SUBJECT: Mayors and Managers and lllnois Municipal League Legislative Programs
The Board has previously been provided with copies of the 2001 DuPage Mayors and Managers
Conference Legislative Action Program and the 2001 Illinois Municipal League Legislative
Agenda. In a memorandum dated February 2, 2001 1 urged the Board to consider adopting both of
these, programs, in whole or in part, as positions of the Village of Oak Brook.
This suggestion arises from a discussion that took place last summer among the Mayors and
Managers Conference Board of Directors and membership. The subject was how to address those
instances when professional municipal employee associations, (e.g., police chiefs, fire chiefs, public
works) to which our department heads belong adopt positions on legislation that might be contrary
to the positions taken by the municipal associations (e.g., DMMC and IML) to which their
employers belong.
One option raised by that discussion was to recommend action by corporate authorities to formally
adopt the legislative positions of the municipal associations in order to assist managers and staff in
determining appropriate responses to those situations when a professional association takes a
contrary stance. This is not a frequent occurrence, but it has happened, most recently in connection
with police pension increases. In order to provide useful guidance to staff members should any
situations of this sort arise, I encourage the Board to consider adopting the legislative positions
expressed by the DuPage Mayors and Managers Conference and Illinois Municipal League in their
respective programs.
It' it is, your wish to proceed in this fashion, it would be appropriate to direct the Village Attorney to
prepare an appropriate resolution for your consideration on February 27. It would also be
appropriate to include in your direction any provisions of either program you wish to except from
such action, so that they might be specified in the resolution.

The Village Board were provided with copies of the 2001 DuPage Mayors and

Municipal League Legislative Agenda. The Village Manager requested
consideration by the Village Board for adoption of these programs, in whole or
in part, as positions of the Village of Oak Brook. Most municipalities are
adopting these as Village policies.

Trustee Savino indicated that many of the positions that would be beneficial to
the Village appear to have been on the Du Page Mayors and Managers
Conference agenda for quite some time. He inquired as to how effective this
organization was in legislative action for municipalities.
Trustee Caleel concurred with Trustee Savino and asked what legislative
successes the Conference have occurred in return for the Village's membership
fee.
Village Manager Veitch indicated he would provide this information for the
Village Board. He noted one specific area is the sales tax information the
Village now obtains was initiated by the Conference's legislative action.

SUBJECT: Results of Legislative Advocacy
Adjun Ict to the February 13 discussion of adoption of the Illinois Municipal League and DuPage
Mayors and Managers Conference legislative programs as positions of the Village of Oak Brook (in
order to give guidance to staff whose professional organizations might adopt contrary positions), the
Board expressed interest in more information on the results of legislative advocacy by the League
and Conference over the last few years.
Below, I have listed several recent Conference and/or League initiatives that we can consider as
legislative '`successes ". While our exact proposals were not enacted in every case, the essence of
what we were trying to achieve was achieved in most cases. In others, we obtained part of what we
sought and the rest remains in the legislative agendas of the League and/or Conference.
• Access to detailed sales tax information by certain non -home rule municipalities (critical to
Oak Brook).
• Separation of library levies from other municipal levies on property tax bills.
• Enhancement of county zoning authority over telecommunications towers in unincorporated
areas.
• Clarification of the Intergovernmental Cooperation Act and expansion of scope of allowable
intergovernmental agreements.
• ,Local option sales tax for non -home rule mwucipalitles.
• Authority to archive public records electronically
Not all successes Lire the result of Conference or League initiatives Many are the result of strategic
partnerships or a strong defense against bad legislation that makes it better (or even acceptable) or
witch Ielps prevent passage. For example
• Expansion o t investment authority for police and fire pension funds.
• Police pension portability.

• Legislation that established the telecommunications IMF to preserve franchise revenue and
allowed retention of limited control over local right -of -way in the face of loss of franchising
authority as dictated by Federal law.
o Local Taxpayer "Bill of Rights" legislation.
• Wireless 911 surcharge legislation.
Authorization of studies on simplification of collection and administration of sales and use
taxes.
Preservation of the local share of the state income tax through prevention of significant new
exemptions.
•; Legislation that would have designated bicyclists as "intended users" of streets and
highways (did not pass).
• Sales tax exemption for leased computers (did not pass).
•' Sales tax "holiday" legislation (did not pass).
• Regional tax -base sharing study legislation (did not pass).
The Conference is also the entree through which Oak Brook has become so deeply involved in the
Metropolitan Mayors Caucus. The Caucus is in fact a confederation of the City of Chicago and the
suburban councils of government, of which the Conference is one. The caucus is active in both
Springfield and Washington, focussing on policy issues of broad regional concern more than on
specific active bills. You are already quite familiar with our roles in Caucus task forces on
economic development, e- commerce and electric reliability.
Of course there are losses too. Most notable in the last two years are the benefit increases granted
through the downstate police and fire pension statutes. These defeats were colored by what many of
us thlought was less than stellar advocacy on the part of the League (not the Conference).
Nevertheless, the political reality is that lawmakers have never been able to bring themselves to
disappoint the huge base of voters and contributors represented by the police and fire lobbies and
unions. And so every few years pension programs that are among the most generous to be found
anywhere are made more generous simply because they have not been changed in a while. The state
dictates the benefits and local governments are left to find a way to pay for them. The best the
employers have been able to do is negotiate legislation that is not as bad as what could have been or
was threatened. The question of why any changes should be made at all (regression is prohibited by
the I11'inois Constitution) is never on the table.
The Village receives full -time representation in Springfield at a fraction of what it would cost to
employ its own representatives (as many larger governmental entities do) Oak Brook's current
annual dues to the DuPage Mayors and Managers Conference and the Illinois Municipal League are
$6,760 and $704, respectively Of course, the benefits received from membership go far beyond
legislative advocacy alone.
