An Ordinance Granting Approval of the Final Plat of Subdivision for Stewart's
Subdivision and Granting a Variation from the Provisions of Section 14- 6 -2B.4 of Title 14
(Subdivision Regulations) of the Village Code of the Village of Oak Brook Relative to Lot
Size
B ack2rou n d /History:
This resolution approves the Final Plat of Subdivision for the Stewart's Subdivision located at
3109 York Road and 405 Oak Brook Road. It also grants a variation from Section 14- 6 -2B.4 of
Title 14 (Subdivision Regulations) of the Village Code. The Plan Commission heard testimony
and found that the Petitioner addressed the applicable standards required for a variation to
standards of the Subdivision Regulations. Thus, the Plan Commission recommended that
approval of a variation to the requirement for lot size. The Plan Commission also recommended
approval of the final plat with certain conditions as outlined in the Resolution.
Recommendation:
I recommend that Ordinance 2005- SD- FP +ZO- V -EXl -R -926 be passed.

WHEREAS, the Plan Commission of the Village of Oak Brook recommended the approval of the
proposed Stewart's Subdivision, and
WHEREAS, the subject property is legally described in Exhibit A, attached hereto and made a
part hereof, and
WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code, and
WHEREAS, Section 14 -7 -4 of the Village Code sets forth the authority and standards of the
granting of variations to the Subdivision Regulations, and
WHEREAS, the Stewart's Subdivision has submitted a petition for a variation to Section 14-6-2 -
B 4 of the Subdivision Regulations, requesting a reduction in the required lot size, and
WHEREAS, the Plan Commission reviewed the petition for variation and recommended approval
of the variation, and
WHEREAS, in making this recommendation, the Plan Commission found that the applicant had
addressed the applicable standards required for a variation to the subdivision regulations, and
WHEREAS, the Village President and Board of Trustees have considered the recommendations
of the Plan Commission and concur with same
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1 That the recitals hereinabove are hereby incorporated into and made a part of this
Resolution
Section 2 That the execution on behalf of the Village of the Final Plat of Subdivision known as
Stewart's Subdivision prepared by Glen D. Krisch Land Surveyor, Inc., dated July 13, 2005,be and is
hereby approved, authorized and directed, and that Final Plat is approved
Section 3 That all requirements, conditions and standards of the Subdivision Regulations of the
Village of Oak Brook including the requirements of this Resolution shall be applicable to the resubdivision
and development of Stewart's Subdivision
Section 4 That a variation to Section 14 -6 -2 -B 4 of the Subdivision Regulations is hereby
granted in order to permit a reduction in the required lot size
Section 5 This resolution shall be in full force and effect from and after its passage, approval and
publication as required by law

WHEREAS, the Plan Commission of the Village of Oak Brook recommended the approval of the
proposed Stewart's Subdivision, and
WHEREAS, the subject property is legally described in Exhibit A, attached hereto and made a

WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code, and
WHEREAS, Section 14 -7 -4 of the Village Code sets forth the authority and standards of the

WHEREAS, the Village President and Board of Trustees have considered the recommendations
of the Plan Commission and concur with same
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows.

RECOMMENDED MOTION: I move to concur with the recommendation of the Plan
Commission and approve the requested final plat of subdivision and variation to the
Subdivision Regulations and authorize the Village Attorney to draft the necessary
resolution for final consideration at the September 13,2005 Board of Trustees meeting.
Background/Historv:
Mr. Warren Stewart, the owner of the properties at both 3109 York Road and 405 Oak Brook
Road has submitted an application seeking approval of a final plat of subdivision and a variation
to Section 14-6-2-B.4 of the Subdivision Regulations in order to permit a reduction in the
required lot size. Both lots are contiguous and neither presently meets the one acre minimum lot
size required in the R-2 zoning district. As such, these lots are currently classified as non-
conforming with regard to lot size.
It is the applicants desire to make one of these lots conforming to the R-2 district standards by
increasing the lot size of the parcel at 405 Oak Brook Road by approximately 11,000 sq.ft. and
by reducing the size of the 3109 York Road lot by a similar amount. In addition to this request,
the applicant has also submitted a request to the Zoning Board of Appeals seeking approval of
variation to permit a reduction in the parcel of size of 3109 York Road.
Village Engineer Durfey has reviewed this submittal and has summarized his comments in his
July 12, 2005 memorandum(see attached).

Commission finds that the applicant has met all requirements for approval of a final plat and

He would like to increase the lot area of 405 Oak Brook Road by 11,000 feet.
Mr. Warren Stewart resides at 405 Oak Brook Road and is the owner of both
properties. He provided a brief overview and history of the properties. He said
that he purchased the property at 3109 York Road about 4 months ago. He
reviewed the configuration of the parcels. The County took 50 feet away from all
the parcels along Oak Brook Road in order to widen it, which left all the parcels in

a nonconforming status. The parcel on York road, which is 587 feet deep and 66
feet wide, has a house that was built on it over 20 years ago. A portion of the rear
of 405 Oak Brook Road abuts to the rear yard and around 3109 York Road.
Because of the long length of the parcel and because the area in the rear portion
was so remote to the lot that yard debris, which became unsightly, ended up at the
rear of the lot which abutted his lot at 405 Oak Brook Road. The applicant had
planted 13-14 mature conifer trees along the lot line to help block the view. In
doing so it cut into his rear lot cutting it back to around 40 feet. He told the
previous owner(of 3109 York)that if he was ever interested in selling the property
he would be interested in buying it, which he did. By adding a portion of the lot
from 3109 to the lot at 405, it not only makes it a complete square, it turns it into a
fully conforming lot meeting the one-acre minimum requirement in the R-2
district. It is currently approximately 39,000 square feet and 3109 York Road is
also currently 39,000 square feet. If approved, the lot at 405 Oak Brook Road
would be 47,000 square feet making it an acre and an eighth and would restore the
depth lost when Oak Brook Road was widened. What is being taken from 3109
York Road is almost useless to the property. The change would shorten the lot by
approximately 167 feet. It will still be 420 feet in depth. The result would leave
the house almost perfectly centered on the lot. The front door of the house faces
the south, which is the side yard of the lot. None of the properties north of 3109
York conform to the R-2 guidelines. If land from 3109 were added to each of the
lots facing Oa.k Brook Road, they would still not become confornung lots. He said
� that he is not into making lots smaller; he is from the Paul Butler school of open
land, lots of nature and trees. That is exactly why he wants the larger parcel. The
development has been stagnant for years with the smaller lot depths. More is
gained by adding the land to 405 Oak Brook Road than what is lost at 3109 York.
Mike Deproseris, 411 Oak Brook Road, residing next to the property at 405 Oak
Brook Road said that he is all for the proposal.
Mr. Stewart said that everyone around him gave him their support and when asked
whether they needed to attend the meeting he told them he did not believe it was
necessary. He did have them sign a petition which was made part of the file. He
understands that he is talking about making a property smaller, but he emphasized
that the property being made smaller loses no desirability. Nothing visually
changes in the neighborhood because of it. As it stands right now there are 5
nonconforming properties, if the variance is granted, that would be reduced to 4.
In addition the property at 3109 York Road which is now the second largest pazcel
of the five will remain the second largest. After the division it would be almost
28,000 square feet which is 10,000 or 11,000 square feet larger than the property at
413 Oak Brook Road, and is comparable to the other 2 properties. He is not taking
anything out of the norm for the other properties. There are many places in Oak
Brook where properties do not meet the guidelines, but after this, this one will
meet the minimum requirements.

Member Wolin said that the proposal makes a lot of sense. He questioned if there
was a driveway to the south of the 3109 York parcel. Mr. Stewart responded that
it was a driveway in the Sue Boon subdivision. He said the driveway changed the
dynamics of the neighborhood dramatically. Not only are there 3 large homes, but
the front doors of 3 large homes. None of the neighbors are happy, because they
would have rather had the back yards facing their backyards. Approval will give
him control over that boundary line. He has spent about $42,000 planting mature
trees trying to shelter the view. He did not want to give the wrong impression
because they are very friendly with the new neighbors and has a good rapport with
them, but it is a striking contrast to what it was before the development. He did
not bring this up in his letter of explanation but it is one of the benefits of doing
this in order to plant large trees to create a buffer. Typically in an urban grid
system, backyards face backyards.
Member Wolin asked that based upon the layout of all the homes, there is really
nothing that can be done with the long narrow lot other than keeping it as it is or
breaking it up.
Village Engineer Durfey said that the plat meets the Code.
No one in the audience spoke in opposition to the request.
Motion by Member Wolin, seconded by Member Adrian to recommend approval
of the final plat of subdivision and variation to the Subdivision Regulations as
proposed. In making this recommendation, the Commission finds that the
applicant has met the requirements for approval of a final plat. Approval is subject
to the approval of the requested variation to the zoning ordinance to allow a
reduction in the lot area requirements.

DISCUSSION: Mr. Warren Stewart, the owner of the properties at 3109 York Road and
405 Oak Brook Road has submitted an application seeking approval of a
final plat of subdivision and a variation to Section 14-6-2-B.4 of the
Subdivision Regulations in order to permit a reduction in the required lot
size. Both lots axe contiguous and neither presently meets the one acre
minimum lot size required in the R-2 zoning district. As such, these lots
are currently classified as non-conforming with regard to lot size.
It is the applicants desire to make one of these lots confortning to the R-2
district standards by increasing the lot size of the parcel at 405 Oak Brook
Road by approximately 11,000 sq.ft. and by reducing the size of the 3109
York Road lot by a similar amount. In addition to this request, the
applicant has also submitted a request to the Zoning Board of Appeals
seeking approval of variation to permit a reduction in the parcel of size of
3109 York Road.
Village Engineer Durfey has reviewed this submittal and has summarized
his comments in his July 12, 2005 memorandum(see attached).

Staff Comment:
The impact of reducing the size of the parcel at 3109 York Road is
negligible due to the significant depth of the parcel. The existing home on
the parcel would not be impacted relative to , becoming more
nonconforming respect to side and rear yard setbacks.
RESPONSIBILITIES OF HEARING BODIES:
The Plan Commission has the responsibility to make a recommendation on
these requests to approve a final plat of subdivision as well as a variation
to the Subdivision Regulations.
CONCLUSION: If the Plan Commission is of the opinion that the applicant has satisfied
the requirements for a final plat of subdivision as well as the variation for
lot size, a recommendation would be in order to approve these requests as
presented. Also, the Commission is authorized to recommend additional
changes and/or modifications as they see fit.

I have reviewed the revised plat received on July 11, 2005 and offer the following comments:
1. This is a reconfiguration of two existing parcels. Proposed Lot 1 is most of Lot 1 in the
Fleishman's Assessment Plat (1981). Lot 2 formalizes a previously infortnal legal
description.
2. I understand that a Lot Area Variation is required for proposed Lot 1 and that the
applicant has made such an application.
3. A few minor drafting revisions remain to be made to the plat.
4. No improvements are proposed to be made with this subdivision; the two existing homes
on the two existing/proposed lots already have water and sanitary service available.
5. Stormwater detention is not required since the site is less than 3 acres.
6. It appears that school contributions will not be required since new lots are not being

RECOMMENDED MOTION: I move to refer the request from Mr. Warren Stewart, the
owner of the properties at 3109 York Road and 405 Oak Brook Road for a final plat of
subdivision and a variation to the Subdivision Regulations to the Plan Commission for
review and recommendation at its July 18,2005 meeting.
Back�round/Historv:
Mr. Warren Stewart, the owner of the properties at 3109 York Road and 405 Oak Brook Road
has submited an application seeking approval of a final plat of subdivision and a variation to
Section 14-6-2-B.4 of the Subdivision Regulations in order to permit a reduction in the required
lot area. Both lots are contiguous and do not meet the one acre minimum lot size required in the
R-2 zoning district. As such, both lots are now classfied as non-conforming with regard to lot
size.
It is the applicants desire to make the lot at 405 Oak Brook Road conforming in lot area by
resubdividing the two lots by adding property from the 3109 York Road parcel (which is now
nearly 600-ft. deep).
Recommendation:
Please refer these requests to the Plan Commission for review and recommendation at its July 18,
2005 meeting.

14-6-2: DESIGN STANDARDS:
A. Block Layout:
1. In detertnining the shape and size of blocks, existing topographic features,basic street
system and traffic plan, areas designated for public and other nonresidential land use, and the
minimum lot areas and dimensions required by the village zoning ordinance for the
applicable zoning area shall be considered.
2. In residential subdivisions,the maximum length of blocks shall be two thousand six
hundred forty(2,640) lineal feet. No blocks shall be less than nine hundred(900) lineal feet
in length unless approved by the plan commission. In nonresidential subdivisions,maximum
length of blocks shall be as approved by the plan commission.
Where a subdivision borders upon or is traversed by a thoroughfare and frontage access is
necessary, frontage roads (on 1 or both sides of such thoroughfare) shall be provided as
needed.
B. Lot Design Standards:
1. Lots shall abut on a street. Flag or interior lots shall not be permitted unless after review
by the village engineer,plan commission, and board of trustees, a determination is made that
the land in question cannot be reasonably developed in any other way. When a flag or
interior lot is permitted, the area of any such lot which is used for access shall not be
construed as the front yard of said lot nor shall the access area be used to satisfy any other
yard, setback or minimum lot area requirement as set forth in the zoning ordinance, and said
access area shall be a minimum of twenty feet(20') in width except when the plan
commission may deem additional width to be necessary.
2. Side lines of lots should be approximately at right angles to straight streets and on radial
lines on curved streets. Very irregular lots should be avoided.
3. Through lots should be avoided except that in residential districts along thoroughfares,
lots shall face on the interior street with a no vehicular access area along such thoroughfares.
Through lots in all ORA(including O) and all business districts shall meet such special
access requirements as the village board on recommendation of the plan commission may
require.
�� 4. Minimum lot areas, dimensions and setback lines shall conform to the provisions of the
zoning ordinance for the district in which the subdivision is located within the corporate
limits of the village. Lot sizes in those areas outside the corporate limits shall be in
conformance with the applicable ordinances regulating lot sizes outside the corporate
boundaries. Where a water supply system or a sanitary sewer system is not available, the
minimum lot area shall meet the requirements set forth in subsection 14-6-3B3 of this

14-7-4: VARIATIONS AND AMENDMENTS:
A. Variations: The plan commission may recommend variations from the requirements of this
title in specific cases which, in its opinion, are in harmony with the intent and purpose of the
official plan of the village and in harmony with the spirit and intent of these regulations.
Such recommendations shall be communicated to the corporate authorities and,where the
land affected lies outside the corporate limits, to the appropriate governing authorities of
DuPage County. The village president and board of trustees may approve variations from
these requirements for subdivisions within the village limits or for those where the land
affected lies within one and one-half(1 1/2) miles of the limits of the village,when, in its
opinion, such variations will not be contrary to the purpose or intent of the official plan and
the spirit and intent of this title.
B. Amendments: These regulations may be amended by the village board from time to time.
The plan commission shall hold a public hearing, due notice of which shall be given, on
proposed amendments. Upon completion of the public hearing, the plan commission shall
make written recommendation to the president and board of trustees for the board's
