WHEREAS, at its meeting on March 16, 2009 the Plan Commission completed its review and
deliberations on an application from the McDonald's Corporation, the owner of the 9+ acres bounded by
22nd Street on the south, Commerce Drive on the north, Spring Road to the west and McDonald's Drive to
the east which is seeking approval for a three lot final plat of subdivision, and
WHEREAS, by a vote of 6 to 1, the Plan Commission recommended approval of the proposed
McDonald's Spring Road Resubdivision No 3 including a variation to Section 14 -6 -3K of the Subdivision
Regulations, subject to the following conditions
a Final engineering approval including all comments raised by the Village Engineer in his
memorandum dated March 13, 2009
b The screening /buffering of the storm water management facility shall meet Village
requirements for design and safety at the time of permitting, and
WHEREAS, the property is legally described as follows
MCDONALD'S SPRING ROAD RESUBDIVISION NO 3, A RESUBDIVISION OF LOTS
1 AND 2 IN THE FINAL PLAT OF SUBDIVISION OF MCDONALD'S SPRING ROAD
RESUBDIVISION NO 2 ACCORDING TO THE PLAT THEREOF RECORDED JUNE 16,
2005 AS DOCUMENT NUMBER R2005- 126135 BEING A RESUBDIVISION OF PART
OF THE SOUTHEAST QUARTER OF SECTION 23, TOWNSHIP 39 NORTH, RANGE
11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS
NOW THEREFORE, be it resolved by the President and Board of Trustees of the Village of Oak
Brook, DuPage and Cook Counties, Illinois, as follows
Section 1 The foregoing preambles are incorporated herein by reference as though fully set forth
herein
Section 2 The Final Plat of Subdivision known as the McDonald's Spring Road Resubdivision
No 3, prepared by Bollinger, Lach and Associates, Inc , last revised March 27, 2009, is hereby approved,
subject to the following conditions
a That the final plat be revised as necessary and the same approved by the Village Engineer
b The screen i ng/buffen ng of the storm water management facility shall meet Village
requirements for design and safety at the time of permitting
Section 3 That a variation to Section 14 -6 -3K of the Subdivision Regulations is hereby granted
waiving the requirement for rear and side yard public utility easements

Section 5 This resolution shall be in full force and effect from and after its passage, approval and
publication as required by law
Section 6 All resolutions or parts thereof in conflict with the provisions of this resolution be and
the same are hereby repealed to the extent of such conflict
