PROTESTING OF
DU PAGE COUNTY ZONING PETITION NO. 2276
Whereas, the Statutes of the State of Illinois and ordinances
of DuPage County, Illinois, provide that upon written protest
against any proposed amendment to the DuPage County Zoning Ordinance
by the Presidert and Board of Trustees of a municipality where the
land effected lies within one and one -half (1 -1/2) miles of the
limits of a zoned municipality, filed with the County Clerk, such
amendment shall not be passed except by the favorable vote of three -
fourths (3/4) of all members of the County Board; and
Whereas, Petition No. 2276 by Gordon Bunge, Attorney, was filed
with the DuPage County Building and Zoning Department making appli-
cation for a special use to allow the construction and operation of
a planned development to utilize the entire area of the property
hereinafter described, such development to include the following:
1. Six (6) sixteen (16) story apartment buildings con-
taining a total of one thousand (1,000) residence
unite:
2. An eighteen (18) story hospital to contain two hundred
(200) to two hundred fifty (250) bade;
3. An eighteen (18) story hotel -motel to contain two
hundred (200) to three hundred (300) rooms;
4. Four (4) office buildings containing one million eight
hundred thousand (1,806,000) square feet, averaging
eighteen (18) to twenty (20) stories in height)
5. A twenty -six (26) story office building containing
approximately four hundred thousand (400,000) square
feet;
6. A sixteen (16) story hotel containing about six hundred
(600) rooms;
7. An exhibition, convention hall and /or theater combination;
8. Two (2) or three (3) service buildings to provide fire and
police protection, service facilities for automobiles and
management facilities.
The property is legally described as foliose:
Lot 1 of Clayton's Assessment Plat of part of the Northeast
quarter of Section 24, Township 34 North, Range 11, East of
the Third Principal Meridian, in DuPage County, Illinois,
except those portions of said Lot 1 which are located in
Cook County, Illinois, or within the boundary of the Village
of Oak brook, Illinois, said Clayton's Assessment Plat having
been recorded in the Recorder's office of DuPage County,
Illinois, as Document No. R65 -8736,

and is situated on the south aide of Roosevelt Road, east of the
East -West Tollway; and
Whereas, the Zoning Board of Appeals of DuPage County held
and conducted a public hearing on the aforesaid application on
June 29, 1971; and
Whereas, the aforesaid application concerns land located within
one and one -half (1 -1/2) .Hiles of the corporate limits of the Village
of Oak Brook, a municipal corporation in DuPage County, Illinois,
and the Village of Oak Brook is the municipality with limits nearest
adjacent; and
Whereas, it is the opinion of the President and Board of Trustees
Of the Village of Oak Brook that the application by Gordon Bunge for
issuance of a Special Use Permit at the location and on the property
described above, is not desirable for the public welfare and is con-
trary to the public interest and that the same would be incompatible
with land uses now permitted in said area and would be incompatible
with land uses actually existing in said area and that the granting
of the Special Use Permit would be deleterious of property values
and would place an extra - ordinary burden on governmental services
in the territory effected and that rezoning of the property would
be inconsistent with the long range planning goals of the County of
DuPage and the.Village of Oak Brook; and
Whereas, it is the opinion of the President and Board of Trustees
Of the Village of Oak Brook that the petitioner is not now denied the
enjoyment and benefit of his property under the present zoning classi-
fication of the County of DuPage since the property is marehantible
as now zoned and classified; and
Whereas, it is further the opinion of the President and Board
of Trustees of the Village of oak Brook that the rezoning and re-
Classification and issuance of a Special Use Permit at this location
would adversely effect vehicular traffic on York Road and Woodside
Drive adjacent to the Village of Oak Brook;
NOW,, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the President
and Board of Trustees of,the Village of Oak Brook, DuPage County,
Illinois, that the Said Village of Oak Brook does protest the grant-
ing of the Special Use Permit requested by Petition No. 2276 applied
for by Grodon Bunge,.and that the Village Clerk is directed to com-
municate this protest to the Board of Supervisors of DuPage County
and the DuPage County Building and Zoning Department and the DuPage
County Zoning Board of Appeals.
BE IT rLWHER RESOLVED that a certified copy of this Resolution
be filed in the office of the County Clark of DuPage County, Illinois,
forthwith.
PASSED by unanimous vote of the corporate authorities of the
Village of 0 BrookCOUnty, Sllinois, and ADOPTED this
day of _ , 1971.
