R-758 - 11/14/2000 - ELECTION - Resolutionsi RESOLUTION 42000- EL- CR -EXI -R -758 A RESOLUTION DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON THE ADVISORY QUESTION OF PUBLIC POLICY IN THE VILLAGE OF OAK BROOK ON NOVEMBER 7, 2000 WHEREAS, on November 7, 2000, there was held in and for the Village of Oak Brook, DuPage and Cook Counties, Illinois, an election for the purpose of voting on the advisory question of public policy, "Shall the Village of Oak Brook be Authorized to Sell to the County of DuPage Not More than 4.2 Acres of Real Estate in the Oak Brook Sports Core in the Village of Oak Brook Along and Adjacent to Oak Brook Road (31S` Street) at a Price Not Less than $835,000 for the Principal Purpose of Improving Oak Brook Road (31st Street) to Four Lanes, with Left Turn Lanes, a Landscaped Median and New Bridge Over Salt Creek, the Proceeds of Sale to be Used for Capital Improvements in the Oak Brook Sports Core ? "; and WHEREAS, the Illinois Election Code provides in relevant part that the Canvassing Board: for a Village shall consist of the Village President, the Village Clerk and one member of the Board of Trustees who has served the longest on the Board, in this case as determined by lot pursuant to statute, as the two senior Trustees have the same tenure on the Village Board (collectively "the Canvassing Board "); and WHEREAS, the said election has been regularly called and held as provided by law, and the returns of said election, including the Certificate of Results for the General Election, November 7, 2000, have been filed with the Village Clerk of the Village of Oak Brook; and WHEREAS, the results of the November 7, 2000 General Election are now before the Canvassing Board of the Village of Oak Brook for the purpose of canvassing the votes cast at said election and declaring the results of said election and the said Canvassing Board is familiar therewith; NOW, THEREFORE, BE IT RESOLVED, by the Canvassing Board of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: SECTION ONE: That the election held on November 7, 2000, was held in all respects as provided by law. Notice of said election was duly given by each of the County Clerks of DuPage and Cook Counties by publishing Notices of Election as required by law in newspapers of general circulation within the Village of Oak Brook. The Judges appointed by the County Clerks of DuPage and Cook Counties were duly qualified to fill such offices in each of the precincts and were duly sworn to perform their duties before the commencement of said election. The returns of said election have been duly tabulated by the County Clerks of Cook and DuPage Counties, and were filed with the Village Clerk of the Village of Oak Brook. SECTION TWO: That the Canvassing Board of the Village of Oak Brook finds from its canvass of returns of said election that the votes as set forth in the tabulation attached hereto and labeled Exhibit A were cast in said election on the advisory question of public policy, "Shall the Village of Oak Brook be Authorized to Sell to the County of DuPage Not More than 4.2 Acres of Real Estate in the Oak Brook Sports Core in the Village of Oak Brook Along and Adjacent to Oak Brook Road (31St Street) at a Price Not Less than $835,000 for the Principal Purpose of Improving Oak Brook Road (31St Street) to Four Lanes, with Left Turn Lanes, a Landscaped Median and New Bridge Over Salt Creek, the Proceeds of Sale to be Used for Capital Improvements in the Oak Brook Sports Core ?" SECTION THREE: That the Canvassing Board of the Village of Oak Brook finds that the results of its canvassing are as follows: 3,213 votes in favor, to adopt, this advisory question of public policy and 1,364 votes opposed, that is, to reject, this advisory question of public policy. SECTION FOUR: Therefore, this Canvassing Board of the Village of Oak Brook, DuPage and Cook Counties, Illinois, hereby proclaims and declares that the votes in favor of this advisory question of public policy have prevailed. SECTION FIVE: That this Canvassing Board declares the adoption of this advisory question of public policy. SECTION SIX: EFFECTIVE DATE. This Resolution shall be in full force and effect upon passage and approval. ROLL CALL VOTE: AYES: President Bushy, Trustee McInerney and Clerk Gonnella NAYS: None.
