BE IT ORDAINED by the President and the Board of Trustees
of the Village of Oakbrook$ Du Page 'County, Illinois :
Section 1. That OrdinanoeCo. G-41 being an 'Ordinance
Creating the Office of Police: Chief and Providing for a Police De-
partment within the Village of Oakbrook$ Illinois," passed and
approved by the President and Board of Trustees of said Village on
the 12th day of .August, A. D. 1958, be and the same is hereby repeal-
ed.
Section 2. There shall be no other offices in the Police
Department of the Village of Oakbrook other than those hereinafter
enumerated and set forth, and there shall be no other rank for any
member of the personnel of said Police Department other than herein-
~ of ter set forth.
:Section 3. Police Chief,. The office of Police Chief of
the Police Department of the Village of Oakbrook is hereby created.
The Police Chief shall be appointed by the President and approved by
the Board of Trustees on the basis of merit, fitness and experience.
he need not be a resident of the Village of Oakbrook at the time of
his appointment but shall reside in theVillage of Oakbrook during
-such time as he occupies the office of Police Chief. The Police
Chief shall serve at the pleasure of the President and Board of Trustees
and may be removed by them at any time.
The Police Chief shall give bond payable to the Village
of Oakbrook in the sum of one Thousand Dollars conditioned according
to lawi, and with sureties to be approved by the Village President.
The person heretofore appointed and now acting as Police:
Chief for the Village of Oakbrook shall continue to act in such

capacity as though appointed pursuant to the terms of this ordinance.
section 4. Police: Chief--Powers and Duties. The Police
Chief shall have the custody, care and control of the public property
of the Police Depsrtment, subject to the supervision of thel village
President, and of all firearms and other equipment; he shall be the
head of the Police Department and shall promulgate such orders, rules
and regulations for the conduct of the Department and the subordinate
members thereof as to him shall seem fit and proper, which said orders,
rules and regulations shall be subject to and not in conflict with the
�., rules and regulations of the Board of Fire and Police Commissioners
of the Village of Oakbrook, Illinois. he shall devote full time, to
the municipal affairs of the Village, preserve the peace, order,
safety and cleanliness thereof, and to this end he shall execute and
enforce all Village ordinances and all orders of the Village Presiderm
Ee shall be charged with the duty of protecting the rights of persons
and the protection of property in the Village.
Section 5. Police Sergeant. The office; of Police Ser-
geant is hereby created. Police Sergeants shall be limited to six
in number unless such number is otherwise changed by the President
r... and Board of Trustees. Police Sergeants shall be appointed by the
Board of Fire and Police Commissioners of the Village of Oakbrook
pursuant to the Statutes of the State of Illinois and the rules of
said Board. All persons heretofore appointed and now acting as
Police Sergeant together with the Chief of Police shall fill the
offices of sergeant herein created as though appointed pursuant to
the terms of this ordinance.
The duties of Police: Sergeant shall be to give his
attention to the affairs of said Village, preserve the peace, order,
safety, cleanliness, and to otherwise enforce the ordinances of
the Village of Oakbrook, and the orders of the Police Chief and the
Village: President*

Such Police Sergeant shall be under the direct super-
vision of the superior officers, and shall at all times be subject
to the rules and regulations of the Board of Fire and Police
Commissioners,
Section 6, Police Patrolman, The office of Police Patrol-
man is hereby created, Police Patrolmen shall be limited to twelve
in number unless such number is otherwise changed by the President
and Board of Trustees, Police Patrolmen shall be appointed by the
Board of Fire and Police Commissioners of the Village of Oakbrook
pursuant to the Statutes of the State of Illinois and the rules of
said Board,
All mele persons heretofore duly appointed and now acting as
Police Patrolmen and/or desk officer for the Village of Oakbrook
shall be patrolmen as though appointed pursuant to the terms of this
ordinance,
The duties of Police Patrolmen shall be to give their
attention to the affairs of said Village, preserve the peace, order,
safety, cleanliness and to otherwise enforce the ordinances of the
Village of Oakbrook, and the orders of superior officers and the
Village President, Such Police Patrolmen shall be under the direct
supervision of their superior officers, and shall at all times be
subject to the rules and regulations of the Board of Fire and Police
Commissioners,
Section 7, Poles woman, The office of Policewoman is
hereby created, Policewoman shall be limited to one in number un-
less such number is otherwise changed by the President and Board
of Trustees, Policewoman shall be appointed by the Board of Fire
and Police Commissioners of the Village of Oakbrook pursuant to the
statutes of the State of Illinois and the rules of said Board. All

present female officers of the Oakbrook Police Department shall be
Policewomen as though appointed pursuant to the terms of this
ordinance.
The duties and obli-ations of policewomen shall be as
designated by her superior officers.
Section 8. Oath. Every member of the Police Department,
before entering upon his duties as such, shall take and subscribe an
oath of office in substantially the following; form, to-wit :
"I solemnly swear that I shall support the Constitution
of the United States and the Constitution of the State
of Illinois and that I will faithfully discharge the
duty of the office of (naming the specific office) to
the best of my ability,"
which oath shall be subscribed and sworn to before some officer
authorized by the State of Illinois to administer oaths and shall be
filed in the Office of the Village Clerk,
Section 9. Removal from Office. Except for the office of
Police Chief, no officer of the Police Department of the Village of
Oakbrook shall be removed from office except pursuant to., and in
accordance with the Statutes of the state of Illinois and the rules
and regulations of the Board of Fire and Police Commissioners of said
Village.
Section 10. Compensation.- Every member of the Police De-
partment shall receive such compensation as the President and Board
of Trustees shall from time to time determine. From and after the
effective date of this ordinances, and until otherwise changed by
the President and the. Board of Trustees, the Police Chief., Police
Sergeants, Police Patrolmen and Policewomen shall receive the same
salary as provided in the salary schedule heretofore adopted by the
President and the: hoard of Trustees except that Police Patrolmen
heretofore designated as desk officers shall continue to receive the
salaries heretofore provided in the salary schedule for desk officers
until a new schedule is adopted.

Section 11, Powers--Arrests, All police officers shall
have power (a) to arrest, with or without process, all persons who
break the peace or are found violating any ordinance of the Village
or any criminal law of the State; (b) to commit arrested persons for
examinations ; (c) if necessary, to detain arrested persons in custody
over night or on Sunday in the Village jail or any other safe place,
until they can be brought before a magistrate or a judge for hearing
or trial. They shall have. all the powers of constables as established
by common law.
Section 12, Police as witnesses. All officers making
arrests shall attend as witnesses before the court where the trial may
be had, and shall procure all necessary evidence in their power, and
furnish a list of witnesses to the court; no Village officer or police
officer shall be entitled to any witness fees to be taxed against the
Village in any action for a violation of any ordinance: where the
Village is plaintiff,
Section 13. Policemen--Furnishinp, hail. , No member of the
police force shall become or furnish bail for any person arrested for
violation of any ordinance of the Village or of the criminal laws of
the State of Illinois,.
Section 14, Police-hiding Fire Department, It shall be
the duty of the, police force to aid the fire department by giving alarms
in case of fire and by clearing the streets or grounds in the immed-
iate vicinity of the fire, so that the members of. the fire department
shall not be hindered or obstructed in the performance of their duties.
Section 15. Accidents--Reports,dents--Reports, Each and every police
officer of the Village, whenever any accident shall occur within the
Village limits of which he has or should have notice or knowledge,
shall record forthwith in writing the place, day and nature of the
accident, the hour of the day or night when it occurred, the condi-
tion of the weather, (and, if at night, whether cloudy, clear or
moonlight and whether the street lamps nearby were or were not lightedi ,

the name of each person injured, the extent and nature of the
injury suffered, the names and residences of the principal
witnesses and the name and residence of the examining physician,
if any. Scid records shall be kept on file at the police station,
and where the Village may be involved a copy of said record shall
be sent forthwith to the `Tillage Attorney.
Section 16. All ordinances or parts of ordinances here-
tofore passed and approved by the President and the Board of
Trustees of the Village of Oakbrook, which are not consistent
with the provisions of this ordinance, are hereby repealed.
Section 17. This ordinance shall be in full force and
effect from and after its passage and approval as by statute in
such cases made and provided.
