R-903 - 05/10/2005 - SUBDIVISION - ResolutionsRESOLUTION 2005- SD- PP- V -EX1 -R -903 A RESOLUTION APPROVING THE PRELIMINARY PLAT OF SUBDIVISION KNOWN AS VILLAS OF OAK BROOK SUBDIVISION AND GRANTING A VARIATION FROM THE PROVISIONS OF SECTION 14 -6 -3A OF TITLE 14 (SUBDIVISION REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATIVE TO PUBLIC RIGHT -OF -WAY (2 901 Oak Brook Road and 3111, 3113 and 3115 Meyers Road, Oak Brook, Illinois 60523) i (06 -33- 103 -031, 06 -33- 103 -034, 06 -33- 103 -007, 06 -33- 103 -033, 06 -33- 103 -008) WHEREAS, an application has been filed for approval of a preliminary plat entitled "Villas of Oak Brook Subdivision Oak Brook, Illinois Preliminary Plat" and a concurrent request for a certain variation to the subdivision regulations of the Village, and HEREAS, the Plan Commission has considered the requested variation and preliminary plat, and WHEREAS, on April 11, 2005 the Plan Commission recommended approval of the preliminary plat, subject to certain conditions, and WHEREAS, the'Village President and Board of Trustees considered the recommendations of the Plan Commission and concur with the same, subject to certain modifications, NIOW THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein i Section 2 That the Preliminary Plat of Subdivision of Villas of Oak Brook Subdivision prepared by The Balsamo /Olson Engineering Company, dated February 1, 2005, last revised April 21, 2005, be and is hereby approved, subject to the following conditions - i 1 That the preliminary plat be revised as necessary and approved by the Village Engineer and, in particular, the items and conditions described in his memorandum of March 15, 2005, and 1 2 That the flood plain and stormwater detention area issues be reviewed again as part of the final plat process, and 3 That a variation from Section 14- 6 -3A(2) of the Village Code is granted, which section requires a sixty -six foot (66') right -of -way dedication provided that the two (2) private streets are constructed ini substantial conformity with the preliminary plat, and 4 That no trees be cut down or removed from the property until after approval of the final plat of subdivision 5 That it is appropriate for the developer to utilize the southeast corner of the Village's well site property for grading purposes as opposed to constructing a wall Resolution 2005- SD- PP- V -EX1 -R -903 Approving Preliminary Plat For Villas of Oak Brook Subdivision, (2901 Oak Brook Rd, 3111, 3113, 3115 Meyers Rd , 06 -33- 103 - 031,06 -33- 103 - 034,06 -33- 103 -007 06 -33- 103 - 033,06 -33- 103 -008) Page 2 Section 3 The variations described above are limited to the property within the Preliminary Plat of Villas of Oak Brook Subdivision Section 4 All resolutions or parts of resolutions in conflict with this resolution are hereby repealed to the extent of the conflict Section 5 This resolution shall be in full force and effect from and after its passage and approval as requirea Dy law APPROVED THIS 10th day of May, 2005 Kevi/ePresident umlan Villa I PASSED THIS 10th day of May, 2005 Ayes Trustees Aktipis, Craig Kennedy, Manofsky, Sanford and Yusuf I Nays None Absent None ®F ATTEST Linda K Gonnella, CMC Village Clerk
