A RESOLUTION APPROVING THE FINAL PLAT
KNOWN AS KANAN COURT SUBDIVISION AND GRANTING
A VARIATION FROM THE PROVISIONS OF SECTION 6 -3 (D)
AND A WAIVER FROM THE PROVISIONS OF SECTIONS 6 -3 (E)
AND (F) OF TITLE 14 ( "SUBDIVISION REGULATIONS ") OF THE
VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE TO
STORM DRAINAGE SYSTEMS, SIDEWALKS AND STREET LIGHTS

WHEREAS, the Plan Commission of the Village of Oak Brook, on June 1, 2004, recommended
the approval of the proposed Kanan Court Subdivision (3308 Midwest Road), and
HEREAS, the property at 3308 Midwest Road is legally described as follows
HE EAST 5 CHAINS (330 00 FEET) OF THE NORTH 6 CHAINS (396 00 FEET) OF THE EAST
ALF OF THE SOUTHWEST QUARTER OF THE NORTHWEST FRACTIONAL QUARTER OF
ECTION 34, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL
ERIDIAN, IN THE VILLAGE OF OAK BROOK, DUPAGE COUNTY, ILLINOIS
iWHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code, and
(WHEREAS, Section 14 -7 -4 of the Village Code sets forth the authority and standards for granting
variations to the Subdivision Regulations, and
IWHEREAS, the owner of the property at 3308 Midwest Road, Mehul Shah, has submitted a
petition for a variation to Section 14 -6 -3 (D) of the Subdivision Regulations relative to storm sewers
constructed to service the entire subdivision to carry off water from all sump pumps, and
WHEREAS, on April 19, May 17 and June 1, 2004, the Plan Commission reviewed the petition for
subdivision, variation and waivers and recommended approval of the plat, variation and waivers, and
WHEREAS, in making this recommendation, the Plan Commission found that the applicant had
addressed the applicable standards required for a variation to the subdivision regulations, and
WHEREAS, the Plan Commission made the following specific findings
1 The subject property is zoned R -3 Single - Family Residence
2 The applicant has proposed four lots, each meeting the 25,000 square foot minimum lot
requirement
3 The applicant has proposed a single, private access road from Midwest Road to the four
lots
4 The Midwest Road access has been granted by the Dupage County Division of
Transportation with certain conditions

5 A number of locations for connections to the Hinsdale Sanitary Sewer service have been
identified
6 Sanitary sewer service will be provided to the site from an existing public utility easement
existing on the north 10 feet of Lot 160 in the Midwest Club Phase 2 Subdivision
(WHEREAS, the Village President and Board of Trustees have considered the recommendations
and findings of the Plan Commission and concur with same
'NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 That the Final Plat of Subdivision known as Kanan Court Subdivision prepared by
Engineering Resource Associates, Inc , dated April 30, 2004 be and is hereby approved
Section 2 That approval of the Final Plat of the Kanan Court Subdivision as per Section 1 hereof
be and is hereby expressly subject to and is not effective until the following conditions are met
That final legal approval of all relevant documents be obtained, and
That all technical comments contained in Village Engineer Durfey's memorandum to Robert
Kalllen, dated May 13, 2004 (page 15 -15b of the case file), are addressed, and that the final
plat and engineering plans be revised as necessary and the same approved by the Village
Engineer, and
That the existing wall on the subject property that is located within the right -of -way of Midwest
Road is removed, and
That the existing bike path running along the west side of Midwest Road near the subject
property be relocated, and
�5) That a private access road be constructed according to Village standards, including the 60'
radius requirement, and
6) That the proposed cul -de -sac pavement be adequately sized to comply with the Oak Brook
Fire Department requirements, and
7) That the proposed subdivision gateway and gate at the entrance to the subdivision be
modified per the concerns and issues raised by the Plan Commission and Staff, and
I
18) That the intent of the proposed tree preservation issue be addressed in the revised
landscape plan on page 23 of the case file, and
19) That sanitary sewer service be provided to the site from an existing public utility easement
existing on the north 10' of Lot 160 in the Midwest Club Phase 2 Subdivision, and
10) That the existing landscape condition is reasonably restored over the public utility easement
on Lot 160, as well as any other damage that may occur on private property
Section 3 All requirements, conditions and standards of the Subdivision Regulations of the
Village Hof Oak Brook shall be applicable to the subdivision and development of said Kanan Court
Subdivision, except as waived or varied by this Resolution
!Section 4 A waiver to Section 6 -3(E) of the Subdivision Regulations is hereby granted waiving
the requirement for a sidewalk on both sides of each street so long as the existing pathway is relocated

Section 5. Based upon testimony provided, a variation to Section 6 -3(D) of the Subdivision
Regulations is hereby granted waiving the requirement for storm sewers to be constructed to service the
entire subdivision to carry off water from all sump pumps
Section 6 Based upon testimony provided and a review of the current and expected conditions
with the (lighting as proposed on page 13 of the case file, a waiver to Section 6 -3(F) of the Subdivision
Regulations is hereby granted waiving the requirement for a street lighting system to be installed on all
streets designed and constructed in accordance with the lighting standards as adopted by the Village
Section 7 This resolution shall be in full force and effect from and after its passage, approval
and publication as required by law
Section 8 All resolutions or parts thereof in conflict with the provisions of this resolution be and
the samo are hereby repealed to the extent of such conflict

remove any trees, shrubs or other plants on the easement
that interfere with the operation of sewers or other utilities.
No permanent buildings or structures shall be placed on said
easements, except as referenced above, but some may be
used for gardens, shrubs, landscaping and other purposes
that do not then or later interfere with the aforesaid uses or
rights. Whenever the Village or affected utility company
determines that any tree, shrub, vegetation, or other
structures or objects (herein collectively known as
°obstruction ") on said easements interfere with the aforesaid
uses or rights, the Village or utility company has the right,
but not the obligation, to remove the obstruction at the
property owner's expense. The Village or affected utility
company will apply gross seed where the obstruction has been
removed but is not required to replace or repair any

principal meridian, in DuPoge County, Illinois, except that port
