RECOMMENDED MOTION: I move that the Village Board approve the Grant of
Easement Plat for Watermain, Storm Sewer, and
Sidewalk to the Village of Oak Brook and Plat of
Vacation of Storm Sewer Easement by approving the
attached resolution (R- 1061).
Background /History:
The John Buck Company is constructing the new mixed use commercial project at the northwest
_,corner of 22nd Street /York Road which includes utilities, grading, structures, paving, and a traffic
signal. Due to right -of -way constraints and access issues to existing and proposed utilities within
the development, parts of the Village owned water system, storm sewer, and sidewalk will be
located outside of right -of -way and on private property. Also an existing storm sewer easement
is being vacated since its storm sewer was relocated. These easements need to be granted in
order for the Village to continue to own, operate and maintain these facilities.

Recommendation:
I recommend that the Village Board approve resolution R -1061.

RESOLUTION 2009 - EASE -V -R -1061
A RESOLUTION APPROVING A GRANT OF EASEMENT PLAT
FOR WATERMAIN, STORM SEWER AND SIDEWALK AND A
PLAT OF VACATION OF STORM SEWER EASEMENT
IN THE CLEARWATER AT OAK BROOK DEVELOPMENT
(2100 & 2122 York Road, P I.N # 06 -24- 308 -001, 06 -24- 308 -006)
WHEREAS, the John Buck Company is constructing the new mixed use commercial project at the
northwest corner of 22nd Street/York Road which includes utilities, grading, structures, paving, and a traffic
signal, and
WHEREAS, due to right -of -way constraints and access issues to existing and proposed utilities
within the development, parts of the Village owned water system, storm sewer, and sidewalk will be
located outside of right -of -way and on private property Also an existing storm sewer easement is being
vacated since its storm sewer was relocated, and
WHEREAS, these easements need to be granted in order for the Village to continue to own,
operate and maintain these facilities, and
WHEREAS, the Village President and Board of Trustees have determined that the Grant of
Easement Plat and the Plat of Vacation should be approved and executed, subject to approval of the
final plat for Clearwater at Oak Brook Development;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 The foregoing preambles are restated and incorporated herein by reference as though
fully set herein
Section 2. That the Grant of Easement Plat for Watermain, Storm Sewer and Sidewalk,
prepared by Bollinger, Lach & Associates, Inc. on September 24, 2009, be and is hereby approved and
that the Village President and Village Clerk shall be authorized to execute such Grant of Easement Plat
on behalf of the Village of Oak Brook.
Section 3 That the Plat of Vacation of Storm Sewer Easement, prepared by Bollinger, Lach &
Associates, Inc on September 24, 2009, be and is hereby approved and that the Village President and
Village Clerk shall be authorized to execute such Plat of Vacation on behalf of the Village of Oak Brook
Section 4: If any section, paragraph, clause or provision of this resolution shall be held invalid, the
invalidity thereof shall not affect any of the other provisions of this resolution.
Section 5. All ordinances or parts thereof in conflict with the provisions of this resolution are hereby
repealed to the extent of such conflict
Section 6 That this resolution shall be in full force and effect from and after its passage, approval
and publication as provided by law.
