GRUD - SCHNEIDER ESTATES SUBDIVISION IN

WHEREAS, at its meeting on May 21, 2012 the Plan Commission completed its review and
deliberations on an application by Stephen and Natalie Grud, and Alan and Patricia Schneider, the
owners (collectively, "Owners'l of the 2.184 acre parcel located at 3213 York Road ( "Subject
Property'), seeking approval of a two -lot final plat of subdivision; and
WHEREAS, by a vote of 5 to 0, the Plan Commission recommended approval of the request for a
final plat of subdivision for the Subject Property; and
WHEREAS, the Subject Property is legally described as follows
THAT PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 36,
TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS
FOLLOWS: COMMENCING AT THE NORTH WEST CORNER OF SAID NORTH EAST QUARTER OF
SECTION 36 AND RUNNING THENCE SOUTH ON QUARTER SECTION LINE 986.5 FEET TO THE

WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the final plat of subdivision for the Subject Property, as set forth below, to
be in the best interests of the Village.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: The foregoing preambles are incorporated herein by reference as though fully set forth
herein.
Section 2: That the Final Plat of Subdivision for the Subject Property known as the Grud-
Schneider Estates Subdivision, prepared by Engineering Resource Associates, dated April 5, 2012, as
attached to this Resolution as Exhibit A ( "Final Plat ") is hereby approved.
Section 3: All requirements, conditions and standards of the Subdivision Regulations of the
Village of Oak Brook shall be applicable to the subdivision and development of the Subject Property.
Section 4: The Village President, Clerk, and other appropriate Village officials will be authorized
and directed to execute, attest, and /or seal the customary certifications on the Final Plat indicating such

RECOMMENDED MOTION: I move to concur with the recommendation from the Plan
Commission with regard to the requested Grud-Schneider Estates Final Plat of Subdivision for
the property located at 3213 York Road subject to the following conditions:
1. Final Engineering Approval.
2. Adoption of a Resolution necessary to grant the requested relief, which Resolution the
Village Attorney shall by this motion be directed to prepare for consideration at the July
10,2012 Board of Trustees meeting.
Background/History:
At its meeting on May 21, 2012, the Plan Commission completed its review and deliberations on an
application from Stephen Grud and Nadine Grud along with Alan and Patricia Schneider, the owners of
the property located at 3213 York Road seeking approval of a f nal plat of subdivision of the 2.184 acre
parcel to create a new two-lot subdivision. The property is now improved with a single-family home on
the west side of the parcel.
As proposed, lot 1 will contain 43,560 square feet net lot area as well as an approximate 6,200 square
foot permanent access easement for lot 2. Lot 2 will contain 45,364 square feet net lot area. This layout
provides both access to lot 2 while maintaining the required lot width on lot 1.
Recommendation:
The Plan Commission reviewed the standards required for approval of a final plat of subdivision and
found that the applicant had satisfactorily addressed those standards.
By a vote of 4 to 0, the Plan Commission recommended approval of the proposed Grud-Schneider
Estates Subdivision as requested.

Jon Green, Engineering Resource Associates, Warrenville, Illinois represented
the property owners. He provided the background and reviewed the proposed
subdivision at 3213 York Road. The subject property is 2.18 acres, they
proposed a flag lot with one lot fronting on York Road, and the second lot
would be located toward the rear of the parcel. Other properties along that area
of York Road have similarly subdivided lots. The property is zoned R-2 and

they have met all aspects of the Village zoning requirements for lot area and lot
width. The area and size of the flag portion to be used for the ingress egress
easement was not counted or allowed in determining net acreage for the lots.
The front lot is 43,560 square feet, which complies with the lot area
requirements.
Supplemental final engineering drawings were submitted to the Flag Creek
Water Reclamation District and to the Village's Engineering Department. A
memo is in the case file indicating that the supplemental drawings had been
approved and showed that they would adequately provide public water service
and public sanitary sewer service to both of the properties.
Member Doyle said that he was very comfortable with the request.
Member Lal said that he viewed the property and it appears that they have met
the requirements as outlined in the case file.
Member Jain asked if there had been any objections.
Gail Polanek, Community Development Administrative Technician noted that
no objections had been received by the Village and notices were sent to all
surrounding property owners.
Chairwoman Tropinski said that the request appeared to be straightforward and
in order.

request. Oakbrook Center consists of three major property owners. Macy's to

by General Growth. There are a number of existing boundaries located within
the Center and the applicant is seeking to realign and reconfigure some of those
subdivision boundaries.

DISCUSSION: Stephen Grud and Nadine Grud along with Alan and Patricia Schneider,
the owners of the property located at 3213 York Road have submitted an
application seeking approval of a final plat of subdivision of the 2.184
acre parcel to create a new two-lot subdivision. The property is now
improved with a single-family home on the west side of the parcel.
If approved, lot 1 will contain 43,560 square feet net lot area (49,756
gross to incorporate an access easement to lot 2) and lot 2 will contain
45,364 square feet net lot area. The applicant is proposing this layout in
order to: provide permanent access easement to lot 2 while maintaining
the required lot width of lot 1.

RESPONSIBILITIES OF HEARING BODIES:
The Plan Commission has the responsibility to make a recommendation

plat of subdivision, a recommendation would be in order to approve this
request as presented.

Section 5: This Resolution shall be in full force and effect from and after its passage, approval
and publication as required by law.
Section 6: All resolutions or parts thereof in conflict with the provisions of this Resolution be and
the same are hereby repealed to the extent of such conflict.
