Gonnella, Village Clerk' ' RECOMMENDATION: That the Village Board approve Resolution 2003-BD-CL- MIN -EXl- R-, A Resolution Approving the Release of Closed Meeting Minutes. Effective January 1, 1982 ILSC 120/2.06 required that all public bodies shall keep written minutes of all their meetings, whether open or closed. The public body shall periodically, but no less than semi- annually, meet to review minutes of all closed sessions that had not been released to the public. At this time, it is recommended that these minutes be released. Upon review of the minutes, it should be determined and reported in open session whether the need for confidentiality still exists as to all or parts of those minutes or whether the minutes no longer require confidential treatment and should be available for public inspection. Attached are the Closed Meeting minutes of January through June, 2003 which have been reviewed by Attorney Martens and items still pending and requiring continued confidentiality have been redacted. Staff has recommended these changes due to the amount of time involved processing each application as the commercial solicitation permit could be renewed at no cost. Each time a renewal permit is issued identification badges have to be printed and the Police Department processes a background check. Trustee Caleel voiced his opposition to commercial solicitors within the , r Village. Clerk Gonnella explained that any resident who does not wish to have solicitors may request a "No Solicitors" sign from the Village and that our ordinance reads that if a solicitor does not heed the sign, they are in violation of Village Code. Motion by Trustee Aktipis, seconded by Trustee Craig, to approve Ordinance 2003- LC -SOL -G -723, "An Ordinance Amending Title 4 ( "Solicitors and Peddlers ") of the Village Code of the Village of Oak Brook, Illinois by Amending Sections 4 -4A -3 ( "Term; Renewal "), 4- 4A-7 ( "Fees ") of Article A and Section 4 -4B -3 ( "Term, Renewal ") of Article B." ROLL CALL VOTE: Ayes: 5 - Trustees Aktipis, Craig, Korin, Miologos and Yusuf Nays: 1 - Trustee Caleel. Absent: 0 - None. Motion carried. Motion carried. 3) ORDINANCE 2003- ZO -TA -G -724 "AN ORDINANCE AMENDING ORD 03- ZO -TA -G- SECTION 13 - I QA -2 BY ADDING A SPECIAL USE IN THE ORA -1 ORD -EDC USE - OFFICE RESEARCH ASSEMBLY DISTRICT OF THE VILLAGE ALLW REC OF OAK BROOK ZONING ORDINANCE." ACTVTs Pursuant to Board direction, an ordinance has been prepared which adds "Parks and open field recreational activities" as a special use in the ORA -1 Office Research Assembly District. Motion by Trustee Aktipis, seconded by Trustee Yusuf, to approve Ordinance 2003- ZO -TA -G -724, "An Ordinance Amending Section 13- 10A-2 By Adding a Special Use in the ORA -1 Office Research Assembly District, of the Village of Oak Brook Zoning Ordinance." ROLL CALL VOTE: Ayes: 6 - Trustees Aktipis, Caleel, Craig, Korin, Miologos and Yusuf. Nays: 0 - None. Absent: 0 - None. Motion carried. 4) ORDINANCE 2003- LC -TA -G -725, "AN ORDINANCE AMENDING ORD- 03- LC -TA -G- 725 - AMND TTLE 4 SECTION 4 -2 -3 -2 ( "TAXICAB DRIVER'S LICENSES ") OF TITLE 4 - TX1DRVER L1C OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK ILLINOIS." Staff has recommended a change in Section 4 -2 -3 -2 of the Village Code regulating taxi cab service within the Village of Oak Brook. The section has been amended to read: Section 2, b "The applicant has been convicted of a felony or misdemeanor unrelated to his conduct or involvement in such business activity or similar business, but which felony or misdemeanor involved theft or retail theft, the use of a deadly weapon, traffic in narcotic drugs, or violence against another person, including criminal sexual assault and sexual abuse, within the past ten (10) years." This recommendation is to ensure the public safety of our residents. Motion by Trustee Aktipis, seconded by Trustee Korin, to approve Ordinance 2003- LC -TA -G -725, "An Ordinance Amending Section 4 -2- 3-2 ( "Taxicab Driver's Licenses ") of Title 4 of the Village Code of the Village of Oak Brook, Illinois."
