Martens,Village Attorney SUBJEC 1 Resolution Authorizing the Sale of Surplus Public Real Estate As a test of your memory,you may recollect that Steven and Lisa Becker asked the Village some time ago to sell a portion of a vacated street to allow the Beckers access to their home at 3025 Lincoln. By way of background,at the request of the then owner of 3025 Lincoln, the Village vacated this adjacent alley in 1984 by bisecting it from"edge to edge"rather than along the "center line". As a result,the Beckers must"trespass"over the Village"half'of the vacated alley to gain entrance to their property. As a first step to addressing the Becker's problem, I have prepared the attached resolution authorizing the sale of this portion of the vacated alley. State statute requires that the Board declare this parcel as"surplus property"and obtain a written appraisal before offering the property for sale. We have obtained a MAI appraisal,paid for by the Beckers,which indicates the subject property has a market value of$5,500.00. I would note that alleys in the Westchester Park Subdivision were not part of the 1978 Sports Core conveyance from the Butler Company to the Village. The attached resolution provides that you are authorizing the solicitation of written offers for the purchase of the subject property in care of the Village Manager not late-than 5 p.m. on Friday. December 13. 1996. Hopefully that will be a lucky day. You may accept any contract proposal determined by you to be in the best interest of the Village by a three-fourths vote, but in no event at a price less than 80 percent of the appraised value. The statute provides that a resolution authorizing the sale of surplus property shall be published at the fir.t opportunity following its passage in a local newspaper. Thus,the attached resolution must be published in full in a local newspaper.
