FOR MCDONALD'S SPRING ROAD RESUBDIVISION NO. 2 AND GRANTING A
VARIATION FROM THE PROVISIONS OF SECTION 14 -6 -3K OF TITLE 14
( "SUBDIVISION REGULATIONS ") OF THE VILLAGE CODE RELATIVE TO
PUBLIC UTILITY EASEMENTS, AND REQUIRING A COVENANT
AS TO SETBACK ALONG COMMERCE DRIVE

WHEREAS, the Plan Commission of the Village of Oak Brook recommended the approval of the
proposed McDonald's Spring Road Resubdivision No 2, and
WHEREAS, the subject property is legally described as follows
LOTS 1 AND 2 IN MCDONALD'S SPRING ROAD RESUBDIVISION
NO 1, ACCORDING TO THE PLAT THEREOF RECORDED
NOVEMBER 25TH, 1986, AS DOCUMENT NUMBER R86- 148402,
AND LOT 2 IN OAK BROOK DEVELOPMENT COMPANY'S
COMMERCE PLAZA SUBDIVISION UNIT ONE, ACCORDING TO
THE PLAT THEREOF RECORDED JULY 12TH, 1968, AS
DOCUMENT NUMBER R68- 30335, ALL BEING PART OF THE
SOUTHEAST QUARTER OF SECTION 23, TOWNSHIP 39 NORTH,
RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN
DUPAGE COUNTY, ILLINOIS
WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code, and
WHEREAS, Section 14 -7 -4 of the Village Code sets forth the authority and standards of the
granting of variations to the Subdivision Regulations, and
WHEREAS, the McDonald's Corporation has submitted a petition for a variation to Section 14-6 -
3K of the Subdivision Regulations relative to the public utility easements, and
WHEREAS, the Plan Commission reviewed the petition for variation and recommended approval
of the variation; and

WHEREAS, in making this recommendation, the Plan Commission found that the applicant had
addressed the applicable standards required for a variation to the subdivision regulations, and
WHEREAS, the Plan Commission found that because of the developed nature of the property, it
would be a hardship to require public utility easements along the rear and side internal lot lines, and
WHEREAS, the Village President and Board of Trustees have considered the recommendations
of the Plan Commission and concur with same; and

WHEREAS, the Board of Trustees has determined it is necessary and desirable to maintain a 50'
setback along Commerce Drive in the rear yard of the subject property and McDonald's Corporation has
agreed, and
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 That the recitals hereinabove are hereby incorporated into and made a part of this
Resolution
Section 2 That the execution on behalf of the Village of the Final Plat of Subdivision known as
McDonald's Spring Road Resubdivision No 2 prepared by Bollinger, Lach & Associates, dated August
12, 2004 be and is hereby approved, authorized and directed, and that Final Plat is approved
Section 3. That the execution by the Village of the final McDonald's Spring Road Resubdivislon
No 2 Plat as per Section 1 hereof shall not occur until the Final Plat reflects the conditions and text as
hereinabove required in the final recital set forth above
Section 4- That all requirements, conditions and standards of the Subdivision Regulations of the
Village of Oak Brook including the requirements of this Resolution shall be applicable to the resubdivision
and development of McDonald's Spring Road Resubdivision No 2
Section 5 That a variation to Section 14 -6 -3K of the Subdivision Regulations is hereby granted
waiving the requirement for rear or side yard public utility easements.
Section 6 That the Final Plat shall include a covenant that restricts the use of the aforesaid fifty
(50) foot setback area along Commerce Drive on Lot 2 of the Resubdivision as follows
Set -Back Restriction- Owner, for itself and for it successors in title, covenants
and agrees as a covenant which touches and runs with the land that no portion of
Lot 2 located within fifty (50) feet of the south boundary of the Commerce Drive
right -of -way as the same exists as of the date of this plat of subdivision shall be
utilized for a parking structure or for a surface parking lot unless and until a
release or modification of this restriction is agreed to by means of a resolution
adopted by the Board of Trustees of the Village of Oak Brook
Section 7• This resolution shall be in full force and effect from and after its passage, approval and
publication as required by law.
Section 8 All resolutions or parts thereof in conflict with the provisions of this resolution be and
the same are hereby repealed to the extent of such conflict
