AN ORDINANCE GRANTING A VARIATION
TO THE RULES AND REGULATIONS
OF THE OAK BROOK ZONING ORDINANCE
Whereas, - the owner of the property more particularly herein-
after described has petitioned the corporate authorities of the
Village of Oak Brook for a variation to the rules and regulations
of the Zoning Ordinance of the Village of Oak Brook with respect
to the flood crest elevation requirements; and
Whereas, a public hearing pursuant to said request has been
held by the Zoning Board of Appeals of the Village of Oak Brook;

Whereas, the President and Board of Trustees of the Village
of Oak Brook are of the opinion that a variation should be granted;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, DuPage County, Illinois, as
follows:
Section 1. That the applicable rules and regulations of
Section V, N of "The Zoning Ordinance of the Village of Oak Brook,
Illinois, of 1966" , being Ordinance G-60, as amended, are hereby
varied to permit the construction of homes to include basements
below the minimum flood plain elevation, on property described as:
Lots 1, `4, 16, 17 and 13 of Merry Lane Subdivision,
being a subdivision in Sections 23 and 24, Township
39 North, Range 11; East of the Third Principal in
DuPage .County, Illinois;
the general location of the property being at Merry Lane Road, Oak
Brook, Illinois.
Section 2. The variation granted hereby is conditioned and
restricted that the actual construction meet the following minimum
standards:
(a) The outer .walls, basement floor, and areaways of
a building which enclose open space that is below
the established high water elevation plus 2.5- feet
shall be constructed of masory materials up to the
minimum elevation, shall be water tight, and shall
i' be designed to withstand the hydrostatic pressure
caused by flood water standing at the high water
elevation adjoining the building site.
(b) Overhead sewers shall be installed to convey sewage
from the lower level of the residence to the sanitary
sewerage system.
(c) Automatic starting generator sets shall be provided
for each residence to provide power to both the sewage
and drain tile sump pumps in case of a power outage.
(d) Where possible gravity drain tile shall be provided
from footing drains to outlet to Salt Creek. These
drain tile shall be equipped with a check valve or
flap gate to prevent reverse flow at times of high
water.
(e) Rear yards, except for an area within 15 ' of the
proposed building, should not be filled. The natural
flood plain is to be retained where possible.

Section 3. That this Ordinance- shall be in full force and
effect from and after its passage and approval as by statute in
\.. such cases made and provided.
PASSED and APPROVED by the President and Board of Trustees of
