. Since the only street is existing Yorkshire Woods,
this request appears to be appropriate.

Backiround/History:

14-7-4: VARIATIONS AND AMENDMENTS:
A Variations: The plan commission may recommend variations from the requirements of this
title in specific cases which, in its opinion, are in harmony with the intent and purpose of the
official plan of the village and in harmony with the spirit and intent of these regulations.
Such recommendations shall be communicated to the corporate authorities and, where the
land affected lies outside the corporate limits, to the appropriate governing authorities of
DuPage County. The village president and board of trustees may approve variations from
these requirements for subdivisions within the village limits or for those where the land
affected lies within one and one-half (11/2) miles of the limits of the village, when, in its
opinion, such variations will not be contrary to the purpose or intent of the official plan and
the spirit and intent of this title.
B. Amendments: These regulations may be amended by the village board from time to time.
The plan commission shall hold a public hearing, due notice of which shall be given, on
proposed amendments. Upon completion of the public hearing, the plan commission shall
make written recommendation to the president and board of trustees for the board's

5.Alignment Of Local Streets: Local streets should be so aligned that their use by through traffic will be
discouraged.
6. Street Jogs: Street jogs with centerline offsets of less than one hundred twenty five feet(125) shall not be
permitted.
7. Intersections: All street intersections should be at or near right angles avoiding acute angles.
An intersection of more than two (2) streets shall be avoided unless specific conditions of design preclude a
different layout.
8. Residential Alleys: Alleys are not permitted in any residentially zoned areas.
B Water Distribution System: A water distribution systemdesigned and constructed in accordance with village
standards and requirements shall be installed to serve all properties within the subdivision and shall include water
mains, fittings, fire hydrants with auxiliary valves, valves and valve vaults and water service lines to property line
for each lot.
1. System layout shall conform with the long range water plans of the village of Oak Brook. All mains shall be a
minimum of six inch (6") diameter.
2. Fire hydrants with auxiliary valves and valve boxes shall be installed at intervals not to exceed three hundred
feet(300') and not less than four feet(4')from the edge of street pavement.
3. Upon satisfactory construction and adjustment of all proposed fire hydrants, the developer shall have a
registered land surveyor ascertain and list the elevation of either the arrow on the hydrant bonnet or the letters
"MUE" on the bonnet flange of each fire hydrant. These elevations shall be based on USGS datum as currently
used within the village of Oak Brook as determined by the village engineer. Said list shall be certified as correct by
the registered land surveyor and submitted to the village engineer prior to the acceptance of the land
improvements by the village.
C anitary Sewer System: Sanitary sewer lines including house service sewer stubs to the property line for each lot
shall be installed to adequately service all property in the subdivision.
1. Sanitary sewer layout shall conform to the long range sanitary sewer plans of the village.
2. Design and construction of sanitary sewers shall conform to the design criteria adopted by the Illinois
environmental protection agency.
3. All sanitary sewers will be checked on completion in accordance with the appropriate sanitary district's
requirements. This work will be the responsibility of and at the cost of the developer. The developer shall meet the
record drawing requirements of subsection.14674A of this chapter.
D. Storm Drainage System: Storm water drainage systems shall be designed and constructed to service the entire
subdivision to carry off water from all sump pumps, inlets, catch basins, or open drainageways, and be connected
with an adequate outfall. The storm drainage system shall be separate and independent of the sanitary sewer
system. It shall consist of sewers, manholes, inlets, catch basins and other necessary facilities to adequately
drain the subdivision, protect roadway pavements, and prevent standing water except in designed retention
basins.

designed and installed to meet the requirements for sewer construction of the village.
2. The amount of runoff from the proposed improvement shall not exceed the existing capacity of downstream
outfall or the increased capacity of downstream outfall as improved.
3. All runoff in excess of that amount carried by the downstream outfall shall be stored safely without damage to
public or private property.
4. Storm water drainage and detention systems shall meet the requirements of title 9 of this code.
Sidewalks: Paved sidewalks shall be installed on both sides of each street, provided that this requirement may be
waived by the village board for good cause shown by the owner. The plan commission, when making its
recommendations to the village board, shall state whether or not in its opinion such requirement should be
waived.
Sidewalks shall have a minimum width of five feet (5')and be constructed in accordance with standard
requirements of the village.
F. treet Lighting System: A street lighting system shall be installed on all streets within the subdivision, designed
and constructed in accordance with the lighting standards as adopted by the village, unless waived by the village
board for residential subdivisions. The plan commission, when making its recommendations to the village board,
shall state whether or not in its opinion such requirements should be waived or modified.
G. Public Utilities:
1. All utility distribution lines, including, but not limited to, telephone, electric and gas service in the subdivision,
shall be placed underground.
2. Underground telephone, electric and gas service shall be placed within easements or dedicated public ways in
a manner which will not conflict with other underground services.All transformer boxes and service posts shall be
located so as not to be unsightly or hazardous to the public.

H. Signs: Street signs shall be furnished and erected to identify every street within the subdivision and shall be so
designed and constructed as to conform with village standards.
I. Grading, Landscaping, And Sediment And Erosion Control:
1. A grading, landscaping, and sediment and erosion control plan shall be submitted for all property within the
subdivision. Except for the traveled portions of areas designated as rights of way or as bicycle and pedestrian
pathways, all areas shall be graded, seeded and planted in accordance with the approved grading, landscaping,
and sediment and erosion control plan. Such plan shall conform to the standards set forth in title 9 of this code.
2. Street trees should be provided by the subdivider along all streets where trees do not exist. Trees should be of
approved species at least two and one-half inch (21/2") caliper, spaced not more than forty feet(40') apart, and
planted in accordance with village standards.
3. Median strips shall be planted with trees and shrubs in accordance with a landscaping plan approved by the
village board and village engineer.
4. The shoreline of all lakes shall be protected by use of a nonerodible material or appropriate bioengineering
technique.

D. The Village hereby waives the requirement for street lights in the Kinst subdivision as
otherwise required by Section 14 -6 -3F.
E. The final plat is subject to approval by the Village Engineer.
Section 3: All requirements, conditions and standards of the Subdivision Regulations of the
Village of Oak Brook shall be applicable to the subdivision and development of said Kinst Subdivision,
except as varied or waived by this resolution.
Section 4: This resolution shall be in full force and effect from and after its passage, approval and
publication as required by law.
Section 5: All resolutions or parts thereof in conflict with the provisions of this resolution be and
the same are hereby repealed to the extent of such conflict.
