1081, A Resolution Approving and Release of Closed Meeting Minutes
Background/History:
The Open Meetings Act requires that all public bodies shall keep written minutes of all their
meetings, whether open or closed. The public body shall periodically, but no less than semi-
annually, meet to review minutes of all closed sessions that had not been released to the public.
At this time, the Board of Trustees has reviewed minutes from July 14, 2009 through December
1, 2009 and is ready to approve and release the minutes as appropriate. The minutes have been
redacted regarding the necessary sections of the meetings for those items that are still pending
and require continued confidentiality. The following list itemizes the minutes for this time
period with recommendations for release:

A RESOLUTION FOR THE APPROVAL AND
RELEASE OF CLOSED MEETING MINUTES
WHEREAS, the Village Board of the Village of Oak Brook has met from time to time in closed
meeting for purposes authorized by the Illinois Open Meetings Act; and
WHEREAS, pursuant to the requirements of 5 ILCS 120/2.06(c), the Village Board has met in closed
meeting to review all closed Meeting minutes; and
WHEREAS, the Village Board has further determined that a need for confidentiality still exists as to
portions of the closed meeting minutes from the meetings set forth on Schedule A, attached hereto as Exhibit
1.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the 2009 closed meeting minutes of July 14, September 8, October 13, October 27,
November 10, and December 1 are hereby approved, as written or amended.
Section 2: That of the 2009 closed meeting minutes listed above the December 1 Minutes are to be
released in their entirety as described in Schedule A, attached hereto and made a part hereof as Exhibit 1.
Section 3: That the 2009 closed meeting minutes of July 14 and October 13 are hereby released,
subject to the redactions described in Schedule B, attached hereto and made a part hereof as Exhibit 1.
Section 4: That the 2009 closed meeting minutes of September 8, October 27, and November 10 are
not ready for release at this time, as listed in Schedule C, attached hereto and made a part hereof as Exhibit
1.
Section 5: That the Village Clerk is hereby authorized and directed to make minutes identified in
Sections 2 and 3 available for inspection and copying in accordance with the standing procedures of the
Clerk's office, subject to the redactions described in Schedule B.
Section 6: That this resolution shall be in full force and effect from and after its passage and approval
as provided bylaw.

Village Manager Niemeyer requested that Public Works' Director Hullihan be brought in to
discuss a sale of water service agreement, but Attorney Sterk stated that this was not
appropriate for closed session since it was not regarding a sale of property.
Trustee Zannis expressed the desire to amend the May 26, 2009 Minutes which had been
tabled during the open meeting.

Library Union: Attorney Sterk reported that the Library Union had filed for certification with the
Illinois Labor Relations Board (ILRB) and that the Village had filed a response, but have not
heard back from the ILRB; he stated that he expected certification. He affirmed that the
potential outsourcing of library services could become a collective bargaining issue once they
are certified.

A. Workers' Compensation Claims
Assistant Village Manager Wing handed out information regarding workers' compensation
claims and stated he is working with each department involved in resolving the older claims.
Ms. Sprecht of Eagle One discussed reducing workers' compensation claims, the costs involved
and working with the third party administrators. She explained that many of the claims are more
expensive because employees are using the emergency room and the benefit of having them
referred to a clinic. She stated that length of treatment and lost wages are huge costs and
getting employees back to work should be the goal. She discussed instituting protocols at the
provider level and specialists in achieving this goal and also instituting wellness programs.
Discussion ensued regarding amount of claims and employees returning to work. Village
Manager Niemeyer discussed that when he came to the Village, there was not enough focus on
Human Resources and Risk Management. He discussed accidents occurring from safety
issues and cutting corners. President Craig discussed investigating malingerers. Discussion
ensued regarding reinstituting safety incentives. Chief Sheahan stated he would like treatment
of the minor claims being handled in a more timely manner and also pursue the automobile
claims more agressively against the motorists who caused the accidents.
Trustee Aktipis entered the room at 7:19 p.m.
