Whereas, Section VIII, G, of the DuPage County Zoning Ordi -MS
nance, adopted on December 10, 1935, as subsequently amended in
its entirety effective May 1, 1957, and again revised effective
February 27, 1968,.as further amended, provides that upon written
protest against any proposed amendment to the aforesaid ordinance by
the President and Board of Trustees of a municipality where the land
effected lies within one and one -half (1 -1/2) miles of the limits of
a zoned municipality, filed with the County Clerk, such amendment
shall not be passed except by the favorable vote of three - fourths
(3/4) of all members of the County Board; and
Whereas, Petition No. 2068 by David E. McCracken, Attorney,
was filed with the DuPage County Building and Zoning Department
making application for the issuance of a Special Use Permit to
allow the construction and operation of a convalescent center
and /or a nursing home on the property hereinafter described:
That part of Block 2 of Estabrook's Addition to Hinsdale,
a subdivision situated in the East Half of Section 2,
Township 38 North, Range 11, East of the Third Principal
Meridian, described as follows, to -wit: Commencing at
the Northwest corner of said Block 2; thence North - Easterly
along the North - westerly line of Block 2, said line also
being the South right -of -way line of Ogden Avenue, a dis-
tance of 308.95 feet; thence South a distance of 437.35
feet, said point being 296.55 feet West of the East line
of said Block 2 and 296.55 feet East of the West line of
Block 2; thence West and parallel to the South line of
said Block 2 a distance of 296.55 feet; thence North along
the West line of said Block 2, a distance of 345.6 feet
to the place of beginning, in DuPage County, Illinois.
This property being situated at the southeast corner of Adams and
Ogden Avenues.
Whereas, the Zoning Board of Appeals of DuPage County held and
conducted a public hearing on the aforesaid application on May 29,
1969; and
Whereas, the aforesaid application concerns land located within
one and one -half (1 -1/2) mites of the corporate limits of the Village
of Oakbrook, a municipal car oration in DuPage County, Illinois, and
the Village of Oakbrook is the municipality with limits nearest ad-
jacent; and
Whereas, it is the opinion of the President and Board of Trustees
of the Villa" of Oakbrook that the application by David E. McCracken
for the issuftes of a special Use Pettit to allow the construction
and operation of a aonvilbeeent center and /or a nutting hays at the

location and on the property described above, is not desirable for
the public welfare and is contrary to the public interest and that
the same would be incompatible with land uses now permitted in said
area and would be incompatible with land uses actually existing in
said area and that the granting of the Special Use Permit requested
would be deleterious of property values and would place an extra-
ordinary burden on governmental services in the territory effected
and that rezoning of the property would be spot zoning inconsistent
with the long range planning goals of the County of DuPage and the
Village of Oakbrook; and
Whereas, it is the opinion of the President and Board of Trustees
of the Village of Oakbrook that the petitioner is not now denied the
enjoyment and benefit of his property under the present zoning classi-
fication of the County of DuPage since the property is merchantible
as now zoned and classified; and
Whereas, it is further the opinion of the President and Board
of Trustees of the Village of Oakbrook that the rezoning and re-
classification and issuance of a Special Use Permit at this location
would adversely effect vehicular traffic on Adams Avenue and Ogden
Avenue adjacent to the Village of Oakbrook;
NOW, THEREFORE BE IT AND IT IS HEREBY RESOLVED by the President
and Board of Trustees of the Village of Oakbrook, DuPage County,
Illinois, that the said Village of Oakbrook does protest the grant-
ing of the Special Use Prrmit requested by Petition No. 2068 applied
for by David E. McCracken, and that the Village Clerk is directed
to communicate this protest to the Board of Supervisors of DuPage
County and the DuPage County Building and Zoning Department and the
DuPage County Zoning Board of Appeals.
BE IT FURTHER RESOLVED that a certified copy of this Resolution
be filed in the office of the County Clerk of DuPage County, Illinois,
forthwith.
PASSED by unanimous vote of the corporate authorities of the
Village of Oakbrook, DuPage County, Illinois, and ADOPTED this 10th
day of June, 1969.

Village of Oakbrook at a duly constituted meeting of said Board

all of which appears in the records of said office now in my care
and custody.
