SUBJECT: 31"Street Project(Jorie to York)
RECOMMENDATION: That the Village Board adopt the attached resolution
approving an intergovernmental agreement between the County of DaPage and the
Village of Oak Brook for reconstructing 31"Street from Jorie Boulevard to York Road
and replacement of the 31"Street Bridge,and authorize President Bushy to execute the
agreement substantially in the form attached thereto.
Attached is a resolution approving an intergovernmental agreement between DuPage County and
the Village of Oak Brook concerning the above referenced project. The agreement itself has been
revised from the version discussed by the Board on November 11, based on the direction given by
the Board with respect to the intersection of 314' Street and Spring Road and some further
developments concerning the project.
On November 11, the Board opted to retain the existing turning restrictions and gate and forego the
installation of a traffic signal at this time. The Board further directed me to negotiate the best terms
possible under which the traffic signal could be installed at a later date if requested by the Village.
The revised agreement provides for the traffic signal and related items to be constructed by the
County, at the Village's option, on a 50:50 cost-sharing basis. The Village may exercise its option
any time between one year and two years after the completion of the pending project.
If requested by the Village, the 3151 Street/Spring Road signalization (the "subsequent project')
includes acquisition of right-of-way, construction of the right turn lane from northbound Spring
Road to eastbound 31st Street' and installation of the traffic signal, including preempticn
equipment. All project costs are subject to a 50:50 cost-sharing arrangement.
' The deletion of this right turn lane from the pending project is a new development,resulting from the County's recent
conclusion that condemnation will be necessary in order to acquire the small amount of right-of-way needed to
constrict it. The revised agreement provides that the County will handle acquisition of any right-of-way needed for the
subsequent project. Given that condemnation might be necessary, the County is not in a position to commit to a
construction schedule for the subsequent project.

The county has reviewed its position regarding the left turn lane from westbound 31st Street to
southbound Spring Road and has determined=to delete it from the pending project. Although the
situation is far from perfect, the County's view is that having the turn lane is preferable to not
hav'mg it, even with the three-hour prohibition and the gate. There will be an opposing left turn
lane, and the County thinks the westbound to southbound lane would be very desirable during the
hours when left turns = permitted. The County further believes that effective signage will be
possible (since there are very few distractions at that location) and they equate the merge back into
:westbound traffic that could be necessary in some instances to the similar traffic movement that has
become somewhat routine where continuous left turn lanes have been installed.'
Because the traffic signal will not be installed, the pedestrian crosswalk at Spring will be deleted
from the pending project (there is no crosswalk in place presently.) A revised sketch of the
intersection is attached to this memorandum for your information.
The deletion of the traffic signal has also had some impact on the amounts and types of right-of-way
needed from the Village at the intersection. The permanent easement has been deleted and the
temporary easements enlarged somewhat. The net economic effect is a decrease in compensation to
the General Corporate Fund of about $4,300. The revised figures are reflected in the schedule of
compensation (Exhibit Q. The right-of-way plat (Exhibit A) and the project plans themselves
(Exhibit B) are in the process of being modified to reflect the changes.
To summarize,the revised agreement provides that DuPage County will:
1. Complete all improvements according to the project plans(as revised).
2. Pay all costs and expenses for the improvements including a new bike path,rebuilding Bath
&Tennis Drive,water main relocation, stormwater detention and compensatory storage.
3. Obtain all necessary permits for the project.
4. Compensate the Village for right-of-way as provided in Exhibit C.
5. If requested by the Village, acquire any needed right-of-way and pay 50%of the costs of the
subsequent project.
In turn, the revised agreement provides that the Village will:
1. Convey its interests in the various parcels of right-of-way.
The County distinguishes between this intersection and the Spring Road/York Road intersection in this regard,baud
on the number of other distractions and traffic movements present in the Graue Mill area. The notion is that sufficiently
effective signage is not possible at the Spring Road/York Road intersection.

2. Provide the temporary easements (shown on the plans) for the bike path and compensatory
storage area.
3. Assume maintenance and jurisdiction of Spring Road.
4. If the Village exercises its option for the 31' Otreet/Spring Road signalization project, pay
50%of the cost of the subsequent project.
5. If the 311" Street/Spring Road traffic signal is installed, allow all turning movements at the
31'/Spring Road intersection with the exception of the evening right turn restriction from
eastbound 31 u to southbound Spring.
I hope the Board finds this revised agreement satisfactory. I recommend its approval substantially
in the form attached,understanding that minor changes may yet be made to the agreement language
and to the exhibits. If the approving resolution is adopted on November 25, the agreement can be
presented to the County Transportation Committee on December 1 and to the full County Board on
December 9,thus enabling the transaction to be completed during January.
