G-57 - 11/23/1965 - LICENSE AGREEMENT - Ordinances aEB:KLM 11-12-65 1 & 3 cc. ��c�NSr-VEA1D1i�Gr M A CN;furs AN ORDINANCE LICENSING VENDING MACHINES IN THE VILLAGE OF OAKBROOK, DU PAGE COUNTY, ILLINOIS BE IT ORDAINED by the President and the Board of Trustees of the Village of Oakbrook, DuPage County, Illinois : Section 1. License Required. No person, firm or corpora- tion who owns, leases or has a possessory interest in any premises within the Village of Oakbrook, shall install, keep, maintain, use or permit the maintenance or use upon such premises of any vending machine, automatic vending machine, coin operated machine or other mechanical device requiring more than one cent for the activation thereof, which is used or intended to be used for the sale or distribution of any product unless the same shall have been first licensed under the provisions of this ordinance, and no owner of any vending machine, automatic vending machine, coin operated machine or other mechanical device requiring more than one cent for the activation thereof, which is used or intended to be used for the sale or distribution of any product, shall install same on any premises located within the Village of Oakbrook without first obtaining a license therefor pursuant to the provisions of this �,. ordinance. Section 2. License. Application. .Application for such license shall be made by the owner or lessee of such machine or mechanical device to the Village Clerk upon forms to be provided by the Village and such application shall correctly describe the premises upon which the machine will be used; the product to be sold or distributed by the machine; the owner of the premises upon which the machine is to be used; and the owner of the machine or lessee of the machine provided, however, that in the event the owner or lessee of the machine is a corporation, the application shall be executed by an authorized officer of such corporation and shall correctly state the names and addresses of all of the directors thereof, and the names and addresses of all stockholders owning more than twenty percent of the outstanding shares of stock of such corporation. Such application shall be under oath and any misrepresenta- tion thereon shall constitute a misdemeanor and shall subject the person making such application to the penalties hereinafter provided. Section 3. License Fee. The annual license fee for a license for each such machine so used on the premises shall be as follows: Fee Candy Vending Machine $ 3.00 Cigarette Vending Machine 35.00 Coffee Vending machine 5.00 Gum Vending Machine 3.00 Ice Vending Machine 3.00 Milk Vending Machine 3.00 Peanut Vending Machine 3.00 Pop Vending Machine 5.00 Sandwich Vending Machine 5.00 All Other Vending Machines 5.00 Section 4. License Period, The period covered by each such license shall be from the first day of July to the last day of June of each year and all licenses issued hereunder shall expire on the last day of June next after the issuance thereof. Any license issued after the first day of January of any given year shall be issued on the basis of a fee equal to one-half of the ordinary yearly license fee above described. Section 5. License to be Issued. Upon receipt of a properly executed application, together with the proper fees as set forth herein, the Village Clerk shall issue such license upon forms to be provided by the Village, which said license shall describe the premises upon which the license machines may be 2 - a operated; the product to be sold or distributed by the licensed machines ; the owner or lessee of the licensed machines; and the owner of the premises upon which the machine is licensed to be used. Section 6 .Display of License, Each such license issued hereunder shall be displayed in a permanent place convenient for inspection thereof on the premises where the licensed machines are used. Section 7. Penalty, Any person, firm or corporation violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined not less than One Dollar nor more than rive Hundred Dollars, and if the offense is of a continuing nature, each day that such violation shall continue shall constitute a separate offense. Section 8. Suspension or Revocation., In addition to the penalties herein provided the President and Board of Trustees, acting jointly, may suspend for a period not to exceed six months, or revoke any license issued hereunder to any person, firm or cor- poration convicted by any court of competent jurisdiction of violat- ing Section 2 of this ordinance. Any licensee whose license has been revoked pursuant to this section shall not be qualified to hold a license hereunder for a period of three years after such revocation. Section 9,. Effective Date. This ordinance shall be in full force and effect from and after the first day of January, 1966.
