AN ORDINANCE AMENDING
ORDINANCE NO. G-11
OF THE VILLAGE OF OAK BROOK
BE IT ORDAINED by the President and Board of Trustees of the
C" Village of Oak Brook as follows:
Ordinance No. G-11, an Ordinance Establishing Rules and Regula-
tions for the Construction, Alteration, Repair; and Conversion of
Buildings within the Village of Oak Brook is hereby amended to
provide as ,follows:
SECTION I. SCOPE
A. It is hereby required that a permit be obtained in advance and
. that all other requirements of the Building Ordinance be complied with,
whenever a building or structure or parts or appurtenances thereof, located
within the Village of Oak Brook, and regulated by this ordinance,. is
erected, installed, altered, converted, remodeled, structurally repaired,
demolished, moved, and/or its use -or occupante is established or changed.
B. Each building and structure and parts and appurtenances thereof
shall be so maintained that the occupants and the users, thereof, and
others are reasonably safe from the hazards of firer explosion, collapse,
'contagic and. spread of infectious disease. If found not to be so main-
;tained, as . set forth elsewhere in this ordinance, the necessary corrective
work, replacement, or removal may be ordered.
C. No permit may be issued on any unrecorded lot or tract of land
until such lot or tract has been surveyed, *platted,- and filed in-.the
Recorder's Office as required by statutes. _
D. No permit may be issued until satisfactory proof has been sub-
mitted that approved water supply and sewage treatment facilities are
available.
E. No construction grading or excavation authorized by. permit may
be made on any property until after the installation of; an access drive
extending from the street to the excavation or site of structure and a
culvert as required and approved by the Highway authority having
jurisdiction:
F. A permit under which no work is commenced within ninety (90) days
after issuance, or if no Work is done for a period of more than ninety - (90)
. .days, shall expire by limitation, and a new permit shall be secured before
such work is started or continued. Nothing in this section shall .prevent
the extension of the expiration date by the Building Official where it can
be shown that a hardship would occur in enforcing the strict letter of
this provision.
G. All - temporary installations and equipment (i.e. tanks, trailers,
signs , etx. ) shall be removed from all construction sites before the final
inspection is made.
H. In the case of all building construction and/or street, curb, or
grading work a cash bond shall be deposited with the Building Official.
The condition of said bond will be such that if the applicant shall clean
all mud and debris resulting from construction work from the streets and
public ways as shall from time to time be required by the Building _
inspector, and restore all streets, curbs, and public ways, and grade to
specifications , then such cash street bond will terminate upon posting of
a cash Performance Bond or upon the issuance of a Certificate of Occupancy
and the amount of such case street bond refunded. If the applicant fails
to provide such clean up, restoration, or grading, then such work shall �be

performed by the Village and the cost of same shall be deducted from
such Performance Bond and the amount, if any remaining, shall be
refunded to the applicant.
I. Following the final inspection, a Performance Bond shall be
posted by the applicant to guarantee that all unfinished work will be
completed within a prescribed time period. Such bond will terminate
upon t^e issuance of a Certificate of Occupancy and the amount of such
bond refunded to the applicant, less any reinspection fees.
J. No building or structure shall be occupied or used for any purpose.
in whole or in part, until a Certificate of Occupancy shall have been
issued by the Building Official, unless a Performance Bond has been posted.
The use for any purpose of buildings and structures already erected or
moved into position which do not comply with the requirements of this
, ordinance is prohibited.
K. Any work started without the issuance of a permit shall be ordered
stopped by the Building Official until such time as the proper permit
application is filed and permit issued. An additional charge shall be
added to all permit fees covering work started without permit.
SECTION II. APPLICATION FOR PERMITS
/ All applications for permits' so to construct, erect, alter, or- repair
any building: structure or part thereof, for which a work permit is requires
by this ordinance, shall be in writing over the signature of the owner or
his authorized -agent on printed forms to be furnished 'by the Village.
Every such application shall have the location of the proposed work
that is, the legal or taxable description of the land upon which the buildix
structure or part thereof is to be erected, constructed, moved, demolished,
altered, or repaired, as the case may be, and shall be filed with the
Building Official. Said application shall be accomplished by plans signed
by the author of said plans.
All plans shall be in sufficient detail to enable. the Building
Official to obtain fuli and complete information as to the character of
the work proposed to be done under the permit sought. Complete framing
drawings shall be submitted of all structural steel, mill or reinforced
concrete construction, said drawings to show the dead and live loads
used in the design.
One (1) copy of the plans on which the permit is issued shall remain
on f ile in the office of the Building Official and a duplicate copy shall
be kept continuously at the building during construction. A plat of the
building site made by a Registered Surveyor shall be furnished upon request
of the Building Official.
One (1) copy of the plans of all attached dwelling units, institu-
tional, commercial or industrial buildings, shall be delivered by
applicant to the Fire Chief of the Village of Oak Brook and the said Fire
Chief within seven (7) days of receipt of the same shall examine said
plans to determine whether they comply with the applicable fire protection
standards of the Bureau of Inspections_ If said plans do meet said
standar-dis, then the Fire Chief shall endorse said plans accordingly -and
deliver the same to the Building Official. If the said plans do not meet
said standards, then the plans shall be returned to the applicant with a
memorandiLm of the specific deficiencies noted.
The Building Official shall not issue any building permzit for
attached dwelling units, institutional, commercial or industrial buildings
unless or until the plans for the same have been approved by the Fire Chief.
When it shall appear to the Building Official that an application
has been made and plans filed in due form and manner as prescribed by this
�- chapter, that the proposed use, manner cf construction, kin'', �an'. Zia Lit-v

of material and workmanship are in all respects in accordance with the
provisions of this ordinance, he shall -thereupon approve the issuance
of the permit sought and it is hereby made the duty of said Building
COfficial to approve or reject any plan filed with him pursuant to the
provisions of this ordinance within a reasonable time.
All work performed and all materials used shall be in accordance
with the plans and specifications submitted with the application for
permit, and any revisions or changes from the plans submitted shall be
deemed a violation unless approved by the Building Official.
In addition to all other documents herein required the applicant
shall submit topographical information in sufficient detail to indicate
the natural drainage of the lot or parcel involved and the proposed -
final grade with intended water flow. Grade pitch shall be away from
the building and at a rate of not less than one-eighth (1/8) inch per
foot. Except in unusual cases where the Building Official shall determine
that- hardship exists, final grades at lot lines shall be established at
the existing elevations. Foundation heights shall be established at
least six' (5) inches above final grade. .,

Before a permit required by this ordinance is issued, the Building
Official shall collect a fee calculated according to the following schedule

dimensions of the building and shall include all space above the lowest

SECTION IV REQUIRED NOTICE FOR INSPECTION
The owner or contractor shall give twenty-four (24) hours advance
notice to the Building Official:
1. Before concrete is poured and after footing excavation has been
completed.
2. Before backfilling and after footing drain tile has been placed
and foundation wall has been waterproofed.
3 . After foundation has been poured and prior to framing, an on site
location and top of foundation elevation, prepared by registered
: land surveyer, it to be submitted to the Building Official.
4 . At the time of water- connection and before backfilling the water.

5. Before any interior wall finish is applied and after the framing
is .completed. -
6. Before any interior wall finish is applied and after the rough
plumbing is completed. -
G 7. Before any interior wall finish is applied and after rough
electrical installation is completed.
S . Before any siding or brick veneer or shingles are applied and
after the application of the sheathing paper.
9. Before any backfilling and after the septic tank and seepage
system has been installed.
10. Before final inspection.
SECTION V BUILDING OFFICIAL
Wherever in this ordinance the term "Building Official" is used, it
shall mean the Building Official appointed by the President and Board of
Trustees and such deputies or assistants as have been or shall be duly
appointed by the President and Board of Trustees. ' That officer is hereby
authorized and it is his duty to administer and enforce the provisions of
the Building Ordinance, making such determinations, interpretations and
orders as are necessary therefore, and requiring such plats, plans and
other descriptive material as are necessary for him to judge compliance
with this ordinance.
SECTION VI FINES - PENP_T,TIES
A. Any person, firm or corporation who violates, disobeys, omits,
neglects, or refuses to comply with, or who resists the enforce-
ment of any of the provisions of the .Building Ordinance, including
provisions adopted by reference, or who refuses to remedy a
violation of any such provisions, shall be fined not less than
Ten and No/100ths ($10.00) Dollars or more than Two Hundred and
No/100ths: .($200.00) Dollars for each offense and each day upon
which such violation continues shall constitute a se_oarate
offense.
B. Any person, firm or corporation licensed or registered by the
State or a subdivision thereof to do work regulated by this
ordinance or to render professional architectural or engineer-
ing service violates the law or ordinance under which licensed or
registered, shall be subject to proceedings or action to revoke
the certificate of license or registration.
C. When a building or structure or part or appurtenance thereof is
found by competent authorities to be maintained in a condition
not reasonably safe from the hazards of fire, .explosion, collapse,
contagion or spread of infectious disease, -the owner thereof,
upon order from the President and Board of Trustees, and after
due notice, shall be liable for correction or removal of the
condition or the cost thereof upon failure to act.
D. A penalty of Twenty-Five and No/100 ($25. 00) Dollars shall be
added to all permits upon issuance of said permit in cases where .
work has commenced prior to issuance of said permit.
SECTION VII PARTIAL INVALIDITY
Should a court of competent jurisdiction hold that the application
of some part of this ordinance is invalid, such holding shall not
invalidate the .remainder.
SECTION VIII ADOPTION BY REFERENCE
All single family residential buildings and appurtenances thereto 7
hereinafter erected, installed, altered, converted, remodeled,
structurally repaired, demolished, moved and/or its use or occupancy
established or changed, shall comply with the provisions of the Suburban
Building Officials Conference Building Code, January 1970, entitled
"Rules and Regulations for the Construction, Alteration, Repair and
Conversion of Buildings for Residential Purposes, " which have been on '
file for more than thirty (30) days in the office of the Village Clerk
of the Village of Oak Brook for public inspection in accordance with the
Statutes of the State of Illinois in such cases made and provided, which
said provisions are hereby-adopted by reference the same as if fully set
forth herein, except for the following amendments, deletions, and
additions:
A. That that portion of the Chicago Building Code copyright 1973 .
known as Chapter 82, Plumbing Provisions, be and the same is
hereby adopted by this reference and shall be known and designated
as Section 82, "Plumbing Code" of this Ordinance, except that all
fees stipulated in said Chapter 82 shall be deleted and replaced
by those fees stipulated in Section III of_,this Ordinance.
B. That that portion of the Chicago Building Code copyright 1973
known as Chapter 86, Chapter 86.1, Chapter 87 and Chapter 88,
Electrical Code, be and the same are hereby adopted by this
reference and shall be known and designated as Section 86,
Section 86.1, Section 87 and Section 88, Electrical Code, of this
Ordinance, except that all fees stipulated in said Chapters shall
be deleted and replaced by those stipulated in Section III of
this Ordinance.
All multi-family residential buildings and appurtenances thereto herein-
after erected, installed, altered, converted, remodeled, structurally
- - repaired, demolished, moved and/or its use or occupancy established or
changed, shall comply with the provisions of the "DuPage County Building
Code for Multi-Family Buildings", copies of which have been on file for
more than thirty (30) days in the office of the Village Clerk of the
' Village of Oak Brook for public inspection in accordance with the Statutes
of the State of Illinois in such cases made and provided, which said
provisions are hereby adopted by reference the same as if fully set forth
herein except for the following amendments and deletions:

A. The definition of "Condominium" as found in Section 200 of said
Code is hereby amended to read:* "Two or more individually owned
and occupied living units in one building, including but not
limited to those buildings now known as the "Villas".
B. Wherever reference is made to a DuPage County official within
the code, such reference shall mean the comparable Village
Official.
C. All reference in said code to electrical and plumbing provisions
shall be amended to comply with the Plumbing Code and Electrical
Code for single family residential buildings in Section VIII of
this Ordinance.
All other .buildings hereinafter erected, installed, ' altered, converter
remodeled,. structurally repaired, demolished, :moved and/or their use or
occupancy established or changed, shall comply with the provisions of the
Chicago Building Code copywrite 1973 which has heretofore been published
in book form, copies of which have been .on file.•:=•for more than thirty (30)
'days in the office of the Village Clerk of the Village of Oak Brook for
public inspection in accordance with the Statutes of the State of Illinois
in such cases made and provided, which said provisions ,are hereby adopted
- ; . by reference the same as if .fully .set forth herein except for the followinc
amendments and deletions:
A. The first paragraph of Section 50-1 shall be amended and as
amended shall read as follows:
Fire Limits. Fire limits shall embrace all zoning districts
within the corporate limits classified Bl, B2, B3, B4, ORA 1,
ORA 2, ORA 3, as defined in the Oak Brook Zoning Ordinance of
March 22, 1966, being Ordinance G-60, together with an addi-
tional 200 feet in all directions from the outer limits 'of
each area or areas so classified.
B. Section 50-7 is hereby amended in line two thereof by changing
the words "Chicago Zoning Ordinance" to "Oak Brook Zoning
Ordinance. "
C: Section 51-1.1, subparagraph (b) is amended in line two thereof
by changing the words "Chicago Zoning Ordinance" to "Oak Brook
Zoning Ordinance. "
D. Section 51-2.1 subparagraph (b) .is amended in line two thereof
by changing the words "Chicago Zoning Ordinance" to "Oak Brook
Zoning Ordinance. "
E. All other references in said Code to the City of Chicago shall
be amended to read the Village of Oak Brook.
F. Chapter 79, Section 79-5. 28 , subsection 7 paragraph two is
amended to read as follows:
The provisions of this Section shall not apply to elevators
in office, hotel and factory buildings where the vertical
travel from the main floor to the top terminal floor is
thirty -five (35) feet or less.
G. Chapter 78 and 78 .1 are hereby deleted in their entirety.
H. All fees in said Code are hereby deleted and shall be' replaced
by those listed in Section III of this Ordinance.

I . Wherever reference is made to a Citv of Chicago Official with 'In
said Code, si:ch reference shall mean the comparable Village
Official.

SECTION .IX
T�_is Ordinance shall be in full force and effect from and after its
passage and approval as provided by law.
PASSED and APPROVED by the President and Board of Trustees of the
Village of Oak Brook, DuPage County, Illinois, this 11~ day of
