Scone. A. It is hereby required that a permit be obtained in advance and all other requirements of the Building Ordinance be complied with whenever a building or structure, or parts or appurtenances thereof, located within the Village of Oakbrook and regulated by this ordinance, is erected, installed, altered, converted, remodeled, structurally repaired, demolished, moved, and/or its use or occupancy is established or changed. B. Each building and structure, and parts and appurtenances thereof, shall be so maintained that the occupants and the users thereof, and others, are reasonably safe from the hazards of fire, explosion, collapse, contagion and spread of infectious disease. If found not to be so maintained, as set forth elsewhere in this ordinance, the necessary corrective work, replacement or removal may be ordered. C. No permit may be issued on any unrecorded lot or tract of land until such lot or tract has been surveyed, platted and filed in the Recorder's Office as required by statute. D. No permit may be issued until satisfactory proof has been submitted that approved water supply and sewage treatment facilities are available. E. No construction grading or excavation authorized by permit may be made on any property until after the installation of an access drive and culvert, approved by the highway authority having jurisdiction. F. A permit under which no work is commenced within ninety (90) days after issuance, or abandoned for more than ninety (90) days, shall expire by limitation and a new permit shall be secured before such work is started. Nothing in this section shall prevent the extension of the expiration date by the Building Official where it can be shown that a hardship would occur in enforcing the strict letter of this provision. G. No building or structure shall be occupied or used for any purpose, in whole or in part, until a certificate of occupancy shall have been issued by the Building Official. The use for any purpose of buildings and structures already erected or moved into position, which do not comply with the requirements of this ordinance, �- is prohibited. Section II. Applications for permits. All applications for permits so to construct, erect, alter, or repair any building, structure or part thereof, for which work a permit is required by this ordinance, shall be in writing over the signature of the owner or his authorized agent on printed forms to be furnished by the village. Every such application shall have the location of the proposed work; that is, the legal or taxable descrip- tion of the land upon which the building, structure or part thereof is to be erected, constructed, moved, demolished, altered, or repaired, as the case may be, and shall be filed with the Village Clerk. Said application shall be accompanied by plans signed by the author of said plans, and an initial fee of Five and No/100ths ($5.00) Dollars, which shall be applied to the permit fee required by Section III of this ordinance. All plans shall be in sufficient detail to enable the Building Official to obtain full and complete information as to the character of the work proposed to be done under the permit sought. Complete framing drawings shall be submitted of all structural steel, mill or reinforced concrete construction, said drawings to show the dead and live loads used in the design. One copy of the plans on which the permit is issued shall remain on file in the office of the Building Official and a duplicate _ 2 _ L.- copy shall be kept continuously at the building during construction, A plat of the building site made by a Registered Surveyor shall be furnished upon request of the Building Official. When it shall appear to the Building official that an application has been .made and plans filed in due form and manner as prescribed by this chapter, that the proposed use, manner of construc- tion, kind and quality of material and workmanship are in all respects in accordance with the provisions of this ordinance, he shall thereupon approve the issuance of the permit sought, and it is hereby made the duty of said Building Official to approve or reject any plan filed with him pursuant to the provisions of this ordinance within a reasonable time. All work performed and all materials used shall be in ac- cordance with the plans and specifications submitted with the application for permit, and any revisions or changes from the plans submitted shall be deemed a violation unless approved by the Building Official* Section III. Permit fee schedule. Before a permit required by this ordinance is issued, the Building Official shall collect for deposit with the Village Collector a fee calculated according to the following schedule, after first allow- ing credit for the initial filing fee of Five and No/100ths ($5.00) Dollars, which shall be the minimum fee in all cases and not refundable. Volume computation: Volume shall be computed on the exterior dimensions of the building and shall include all space above the lowest level of the foundation wall and to the highest point of the main roof and to include all projections. Required notice for inspection. A. The owner or contractor shall give twenty-four (24) hours' advance notice to the Building Official; 1. Before concrete is poured and after footing excava- tion has been completed. 2. Before backfilling and after footing drain the has been placed and foundation wall has been waterproofed. 3. Before any interior wall finish is applied and after the framing is completed. 4. Before any siding or brick veneer is applied and after the application of the sheathing paper. 5. Before any interior wall finish is applied and after the rough plumbing is completed. 6. Before any interior wall finish is applied and after the rough electrical installation is completed. 7. Before any backfilling and after the septic tank �- and seepage system has been installed. 8. Before final inspection. B. The owner or contractor shall obtain an occupancy permit from the Building Official prior to the use or occupancy of any building or structure. Section V. Building official. Wherever in this ordinance the term "Building Official" is used, it shall mean the Building Official appointed by the President and Board of Trustees and such deputies or assistants as have been or shall be duly appointed by the President and Board. of Trustees. That officer is hereby authorized and it is his duty to administer and en- force the provisions of the Building Ordinance, making such determina- tions, interpretations and orders as are necessary theref or , and - 6 - requiring such plats, plans and other descriptive material in connection with applications for permits as are necessary for him to judge compliance with this ordinance. Section VI. Fines - Penalties. A. Any person, firm or corporation who violates, dis- obeys, omits, neglects, or refuses to comply with, or who resists the enforcement of any of the provisions of the Building Ordinance., including provisions adopted by reference, or who refuses to remedy a violation of any such provisions, shall be fined not less than Ten and No/100ths ($10.00) Dollars or more than Two Hundred and No/lOOths ($200.00) Dollars for each offense and each day upon which such violation continues shall constitute a separate offense. B. Any person, firm or corporation licensed or registered by the State or a subdivision thereof to do work regulated by this ordinance or to render professional architectural or engineering service on any such work, when in doing work or rendering service violates the law or ordinance under which licensed or registered., shall be subject to proceedings or action to revoke the certificate of license or registration. C. 'When a building or structure or part or appurtenance thereof is found by competent authorities to be maintained in a condition not reasonably safe from the hazards of fire, explosion., collapse, contagion or spread of infectious disease, the owner thereof, upon order from the President and Board of Trustees, and after due notice, shall be liable for correction or removal of the condition or the cost thereof upon failure to act. Section VII. Partial invalidity. Should a court of competent jurisdiction hold that the application of some part of this ordinance is invalid such holding shall not invalidate the remainder. Section VIII The National Building Code, 1955 Edition, as recommended - 7 - N by the National Board of Fire Underwriters, and the Suburban Building Regulations for Residences, April 1957 Edition, both of which have been heretofore published in pamphlet form and copies of which have been ors file for more than thirty (30) days in the Office of the Village Clerk of the Village of Oakbrook for public inspection in accordance with the statutes of the State of Illinois in such cases made and provided, are hereby adopted by reference and made a part of this ordinance, and all buildings and structures and parts and appurtenances thereof hereinafter erected, installed, altered, converted, remodeled, structurally repaired., demolished, moved, and/or its use or occupancy established or changed, shall comply with the provisions of said code and regulations. Section IX. Effective date. This ordinance shall be in full force and effect from and after its passage and publication as by statute in such case made and pr ovided.
