G-176 t AN ORDINANCE PROVIDING FOR THE REGULATION OF THE INSTALLATION, OPERATION, AND MAINTENANCE OF AUTOMATIC BURGLAR ALARMS AND AUTOMATIC FIRE ALARMS BY THE VILLAGE OF OAK BROOK, DUPAGE COUNTY, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES of the Village of Oak Brook, DuPage County, Illinois, that: SECTION 1: Definitions: A. Alarm Equipment Suppliers: Any person, firm, or corporation that sells, leases, or installs automatic protection devices or signaling devices which transmit alarms upon receipt of a stimulus from a detection apparatus. B. Automatic Protection Device: An electrically-operated instrument which automatically sends a voice alarm over regular public telephone lines upon detection of a fire or unauthorized intrusion. \ C. Signaling Device: An electrically-operated instrument which sends, automatically, visual and/or audible signals over a signal line to be registered by indicators at a monitor panel at the receiving terminal. D. False Alarm: A visual and/or audible signal transmitted by an Automatic Protection Device or a Signaling Device which indicates the existence of an emergency situation when in fact, no such emergency situation exists. SECTION 2: Automatic Protection Devices: A. Permit Required. No person shall operate or maintain any Automatic Protection Device which automatically transmits a signal, message, or warning to a Village Police Department or Fire Department telephone line without first obtaining a permit as required by this Section. B. Application for Permit. 1. Applications for permits to install, maintain, and operate an Automatic Protection Device shall be filed with the concerned Chief of the Police or the Fire Department on forms supplied by the Village with an application fee of TWENTY-FIVE DOLLARS ($25. 00). Said application shall set forth the name, address, and telephone number. of both the installer and the person or business on whose premises the system will be installed, as well as a description of the system and the location where it is proposed to be installed. 2. The concerned Chief of the Police or the Fire Department shall approve such application if he finds that: .(a) The use of said Automatic Protection Device to transmit a signal message or warning to a designated Village Police Department or Fire Department telephone line will not interfere with the orderly conduct of municipal business; and (b) The Alarm Equipment Supplier installing the system maintains a service organization capable of promptly and effectively repairing, maintaining, and otherwise servicing the Automatic Protection Devices sold or leased by him. The concerned Chief of Police or Fire Department or his designate shall have the right to inspect any Automatic Protection Device on the premises where it is installed to be used, both prior and subsequent to the issuance of a permit, at reasonable times, to determine (- whether a permit should be granted or whether' it is being used in conformity with the terms of the permit and the provisions of this Ordinance. D. Restricted Numbers. It shall be unlawful for any person, firm, or corporation to install, maintain, or operate an Automatic Protection Device except to such telephone numbers as designated by the permit issued under the provisions of this Ordinance. E. Revocation. The concerned Chief of Police or Fire Department may revoke or suspend any permit issued pursuant to the provisions of this Section, after giving written notice to the permit holder and an opportunity for the permit holder to be heard, if he determines that the Automatic Protection Device under said permit has been installed, maintained, or operated in violation of the provisions of this Ordinance or of any term or condition of said permit or for failure to pay the annual service fee specified in Section F. F. Annual Permit. Each permit holder shall pay to the Village on or before July 1 of each year a fee in the amount of FIFTEEN DOLLARS ($15.00) to reimburse the Village for the cost of providing special telephone lines to receive calls from Automatic Protection Devices and other expenses of operations SECTION 3: Signaling Devices: A. Monitoring System. The Village Police Department and Fire Department are authorized to contract for the installation of a uniform monitoring system to receive visual and/or audible signals over a signal line or lines at a central location. This system shall have a capacity for 999 terminals and shall be available to any subscriber who meets the requirements for a permit for connection. B. Permit Required. No person shall install, operate, or maintain a Signaling Device over a signal line to the Police Department or Fire Depart- ment without first obtaining a permit as required by this Section. C. Application for Permit. 1. Applications for permits to install, maintain, and operate a signaling device shall be filed with the concerned Chief of Police or Fire. Department on forms supplied by the Village with an applica- tion fee of TWENTY-FIVE DOLLARS. ($25. 00). Said application shall set forth the name, address, and telephone number of both the installer and the person or premises on which the device will be installed, as well as a description of the system and the location where it is to be installed. 2. The concerned Chief of Police or Fire Department shall approve such application if he finds that; (a) The components of the Signaling Device shall be Under- writer's Laboratories approval or equal to Underwriter's Laboratories approved; and (b) The Alarm Equipment Supplier installing the device main- tains a service organization capable of promptly and -G- •r effectively repairing, maintaining, and otherwise ser- vicing the Signaling Devices sold, leased, or installed by him. Notwithstanding the foregoing, the Police Chief or Fire Chief may impose reasonable conditions on the issuance and exercise of said permit. D. Right of Inspection. The concerned Chief of Police or Fire Department or his designate shall have the right to inspect any Signaling Device on the premises where it is intended to be used, both prior to and subsequent to the issuance of a permit at reasonable times to determine whether a permit should be granted and whether it is being used in conformity with the terms of the permit and the .provisions of this Ordinance. E. Revocation. . The concerned Chief of Police or Fire Department may re- voke or suspend any permit issued pursuant to the provisions of this Ordinance, after giving written notice to the permit holder and an opportunity to be heard, if he determines that the Signaling Device under said permit has been installed, maintained, or operated in violation of the provisions of this Ordinance or of any term or condition of said permit. F. Subscription Charges. Nothing herein shall preclude the Alarm Equip- ment Supplier from. charging a permit holder for all equipment at their location ff and connection fees to the monitoring system and maintenance charges neces- sitated by the installation, operation, and maintenance of the Signaling Device in the monitoring system. The company supplying and maintaining the moni- toring system shall have the right to charge subscribers or their Alarm Equip- ment Supplier a reasonable fee for connection to and maintenance of the system. SECTION 4: False Alarms. A. False Alarms. Each person, firm, or corporation holding a permit for the operation or maintenance of an Automatic Protection Device or Signaling Device shall be responsible for any False Alarm transmitted by the device which they operate or maintain. B. Records. The concerned Chief of Police or Fire Department shall main- tain a record of all false alarms so transmitted and pursuant to the required notice and opportunity to be heard may revoke or suspend the permit for the operation of an Automatic Protection Device or Signaling Device involved in the transmission of False Alarms in such numbers to constitute a deterrent to the overall effective operation of the system, or may make reasonable charges therefor. C. Charges. A permit holder shall be charged an additional fee of TWENTY- FIVE DOLLARS ($25. 00) for each False Alarm in excess of one in any three- month period transmitted by any permitted Automatic Protection Device or Signaling Device. Such charge shall be remitted to the Village by such permit holder upon receipt of a statement for such charge. SECTION 5: . Liability of Village Limited. The Village assumes no liability for any defects in operation of Automatic Protection Devices and Signal Device systems for any failure or neglect to respond appropriately upon receipt of an alarm from such a source, nor for the failure or neglect of any person in connection with the installation and operation of equipment, the transmission of alarm signals, and pre-recorded alarm messages or the relaying of such signals and messages. -3- SECTION 6: Penalties for Violation. Failure of any person to comply with the requirements contained in a written notice of a violation of any provision hereof within three (3) days of receipt of such notice, shall constitute an offense punishable by a fine not to exceed HUNDRED FIFTY DOLLARS ($250. 00). Such notice shall continue in-force and effect until full com- pliance with the requirements stated therein, and each and every failure to comply with such notice within twenty-four (24) hours after the three (3) days allowed for conipliance shall constitute a separate offense. SECTION 7: Severability. Should any section, paragraph, sentence, clause, or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of said Ordinance shall not be affected thereby, and shall remain in full force and effect, and the same shall not affect the validity of the remaining portions of this Ordinance. SECTION 8: Conflict. All ordinances or parts of ordinances in conflict here- with are hereby repealed solely to the extent of the conflict. SECTION 9: Effect. This Ordinances shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
