SUBJECT: DU -COMM Intergovernmental Agreement

BUDGET SOURCE/BUDGET IMPACT: 3% Administration Fee (Seeking Reimbursement — See
below) and then ongoing budget savings to the Police Department Budget
RECOMMENDED MOTION: I move that the Village Board authorize the Village of Oak Brook's
participation and membership in the DuPage Public Safety Communication Cooperative
(DU -COMM) and approve Resolution 2011 -AG- DUCOMM -EXI -R -1138.
Background/History:
After three (3) years of assessing the Village's long -term options on how to best staff emergency
dispatching services, on August 18, 2011 the Village Board directed staff to begin the necessary steps to
consolidate services and become a member of DU -COMM.
Following the Board's direction, staff sought and received during the month of September DU- COMM's
Chiefs' Committee and Executive Committee approvals to accept the Village into DU -COMM. Finally,
on the morning of October 25th, the DU- COMM's Board of Director's will vote to approve Oak Brook's
membership request, pending the outcome of the Oak Brook Board meeting on the evening of the 25th.
Staff from the Police, Fire, Administration, HR and IT Departments will continue to work with
DU -COMM staff and in November a draft consolidation cutover timeline should be ready to share with
the Village Board. The current target cutover date is somewhere between June and July of 2012, and
depends mainly on the process of the county -wide radio project.
Attached are DU- COMM's IGA and By -laws, as well as resolution approving Oak Brook's participation
and membership in DU -COMM. A few of the top highlights of membership in DU -COMM are:
• Reduce the Village's emergency dispatching cost significantly over the next 5 years and beyond
• Village representation (Board as well as both Police and Fire Chiefs)
• Improved overall service and technology for residents, visitors, and businesses in Oak Brook
Recommendation:
Staff recommends that the Village Board authorize the attached resolution and 3% administration
membership fee (which will the Village will seek reimbursement from the ETSB for in 2012).

A RESOLUTION APPROVING THE VILLAGE OF OAK BROOK'S
PARTICIPATION IN THE DUPAGE PUBLIC SAFETY COMMUNICATION
COOPERATIVE ( "DU- COMM ") AND AUTHORIZING EXECUTION OF DU- COMM'S
JOINT PUBLIC SAFETY COMMUNICATIONS SYSTEM AGREEMENT
WHEREAS, the Village of Oak Brook, is an Illinois municipal corporation; and
WHEREAS, the Constitution of the State of Illinois, 1970 Article 7, Section 10 and the Illinois
Intergovernmental Authorization Act (5 ILCS 220/1 et.seq.) authorize units of local government to
contract and otherwise associate themselves in any manner not prohibited by law or ordinance, and to
exercise and combine with any other unit of local government, any power or powers, privileges,
functions or authority exercised by a unit of local government; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook have determined that it is in the
best interest of the public health, safety and welfare, and in accordance with the Illinois Constitution and
the Intergovernmental Cooperation Act, to join the DuPage Public Safety Communication Cooperative,
which operatesa ¢ edpublicsafetycommuriiationssystemwilhmNoitt ieasternHinds (hereinafter "Du- Comm');and
WHEREAS, Du -Comm is governed by, and operates pursuant to, the Joint Public Safety
Communications System Agreement attached to this Resolution as Exhibit A ( "Agreement "); and
WHEREAS, in order to join Du -Comm, the Village is required to pass a Resolution approving its
participation in Du -Comm and to execute the Agreement; and
WHEREAS, the Village President and Board of Trustees have determined that approving the
Village's participatin in Du -Comm and authorizing the Agreement is in the best interests of the Village
and its residents;
NOW THEREFORE BE IT ORDAINED, by the President and Board of Trustees of the Village of Oak
Brook, DuPage and Cook Counties, Illinois as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of Participation in Du -Comm. The President and Board of Trustees
hereby approve the participation in DuComm by the Village pursuant to the Agreement attached to this
Resolution as Exhibit A.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the Agreement on behalf of the Village after review
and approval of the final form of the Agreement by the Village Manager and the Village Attorney.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
