PROTESTING OF
DU PAGE COUNTY ZONING PETITION NO. 2144
Whereas, Section VIII, G, of the DuPage County Zoning Ordi-
nance, ado ted op )}acember 10, 1935, as subsequently amended in
its entire " eff4iC4ve May 1, 1957, and again revised effective
February 2 , 196'9 aI" further amended, provides that upon written
protest against Any proposed amendment to the aforesaid ordinance by
the President and Board of Trusts", of a municipality whore the land
effected Nils within one and one -half (1 -1/2) miles of the limits of
a zoned municipality, filed with the County Clerk, such amendment
shall not be gassed except 'by the favorable vote of three — fourths
(3/4) of All members of the County Board; and
Whorses., Petition No. 2144 by L. J. Sheridan, Jr., was filed
with the DnPage County Building and Zoning Department making appli-
catioa for +rezoning from *8- 3°'Single Family Residence District to
"8 -2" General Retail District and for the issuance of a Special Use
permit for the construction and operation of multiple - family units
and offices on the property hereinafter described:
Lots 18,.19, 20, 21, 24, 25, 26, 27, 28, 29, 30, and 31 in
York Township Supervisors Assessment Plat M8 in the SW}
of Section 22, Township 39 North, Range 110 Bast of the
Third Principal Meridian, in Du Page, County, Illinois,
R1802
Lots 1, 72 and 8 in Butterfield Acres in the S94 of
Section 21, Township 39 North, Range 11, Bast of the Third
Principal Meridian, in DuPage County, Illinois,
and also:
Lot 1 of Dr. Pays Division of Lots 22 and 23 of York Town-
ship Supervisors Assessment Plat Na in the SN'4 of Section 22,
Township 39 North, Range 11, Bast of the Third Principal
Meridian, in Du Page County, Illinois.

This property being situated between the triangle formed by 22nd
Street, Butterfield Road and Summit Avenue.
whereas, the Zoning Board of Appeals of DuPage County held
and conducted a public hearing on the aforesaid application on
September 24, 1970; and
Whereas, the aforesaid application concerns land located within
one and one -half (1 -1/2) miles of the corporate limits of the Village
of Oak Brook, a municipal corporation in DuPage County, Illinois, and
the Village of Oak Brook is the municipality with limits nearest ad-
jacent; and
Whereas, it is the opinion of the President and Board of Trustees
of the Village of Oak Brook that the application of L. J. Sheridan, Jr.,
for rezoning and for issuance of a Special Use Permit at the location
described above be objected to with respect to the proposed density
of twenty (20) multiple - family units per acre, but the corporate
authorities concur in the recommendation of the DuPage County Zoning
Board of Appeals with respect to the 0.4 floor area ratio. The
corporate authorities also object to any further development of the
subject property until adequate sewer and water service and municipal
fire protection service are available.
Whereas, it is the opinion of the President and Board of Trustees
of the Village of Oak Brook that the petitioner is not now denied the
enjoyment and benefit of his property under the present zoning classi-
fication of the County of DuPage since the property is merchantible
as now zoned and classified; and
Whereas, it is further the opinion of the President and Board
of Trustees of the Village of Oak Brook that the rezoning and re-
classification and issuance of a Special Use Permit at this location
would adversely effect vehicular traffic on 22nd Street, Summit Avenue
and Butterfield Road adjacent to the Village of Oak Brook;
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the President
and Board of Trustees of the Village of Oak Brook, DuPage County,
I'linois, that the said Village of Oak Brook does protest the grant-
ing of the rezoning and Special Use Permit requested by Petition No.
2144 applied for by L. J. Sheridan, Jr., and that the Village Clerk
is directed to communicate this protest to the Board of Supervisors
of DuPage County and the DuPage County Building and Zoning Department
and the DuPage County Zoning Board of Appeals.
BE IT FURTHER RESOLVED that a certified copy of this Resolution
be filed in the office of the County Clerk of DuPage County, Illinois,
forthwith.
PASSED by unanimous vote of the corporate authorities of the
Village of Oak Brw�k�,� DuPage County, Illinois, and ADOPTED this
