G-94 AN ORDINANCE AUTHORIZING A CONTRACT WITH OAKBROOK TERRACE, INC. , A CORPORATION FOR THE REGULATION OF TRAFFIC WITHIN THE "OAK BROOK SHOPPING CENTER" i WHEREAS, the corporate authorities of each municipality are authorized by Paragraph 123.1 of Chapter 95�2, Illinois Revised Statutes (1967) to enter into a contract with the owner of any i shopping center to empower the municipality to regulate the parking of automobiles and the traffic at such shopping center; l L. and, I WHEREAS, the owners of the Oak Brook Shopping Center have requested that the Village of Oakbrook regulate parking and traffic at said shopping center and enter into a contract for that purpose; j and, WHEREAS, the corporate authorities of the Village of Oak- brook deem it to be in the public interest to regulate parking j and traffic at said shopping center in order to minimize the risk of accidents and to prevent damage to persons or property and in the interest of public safety; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oakbrook, Du Page County, Illinois, as follows: Section 1. The contract between the Oakbrook Terrace, Inc. , an Illinois corporation, and the Village of Oakbrook, a copy of which is attached hereto, marked Exhibit A, and by this reference made a part hereof, is hereby approved and the Village President and Village Clerk are authorized and directed to execute the original and necessary copies thereof. Section 2. This ordinance shall be in full force and effect from and after its passage and approval as required by statute in such case made and provided. Fricek Village Clerk I i AYES: 5 NAYS: 1 ABSENT: 1 IPA I i i 9 �� C O N T R A C T THIS AGREEMENT made and entered into October 22 , 1968, by and between the VILLAGE OF OAKBROOK, a municipal corporation of DuPage County, Illinois (hereinafter called "Village") , and OAK- BROOK TERRACE, INC. , an Illinois corporation, one of the owners and authorized agent for the other owners of the OAK BROOK SHOPPING CENTER (hereinafter called "Owner") : WHEREAS, Paragraph 123 .1 of Chapter 952, Illinois Revised Statutes (1967) permits the corporate authorities of any municipality and the owner of any shopping center located within the municipality to enter into a contract empowering the municipality to regulatethe parking of automobiles and traffic at such shopping center; and, WHEREAS, the Oak Brook Shopping Center is located in the area bounded by the following streets or highways, to-wit: 16th Street, Illinois Route 83 (Robert Kingery Highway) , Spring Road and 22nd Street, and said area is completely within the corporate limits of said Village of Oakbrook, DuPage County, Illinois; and, WHEREAS, Oakbrook Terrace, Inc. , an Illinois corporation, is one of the owners and the duly authorized agent of the other owners of said Oak Brook Shopping Center and said owners desire the Village of Oakbrook to regulate traffic and parking within said shopping center; NOW, THEREFORE, in consideration of the premises herein, it is agreed by and between the parties hereto that the Village of Oakbrook shall have the following police powers within the area hereinbefore described to accomplish all or any part of the follow- ing: Section 1. The erection of stop signs, flashing signals or yield signs at specified locations in a parking area and the adoption of appropriate regulations thereto pertaining, or the designation of any intersection in the parking area as a stop intersection or as a yield intersection and the ordering of like signs or signals at one or more entrances to such intersection, subject to the provisions of Paragraph 123.1 of Chapter 952, Illinois Revised Statutes (1967) . Section 2 . The prohibition or regulation of the turning of vehicles or specified types of vehicles at intersections or other designated locations in the parking area. Section 3 . The regulation of the crossing of any roadway in the parking area by pedestrians. Section 4. The designation of any separate roadway in the parking area for one-way traffic. Section 5. The establishment and regulation of loading zones. Section 6. The prohibition, regulation, restriction, or limitation of the stopping, standing or parking of vehicles in specified areas of the parking area. -2- Section 7. The designation of safety zones in the parking area and fire lanes. Section 8. Providing for the removal and storage of vehicles parked or abandoned in the parking area during snowstorms, floods, fires or other public emergencies, or found unattended in the park- ing area, (a) where they constitute an obstruction to traffic, or (b) where stopping, standing or parking is prohibited, and for the payment of reasonable charges for such removal and storage by the owner or operator of any such vehicle, (c) where the vehicle is abandoned. Section 9. The initial designation of streets and drives and the location and kind of traffic control signals and devices shall be shown as Exhibit 1, attached hereto and by this reference made a part hereof, and the regulations relating thereto are shown on Exhibit 2 hereof. Section 10. Changes in the initial traffic control scheme shown on Exhibit A may be made by the Village but thirty (30) days' notice prior to installation or enforcement must be given to owner. Section 11. The cost of planning and enforcement of parking and traffic regulations pursuant to this contract shall be borne by the Village. Section 12 . The cost maintenance and installation of parking and traffic signs, signals and devices shall be borne by the owner. Section 13. This agreement shall be for a period of one (1) year from the date hereof but either party may terminate this agree- ment upon thirty (30) days ' written notice to the other party. Section 14. This contract shall be recorded in the office of the Recorder of Deeds of DuPage County, Illinois. WITNESS the hands and seals of the duly authorized officers of the parties at Oakbrook, Illinois. Oliver Isl Lorraine E. Fricek Assistant Secretary Village Clerk -60- EXHIBIT 'IT" ARTICLE VIII REGULATION OF TRAFFIC IN SHOPPING CENTERS 8.01 SPEED RESTRICTIONS. It shall be unlawful to drive any motor vehicle on any street or drive in the Oak Brook Shopping Center at a speed in excess of twenty (20) miles per hour. 8.02 PARKING RULES. It shall be unlawful within the Oak Brook Shopping Center to permit any vehicle to stand at any time in any of the following places: (a) At any curb except at a loading zone so designated by sign. (b) At any place where the vehicle would block the use of a driveway. (c) On any sidewalk or parkway. (d) At any place where official signs prohibit parking. (e) The police department and all members thereof are hereby authorized to remove and tow away or have removed and tow away by abandoned or commercial towing service, any car or other vehicle illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant or obstructs or may obstruct the movement of any emergency vehicle. Cars so towed away shall be stored on any Village property or in a public garage or parking lot and shall be restored to the owner or operator thereof after payment of the expense incurred by the Village in removing and storing such vehicles. (f) Appropriate signs shall be posted in all areas where parking is limited or prohibited, indicating such limitations or prohibitions. -61- 8.03 LOADING ZONE - SERVICE AREA. It shall be unlawful for the driver of a vehicle to stand a passenger vehicle for a period of time longer than is necessary for the loading or unloading of passengers or freight in any place designated as a loading zone or service area and marked as such. 8.04 YIELD RIGHT-OF-WAY. Any drive or street within the Oak Brook Shopping Center designated as a yield right-of-way street and so posted is hereby declared to be a yield right-of-way street. The driver of a vehicle in obedience to a yield right-of-way sign shall reduce the speed of his vehicle to not more than fifteen (15) miles per hour and shall yield the right-of-way to other vehicles which have entered the intersecting street or drive either from the right or left or which are approaching so closely on such inter- section as to constitute a hazard; but said driver having so yielded may proceed at such time as a safe interval occurs. 8.05 Appropriate signs shall be posted to show all yield right-of- way streets or drives. 8.06 STOP STREETS. The driver of a vehicle shall stop in obedience to a stop sign at an intersection where a stop sign is erected pursuant to this ordinance, at one or more entrances thereto, and shall proceed cautiously, yielding to the vehicles not so obligated to stop which are within the intersection or approaching so close as to constitute an immediate hazard, unless traffic at such inter- section is controlled by a police officer on duty, in which event the directions of the police officer shall be complied with. 8.07 Appropriate signs shall be posted to show all stop inter- sections. -62- 8.08. Any person, firm or corporation violating any provision of Article VIII of this ordinance regulating traffic and parking within the area of the Oak Brook Shopping Center shall be fined not less than five (5) dollars nor more than two hundred (200) dollars for each offense.
