A RESOLUTION AUTHORIZING A CHANGE ORDER FOR THE
HERITAGE CENTER WINDOW RESTORATION PROJECT
WHEREAS, Pursuant to Resolution 2013- BSLM USE UM- CNTRCT -EX -R -1258, the Village
approved an agreement ( "Agreement") with Restoric, LLC of Chicago, Illinois ( "Restoric "), for Restoric
to replace the windows and a portion of the exterior trim ( "Restoration Project's on the Oak Brook
Heritage Center ( "Heritage Center"); and
WHEREAS, at the time the Village awarded the Agreement to Restoric, the Village did not realize
that the windows provided by Restoric would not provide adequate ultraviolet light protection for the light
sensitive materials maintained in the Heritage Center; and
WHEREAS, installing storm windows at the Heritage Center will reduce the energy consumed by
the Heritage Center; and
WHEREAS, the Village staff recommends entering into the change order to the Agreement
attached hereto as Exhibit A for an amount not to exceed $27,000; and
WHEREAS, the President and the Village Board find that the circumstances requiring a change to
the Agreement were not reasonably foreseeable at the time the Restoration Project was bid and the
Change Order will be in the best interest of the Village and authorized by law; and
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Change Order. The Village President and Board of Trustees
hereby approve the Change Order in substantially the same form as attached as Exhibit A, and in final
form approved by the Village Attorney and Village Manager.
Section 3: Execution of the Change Order. The Village President and the Village Clerk shall
be, and are hereby, authorized to execute the final Change Order on behalf of the Village.
. Section 4: Determination. This Resolution shall constitute the written determination
required by Section 33E -9 of Article 33E of the Criminal Code of 1961.
Section 5: Effective'Date. This Resolution shall be in full force and effect from and after its
passage by two- thirds of the Trustees and its approval in the manner provided by law.
