R-1180 - 05/08/2012 - GOVERNMENT LEGISLATION - Resolutions Supporting DocumentsITEM 66G.2) } AGENDA ITEM Regular Board of Trustees Meeting of May 8, 2012 SUBJECT: Aggregation of Natural Gas Legislation FROM: David Niemeyer, Village Manager NVI BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: I move for passage of Resolution R -1180, "A Resolution In Support Of Illinois Senate Bill 3766, As Amended, To Allow Municipalities To Pursue Natural Gas Aggregation For Residential And Small Commercial Customers ". Background/History: There is currently pending in the Illinois General Assembly legislation which would allow corporate authorities of a county or municipality to pursue aggregation of natural gas for their residents. The legislation is modeled after the electricity aggregation law and as of this date is being reviewed by the Illinois House Rules Committee after passing the Illinois Senate 40 -10 -0. Recommendation: I recommend that this Resolution be passed RESOLUTION 2012- GL -ST- GAS -R -1180 A RESOLUTION IN SUPPORT OF ILLINOIS SENATE BILL 3766, AS AMENDED, TO ALLOW MUNICIPALITIES TO PURSUE NATURAL GAS AGGREGATION FOR RESIDENTIAL AND SMALL COMMERCIAL CUSTOMERS WHEREAS, securing affordable energy is vital to the economic welfare of the Village, its residents, and businesses; and WHEREAS, the General Assembly previously passed legislation allowing municipalities to aggregate the electricity demands of residential and small commercial customers in order for municipalities to secure better electricity pricing ( "Electric Aggregation Program "); and WHEREAS, the Electric Aggregation Program has been extremely successful throughout Illinois in helping residential and small commercial customers secure significant savings in electricity costs; and WHEREAS, the Electric Aggregation Program provided Oak Brook residential customers a 30% savings and small commercial customers a 27% to 30% savings in electricity costs; and WHEREAS, Senate Bill 3766, as amended by Senate Floor Amendment Number Two, is currently pending before the Illinois General Assembly; and WHEREAS, Senate Bill 3766 would amend the Illinois Public Utilities Act, 20 ILCS 5/1 et seq., to allow municipalities to aggregate the demand of residential and small commercial customers for natural gas in order to secure better pricing for natural gas from natural gas suppliers in the same way that the Electric Aggregation Program allowed for electric aggregation; and WHEREAS, the Village President and Board of Trustees believe that natural gas aggregation would result in costs savings to the residents and businesses in the Village much like the Electric Aggregation Program; and WHEREAS, the Village President and Board of Trustees believe that passing Senate Bill 3766 is in the best interest of the Village and the State of Illinois; and NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows: Section 1: The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: The President and Board of Trustees for the Village of Oak Brook hereby express their collective support for Senate Bill 3766 and believe it is imperative that Senate Bill 3766 be passed in order to provide the Village and other municipalities the authority to aggregate the demand for natural gas in order to secure better pricing from natural gas suppliers. Section 3. The Village President and Village Clerk hereby authorize the Village Manager to send a suitable copy of this Resolution to the Village's local state senators and representatives. Section 4. All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed to the extent of the conflict. Section 5. This Resolution shall be in full force and effect from and after its passage, approval and publication as required by law.
