RECOMMENDED MOTION: I move to approve Ordinance G-1068
Background/History:
On February 17th, 2009 the American Recovery and Reinvestment Act(ARRA) or Stimulus
Package was signed into law. The package contains extensive funding for science, engineering
research and infrastructure,along with some requirements for states that receive the funding.
One of the provisions mandates that each state that receives the funding shall adopt and enforce
an energy code-or return all money back to the federal government. The state of Illinois
responded by enacting legislation to implement the"most current"edition of the International
Energy Conservation Code(IECC).
The most current edition of the IECC is now the 2015 IECC, and the state has mandated
statewide application of this code effective January 1, 2016.
The Village of Oak Brook is required to enforce this code by state law, it makes it much easier to
communicate this requirement when it's clearly identified in the municipal code.
Recommendation:
The Village adopt the 2015 IECC as adopted and amended by the state of Illinois.
ORDINANCE 2016-CD-BC-G-1068
AN ORDINANCE AMENDING SECTION 10-1-1H OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK RELATING TO THE ENERGY CONSERVATION CODE
WHEREAS, the Illinois Energy Efficient Building Act, 20 ILCS 3125/1 et seq.("Act"), restricts the
authority of municipalities to adopt energy efficient building standards which are inconsistent with the Act
and with the latest-published edition of the International Energy Conservation Code published by the In-
ternational Code Council, Inc. that is adopted by the Illinois Capital Development Board ("Conservation
Code"); and
WHEREAS, the Village has adopted the 2009 edition of the Conservation Code by reference and
has codified it in Section 10-1-1H of the Village Code of the Village of Oak Brook, Illinois ("Village
Code"); and
WHEREAS, the Illinois Capital Development Board has adopted the 2015 edition of the Conser-
vation Code; and
WHEREAS, in order to comply with the Act, the President and Board of Trustees desire to amend
the Village Code to adopt by reference the 2015 edition of the Conservation Code ("Amendment"); and
WHEREAS, the Village President and Board of Trustees deem the Amendment to be in the best
interest of the public health, safety and welfare of the Village and its residents;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Amendment to Section 10-1-1 H of the Village Code. Subsection H of Section 1,
entitled 'Building Codes Adopted", of Chapter 1, entitled "Building Code", of Title 10, entitled "Building
Regulations,"of the Village Code shall be amended further and shall hereafter read as follows:
"H. Illinois energy conservation code: International energy conservation code, 2012
2015 edition, published by the International Code Council, Inc., is adopted without
amendment other than those amendments adopted by the Illinois Capital Develop-
ment Board."
Section 3: Filing With Village Clerk. Pursuant to, and in accordance with, Section 1-3-2 of
the Illinois Municipal Code, 65 ILCS 5/1-1-1, et seq., the Village Clerk is hereby directed to keep on file
and make available for public use, inspection, and examination, one copy of the 2015 edition of the Con-
servation Code.
Section 4: Severability. If any provision of this Ordinance or part thereof is held invalid by a
court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and
effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose
and intent of this Ordinance to the greatest extent permitted by applicable law.
Section 5: Effective Date. This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
