ILLIN015 April 4, 1975 MEMO TO: President & Board of Trustees SUBJECT: Hawthorn Development Gentlemen, 654 -2220 On Wednesday, April. a, 1975 a meeting was held in the offices of Village Attorney Bi.anucci with members of the ftwthorn Development Croup, specifically Joe Beale, Lee Prey and Bib Webber, Attorney. In attendance representing the Village of Oak Brook was Attorney Bianucci, Chet Yarbrough and me. The purpose of the meeting was to review on a staff level, the annexation agreement Bch we received on April 1, 1975 and to establish some preliminary suggestions in terms of steps to be followed relative to the annexation and reezoni.ng. The preliminary draft of the annexation agreement submitted was very preliminary and since we had only received it one day prior to the meeting, we were not in a position to coument formally on' each of the items, however, we did raise some questions relative to the language or general provisions that would have to be addressed in the annexation agree nt . We indicated to the developers thi, t it was our understanding that the village board would require an annexation agreement in finalized form prior to any public hearings on annexation or rezoning. Bused on this premise, it was concluded that it would take at least 60 days to review and work out the terms of the annexation agreement assuming that a joint public hearing would be held by the village board, plan Commission and Zoning Board of Appeals. IT. was the con- clusion that no final action would be taken until some 30 days after the joint public rearing based on the asst=ption that the terms of the annexation agreement had been completed,, at least on a staff level prior to that ties. , Our discussions dealt with technical and application dealing with the annexation agreement and specifically excluded the policy isslies that will be required to be discussed and made by the village board. E-1111 C - 2 It is important that the neg€ati,.ting team, if restricted to the staff members, t:he village attorney, myself and Chet: Yarbrough., are to carry on the negotiations and meetings on the annexation agreement be provided with the parameters and some specifics dealing with the various items. if a member of the board cf trustees," members of the plan Commission and Zoning ]Board of Appeals are going to be part of that negotiating team, then the time required first of all will be lengthened , and secondly, the times at which the meetings will be held will have to be altered from daytime to evening meetings. I have discusced this matter with .doe Rush and he has-suggested that we call a Ce " o ttee -of- the -Whole meeting prior to the hoard meeting on April Rth, 1`75 at 7:00 P.M. to discuss this matter so that the staff can be given direction.
