R-858 - 09/23/2003 - DUPAGE COUNTY - Resolutions1 J � } RESOLUTION 2003- DU -ZBA- R -858 A RESOLUTION OF PROTEST TO DUPAGE COUNTY MAP AMENDMENT FOR EXTRA SPACE DEVELOPMENT, LLC'S MINI - WAREHOUSE SELF - STORAGE FACILITY WHEREAS, Extra Space Development, LLC, is the contract purchaser of approximately 4 6 acres of vacant land in unincorporated DuPage County, located within one and one -half (I V2) miles of the borders of the Village of Oak Brook; and WHEREAS, Extra Space Development, LLC has applied to the County of DuPage for a zoning map amendment from the property's current DuPage County R -3 Single Family Residence District and R -5 General Residence District zoning to B -1 Local Business District zoning In order to develop a mini - warehouse self - storage facility on that property; and WHEREAS, the DuPage County Zoning Board of Appeals and its Case Number 4910 -03 has heard this matter and made its recommendation to the DuPage County Board; and WHEREAS, Section 5/5 -12014 of the County Code (55 ILLS 5/5- 12011) provides that the Village may protest the proposed DuPage County map amendment, by resolution of the corporate authorities, which written protest would cause passage of said map amendment by the DuPage County Board to require a favorable vote of three quarters (3/4) of all of the members of the County Board. NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: 1. That the Village of Oak Brook hereby protests the map amendment proposed by Extra Space Development, LLC in Case Number 4910 -03 before the DuPage County Zoning Board of Appeals and to be considered by the DuPage County Board, in accordance with Section 5/5 -12012 of the County Code (55 ILCS 5/5- 12014). 2. The Village Clerk is hereby authorized and directed to file a certified copy of this Resolution of Protest with the DuPage County Clerk prior to the DuPage County Board taking any action on the aforesaid application for map amendment by Extra Space Development, LLC. That all resolutions or parts of resolutions in conflict herewith are hereby repealed, and this Resolution shall be in full force and effect upon its adoption.
