SUBJECT: Award of Contract — Bath & Tennis Entrance Wetland Restoration Project

BUDGET SOURCE/BUDGET IMPACT: $50,000 is budgeted in Program 364, Drainage
Maintenance, Stormwater Maintenance (341- 90200) for this item
RECOMMENDED MOTION: I move that the Village Board award a contract, to lowest
responsive and responsible bidder, ENCAP, Inc., Sycamore, IL., in the amount of $45,546.50 for the
2012 Bath & Tennis Entrance Wetland Restoration Project, and approve Resolution R -1202, a
Resolution Approving and Authorizing the Execution of an Agreement by and between the Village
of Oak Brook and ENCAP, Inc., for Wetland Restoration at the Entrance of the Bath & Tennis
Club, subject to staff and attorney review.
Back2round/History:
Due to the specialized nature of the work, a request for bids was sent to four prequalified firms:
Conservation Land Stewardship, Inc.
ENCAP, Inc.
JF New
V3 Construction Group, Ltd.
Three sealed bids were received and opened on Thursday, August 30, 2012:
ENCAP, Inc. $45,546.50
Conservation Land Stewardship, Inc. $69,957.42
V3 Construction Group, Ltd. $76,663.35
Construction specification will be prepared based on the attached plan. This design will maintain the
ecological functions of the wetland and improve appearance. Earthwork, dormant seeding, and some
shrubs and trees will be planted this Fall and Winter. Other plants and trees, such as water lily plugs and
oak trees, cannot be planted in the fall or winter seasons so will therefore be planted in the Spring of
2013. The projected completion date of this project is Spring of 2013. Staff has received and reviewed
references and is satisfied.
The wetland area to the east of the Bath & Tennis entrance was created during the reconstruction of 315`
Street in 2001. The wetland area was constructed to compensate for wetlands lost due to the road
widening. The near constant inundation has caused non - aquatic vegetation (e.g. oak trees) to die. While

the wetland is protected under State and Federal law, it is possible to enhance the performance of the area
through adjustment of grading and introduction of native plants more suited to wetland environments.
The proposed planting plan will improve appearance by:
Removing dead trees
Introducing wetland grasses and forbs
Introducing varieties of flowering bushes to provide year round color
Recommendation:
That the Village Board award a contract, to lowest responsive and responsible bidder, ENCAP, Inc.,

RESOLUTION 2012 -B &T- WETLAND -AG -R -1202
A RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF AN
AGREEMENT BY AND BETWEEN THE VILLAGE AND ENCAP, INC. FOR
WETLAND RESTORATION AT THE ENTRANCE OF THE BATH AND TENNIS CLUB
WHEREAS, the area directly to the east of the entrance to the Oak Brook Bath and Tennis Club
is a wetland area; and
WHEREAS, the Village of Oak Brook ( "Village ") desires to enhance the wetland area to preserve
its ecological function and improve its appearance ( "Wetland Restoration Services'); and
WHEREAS, the Village solicited bids for Wetland Restoration Services; and
WHEREAS, ENCAP, Inc. of Sycamore, Illinois ( "ENCAP' was the lowest responsive and
responsible bidder to provide Wetland Restoration Services; and
WHEREAS, the Village and ENCAP desire to enter into and execute an agreement for ENCAP to
provide the Village Wetland Restoration Services ( "Agreement"); and
WHEREAS, the President and Board of Trustees have determined that it is in the best interests of
the Village to enter into the Agreement in a final form as approved by the Village Manager and Village
Attorney;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby award
and approve an Agreement not to exceed $45,546.50 by and between the Village and ENCAP in a form
acceptable to the Village Manager and the Village Attorney.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the final Agreement on behalf of the Village if a form
acceptable to the Village Manager and the Village Attorney.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
