CONTRACT AWARD - 22nd STREET /JORIE BOULEVARD
WHEREAS, the Village of Oak Brook has entered into agreements
with the Illinois Department of Transportation and the Federal Highway
Administration for the improvement of 22nd Street from the East -West
Tollway structure to Clearwater Drive, including major improvements to
the intersection at Jorie Boulevard- Enterprise Drive and the structure
over Salt Creek: and,
WHEREAS, the Illinois Department of Transportation, received
bids on September 2, 1976 for the construction of said improvements; and,
WHEREAS, acceptable bids have been received from more than two
construction companies; and,
WHEREAS, said bids compare favorably with the engineer's estimate.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF OAK BROOK,
COUNTY OF DU PAGE, STATE OF ILLINOIS:
Section 1: That the contract be awarded to the low bidder,
Brighton Building and.Malntenance Company and Krug Excavating Company in
the amount of $1,247,576.21.
Section 2: That the contractor's be notified of .the award at
the earliest possible time'to-rexpddite execution of the cohtract and
commencement of construction.
Section 3: All ordinances, rules, and regulations of the
Village of Oak Brook which are in conflict with the provisions of this
Resolution are hereby repealed to the extent of the conflict.
Section 4: If any section, sub - section, sentence, clause, or
phrase of this Resolution is for any reason hold to be invalid, such
determination shad not affect the validity of any remaining portion of
this Resolution.
Section 5: This Resolution shall be in full force and effect
from and after its passage, approval, and publication in panphiet form
as required by law.

Gentlemen,

Attached is a "Resolution dealing with the contract award for the 22nd Street/
Jorie Blvd. project. Engineer's estimate for this project is $1,382,863,90.
The four lowest bidders were as follows:
Brighton Building 6 Maintenance Co. 8 Krug Excavating Co. - $1,2470576.21
Thomas Madden 1,334,293.07
Robert Addison 1,360,935.79
Swenson Company 1,404,894.14
The low bidder is Brightoe/Yrug who pas:- the contractor: on 22n1 Street from
Route 83 west. .You will recall that the job was started long before our 22nd
and Spring improvement and has dragged on so that even at the present time it
IS not completed. It would be BY recommendation that in the letter of trans-
mittal to the "State of Illinois with this attached resolution, that we advise
the State of Illinois -
1. that we take this action based on the. State of Illinois making the
contractor avnre that the Village of Oak Brook will not tolerate
undue delays in the expedious.Implementation of these itprovea0uts.
2. that was will not tolerate excessive costs and overruns to the basic
contract as was experienced on 22nd Street from Route 83 west..
3. that we will not tolerate the uncooperative attitude expressed by
the contractor An coordination with the various agencies and land
owners involved along 22nd Street.
I am sure that Brighton /Krug is aware of these problems and probably will have
good reasons in mind why they occurred. However, in my judgment, we should
make our position clear to the contractor in advance of any construction on our
project.
