WHEREAS, the Village Board of the Village of Oakbrook, at a
meeting held on the 20th day of February, 1962, passed a resolution
authorizing the joint improvement by the Village of Oakbrook and
the State of Illinois on York Road at and near the intersection of
22nd Street, which said project is designated as "F.A.S. Route 1135
(York Road), Village Section 2 C.S., State Section 163 M.F.T.; and
WHEREAS, the plans and specifications approved in connection
with such project provided for a median strip improved with black-
top surfacing; and
WHEREAS, it is the opinion of the President and the Board of
Trustees of the Village of Oakbrook that it would be to the best
interest of the Village and the citizens thereof to improve such
median strip with sod in lieu of blacktop; and
WHEREAS, the State of Illinois, acting by and through its
proper agencies, has agreed to alter the plans for said construc-
tion by improving said median strip with sod in lieu of blacktop
provided the Village will undertake to do certain things more
particularly hereinafter described in connection therewith;
NOW, THEREFORE, BE IT RESOLVED by the President and the Board
of Trustees of the Village of Oakbrook, DuPage County, Illinois:
Section 1. In the event the median strip constructed in
connection with the project known and d"ignated as F.S.A.
Route 1135 (York Road), Village Section 2 C.S., State Section
163 M.F.T., is improved with sod in lieu of blacktop, as provided
on the approved plans for said project, then in such event the
Village of Oakbrook agrees to and will maintain such median strip
from date of completion thereof henceforth and foi all time.
Section 2. BE IT FURTHER RESOLVED that in such event the
Village of Oakbrook will, upon request from the proper authority
and agent of the State of Illinois, at the expense of the
Village of Oakbrook, remove accumulated snow from such median strip.
Section 3. BE IT FURTHER RESOLVED that the Village of Oakbrook
will not at any time further improve said median strip with land-
scaping or otherwise without the prior approval of the proper
authori,ty.of the State of Illinois.
SS„getion 4. BE IT FURTHER RESOLVED that a certified copy of
these resolutions be forwarded by the Village Clerk of the Village
of Oakbrook to the Department of Highways. of the State of Illinois
