AN ORDINANCE ESTABLISHING A FIREMEN'S PENSION FUND AND PROVIDING FOR THE BOARD OF TRUSTEES THEREOF IN THE VILLAGE OF OAKBROOK, DU PAGE COUNTY, ILLINOIS WHEREAS, there was submitted to the electorate of the Village of Oakbrook, DuPage County, Illinois, on the 18th day of April, 1967, at a special election held in conjunction with the regular election of said Village, the question whether the Village of Oakbrook should adopt Article 4 of the Illinois Pension Code pertaining to the Firemen's Pension Funds ; and WHEREAS, a majority of the votes cast on such a propo- sition were in favor of such proposition; and WHEREAS, the President and Board of Trustees have canvassed the election and have heretofore adopted a canvassing resolution declaring the proposition to have been passed and adopted; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oakbrook, DuPage County, Illinois, as follows: Section 1. Creation of Fund. There is hereby created a Firemen's Pension Fund pursuant to the provisions of Article 4 of the Illinois Pension Code approved March 18, 1963, as hereto- fore or hereafter amended. Section 2. Board of Trustees. There is hereby created a Board of Trustees of the Firemen's Pension Fund, which said Board shall perform all the duties under the provisions of said Article 4 of the Illinois Pension Code approved March 18, 19633, as heretofore or hereafter amended. Such Board shall be composed of seven members, The President of the Village of Oakbrook, the Village Attorney and the Chief of the Fire Department shall all be ex-officio members of said Board. Of the remaining four members three shall be chosen s from the active firemen of the Village of Oakbrook and one shall be chosen from the firemen of said Village who have been retired and are receiving a pension under the provisions of this ordinance. In the event there are no retired firemen qualified to receive a pension under this ordinance, then in such event such office shall remain vacant and the Board shall consist of six members. The members of the Board to be chosen from the active and retired firemen shall be elected by ballot at elections to be held on the third Monday in April of the applicable years under the Australian ballot system, at such place or places in the Village of Oakbrook and under such regulations as shall be prescribed by the Board. No person shall cast more than one vote at such election for each candidate for whom he is eligible to vote. In the elections for Board members to be chosen from the active firemen, all active firemen and none others may vote. In the elections for Board members to be chosen from the firemen who have been retired, the firemen who have been so retired and none others may vote. Each member of the Board so elected shall hold office for a term of three years and until his successor has been duly elected and qualified. The Board shall canvass the ballots at each election and declare the results as to which person or persons have been elected and for what term or terms respectively. In case of a tie vote be- tween any two or more candidates, the Board shall determine by lot which candidate or candidates have been elected and for what term or terms respectively. In the event of the failure, resignation or inability to act of any member of the Board, his successor shall be elected for the unexpired term at a special election which shall be �- called by the Board and conducted in the same manner as regular elections hereunder. - 2 - .� v7 1 L.. The Board shall elect from its number a President and Secretary* __ At the first election of Board members after the effective date of this ordinance, from the active firemen one member shall be elected for a term that shall end on the third Monday in April of the year following, one member shall be elected for a term that shall end on the third Monday in April of the next succeeding year, and one member shall be elected for a term to expire on the third Monday of April of the second next succeeding year, or in each instance until their successors have been duly elected and qualified. Section 3. Power The Board shall have the powers and duties as set forth in Section 4-123 to 4-129 inclusive of Article 4 of the Illinois Pension Code approved March 18, 1963, as hereto- fore or hereafter amended. Section 4. Treasurer, The Village Treasurer shall be ex officio the Treasurer of the Board. He shall be the custodian of the Pension Fund and shall secure and safely keep the same subject to the control and direction of the Board; and shall keep his books and accounts concerning such fund in such manner as may be prescribed by the Board; and the books and accounts shall be subject to inspection by the Board or any member thereof. Section 5. Disbursements. All monies ordered paid from the Pension Fund shall be paid by the Treasurer of the Board only upon warrants signed by the President of the Board and countersigned by the Secretary thereof, No warrants shall be drawn excerpt by order of the Board duly entered in the records of the proceedings of the Board. Section 6. Interest on Deposits. If the Pension Fund, or any part thereof, shall, by order of the Board or otherwise, be deposited in any banks, or loans, all interests or monies which �- may be paid, or agreed to be paid on account of any such loan or - 3 - v - G . 9 deposit shall belong to and constitute a part of the Fund. Nothing herein contained shall be construed as authorizing the lending or depositing of such Fund, or any part thereoft unless so authorized by the Board. Section 7. Firemen Defined. The term "firemen" as used in this ordinance shall mean full time paid members of the Oakbrook Fire Department and shall not include part time or volunteer fire fighting personnel and no member of the Oakbrook Fire Department other than full time paid members of the Oakbrook Fire Department shall be qualified to receive any of the benefits provided herein. Section 8. Conflicting Ordinances Repealed. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed.
