RECOMMENDED MOTION: I move that the Village Board award a Professional Services
Agreement, subject to attorney and staff review, to the attorney/ legal firm with the best overall
value, Marquardt & Belmonte, P.C., for Administrative Adjudication Hearing Officer.
Additionally, I move that the Village Board approve Resolution 2013- ADJUD - OFCR -PD -R-
1247, A Resolution Approving and Authorizing a Professional Services Agreement By and
Between the Village of Oak Brook and Marquardt & Belmonte, P.C. for Administrative
Adjudication Hearing Officer Services.
Backeround/History:
Nine (9) sealed request for qualifications were received and opened on Wednesday, February 27,
2013. The attomeys /legal firms who submitted qualifications are as follows:

Richard Jones $150/hr
David G. Eterno $150/hr
Storino, Ramello, & Durkin $170/hr (plus $.565 /mile round trip plus toll).
Marquardt & Belmonte $185/hr ($120/hr for travel)

Sam Tomatore Hourly rate to be determined
Staff reviewed the qualifications submitted and interviewed David G. Eterno, and Marquardt &
Belmonte, P.C. The two lower hourly rate submissions (Messineo and Jones) and one that gave
no hourly rate (Tomatore) indicated either minimal or no previous hearing officer experience.
Following the interviews, staff determined that Marquardt & Belmonte, P.C. was the best overall
fit and value for the Village. Marquardt & Belmonte, P.C. has a full staff with numerous
attorneys who have served in the DuPage County States Attorney's Office and have the
appropriate certification to act as Hearing Officers. They would be able to insure a hearing
officer is always available in the event of an emergency. They have a large list of clients based in
DuPage County and are familiar with the demographics in Oak Brook. They anticipate the cost
to be approximately $300 per hearing. The Village's current cost per hearing is between $500
and $600. Staff checked references and is extremely satisfied. While Mr. Etemo did have a
extensive background in administrative hearings, he is a sole proprietor that limits his practice to
serving as a hearing officer. Reference checks also suggested that hearings may take longer thus
negating the lower hourly rate.
The specific responsibilities and tasks of the Administrative Hearing Officer for the Village of
Oak Brook include:
1. Act as the presiding adjudicative officer at Village of Oak Brook Administrative
Hearings
2. Hear testimony and accept evidence at Hearings
3. Issue subpoenas directing witnesses to appear at Hearings
4. Preserve and authenticate the record of Hearings
5. Issue determinations based on evidence presented at Administrative Hearings
6. Impose penalties
The Administrative Hearings are held in the Samuel E. Dean Board Room in the Butler
Government Center, 1200 Oak Brook Road, Oak Brook, Illinois 60523. The Administrative
Hearings are conducted on the second Wednesday of every month at 2:00 pm.
Recommendation:
That the Village Board award a Professional Services Agreement, subject to attorney and staff
review, to the attorney/ legal firm with the best overall value, Marquardt & Belmonte, P.C., for
Administrative Adjudication Hearing Officer. Additionally, I move that the Village Board
approve Resolution 2013 - ADJUD - OFCR -PD -R -1247, A Resolution Approving and Authorizing

A RESOLUTION APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
BY AND BETWEEN THE VILLAGE OF OAK BROOK
AND MARQUARDT & BELMONTE, P.C.
FOR ADMINISTRATNE ADJUDICATION HEARING OFFICER SERVICES
WHEREAS, the Village desires to retain an attorney to perform administrative adjudication
hearing officer services for the Village ( "Services "), and
WHEREAS, pursuant to Section 1- 7 -6(B) of the Village Code of the Village of Oak Brook, Illinois,
the Village invited requests for qualifications ( "RFQ') to perform the Services and received 9 sealed
responses, which were opened on February 27, 2013; and
WHEREAS, Village staff has determined that Marquardt & Belmonte, P.C. ( "M &B ") has the
qualifications necessary to perform the Services and would provide the best value to the Village, and
WHEREAS, the Village and M &B desire to enter into and execute an agreement for M &B to
perform the Services in substantially the form attached to this Resolution as Exhibit A ( "Agreement');
and
WHEREAS, the President and Board of Trustees have determined that it is in the best interest of
the Village to enter into the Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve the Agreement by and between the Village and M &B in a final form to be prepared and approved
by the Village Attorney and Village Manager.
Section 3: Execution of Agreement. The Village President and the Village Clerk shall be,
and are hereby, authorized to execute the approved final Agreement on behalf of the Village.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.

VILLAGE OF OAK BROOK
PROFESSIONAL SERVICES AGREEMENT
This AGREEMENT is dated as of the _ day of
2013 ( "Agreement'), and is by and between
the VILLAGE OF OAK BROOK, an Illinois municipal
corporation ( "Village'% and MARQUARDT & BELMONTE,
RC., 311 S. County Farm Road, Suite 1, Wheaton, Illinois
( "Consultant').
IN CONSIDERATION OF the recitals and the mutual
covenants and agreements set forth in the Agreement, and
pursuant to the Village's statutory and home rule powers, the
parties agree as follows:
SECTION 1. SCOPE OF SERVICES. Except as
specifically provided in the text of this Agreement, the
Consultant shall, and does hereby, accept the selection and
agrees to provide Administrative Hearing Officer services
( "Services ") to the Village in the manner set forth in the
following documents:
A. The RFQ, a copy of which is attached as Exhibit
A; and
B. The Consultant's proposal, a copy of which is
attached to this Agreement as Exhibit B ( "Consultant
Proposal ").
In the event of a conflict between an Exhibit and the text of
this Agreement, the text of this Agreement shall control. In
the event of a conflict between the RFQ and the Consultant
Proposal, for which the Consultant Proposal expressly accepts
the terms of the RFQ, then the Consultant Proposal shall
control. In the event of any other conflict between the RFQ
and the Consultant Proposal, the RFQ shall control.
SECTION 2. TERM. The Consultant shall perform the
Services for a term of one year beginning on
, unless this Agreement is earlier
terminated pursuant to the terms of this Agreement (`Initial
Term'). The Village shall have the right, but not the
obligation, to extend this Agreement for two additional one -
year terms immediately following the Initial Term.
SECTION 3. COMPENSATION.
A. Agreement Amount. The Consultant
agrees to charge, and the Village agrees to compensate the
Consultant $185.00 per hour for all work performed at, and
preparing for, the hearings. The Consultant agrees to charge,
and the Village agrees to compensate Consultant $120.00 per
hour for travel time. The Consultant shall not charge, nor be
entitled to compensation or reimbursement for any other fees
or costs without the prior express written authorization of the
Village Manager. The terms for payment to the Consultant
shall be as follows:
B. Invoices and Payment. The Consultant shall
submit invoices in an approved format to the Village Manager
for performing the Services. Invoices shall be submitted to the
Village on a monthly basis. The amount billed in each invoice
for the Services shall be based solely upon the rates set forth
in this Agreement. The Village shall pay to the Consultant the
amount billed within 45 days after receiving such an invoice.
Hours will only be billed to reflect services provided by
Consultant to Client for requested services pursuant to this
Agreement. If no service is provided in a given month, an
invoice will not be generated for that period.
C. Records. The Consultant shall maintain records
showing actual time devoted, and shall permit the Village to
inspect and audit all data and records of the Consultant for
work done pursuant to this Agreement. The records shall be
made available to the Village at reasonable times during the
term of this Agreement, and for one year after the termination
of this Agreement.
D. Additional Services. The Consultant
acknowledges and agrees that the Village shall not be liable
for any costs incurred by the Consultant in connection with
any services provided by the Consultant that are outside the
scope of this Agreement ( "Additional Services'j, regardless
of whether such Additional Services are requested or directed
by the Village, except upon the prior written consent of the
Village.
E. Taxes, Benefits, and Royalties. Each
payment by the Village to the Consultant includes all
applicable federal, state, and Village taxes of every kind and
nature applicable to the Services as well as all taxes,
contributions, and premiums for unemployment insurance, old
age or retirement benefits, pensions, annuities, or similar
benefits and all costs, royalties, and fees arising from the use
of, or the incorporation into, the Services, of patented or
copyrighted equipment, materials, supplies, tools, appliances,
devices, processes, or inventions. All claim or right to claim
additional compensation by reason of the payment of any such
tax, contribution, premium, costs, royalties, or fees is hereby
waived and released by Consultant.
SECTION 4. REPRESENTATIONS OF
CONSULTANT. The Consultant represents and certifies that
the Services shall be performed in accordance with the
standards of professional practice, care, and diligence
practiced by recognized consultants in performing services of
a similar nature in existence during the term of this
Agreement. The representations and certifications expressed
shall be in addition to any other representations and
certifications expressed in this Agreement, or expressed or
implied by law, which are hereby reserved unto the Village.
The Consultant further represents that it is financially solvent,
has the necessary financial resources, and is sufficiently
experienced and competent to perform and complete the
Services in a manner consistent with the standards of
professional practice by recognized consultants providing
services of a similar nature. The Consultant shall provide all
personnel necessary to complete the Services.
Consultant represents and warrants to the Village that it will
only use attorneys employed by the Consultant to provide the
Services who: (1) are and have been for the three years
immediately preceding the Effective Date of this Agreement
duly licensed and in good standing as attorneys in the State of
Illinois; and (2) have no knowledge of any administrative
proceedings or other matters which would affect the attorney's
licensure within the State of Illinois. The Consultant agrees
that the foregoing representations constitute continuing
obligations and that if Consultant uses any attorneys to
provide the Services that fail to meet such requirements, or if
Consultant uses attorneys to provide Services that have their
licenses suspended or terminated by the Illinois Attorney
Registration and Disciplinary Commission, this Agreement
will be immediately terminated.
SECTION 5. INDEMNIFICATION;
INSURANCE; LIABILITY.
A. Indemnification. The Consultant proposes
and agrees that the Consultant shall indemnify, save harmless,
and defend the Village against all damages, liability, claims,
losses, and expenses (including attorneys' fee) that may arise,
or be alleged to have arisen, out of or in connection with the
Consultant's performance of, or failure to perform, the
Services or any part thereof, or any failure to meet the
representations and certifications set forth in Section 4 of this
Agreement. Notwithstanding anything contained herein to the
contrary, the parties expressly agree that Consultant shall not
be obligated to indemnify the Village for any damages,
liability, claims, losses, and expenses (including attorneys'
fees) for an appeal to the Circuit Court.
B. Insurance. The Consultant acknowledges
and agrees that the Consultant shall, and has a duty to,
maintain adequate professional liability insurance, in an
amount, and in a form and from companies, acceptable to the
Village. The Consultant's maintenance of adequate insurance
shall not be construed in any way as a limitation on the
Consultant's liability for losses or damages under this
Agreement.
C. No Personal Liability. No elected or
appointed official, or employee of the Village shall be
personally liable, in law or in contract, to the Consultant as the
result of the execution of this Agreement.
SECTION 6. GENERAL PROVISIONS.
A. Relationship of the Parties. The
Consultant shall act as an independent contractor in providing
and performing the Services. Nothing in, nor done pursuant
to, this Agreement shall be construed to: (1) create the
relationship of principal and agent, employer and employee,
partners, or joint venturers between the Village and
Consultant; or (2) to create any relationship between the
Village and any subcontractor of the Contractor.
B. Conflicts of Interest. The Consultant
represents and certifies that, to the best of its knowledge: (1)
no Village employee or agent is interested in the business of
the Consultant or this Agreement (2) as of the date of this
Agreement, neither the Consultant nor any person employed
or associated with the Consultant has any interest that would
conflict in any manner or degree with the performance
of the obligations under this Agreement; and (3) neither the
Consultant nor any person employed by or associated with the
Consultant shall at any time during the term of this Agreement
obtain or acquire any interest that would conflict in any
manner or degree with the performance of the obligations
under this Agreement.
C. No Collusion. The Consultant represents
and certifies that the Consultant is not barred from contracting
with a unit of state or local government as a result of (1) a
delinquency in the payment of any tax administered by the
Illinois Department of Revenue unless the Consultant is
contesting, in accordance with the procedures established by
the appropriate revenue act, its liability for the tax or the
amount of the tax, as set forth in Section 1 I- 42.1 -1 et seq. of
the Illinois Municipal Code, 65 ILCS 5/1142.1 -1 et seq.; or
(2) a violation of either Section 33E -3 or Section 33E -4 of
Article 33E of the Criminal Code of 1961, 720 ILCS 5/33E -1
et seq. If at any time it shall be found that the Consultant
has, in procuring this Agreement, colluded with any other
person, firm, or corporation, then the Consultant shall be liable
to the Village for all loss or damage that the Village may
suffer, and this Agreement shall, at the Village's option, be
null and void.
D. Termination. Notwithstanding any other
provision hereof, the Village may terminate this Agreement at
any time upon 30 days prior written notice to the Consultant.
In the event that this Agreement is so terminated, the
Consultant shall be paid for Services actually performed and
reimbursable expenses actually incurred, if any, prior to
termination, not exceeding the value of the Services
completed.
E. Compliance with Laws and Grants.
Consultant shall give all notices, pay all fees, and take all
other action that may be necessary to ensure that the Services
are provided, performed, and completed in accordance with all
required governmental permits, licenses, or other approvals
and authorizations that may be required in connection with
providing, performing, and completing the Services, and with
all applicable statutes, ordinances, rules, and regulations,
including without limitation the Fair Labor Standards Act; any
statutes regarding qualification to do business; any statutes
prohibiting discrimination because of, or requiring affirmative
action based on, race, creed, color, national origin, age, sex, or
other prohibited classification, including, without limitation,
the Americans with Disabilities Act of 1990, 42 U.S.C. §§
12101 at seq., and the Illinois Human Rights Act, 775 ILCS
511 -101 et seq. Consultant shall also comply with all
conditions of any federal, state, or local grant received by the
Village or Consultant with respect to this Contract or the
Services. Consultant shall be solely liable for any fines or
civil penalties that are imposed by any governmental or quasi-
governmental agency or body that may arise, or be alleged to
have arisen, out of or in connection with Consultant's, or its
subcontractors, performance of, or failure to perform, the
Services or any part thereof. Every provision of law required
by law to be inserted into this Contract shall be deemed to be
inserted herein.
F. Default. If it should appear at any time that
the Consultant has failed or refused to prosecute, or has
delayed in the prosecution of, the Services with diligence at a
rate that assures completion of the Services in full compliance
with the requirements of this Agreement, or has otherwise
failed, refused, or delayed to perform or satisfy the Services or
any other requirement of this Agreement ( "Event of
Default'% and fails to cure any such Event of Default within
ten business days after the Consultant's receipt of written
notice of such Event of Default from the Village, then the
Village shall have the right, without prejudice to any other
remedies provided by law or equity, to (1) terminate this
Agreement without liability for further payment; or (2)
withhold from any payment or recover from the Consultant,
any and all costs, including attorneys' fees and administrative
expenses, incurred by the Village as the result of any Event of
Default by the Consultant or as a result of actions taken by the
Village in response to any Event of Default by the Consultant.
G. Assi¢nment. This Agreement may not be
assigned by the Village or by the Consultant without the prior
written consent of the other party.
H. Notice. All notices required or permitted to
be given under this Agreement shall be in writing and shall be
delivered: (1) personally; (2) by a reputable overnight courier;
or by (3) by certified mail, return receipt requested, and
deposited in the U.S. Mail, postage prepaid. Unless otherwise
expressly provided in this Agreement, notices shall be deemed
received upon the earlier of (a) actual receipt; (b) one
business day after deposit with an overnight courier as
evidenced by a receipt of deposit; or (c) three business days
following deposit in the U.S. mail, as evidenced by a return
receipt. Notices and communications to the Village shall be

I. Waiver. Neither the Village nor the
Consultant shall be under any obligation to exercise any of the
rights granted to them in this Agreement except as it shall
determine to be in its best interest from time to time.
The failure of the Village or the Consultant to exercise at any
time any such rights shall not be deemed or construed as a
waiver of that right, nor shall the failure void or affect the
Village's or the Consultant's right to enforce such rights or any
other rights.
J. Third Party Beneficiary. No claim as a
third party beneficiary under this Agreement by any person,
firm or corporation shall be made or be valid against the
Village.

The Village of Oak Brook is seeking responses to this Request for Qualifications (RFQ) for the
position of Administrative Hearing Officer. The Administrative Hearing Officer is appointed by
the Village President, with the consent of the Village Board, and provides adjudication in
compliance citations, parking, and quasi - criminal violations within the Village of Oak Brook. A
list of offenses can be found in the Village Code Titles 6 & 7. The code can be viewed or
downloaded from the Village website at www.oak- brook.org.
Qualified firms interested in performing such services can obtain this Request For Qualifications
package from the Village's Purchasing Division, 630 - 368 -5164, or it can be downloaded from
the Village's website at www.oak- brook.ora, or it can be picked up at the Butler Government
Center, 1200 Oak Brook Road, Oak Brook, Illinois 60523, between the hours of 8:00 A.M. and

Section 2. Background Information
The Village of Oak Brook is a non -home rule municipality with a population of 7,883.
The Village operates many operations and departments to serve the needs of its residents
and the greater populace that serve as the community of the Village, including the
Business and Corporate Community.
The Village is led by an elected Village Board consisting of on Village President, six
Trustees, and a Village Clerk. All elected officials are elected at large. Day to day
operations of staff is overseen by the Village Manager.
On November 25, 2008, the Village Board approved passage of an ordinance that allows
the impoundment of a motor vehicle used in connection with illegal activity. The fee is
$500 for impoundment. On February 14, 2012, the Village Board approved passage of
an ordinance that expanded the Adjudication Program to include compliance citations, all
parking violations and quasi - criminal violations. A list of offenses can be found in the
Village Code Titles 6 & 7. The code can be viewed or downloaded from the Village
website at www.oak- brook.org. The fines for citations, parking violations and quasi -
criminal violations range from $25 - $250 and increase if not paid by the due date. The
Administrative Hearing Officer has the ability to increase the fine if the violator chose
not to pay within 30 days.

Section 4. Qualifications Statement
Five (5) copies of the Statement of Qualifications must be submitted in a sealed envelope to:

and clearly marked on the outside of the envelope "ADMINISTRATIVE HEARING
OFFICER" on or before 4:00 p.m. Wednesday, February 27, 2013. Any statement of
qualification received after this date and time will be refused. It is suggested that the statement
be submitted in a standard 8 -1/2" x 11" format for ease of review and reproduction. No size
larger than 11" x 17" can be accepted to allow for Village reproduction.
Submittal Requirements:
The following items must be included in all responses to this Request for Qualifications:
1. A clear and detailed statement of interest identifying why the applicant is
interested in the position; why the applicant believes he /she is qualified to
perform the duties as outlined; a mission statement from the applicant; and a
description of the performance style which will be exhibited by the applicant if
chosen.
2. The name and resume for the person who will act as the Administrative Hearing
Officer.
3. A summary describing the nature of the applicant's previous and current
experience in litigating municipal code violations with municipal clients in
DuPage County.
4. A summary describing the nature of the applicant's previous and current
experience with municipal clients in DuPage County.
5. A statement describing any existing or potential conflicts of interest that might
affect the applicant's ability to represent the Village.
6. A list of professional references.
7. The hourly rate that the applicant charges as an Administrative Hearing Officer.

8. Any exceptions taken to this Request for Qualifications shall be clearly identified.
Section S. Minimum Qualifications
1. The applicant must be an attorney that has been licensed to practice in Illinois for
at least three years.
2. The applicant must be in good standing with the Illinois Supreme Court Attorney
Registration and Disciplinary Commission.
Section 6. Review Process
A. Selection Process and Basis ofAward
The Village of Oak Brook reserves the right to waive any informality or technical error and to accept the
applicant deemed by the Village to be in its best interests.
B. Evaluation Criteria
Critical factors which will be considered in evaluating the statements of qualification are as
follows:
1. Qualifications of individuals who would have direct involvement in tasks on this project.
Despite a team's overall capabilities and experience, attention will be focused directly on
the personnel assigned to the project and the manner in which they will be organized and
managed.
2. Capabilities and experience in comparable previous projects of this kind and the
specialized experience and technical competence of the applicant.
3. Past record of performance on contracts with other governmental agencies or public
bodies, including such factors as control of costs, quality of work and ability to meet
schedules. References from past and existing clients will be utilized to determine past
record of performance.
4. The firm's approach to the project - although the Village has identified a general nature
of services required, the candidate is given broad leeway toward approach and
methodology to provide the expected outcomes.
5. Capacity of the candidate to perform the work within time schedules.
C. Terms and Conditions

Any contract or agreement resulting from negotiations with the selected most qualified
firm by the Village shall be on forms either supplied by or approved by the Village's
Legal Department, and shall contain, as a minimum, applicable provisions of this Request
For Qualifications. The Village reserves the right to reject any agreement that does not
conform to this Request For Qualifications and any Village requirements for agreements
and contracts.
2. If, through any cause, the firm fails to fulfill any of the obligations agreed to in a timely
and proper manner, the Village shall have the right to terminate the contract by notifying
the firm in writing of such termination at least 15 calendar days in advance of such
termination.
3. The Village shall not be liable for any expenses incurred by the candidate including, but
not limited to, expenses associated with the preparation of the statement, attendance at
interviews, preparation of a cost statement or final contract negotiations.
4. All responses to this RFQ will become the property of the Village. Reasonable
precautions will be taken to ensure the confidentiality of the material. Each respondent
shall denote and clearly indicate any proprietary information that is submitted as part of
their statement. The successful statement will become public information after selection.
5. The Village reserves the right to reject any and all statements of qualifications and to
request clarification of information submitted and request additional information as
needed.
6. The term of the agreement shall be for one (1) year with two (2) additional one (1) year
extensions.

In its prosecutorial role for each municipal client detailed above, M &B performs

Clerks and Chief Judge's office, research, plea negotiations, assisting officers and staff
with legal issues, officer training and attending all requested Village and Department
meetings. Additionally, as Administrative Tow Hearing Prosecutors our firm was
instrumental in establishing procedures and guidelines for how the towing of vehicles for
violations of local ordinances are processed.
The services currently being performed for the Villages of Schaumburg and
Addison involve one of our attorneys acting as Administrative Hearing Officers for
various types of local ordinance violations on a monthly or bi- weekly basis. As part of
our duties as Administrative Hearing Officers we are required to make an opening
statement describing the procedures, swear in witnesses, hear evidence and make a
written determination as to liability and fines, if necessary. We are also required to rule
upon write -in contests of the local ordinance violations. The violations currently heard
include, but are not limited to, building code violations, traffic violations, parking
violations and minor criminal offenses. Additionally, we are Administrative Hearing
Officers for red light camera violations for the Villages of Willowbrook and Addison.
We were also the Administrative Hearing Officers for the Schaumburg Red Light Photo
Enforcement Program which had attracted extensive publicity until the Village decided to
terminate the program.
In addition to the hearings enumerated above, Mr. Belmonte has sat as an
Administrative Hearing Officer for a License Revocation hearing for the City of
Wheaton. The violation was brought against a massage parlor which had been granted a
license by the City, but began to conduct suspect activities. The hearing was conducted
pursuant to the City Ordinance and a recommendation was made to the City Manager
based upon the evidence.
Servicine Attornevs
Although Daniel Hanlon, whose resume is included with this submittal, will be
the primary Hearing Officer, given the number of attorney's working at M &B who are
certified to act as Administrative Hearing Officers, all adjudication dates will be covered
by an attorney of M &B. In the event there is an unforeseen event which would prevent
each of M &B's attorneys from being able to attend one of the scheduled administrative
hearings, M &B has extensive relationships with licensed Administrative Hearing Officers
who could temporarily cover the Administrative Hearing. However, over the years of
prosecuting ordinance violations and acting as Administrative Hearing Officers and
Prosecutors, M &B has not needed to rely on any outside attorneys to cover its required
court calls and administrative hearings.
Availability and Accessibility of Attorneys
Each attorney of M &B is available during normal business hours for consultation
with all Village and Police officials and staff. Realizing that unexpected issues and
concerns arise at odd times, the attorneys will also be available at other times requested
by the Village which include evenings, weekends, and holidays. As stated above, M &B
prides itself on its responsiveness to the client.
Services Offered
M &B is seeking to provide the Village with the following, non - exclusive,
services and all other related requested and required services:
• Attending all required training and orientation courses;
• Attending and performing each and every responsibility and duty of an
Administrative Hearing Officer in a fair and impartial manner;
Fees
M &B proposes to perform the above referenced services at an hourly rate of
$185.00 per hour for all work performed both at the hearings and in preparation for the
hearings with all travel time to be compensated at an hourly rate of $150.00 per hour.

Scott R Marquardt
Scott R. Marquardt is the President of M &B. Mr. Marquardt received his
Bachelor's degree from the University of Illinois, Champaign, Illinois and his Juris
Doctorate from Chicago -Kent College of Law, Chicago, Illinois.
During law school, Mr. Marquardt was a Supreme Court Rule 711 clerk at the
DuPage County State's Attorney's Office. After graduating from law school in 1992,
Mr. Marquardt became an Assistant State's Attorney in DuPage County. During his
career at the State's Attorney's Office he worked in several divisions including traffic,
misdemeanor and felony. Prior to his departure in 1996, Mr. Marquardt was in charge of
the Felony Screening Division. Since that time he has focused his attention on criminal
defense, municipal prosecutions and property tax appeals. He has both prosecuted and
defended all types of criminal cases ranging from traffic violations and driving under the
influence matters to theft and domestic battery as well as hundreds of felony matters. Mr.
Marquardt is also the president of Roger C. Marquardt & Co., Inc., a lobbying firm that
focuses on State of Illinois legislative and executive issues. Mr. Marquardt was
instrumental in the drafting and passage of the legislation which allows local
municipalities to operate red light enforcement cameras.
Mr. Marquardt is a member of the Illinois State Bar Association and the DuPage
County Bar Association.
William T. Belmonte
William T. Belmonte is a partner with M &B and concentrates his practice on
municipal prosecutions and administrative hearings, criminal defense, real estate and
personal injury law. Mr. Belmonte is a licensed Administrative Hearing Officer and
currently conducts hearings for the Village of Addison and Winfield. Mr. Belmonte
received his Bachelor of Science degree from Marquette University, Milwaukee,
Wisconsin and his Juris Doctorate from DePaul University College of Law, Chicago,
Illinois.
Mr. Belmonte is admitted to practice before every Illinois State Court and the
United States District Court for the Northern District of Illinois. He is also a member of
the Illinois State Bar Association and DuPage County Bar Association. Mr. Belmonte is
also a Certified Illinois Municipal Administrative Hearing Officer.
Mr. Belmonte has over 18 years of experience concentrating in criminal
prosecution and defense. Beginning in 1991 he served as a law clerk for the DuPage
County's State's Attorney's Office and subsequently was hired on as an Assistant State's
Attorney in 1993. As an Assistant State's Attorney, Mr. Belmonte handled cases ranging
from traffic and DUI matters to felony narcotics cases. As a felony assistant in the
Narcotics Division, part of his duties included the drafting of search warrants and
eavesdropping requests, handling all civil forfeitures, case preparation and trial. Also,
while as an Assistant State's Attorney, Mr. Belmonte taught search and seizure laws at

Brook Mall Retailers Association. In 1998 Mr. Belmonte was appointed as the lead
investigator for the Illinois State Crime Commission reviewing the investigation of the

Demetrios N. Panoushis
Demetrios N. Panouhis is a partner with M &B. Mr. Panoushis received his
Bachelor's degree from Northern Illinois University, DeKalb, Illinois and his Juris
Doctorate from Chicago -Kent College of Law, Chicago, Illinois.
During law school, Mr. Panouhis was a Supreme Court Rule 711 clerk at the
DuPage County State's Attorney's Office working in the Criminal Complaints and
Victim Services Units. After graduating from law school in 2001, Mr. Panoushis became
an Assistant State's Attorney in DuPage County. As an Assistant State's Attorney Mr.

During law school, Mr. Hanlon was a Supreme Court Rule 711 clerk at the

Felony Division. After graduating from law school in 1999, Mr. Hanlon became an
Assistant State's Attorney in DuPage County. As an Assistant State's Attorney Mr.

2001, Mr. Hanlon prosecuted juvenile felony and juvenile misdemeanor matters. hi

President of the Student Bar Association and serving in that capacity for one year.
Shortly after graduating law school, Mr. hnielski was hired as an Assistant State's

Michael W. Reidy
Michael W. Reidy is of counsel for the law firm of M &B. He received a Bachelor
of Arts Degree from University of Wisconsin- Madison and a Juris Doctorate from
DePaul University.
Mr. Reidy is a seasoned trial attorney with over 16 years of courtroom
experience. Mr. Reidy began his legal career as a law clerk with Ruff, Weidenaar &
Reidy, Ltd. in Chicago, Illinois. He then worked as a law clerk with Kiesler & Berman in
Chicago, Illinois where he was later hired as an associate attorney upon graduating law
school in 1996. Later in 1996, he joined the DuPage County State's Attorney's Office as
an Assistant State's Attorney. While with the State's Attorney's Office, Mr. Reidy
worked his way up to being a felony trial supervisor whose assignments included the
prosecution of traffic, DUI, misdemeanor, felony, narcotics, sex crimes, reckless
homicides and murders. In 2006, Mr. Reidy became the First Assistant State's Attorney
of Kendall County. In 2010, Mr. Reidy joined the law firm of Martin, Kent & Reidy as a
partner where he practiced criminal defense and civil litigation. In 2012, Mr. Reidy

Barbara D. Skurka
Barbara D. Skurka is an associate with M &B. Ms. Skurka received her
Bachelor's degree from DePaul University, Chicago, Illinois and her Juris Doctorate

During law school, Ms. Skurka was a law clerk with the DuPage County State's
Attorney's Office and was hired as an assistant shortly after graduation in 1991. While at
the State's Attorney's Office, Ms. Skurka worked in several different divisions including,
traffic, juvenile, misdemeanor and felony. Prior to her departure from the State's
Attorney's Office in 1995, Ms. Skurka oversaw auto theft prosecutions in DuPage

general practice law firm handling criminal, personal injury, estate, and real estate law.
October 1997 to June 2000: Appointed as Lead Investigator for Illinois State Crime
Commission's Brown's Chicken Investigation.
November 1993 to August 1997: Assistant State's Attorney, DuPage County State's Attorneys
Office, Criminal Division. Assigned to Traffic, misdemeanor, and Felony Divisions. As a felony
prosecutor assigned to the Narcotics Division, responsible for all drug cases and coordination of
ongoing investigations with the County Meg unit. Assisted in drafting requests for search
warrants and eavesdrops and obtaining judicial approval. As a general felony assistant, cases such
as armed robbery, financial crimes, reckless homicides, and other general felonies were assigned.
Conducted grand jury investigations and was responsible for indicting all assigned cases.
