ORDINANCE NO. c /7 7
AN ORDINANCE REGULATING THE USE OF STREETS AND HIGHWAYS
WITHIN THE VILLAGE OF OAK BROOK, DUPAGE COUNTY, ILLINOIS
WHEREAS, the Village of Oak Brook polices a system of streets
and highways within the Village, and
WHEREAS, the protection of the public health, safety and general
welfare of the citizens of the Village require that certain rules and regula-
tions be enforced on the streets and highways within the Village, and
WHEREAS, the Corporate Authorities of the Village of Oak Brook
deem this Ordinance to be in the best interest of the Village of Oak Brook.
NOW. THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Oak Brook, DuPage County, Illinois, that:
SECTION 1: The provisions of the preamble hereinbefore set forth are here-
by restated herein as though herein fully set forth.
SECTION 2: The following rules and regulations are hereby enacted to govern
the use of the public streets and highways of the Village of Oak Brook and the
penalties for misuse thereof:

ARTICLE I
SPECIAL DEFINITIONS
DIVISION i
D-101 Definition of words and phrases.
The following words and phrases when used in this Ordinance shall, for
the purpose of this Ordinance, have the meanings respectively ascribed
to them in this chapter, except when the context otherwise requires and
except where another definition set forth in another Chapter of this
Ordinance and applicable to that Chapter or a designated part thereof
is applicable.
D-102 Alley
A public way within a block, generally giving access to the rear of lots
or buildings and not used for general traffic circulation.
D-102.1 Antique Vehicle.
A motor vehicle that is more than 25 years of age and which is driven on
the highways only going to and returning from an antique auto show or an
exhibition, or for servicing or demonstration, or a fire-fighting vehicle
more than 20 years old which is not used for fire-fighting equipment but
is used only for the purpose of exhibition or demonstration.
D-103 Approved driver education course.
(a) Any course of driver education approved by the Superintendent of
Public Instruction, offered by public or private schools maintaining
grades 9 through 12, and meeting at least the minimum requirements of the
"Driver Education Act", as now or hereafter amended, or
(b) Any course of driver education offered by a school licensed to give
driver education instructions under this Ordinance which meets at least
the minimum educational requirements of the "Driver Education Act", as now
or hereafter amended, and is approved by the Superintendent of Public
Instruction, or
(c) Any course of driver education given in another State to an Illinois
resident attending school in such State and approved by the State admin-
istrator of the Driver Education Program of such other State.
D-104 Arterial Street.
Any U.S. or State numbered route, controlled access highway, or other major
radial or circumferential street or highway designated by local authorities
within their respective jurisdictions as part°.ofra major arterial system of
streets or highway.
D-105 Authorized emergency vehicle.
Emergency vehicles of municipal departments or public service corporations
as are designated or authorized by proper local authorities; police
vehicles; vehicles of the fire department and ambulances.
D-106 Bicycle.
Every device propelled by human power upon which any person may ride, having
two tandem wheels either of which is more than 16 inches in diameter.
D-106.1 Bicycle pathway or bikeway.
That portion of a trail or path improved and so designated as a bicycle trail
exclusively used by bicycles and pedestrian traffic.
D-107 Bus.
Every motor vehicle designed for carrying more than 10 passengers and used
for the transportation of persons; and every motor vehicle, other than a
taxicab, designed and used for the transportation of persons for compensation.

D-108 Business district.
The territory contiguous to and including a highway when within any 600
feet along such highway there are buildings in use for business or indus-
trial purposes, including but not limited,to hotels, banks, or office
buildings, railroad stations and public buildings which occupy at least 300
feet of frontage on one side or 300 feet_collectively on both sides of-:the
highway.
D-109 Camper.
A recreational motor vehicle of the Second Division converted or equipped
and primarily used for living quarters or for human habitation, rather than
for the transportation of freight, goods, wares and merchandise.
D-112 Controlled access highway.
Every highway, street or roadway in respect to which owners or occupants
of abutting lands and other persons have no legal right of access to or
from the same except at such points only and in such manner as may be deter-
mined by the public authority having jurisdiction over such highway, street
or roadway.
D-113 Cross walk.
(a) The part of a roadway at an intersection included within the connec-
tions of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs, or, in the absence of curbs, from the edges
of the traversable roadway;
(b) any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by lines or other markings on the surface
placed in accordance with the provisions in the Ptanual adopted by the
Village as authorized in Section 1-301 of this Ordinance.
D-116 Driver.
Every person who drives or is in actual physical control of a vehicle.
D-119 Explosives.
Any chemical compound or mechanical mixture that is commonly used or
intended for the purpose of producing an explosion and which contains any
oxidizing and combustive units or other ingredients in such proportions,
quantities or packing that an ignition by fire, by friction, by concussion,
by percussion or by detonator of any part of the compound or mixture may
cause such a sudden generation of highly heated gases that the resulting
gaseous pressures are capable of producing destructive effects on contig-
uous objects or of destroying life or limb.
D-120 Farm tractor.
Every motor vehicle designed and used primarily as a farm implement for
drawing wagons, plows, mowing machines and other implements of husbandry,
and every implement of husbandry which is self propelled.

D-120.1 Fire Lane
Travel lanes for the fire fighting equipment upon which there shall be no
standing or parking of any motor vehicle at any time so that fire fighting
equipment can move freely there on.
D-121 Flammable liquid
Any liquid which has a flash point of 70 F. , or less, as determined by a
tagliabue of equivalent closed-cup test device.'
D-123 Foreign vehicle
Every vehicle of a type required to be registered hereunder brought into this
State from another State, territory or country other than in the ordinary
course of business by or through a manufacturer or dealer and not registered
in this State.
D-124 For-hire
The operation of a vehicle for compensation and subject to federal regulation
by the Interstate Commerce Commission or to state regulation by the Illinois
Commerce Commission.
D-125 Gross weight
The weight of a vehicle whether operated singly or in combination without load
plus the -weight of the load thereon.
D-125 Highway
The entire width between the boundary lines of every way publicly maintained
when any part thereof is open to the use of the public for purposes of
vehicular traffic.
D-128 House trailer
(a) A recreational trailer or semitrailer equipped and used for living quarters
or for human habitation (temporarily or permanently) rather than for the
transportation of freight, goods, wares and merchandise; or
(b) A house trailer or a semitrailer which is used commercially (temporarily'
and permanently), that is, for the advertising, sales, display or promotion
of merchandise or services, or for any other commercial purpose except the
transportation of property for distribution by a private carrier.
130 Implement of husbandry
Every vehicle designed and adapted exclusively for agricultural, horticultural ,
or livestock raising operations, including farm wagons, wagon trailers or
like vehicles used in connection therewith, or for lifting or carrying an
implement of husbandry provided that no farm wagon, wagon trailer or like
vehicle having a capacity of more than 400 bushels or a gross weight of
more than 30,000 pounds, shall be included 'hereunder.
D-131 Improved highway
Any roadway of concrete, brick, asphalt, macadam and crushed stone or gravel.

D-132 Intersection
The area embraced within the prolongation or connection of the lateral curb
lines, or, if none, then the lateral boundary lines of the roadways of two
highways which join one another at, or approximately at, right angles or the
area within which vehicles traveling upon different roadways joining at any
other angle may come in conflict.
(b) Where a highway includes two roadways 40 feet or more apart, then eveey
crossing of each roadway of such divided highway by an intersecting highway
shall be regarded as a separate intersection.
(c) The junction of an alley with a street or highway does not constitute
an intersection.
D-135 Lane-control signal
An official traffic control device consisting of an electrically controlled and
illuminated signal of a square or rectangular design and employing distinctive
colors or symbols used to control the direction of vehicular flow on the
particular lane to which the indication applies.
D-136 Laned roadway
A roadway which is divided into two or more_clearly marked lanes for vehicular
traffic.
D-137 Lease -
A written document vesting exclusive possession, control of and responsibility
over the operation of the vehicle in the lessee for a specific period of time
as if such lessee were the legal owner.
D-138 License to drive
Any driver's license or any other license or permit to operate a motor vehicle
issued under the laws of this State including_
1. Any temporary license or instruction permit;
2. The privilege of any person to drive a motor vehicle whether or not such
person holds a valid license or permit;
3. Any nonresident's driving privilege as defined herein.
D-140 Local authorities
Every county, municupal, and other local board or body having authority to
enact laws relating to traffic under the constitution and laws of this State.
D-142 Manufacturer
Every person engaged in the business of manufacturing and assembling vehicles or
reconstructed vehicles, or engine and driveline components for vehicles.
D-143 Merging traffic
A manuever executed by the drivers of vehicles on converging roadways to
permit entry into the junction thereof, wherein the driver of each vehicle
involved is required to adjust his vehicular speed and lateral position so
as to avoid a collision with any other vehicle.
D-144 Metal tire
Every tine the surface of which in contact with the highway is wholly or
partly of metal or other hard, nonresilient material.

0-146 i,otor Vehicle
Every vehicle which is self-propelled and every vehicle which is propelled
by electric power obtained from overhead trolley, wires, but not operated
upon rails. For this Ordinance, motor vehicles are divided into tao divisions:
First Division: Those motor vehicles which are designed for the carrying
of not more than 10 persons.
Second Division: Those motor vehicles which are designed for carrying more
than 10 persons, those designed or used for living quarters and those motor
vehicles which are designed for pulling or carrying freight or cargo, and those
motor vehicles of the First Division remodelled for use and used as motor
vehicles of the Second Division.
D-147 i-iotorcycl e
Every motor vehicle having a seat or saddle for the use of the rider and
designed to travel on not more than 3 wheels in contact with the ground,
but excluding a tractor.
-148 Motor driven cycle
Every motorcycle, every motor scooter, or every bicycle with motor attached,
with less than 150 cubic centimeter piston displacement.
D-154 Official traffic-control devices.
All signs, signals, markings, and devices which conform with the State Manual
and riot inconsistent with this Ordinance, placed or erected by authority of
a public body or official having jurisdiction, for the purpose of regulating,
warning, or guiding traffic.
D-155 Owner
(a) A person who holds legal title of a motor vehicle, or in the event a
motor vehicle is the subject of an agreement for the conditional sale or
lease thereof with the right of purchase upon performance of the conditions
stated in the agreement and with an immediate right of possession vested
in the conditional vendee or lessee, or in the event a mortgagor of such
motor vehicle is entitled to possession, then such conditional vendee or
lessee or mortgagor shall be deemed the owner for the purpose of this Ordinance.
(b) Any person, group of persons, firm, association, partnership, private
corporation, public or quasi-public corporation, institution or a combination
of any of them or other legal entity having a proprietary interest in the
subject real or personal property.
D-156 Park or parking
Means the standing of a vehicle, whether occupied or not, otherwise than
when temporarily and actually engaged in loading or unloading merchandise
or passengers.
D-157 Passenger car
A motor vehicle of the First Division that is designed for carrying not more
than 10 persons.
D-153 Pedestrian
Any person afoot.

D-159 Person
Every natural person, firm, copartnership, association or corporation.
D-159.1 Physically handicapped person
Every natural person who has permanently lost the use of a leg or both legs
or an arm or both arms, or any combination thereof or any person who is so
severely disabled as to be unable to move without the aid of crutches or
a wheelchair.
D-160 Pneumatic tire
Every tire in which compressed air is designed to support the load.
D-161 Pole trailer
Every vehicle without motive power designed to be drawn by another vehicle
and attached to the towing vehicle by means of a reach or pole, or by being
boomed or otherwise secured to the towing vehicle, and ordinarily used for
transporting long or irregularly shaped loads such as poles, pipes or
structural members capable, generally, of sustaining themselves as beams
between the supporting connections.
D-162 Police officer
Every officer authorized to direct or regulate traffic or to make arrests
for violations of traffic regulations.
D-163 Private road or driveway
Every way or place in private ownership and used for vehicular travel
by the owner and those having express or implied permission from the owner,
but not by other persons.
D-154 Public building
A building used by the municipality, the county, any park district, school
district, the State of Illinois, or the United States Government.
D-169 Recreational vehicle
Every vehicle originally designed or permanently converted to and used for
living quarters or for human habitation and not used as a commercial
vehicle, including any house, car, house trailer, camper or private living coach.
D-172 Residence district
The territory contiguous to and including a highway not comprising a business
district when the property on such highway for a distance of 300 feet or
more is in the main improved with residences or residences and buildings
in use for business.
D-173 Resident
Every natural person who resides in this Village shall be deemed a resident
of this Village.
D-175 Reversible lane
A lane of a 2 or more lined roadway upon which traffic may be directed to
move in either direction by means of lane-control signals or other devices,
in conjunction with official signs.
177 Right-of-way
The right of one vehicle or pedestrian to proceed in a lawful manner in
preference to another vehicle or pedestrian approaching under such circum- ,
stances of direction, speed and proximity as to give rise to danger of
collision unless one grants precedence to the other.

D-178 Road tractor
Every motor vehicle designed and used for drawing other vehicles and not so
constructed as to carry any load thereon either independently or any part of
the weight of a vehicle or load so drawn.
D-179 Roadway
That portion of a highway improved, designed, or ordinarily used for
vehicular travel , exclusive of the berm or shoulder. In the event a
highway includes two or more separate roadways the term "roadway" as used
herein shall refer to any such roadway separately but not to all such
roadways collectively.
D-180 Rural mail delivery vehicle
Every vehicle used to deliver U.S. mail on a rural mail delivery route.
D-181 Safety zone
The area or space officially set apart within a roadway for the exclusive
use of pedestrians and which is protected or is so marked or indicated by
adequate signs as to be plainly visible at all times while set apart as a
safety zone.
D-182 School bus
Every motor vehicle of the Second Division owned or operated by or for a
public or governmental agency or by or for a private or religious organ-
ization for the transportation of pupils in connection with any school
activity. This definition does not include a bus operated by a public
utility or a municipal corporation authorized to conduct local or interurban
transportation of passengers.
D-1087 Semitrailer
Every vehicle without motive power, other than a pole trailer, designed for
carrying persons or property and for being drawn by a motor vehicle and so
constructed that some part of its weight and that of its load rests upon
or is carried by another vehicle.
D-188 Sidewalk
That portion of a street between the curb lines, or the lateral lines of
a roadway, and the adjacent property lines, intended for use of pedestrians.
0-189 Snowmobile
Every self-propelled device designed for travel on snow or ice steered by
wheels, skis or runners.
D-190 Solid tire
Every tire of rubber or other resilient material which does not depend upon
compressed air for the support of the load.
D-193 Speed change lane
An auxiliary lane, including tapered areas, primarily for the acceleration or
deceleration of vehicles entering or leaving the through traffic lanes.
D-194 Stand or standing
Means the halting of a vehicle, whether occupied or not, otherwise than when
temporarily and actually engaged in receiving or discharging passengers.

D-199 Stop
When required means complete cessation from movement.
D-200 Stop or stopping
!deans any halting even momentarily of a vehicle, whether occupied or not,
except when necessary to avoid conflict with other traffic or in compliance
with the directions of a police officer or traffic-control sign or signal.
D-201 Street
The entire width between boundary lines of every way publicly maintained
when any part thereof is open to the use of the public for purposes of
vehicular travel.
D-203 Suburban district
That portion of any city, village or incorporated town other than the
business and residence districts.
D-205 Through highway
Every highway or portion thereof on which vehicular traffic is given
preferential right of way, and at the entrances to which vehicular
traffic from intersecting highways is required by law to yield right
of way-to vehicles on such through highways in obedience to either
a stop sign or a yield sign, when such signs are erected as provided
in this Ordinance.
D-207 Traffic
Pedestrians, ridden or herded animals, vehicles and other conveyances
either singly or together while using any highway for purposes of travel.
D-208 Traffic control signal
Any official traffic control device, whether manually, electrically or
mechanically operated, by which traffic is alternately directed to stop
and permitted to proceed.
D-209 Trailer
Every vehicle without motive power in operation, other than a pole trailer,
designed for carrying persons or property and for being drawn by a motor
vehicle and so constructed that no part of its weight rests upon the
towing vehicle.
D-211 Truck
Every motor vehicle designed, used or maintained primarily for the trans-
portation of property.
D-211.1 Truckster
Every motor vehicle or motorcycle with 3 wheels designed, used or maintained
primarily for the transportation of property.

D-212 Truck tractor
Every motor vehicle designed and used primarily for drawing other vehicles
and not so constructed as to carry a load other than a part of the weight
of the vehicle and load so drawn.
D-214 Urban district
The territory contiguous to and including any street which is built up with
structures devoted to business, industry or dwelling houses situated at inter-
vals of less than 100 feet for a distance of a quarter of a mile or more.
D-215 Urban area
An urban area is an incorporated or unincorporated area developed primarily
for residential and/or business purposes.
D-217 Vehicle
Every device, in, upon or by which any person or property is or may be
transported or drawn upon a highway, except devices moved by human power.
For this Ordinance vehicles are divided into 2 divisions:
First Division: Those motor vehicles which are designed for the carrying
of not more than 10 persons.
Second Division: Those vehicles which are designed for carrying more than
10 persons, those designed or used for living quarters and those vehicles
which are designed for pulling or carrying freight or cargo, those motor
vehicles of the First Division remodelled for use and used as motor vehicles
of the Second Division, and those motor vehicles of the First Division
used and registered as school buses.

Village of Oak Brook.
D-219 Yield right-of-way
When required by an official sign means the act of granting the privilege
of the immediate use of the intersecting roadway to traffic within the
intersection and to vehicles approaching from the right or left, but when
the roadway is clear may proceed into the intersection.

DIVISION II
OBEDIENCE TO AND EFFECT OF TRAFFIC LAWS
1-201 Provisions of Ordinance refer to vehicle upon the highways - Exceptions
The provisions of this Chapter relating to the operation of vehicles refer exclu-
sively to the operation of vehicles upon highways except:
1. Where a different place is specifically referred to in a given section.
2. The provisions of Divisions IV and V of this Article shall apply upon
highways and elsewhere throughout the Village.
1-202 Required obedience to traffic iaws.
It is unlawful and, unless otherwise declared in this Chapter with respect to par-
ticular offenses, it is a misdemeanor for any person to do any act forbidden or
fail to perform any act required in this Chapter.
1-203 Obedience to police officers.
No person shall wilfully fail or refuse to comply with any lawful order or direc-
tion of any ,police officer invested by law with authority to direct, control, or
regulate traffic.
1-204 Fleeing or attempting to elude police officer.
(a) Any driver or operator of a motor vehicle who, having been given a visual
or audible signal by a peace officer directing such driver or operator to
bring his vehicle to a stop, wilfully fails or refuses to obey such direc-
tion, increases his speed, extinguishes his lights, or otherwise flees or
attempts to elude the officer, is guilty of a misdemeanor. The signal
given by the peace officer may be by hand, voice, siren, red or blue light.
Provided, the officer giving such signal shall be in police uniform, and,
if driving a vehicle, such vehicle shall be marked showing it to be an
official police vehicle.
(b) Upon receiving notice of such conviction the Secretary of State may forth-
with suspend the drivers license of the person so convicted for a period
of not more than six months.
1- 205 Public officers and employees to obey Ordinance Exceptions
(a) The provisions of this O-dinanceapplicable to the drivers of vehicles upon
the highways shall apply to the drivers of all vehicles owned or operated
by the United States, this State or any county, city, town, district or any
other political subdivision of the State, except as provided in this Sec-
tion and subject to such specific exceptions as set forth in this Chapter
with reference to authorized emergency vehicles.
(b) The driver of an authorized emergency vehicle, when responding to an emer-
gency call or when in the pursuit of an actual or suspected violator of
the law or when responding to but not upon returning from a fire alarm,
may exercise the privileges set forth in this Section, but subject to the
conditions herein stated.
(c) The driver of an authorized emergency vehicle may:
1. Park or stand, irrespective of the provisions of this Chapter;
2. Proceed past a red or stop signal or stop sign, but only after
slowing down as may be required and necessary for safe operation;
3. Exceed the maximum speed limits so long as he does not endanger
life or property;
4. Disregard regulations governing direction of movement or turning
in specified directions.

(d) The exceptions herein granted to an authorized emergency vehicle, other
than a police vehicle, shall apply only when the vehicle is making use
of either an audible signal when in motion or visual signals meeting
the requirements of Division 2-215 of this Ordinance.
(e) The foregoing provisions do not relieve the driver of an authorized
emergency vehicle from the duty of driving with due regard for the
safety of all persons, nor do such provisions protect the driver
from the consequences of his reckless disregard for the safety of
others.
_(f) The provisions of this Chapter, with the exception of Division IV and
V of this Chapter do not apply to persons, teams, motor vehicles and
other equipment while actually engaged in work upon the surface of
the highway but apply to such persons and vehicles when traveling to
or from such work.
1-206 Traffic laws apply to persons riding bicycles or animals or driving animal-
drawn vehicles.
Every person riding a bicycle or an animal or driving any animal drawing a
vehicle upon a roadway shall be subject to the provisions of this Chapter
applicable to the driver of a vehicle except those provisions of this Chap-
ter which by their nature can have no application.
Regulations applicable to bicycles shall apply whenever a bicycle is`oper-
ated upon any highway and also upon any bikeway set aside for the exclusive
use of bicycles subject to those exceptions stated herein.
Wherever a usable path or surface has been provided for bicycles adjacent
to a roadway and designated by official traffic control devices, bicycle
riders shall use such path or surface and shall not use the roadway.
Every person operating a bicycle upon a roadway or a designated bicycle path-
way shall ride as near to the right side as practicable, exercising due care
when passing a standing vehicle or one proceeding in the same direction.

DIVISION iII
TRAFFIC SIGNS, SIGNALS AND MARKINGS
1-301 Village to adopt sign manual
The Village shall adopt the "Manual on Uniform Traffic Control Devices
for Streets and Highways" as published by the State of Illinois
Department of Transportation.
1-302 Authority to designate through highway and stop and yield intersections.
(a) The Village with reference to streets and highways under its juris-
disction may designate through highways and erect stop signs or
yield signs at specified entrances thereto, or may designate any
intersection as a stop intersection or as a yield intersection as
a stop intersection or as a yield intersection and erect stop
signs or yield signs at one or more entrances to such intersection.
(b) Every stop sign and yield sign shall conform to the State Manual
and Specifications and shall be located as near as practicable to
the nearest line of the crosswalk on the near side of the inter-
section or, if there is no crosswalk, then as close as practicable
to the nearest line of the intersecting roadway,
(c) The Village in its direction and when traffic conditions warrant
such action give preference to traffic upon any of the streets
and highways under its jurisdiction over traffic crossing or enter-
ing such highway by erecting appropriate traffic control devices.
1-303 The Village to place signs on all streets and highways
The Village shall place and maintain such traffic-control devices, confor-
ming to its manual and specifications on all highways under its jurisdic-
tion as it shall deem necessary to indicate and to carry out the provi-
sions of this Chapter or to regulate, warn or guide traffic.
1-303.1 Signs on private roads and driveways
The owners of private property within a business district containing one
or more private roads or driveways from which vehicles may enter onto a
public highway or street shall post a stop sign pursuant to the Village
manual and specifications at such place as is designated on such private
road or driveway by the Chief of Police or his agent.
1-305 Obedience to traffic control devices
(a) Every person shall obey the instructions of any official traffic con-
trol device applicable thereto placed in accordance with this Chapter,
unless otherwise directed by a police officer, subhect to the excep-
tions granted the driver of an authorized emergency vehicle in this
Chapter.
(b) It is unlawful for any person to leave the roadway and travel across
private property to avoid an official traffic control device.
(c) No provision of this Chapter for which official traffic control devices
are required shall be enforced against an alleged violator if at the
time and place of alleged violation an official device is not in
proper position and sufficiently legible to be seen by an ordinarily
observant person. Whenever a particular section does not state
that official traffic control devices are required, such section
shall be effective even though no devices are erected or in place.

1-306 Traffic control signal legend
Whenever traffic is controlled by traffic-control signals exhibiting different
colored lights successively one at a time, or with lighted green arrows, only
the following colors shall be used and such terms and lights and lighted green
arrows sh•a11 indicate and apply to drivers of vehicles and pedestrians as
fol10."4s:
(a) Circular green - (alone)
1. Vehicular traffic facing the signal may proceed straight through
or turn right or left unless a sign at such place prohibits either
such turn. All vehicular traffic shall yield the right-of-way to
other vehicles and to pedestrians lawfully within the intersection
at the time such signal is exhibited.
2. Pedestrians facing the signal nay proceed across the roadway within
any marked or unmarked crosswalk unless directed otherwise by a ped
estrian ,signal as provided under Section 1-3o7of this Ordinance.
(b) Steady yellow
1. Vehicular traffic facing a steady yellow signal is thereby earned
that the related green movement is being terminated or that a red
indication will be exhibited immediately thereafter when vehicular
traffic may not enter the intersection.
2. Pedestrians facing a steady yellow signal unless otherwise directed
by !a pedestrian control signal ,'as provided in Section 1-307 of this
Ordinance are thereby advised that there is insufficient time to
cross the roadway and no pedestrian shall start to cross.
(c) Steady red indication
1. Vehicular traffic facing a steady red signal alone must stop at a
clearly marked stop line, but if none, before entering the cross-
walk on the near side of an intersection, or if none, then before
entering the intersection and shall remain standing until an indi-
cation to proceed is shown except as provided in paragraphs (c)
2 and (c) 3 of this Section.
2. Vehicular traffic facing a steady red signal at an intersection may
turn right after stopping as required by paragraph (c) 1 of this Sec-
tion, but shall yield the right-of-way to pedestrians lawfully within
an adjacent crosswalk and to other traffic lawfully using the inter-
section. However, local authorities may by ordinance and state author-
ities may by rule or regulation prohibit any such right turn against a
steady red signal at any intersection under their respective jurisdic-
tion. Such ordinance or rule or regulation shall be effective when a
sign is erected at such intersection giving notice of the ordinance or
rule or regulation prohibiting the right turn.
3. Vehicular traffic on a one-way highway facing a steady red signal may,
after stopping as required by paragraph (c) 1 of this Section, cautiously
enter the intersection and make a left turn onto an intersecting one-way
highway on which traffic travels to the left but shall yield the right-
of-way to pedestrians lawfully within an adjacent crosswalk and to other
traffic lawfully using the intersection. However, local authorities may
by ordinance and state authorities may be rule or regulation prohibit
any such left turn against a steady red signal at any intersection
within their respective jurisdiction. Such rule or regulation shall be
effective when a sign is erected at such intersection giving notice of
the ordinance or rule or regulation prohibiting the left turn.

(d) Green straight - through arrow (alone)
1. Vehicular traffic facing the signal may proceed straight through,
but shall not turn right or left. Such vehicular traffic shall
yield the right-of-way to other vehicles and to pedestrians legally
within theintersection at the time such signal is exhibited.
2. Pedestrians facing the signal may proceed across the roadway within
the appropriate marked or unmarked crosswalk unless directed other-
wise by a pedestrian signal as provided in Sectionl-307 of this
Ordinance.
(e) Green turn arrow (with circular green, with steady yellow, with steady
red, or with green straight-through arrow) -
1. Vehicular traffic facing the signal shall comply with the meaning
of the circular green, steady yellow, steady red, or green straight-
through arrow indication as if it were shown alone, except that such
vehicular traffic may cautiously enter the intersection to make the
movement indicated by the green turn arrow. Vehicular traffic shall
yield the right-of-way to pedestrians lawfully within a crosswalk and
to other traffic lawfully using the intersection.
2. Pedestrians facing such signal shall comply with the meaning of the
circular green, steady yellow, steady red, or straight-through arrow
indication as if it were shown alone, unless directed otherwise by
a_pedestrian signal as provided in Section1-3( of this Ordinance.
(f) In the event an official traffic control signal or flashing red signal is
erected and maintained at a place other than an intersection, the provi-
sions which by their nature can have no application. Any stop required
shall be at a traffic sign or a marking on the pavement indicating where
the stop shall be made,
1-307 Pedestrian control signals
Whenever special pedestrian control signals exhibiting the words "Walk" or
"Don't Walk" are in place such signals shall indicate as follows:
(a) WALK While the "Walk" indication is illuminated, pedestrians facing
such signal may proceed across the roadway in the direction of the
signal, and shall be given the right-of-way by the drivers of all
vehicles.
(b) DON'T WALK While the "Don't Walk" indication is illuminated, either
steady or flashing, no pedestrian shall start to cross the roadway in
the direction of the signal, but any pedestrian who has partly comple-
ted his crossing during the "Walk" indication shall proceed to a side-
walk, or to a safety island if one is provided.
I-308 Lane-control signals
Whenever lane-control signals are used in conjunction with official signs,
they shall have the following meanings:
(a) Downward-pointing green arrow. A driver facing this indication is permitted
to drive in the lane over which the arrow signal is located. Otherwise he
shall obey all other traffic controls present and follow normal safe-driving
practices.

(b) Red X symbol . A driver facing this indication shall not drive in the
lane over which the signal is located, and this indication shall modify
accordingly the meaning of all other traffic controls present. Other-
wise he shall obey all other traf'f'ic controls and follow normal safe
driving practices.
(c) Yellow X, (steady). A driver facing this indication should prepare to
vacate the lane over which the signal is located, in a safe manner to
avoid, if possible, occupying that lane when a steady red X is displayed.
1-309 Flashing signals
Whenever an illuminated flashing red or yellow signal is used in conjunction
with a traffic control device it shall require obedience by vehicular traffic
as follows:
1 . Flashing red (stop signal). When a red lens is illuminated with rapid
intermittent flashes, drivers of vehicles shall stop at a clearly marked
stop line, but if none, before entering the crosswalk on the near side
of the intersection, or if none, then at a point nearest the intersec-
ting roadway where the driver has a view of approaching traffic on the
intersecting roadway before entering the intersection and the right to
proceed shall be subject to the rules applicable after making a stop
at a stop sign.
2. Flashing yellow (caution signal). When a yellow lens is illuminated with
rapid intermittent flashes, drivers of vehicles may proceed through the
intersection or past such signal only with caution.
1-310 Display of unauthorized signs, signals, markings or advertising signs.
(a) No person shall place, maintain or display upon or in view of any high-
way any unauthorized sign, signal , marking or device which purports to be
or is an imitation of or resembles an official traffic-control device
which purports to be or is an imitation of or resembles an official traf-
fic-control device or railroad sign or signal, or which attempts to direct
the movement of traffic nor shall any person place, maintain or display
upon or in view of any street or highway any other sign which hides from
the view or interferes with the movement of traffic or the effectiveness
of any traffic control device.
(b) No person may place or maintain nor may any public authority permit upon any
street or highway any traffic sign or signal bearing thereon any commercial
advertising.
(c) Every such prohibited sign, signal or marking is a public nuisance and the
authority having jurisdiction over the highway is empowered to remove the
same or cause it to be removed without notice.
(d) No person shall sell or offer for sale any traffic control device to be
used on any street or highway in this Village which does not conform to
the requirements of this Chapter.
1-311 Interference with official traffic-control devices or signals
No person shall without lawful authority attempt to or in fact alter, deface,
injure, knock down, or remove any official traffic-control device or signal or
any inscription, shield, or insignia thereon, or any other part thereof.

1-312 Unlawful use or damage to highways, appurtenances and structures
It shall be unlawful for any person to wilfully injure or damage any public
highway or street or any bridge, culvert, sign, signpost or structure upon
or used or constructed in connection with any public highway or street for
the protection thereof or for protection or regulation of traffic thereon
by any wilfully unusual , improper or unreasonable use thereof, or by wil-
fully careless driving or use of any vehicle thereon, or by wilfully muti-
lation, defacing or destruction thereof.
1-313 Unlawful possession of highway sign or marker.
(a) The Village with reference to traffic control signs, signals, or markers
owned by the Department or local authority, are authorized to indicate the
ownership of the signs, signals, or markers on the back of such devices in
letters not less than 3/8 inch or more than 3/4 inch in height by use of a
metal stamp, etching, or other permanent means and, except for employees of
the Village, police officers, constractors and their employees engaged in a
highway construction contract or work on the highway, approved by the
Department or Village, it is a misdemeanor for any person to possess such sign,
signal , or marker so identified.
(b) Every person convicted of a violation of this Section shall be guilty of
a misdemeanor and fined not more than $500.00_

1-319 Location of intersection controlled by traffic controlled signals.
The intersections hereinafter described in Schedule XVI shall be designated as
intersections controlled by traffic control signal lights and said Schedule XVI
by this reference is made a part hereof.

DIVISION IV
ACCIDENTS
1-401 Accidents involving death or personal injuries.
(a) The driver of any vehicle involved in an accident resulting in injury
to or death of any person shall immediately stop such vehicle at the
scene of such accident, or as close thereto as possible and shall then
forthwith return to, and in every event shall remain at, the scene of
the accident until he has fulfilled the requirements of Section 1-403.
-Every such stop shall be made without obstructing traffic more than is
necessary.
(b) Any person who has failed to stop or comply with said requirements
shall , within 48 hours after such accident, or, if hospitalized and
incapacitated from reporting at any time during such period, within 48
hours after being discharged from the hospital,report the place of
accident, the date, the approximate time, his name, address, the
registration number of the vehicle driven and the names of the occu-
pants, if any, of such vehicle at the village police station. No
report made as required under this Subsection shall be used, directly
or indirectly, as a basis for the prosecution of any violation of Sub-
section (a) of this Section.
(c) Any person failing to comply with this Section shall be guilty of a
misdemeanor.
1-402 Accident involving damage to vehicle.
The driver of any vehicle involved in an accident resulting only in damage to
a vehicle which is driven or attended by any person shall immediately stop
such vehicle at the scene of such accident or as close thereto as possible,
but shall forthwith return to and in every event shall remain at the scene
of such accident until he has fulfilled the requirements of Section 1-403 & 1-404
of this Chapter. Every such stop shall be made without obstructing traffic
more than is necessary.
1-403 Duty to give information and render aid.
The driver of any vehicle involved in an accident resulting in injury to or
death of any person or damage to any vehicle which is driven or attended by
any person shall give his name, address and the registration number of the
vehicle he is driving and shall upon request and if available exhibit his
driver's license to the person struck or the driver of occupant of or person
attending any vehicle collided with and shall render to any person injured
in such accident reasonable assistance, including the carrying or the making
of arrangements for the carrying of such person to a physician, surgeon or
hospital for medical or surgical treatment, if it is apparent that such
treatment is necessary of if such carrying is requested by the injured person.
If none of the persons entitled to information pursuant to this Section is
in condition to receive and understand such information and no police officer
is present, such driver after rendering reasonable assistance shall forthwith
report such accident at the nearest office of a duly authorized police autho
rity, disclosing the information required by this Section.

1-404 Duty upon damaging unattended vehicle or other property.
The driver of any vehicle which collides with or is involved in an accident
with any vehicle which is unattended, or other property, resulting in any
damage to such other vehicle or property shall immediately stop and shall
then and there either locate and notify the operator or owner of such vehi-
cle or other property of his name, address and the registration number of
the vehicle he is driving or shall attach securely in a conspicuous place
on or in the vehicle or other property struck a written notice giving his
name, address and the registration number of the vehicle he is driving and
shall without unnecessary delay notify the nearest office of a duly autho-
rized police authority and shall make a report of such accident. Every
such stop shall be made without obstructing traffic more than is necessary.

1-407 Immediate notice of accident.
(a) The driver of a vehicle which is in any manner involved in an accident
described in this Chapter shall , if no police officer is present, give
notice of the accident by the fastest available means of communication to
the Village police department.
(b) Whenever the driver of a vehicle is physically incapable of giving imme-
diate notice of an accident as required in Subsection (a) and there was
another occupant in the vehicle at the time of the accident capable of
doing so, that occupant must give notice as required in Subsection (a).

1-409 False reports.
Any person who provides information in an oral or written report required by
this Article with knowledge of reason to believe that such information is
false shall be guilty of a misdemeanor.
1-410 When driver fails to report.
Whenever the driver of a vehicle is physically incapable of making a required
accident report and if there was another occupant in the vehicle at the time
of the accident capable of making a report, such occupant shall make or cause
to be made such report. If said driver fails for any reason to make such
report, the owner of the vehicle involved in such accident, shall , as soon as
he learns of the accident, make said report to the Village.

1-416 Furnishing copies - Fees,
The Village of Oak Brook may furnish copies of an Oak Brook Police Traffic
accident report that has been investigated by the Oak Brook Police and shall
be paid a fee of $5.00 for each such copy.

DIVISION V
TRANSPORTING ALCOHOLIC LIQUOR, AND RECKLESS DRIVING
-502 Transportation of alcoholic liquor Penalty
No person shall transport, carry, possess or have any alcoholic liquor within
the passenger area of any motor vehicle except in the original package and with
the seal unbroken. A person convicted of violating this Section shall be
guilty of a misdemeanor.
1-503 Reckless Driving
Reckless driving is unlawful, and for the purpose of this ordinance is const-
rued to mean the following: Any person who drives any vehicle upon a highway
carelessly disregarding the right or safety of others, or in a manner so as to
endanger any person or property.
L-504 Drag Racing
Drag Racing means the act of two or more individuals competing or racing on any
street or highway in this Village in a situation in which one of the motor vehi-
cles is beside or to the rear of a motor vehicle operated by a competing driver
and the one driver attempts to prevent the competing driver from passing or over-
- taking him; either by acceleration or manuever or one or more individuals compe-
ting in a race against time on any street or highway in this Village.
Drag racing is in violation of this Ordinance.

DIVISION VI
SPEED RESTRICTIONS
1-601 General speed restrictions
(a) No vehicle may be driven upon any street or highway of this Village at a
speed which is greater than is reasonable and proper with regard to traf-
fic conditions and the use of the street or highway, or endangers the
safety of any person or property. The fact that the speed of a vehicle
does not exceed the applicable maximum speed limit does not relieve the
driver from the duty to decrease speed when approaching and crossing an
intersection; when approaching and going around a curve; when approaching
a hillcrest; when travelling upon any narrow or winding roadway or when
special hazards exist with respect to pedestrians or other traffic or
by reason of weather or highway conditions:
Speed must be decreased as may be necessary to avoid colliding with any
person or vehicle on or entering the highway in compliance with legal
requirements and the duty of all persons to use due care.
(b) No person may drive a vehicle upon any highway of this Village at a
speed which is greater than the applicable statutory maximum speed limit.
(c) The maximum speed limit in an urban district for all vehicles is: 30
miles-per hour and 15 miles per hour in an alley.
(d) Unless some other speed restriction is established under this Ordinance
the maximum speed limit outside an urban district for any vehicle of the
first division or a vehicle of the second division designed or used for
the carrying of a gross weight of less than 8,000 pounds (including the
weight of the vehicle and maximum load) is 55 miles per hour.
(e) Unless some other speed restriction is established under this Ordinance,
the maximum speed limit outside an urban area for a vehicle of the second
division designed or used for the carrying of a gross weight of 8,000
pounds or more (including the weight of the vehicle and maximum load)
is 50 miles per hour.
(f) Provided that if the President and Board of Trustees by Ordinance set
other limits as provided by statute (Chapter 95-1/2, Section 11-604
I.V.C.) after an engineering or traffic survey, then such limits shall
govern the rate of speed on the streets indicated by such Ordinance.
Appropriate signs shall be posted showing such speed limits.

1-605 Special speed limit while passing schools
No person shall drive a motor vehicle at a speed in excess of 20 miles per
hour while passing a school zone or while travelling upon any public thorough-
fare on or across which children pass along to and from school during school
days when school children are present.

This Section shall not be applicable unless appropriate signs are pos-
ted upon streets and highways under its jurisdiction and maintained by
the Village. Such signs shall give proper due warning that a school
zone is being approached and shall indicate the school zone and the
maximum speed limit in effect during school days when school children
are present. Nothing in this Chapter shall prohibit the use of elec-
tronic speed-detecting devices with 500 feet of signs within a special
school speed zone indicating such zone, as defined in this Section,
nor shall evidence obtained thereby be inadmissible in any prosecution
for speeding provided the use of such device shall apply only to the
enforcement of the speed limit in such special school speed zone.
1-606 Minimum speed regulation
No person shall drive a motor vehicle at such a slow speed as to impede or
block the normal and reasonable movement of traffic except when reduced speed
is necessary for safe operation of his vehicle or in compliance with law.

1-612 Speed restrictions on specific streets
It is hereby determined upon the basis of an engineering and traffic investi-
gation that the maximum speed limit on Jorie Boulevard shall be and is hereby
established as thirty-five (35) miles per hour for vehicles in both divisions
as defined in this Ordinance.

DIVISION VII
DRIVING ON RIGHT SIDE OF ROADWAY - OVERTAKING AND PASSING, ETC.
1-701 Drive on right side of roadway - Exceptions.
(a) Upon all roadways of sufficient width a vehicle shall be driven upon the
right half of the roadway, except as follows:
1 When overtaking and passing another vehicle proceeding in the same
direction under the rules governing such movements;
2. When an obstruction exists making it necessary to drive tD the left
of the center of the roadway; provided, any person so doing shall
yield the right-of-way to all vehicles traveling in the proper dir-
ection upon the unobstructed portion of the roadway within such dis-
tance as to constitute an immediate hazard;
3. Upon a roadway divided into three marked lanes for traffic under the
rules applicable thereon;
^. Upon a roadway restricted to one way traffic;
5. Whenever there is a single track paved road on one side of the public
highway and two vehicles meet thereon, the driver on whose right is
the wider shoulder shall give the right-of-way on such pavement to
the other vehicle.
(b) Upon all roadways any vehicle proceeding at less than the normal speed of
traffic at the time and place and under the conditions then existing shall be
driven in the right-hand lane available for traffic, or as close as practicable
to the right hand curb or edge of the roadway, except when overtaking and pas-
sing another vehicle proceeding in the same direction or when preparing for a
left turn at an intersection or into a private road or driveway.
(c) Upon any roadway having 4 or more lanes for moving traffic and providing
for 2-way movement of traffic, no vehicle shall be driven to the left of the
center line of the roadway, except when authorized by official traffic-control
devices designating certain lanes to the left side of the center of the roadway
for use by traffic not otherwise permitted to use such lanes, or except as
permitted under Subsection (a) 2. However, this Subsection shall not be construed
as prohibiting the crossing of the center line in making a left turn into or
from an alley, private road or driveway.
1-702 Passing vehicles proceeding in opposite directions.
Drivers of vehicles proceeding in opposite directions, except as provided in
Section 1-701 shall pass each other to the right and upon roadways having
width for not more than one line of traffic in each direction each driver shall
give to the other at least one-half of the main traveled portion of the road-
way as nearly as possible.
1-703 Overtaking a vehicle on the left.
The following rules govern the overtaking and passing of vehicles proceeding
in the same direction, subject to those limitations, exceptions and special
rules otherwise stated in this Chapter:
(a) The driver of a vehicle overtaking another vehicle proceeding in the same
direction shall pass to the left thereof at a safe distance and shall not
again drive to the right side of the roadway until safely clear of the over-
taken vehicle. In no event shall such movement be made by driving off the
pavement or the main traveled portion of the roadway.

(b) Except when overtaking and passing on the right is permitted, the driver
of an overtaken vehicle shall give way to the right in favor of the overtaking
vehicle on audible signal and shall not increase the speed of his vehicle
until completely passed by the overtaking vehicle.
(c) The driver of a two wheeled vehicle may not in passing upon the left of
any vehicle proceeding in the same direction, pass upon the right of any
vehicle proceeding in the same direction unless there is an unobstructed lane
of traffic available to permit such passing manuever safely.
1-704 When overtaking on the right is permitted.
(a) The driver of a vehicle with three or more wheels may overtake and pass
upon the right of another vehicle only under the following conditions:
1. When the vehicle overtaken is making or about to make a left turn;
2. Upon a street or highway with unobstructed pavement not occupied by
parked vehicles of sufficient width for two or more lines of moving
vehicles in each direction.
3. Upon a one-way street, or upon any roadway on which traffic is res-
tricted to one direction of movement, where the roadway is free from
obstructions and of sufficient width for two or more lines of moving
vehicles.
(b) The driver of a two wheeled vehicle may not pass upon the right of any
other vehicle proceeding in the same direction unless the unobstructed pave-
ment to the right of the vehicle being passed is of a width of not less than
eight feet.
(c) The driver of a vehicle may overtake and pass another vehicle upon the
right only under conditions permitting such movement in safety. In no event
shall such movement be made by driving off the pavement or main-traveled por-
tion of the roadway.
1-705 Limitations on overtaking on the left.
No vehicle shall be driven to the left side of the center of the roadway in
overtaking and passing another vehicle proceeding in the same direction unless
authorized by the provisions of this Chapter and unless such left side is
clearly visible and is free of oncoming traffic for a sufficient distance
ahead to permit such overtaking and passing to be completely made without
interfering with the safe operation of any vehicle approaching from the oppo-
site direction or any vehicle overtaken_ In every event the overtaking vehi-
cle must return to an authorized lane of travel as soon as practicable and
in the event the passing movement involves the use of a lane authorized for
vehicles approaching from the opposite direction, before coming within 200
feet of any vehicle approaching from the opposite direction.
1-706 Further limitations on driving to the left of center of roadway.
(a) No vehicle may, in overtaking and passing another vehicle, be driven to
the left side of the roadway under the following conditions:
1. When approaching or upon the crest of a grade or a curve in the
highway where the driver's view is obstructed within such distance
as to create a hazard in the event another vehicle might approach
from the opposite direction,
2. When approaching within 100 feet of or traversing any intersection.
(b) The limitations in sub-paragraphs l and 2 do not apply upon a one-way
roadway nor upon a roadway with unobstructed pavement of sufficient width
for 2 or more lanes of moving traffic in each direction nor to the driver of
a vehicle turning left into or from an alley, private road or driveway when
such movements can be made with safety.

1-707 No Passing Zones.
(a) The Village is authorized to determine those portions of any
highway under its jurisdiction where overtaking and passing or dri-
ving to the left of the roadway would be especially hazardous and may be
appropriate signs or markings on the roadway indicate the beginning and
end of such zones, and when such signs or markings are in place and clearly
visible to an ordinarily observant person every driver of a vehicle shall
obey the directions thereof.
(b) Where signs or markings are in place to define a no-passing zone as set
forth in paragraph (a) no driver may at any time drive on the left side
of the roadway within the no-pissing zone or on the left side of any pavement
striping designed to mark such no-passing zone throughout its length except
as otherwise indicated in this section.
(c) The pavement striping designed to mark the no-passing zone may be crossed
(1) from the left hand lane for the purpose of completing a pass that was
begun prior to the beginning of the zone in the driver's direction of travel,
(2) from the right-hand lane when making a left turn into or from an alley,
private road or driveway when such movement can be made with safety, or (3)
under conditions set forth in Section 1-701 (a) 2 of this Division.
1-708 One-way roadways and rotary traffic islands.
(a) The Village with respect to highways under its jurisdiction
may designate any highway, roadway, part of a roadway or specific lanes upon
which vehicular traffic shall proceed in one direction at all or such times
as shall be indicated by official traffic control devices.
(b) Upon a roadway so designated for one-way traffic, a vehicle shall be dri-
ven only in the direction designated at all or such times as shall be indicated
by official traffic control devices.
(c) A vehicle passing around a rotary traffic island must be driven only to
the right of 'such island.
(d) Whenever any highway has been divided into two or more roadways by leaving
an intervening space or by a physical barrier or a clearly indicated dividing
section so constructed as to impede vehicular traffic, every vehicle must be dri-
ven only upon the right-hand roadway unless directed or permitted to use another
roadway by official traffic-control devices or police officers. No vehicle may
be driven over, across, or within any such dividing space, barrier, or section,
except through an opening in the physical barrier, or dividing section, or space,
or at a cross-over or intersection as established by public authority. -
1-709 Driving on roadways laned for traffic.
Whenever any roadway has been divided into two or more clearly marked lanes for
traffic the following rules in addition to all others consistent herewith shall
apply.
(a) A vehicle shall be driven as nearly as practicable entirely within a single
lane and shall not be moved from such lane until the driver has first ascertained
that such movement can be made with safety.
(b) Upon a roadway which is divided into three lanes and provides for two-way
movement of traffic, a vehicle shall not be driven in the center lane except
when overtaking and passing another vehicle traveling in the same direction
when such center lane is clear of traffic within a safe distance, or in pre-
paration for making a left turn or where such center lane is at the time allo-
cated exclusively to traffic moving in the same direction that the vehicle is
proceeding and such allocation is designated by official traffic control devices.

(c) Official traffic control devices may be erected directing specific
traffic to use a designated lane or designating those lanes to be
used by traffic moving in a particular direction regardless of the
center of the roadway and drivers of vehicles shall obey the direc-
tions of every such sign.
(d) Official traffic control devices may be installed prohibiting the
changing of lanes on sections of roadway and drivers of vehicles
shall obey the directions of every such device.
1-710 Following too closely.
(a) The driver of a motor vehicle shall not follow another vehicle more
closely than is reasonable and prudent, having due regard for the
speed of such vehicles and the traffic upon and the condition of
the highway.
(b) The driver of any motor vehicle of the second division or motor vehi-
cle drawing another vehicle when travelling upon a roadway outside of
a business or residence district shall not follow within 300 feet of
another motor vehicle of the second division or motor vehicle drawing
another vehicle. The provisions of this subdividion shall not be
construed to prevent overtaking and passing nor shall the same apply
upon any lane specially designated for use by motor vehicles of the
second division.
(c) Motor .vehicles being driven upon any roadway outside of a business or
residence district in a caravan or motorcade whether or not towing
other vehicles shall be so operated as to allow sufficient space between
each such vehicle or combination of vehicles so as to enable any other
vehicle to enter and occupy such space without danger. This provision
shall not apply to funeral processions.
1-711 Restrictions on use of controlled access highway.
(a) No person may drive a vehicle onto or from any controlled access high-
way except at entrances and exits established by public authority.
(b) The Village with respect to any controlled access highway under its
jurisdiction may prohibit the use of any such highways by pedestrians
(except in authorized areas or facilities), bicycles, farm tractors,
implements of husbandry, funeral processions, and any vehicle unable
to maintain the minimum speed for which the highway is posted, or
other non-motorized traffic or by any person operating a motor driven
cycle. The Village may also prohibit the use of such highway to school
buses picking up and discharging children and mail delivery vehicles
picking up or delivering mail. The Village shall erect and maintain
official signs on the controlled access highway on which such prohibi-
tions are applicable and when so erected, no person may disobey the
restrictions stated on such sign.

DIVISION VII
TURNING AND STARTING AND SIGNALS OF STOPPING AND TURNING
1-801 Required position and method of turning at intersections.
The driver of a vehicle intending to turn at an intersection shall do as
follows:
(a) Both the approach for a right turn and a right turn shall be made
as close as practical to the right-hand curb or edge of the roadway.
(b) The driver of a vehicle intending to turn left at any intersection
shall approach the intersection in the extreme left-hand lane law-
fully available to traffic moving in the direction of travel of
such vehicle, and after entering the intersection, the left turn
should be made so as to leave the intersection in a lane lawfully
available to traffic moving in such direction upon the roadway being
entered. Whenever practicable the left turn shall be made in that
portion of the intersection to the left of the center of the inter-
section.
(c) The Village in its jurisdiction may cause official traffic control
devices to be placed within or adjacent to intersections and there-
by require and direct that a different course from that specified

in-this Division be traveled by vehicles turning at an intersection,
and 'when such devices are so placed no driver of a vehicle shall turn
a vehicle at an intersection other than directed and required by
such devices.
1-802 Turning on curve or crest of grade prohibited.
No vehicle shall be turned so as to proceed in the opposite direction upon
any curve, or upon the approach to, or near the crest of a grade, where such
vehicle cannot be seen by the driver of any other vehicle approaching from
either direction within 500 feet.
1-803 Starting parked vehicle.
No person shall start a vehicle which is stopped, standing or parked unless
and until such movement can be made with reasonable safety.
1-804 When signal required.
(a) No person may turn a vehicle at an intersection unless the vehicle is in
proper position upon the roadway as required in Section 1-801 or turn a
vehicle to enter a private road or driveway, or otherwise turn a vehicle
from a direct course or move right or left upon a roadway unless and
until such movement can be made with reasonable safety. No person may
so turn any vehicle without giving an appropriate signal in the manner
hereinafter provided.
(b) A signal of intention to turn right or left when required must be
given continuously during not less than the last 100 feet travelled by
the vehicle before turning within a business or residence district, and
such signal must be given continously during not less than the last
200 feet travelled by the vehicle before turning outside a business or
residence district.
(c) No person may stop or suddenly decrease the speed of a vehicle without
first giving an appropriate signal in the manner provided in this
Chapter to the driver of any vehicle immediately to the rear when there
is opportunity to give such a signal.
(d) The electric turn signal device required in Section 2-208 of this Ordi-
nance must be used to indicate an intention to turn, change lanes or
start from a parallel parked position, but must not be flashed on
one side only on a parked car or disabled vehicle or flashed as a cour-
tesy or "do pass" signal to operators of other vehicles appraoching
from the rear. However, such signal devices

may be flashed simultaneously on both sides of a motor vehicle to indicate
the presence of a vehicular traffic hazard requiring unusual care in app-
roaching, overtaking and passing.
1-805 Signal by hand and armor signal device.
Any stop or turn signal when required herein shall be given either by means
of the hand and arm or by an electric turn signal device.
1-806 Method of giving hand and arm signals
All signals herein required by hand and arm shall be given from the left side
of the vehicle in the following manner and such signals shall indicate as
follows:
1. Left turn-Hand and arm extended horizontally.
2. Right turn-Hand and arm extended upward.
3. Stop or decrease of speed-Hand and arm extended downward.

DIVISION IX
RIGHT-OF-WAY
1-901 Vehicles approaching or entering intersection.
(a) When two vehicles approach or enter an intersection from different
roadways at approximately the same time, the driver of the vehicle
on the left must yield the right-of-way to the vehicle on the right.
(b) The right-of-way rule declared in paragraph (a) of this Section is
modified at through highways and otherwise as stated in this Chapter.
1-902 Vehicle turning left.
The driver of a vehicle intending to turn to the left within an intersection
or into an alley, private road, or driveway shall yield the right-of-way
to any vehicle approaching from the opposite direction which is so close as
to constitute an immediate hazard, but said driver, having so yielded may
proceed at such time as a safe interval occurs.
1-903 Vehicles entering stop crosswalk.
Where stop signs or flashing red signals are in place at an intersection or
flashing red signals are in place at a plainly marked crosswalk between inter-
sections, drivers of vehicles shall stop before entering the nearest cross-
walk and pedestrians within or entering the crosswalk at either edge of the
roadway shall have the right-of-way over vehicles so stopped. Drivers of
vehicles having so yielded the right-of-way to pedestrians entering or within
the nearest crosswalk at an intersection shall also yield the right-of-way
to pedestrians within any other crosswalk at the intersection.
1-904 Vehicle entering stop or yield intersection.
(a) Preferential right-of-way at an intersection may be indicated by stop
or yield signs as authorized in Section 1-302 of this Chapter.
(b) Except when directed to proceed by a police officer or traffic-control
signal, every driver of a vehicle appraoching a stop intersection indi-
cated by a stop sign shall stop at a clearly marked stop line, but if
none, before entering the crosswalk on the near side of the intersection,
or if none, then at the point nearest the intersecting roadway where the
driver has a view of approaching traffic on the intersecting roadway
before entering the intersection. After having stopped, the driver
shall yield the right-of-way to any vehicle which has entered the inter-
section from another roadway which is approaching so closely on the
roadway as to constitute an immediate hazard during the time when
the driver is moving across or within the intersection, but said driver
having so yielded may proceed at such time as a safe interval occurs.
The streets at the intersections described in Schedule III and IV
attached hereto and by this reference made a part hereof, shall be
designated as a stop street.
(c) The driver of a vehicle approaching a yield sign shall in obedience to
such sign slow down to a speed reasonable for the existing conditions
and, if required for safety to stop, shall stop at a clearly marked
stop line, but if none, before entering the crosswalk on the near side
of the intersection, or if none, then at the point nearest the inter-
secting roadway where the driver has a view of approaching traffic
on the intersecting roadway. After slowing or stopping, the driver
shall yield the right-of-way to any vehicle in the intersection or
approaching on another-roadway so closely as to constitute an immediate
hazard during the time such driver is moving across or within the
intersection.

(d) If a driver is involved in a collision at an intersection or inter-
feres with the movement of other vehicles after driving past a yield
right-of-way sign, such collision or interference shall be deemed
prima facie evidence of the driver's failure to yield right-of-way.
(e) The streets at the intersections described in Schedule V attached
hereto and by this reference made a part hereof, shall be designated
as yield streets.
1-905 Merging traffic,
At an intersection where traffic lanes are provided for merging traffic the
driver of each vehicle on the converging roadways is required to adjust his
vehicular speed and lateral position so as to avoid a collision with another
vehicle.
1-906 Vehicle entering highway from private road or driveway.
The driver of a vehicle about to enter or cross a highway from an alley,
building, private road or driveway shall come to a complete stop and yield
the right-of-way to all vehicles approaching on the highway to be entered.
The vehicle having so stopped and yielded may proceed at such time as a
safe interval occurs.
1-907 Operation of vehicles on approach of authorized emergency vehicles.
(a) Upon the immediate approach of an authorized emergency vehicle making
use of audible and visual signals meeting the requirements of this Chap-
ter or a police vehicle properly and lawfully making use of an audible
or visual signal, the driver of every other vehicle on the same roadway
shall yield the right-of-way and shall immediately drive to a position
parallel to, and as close as possible to, the right hand edge or curb of
the highway clear of any intersection and shall stop if possible and
remain in such position until the authorized emergency vehicle has
passed, except when otherwise directed by a police officer.
(b) This Section shall not operate to relieve the driver of an authorized
emergency vehicle from the duty to drive with due regard for the safety
of all persons using the highway.

1-913 Prohibited turns.
It shall be unlawful for the operator of any vehicle to turn left or right
at any place where such turns are prohibited by ordinance as listed in
"Schedule IX". Such prohibition shall be indicated by appropriate signs.

DIVISION X
PEDESTRIANS RIGHTS AND DUTIES
1-1001 Pedestrian obedience to traffic control devices and traffic regulations.
(a) A pedestrian shall obey the instructions of any official traffic con-
trol device specifically applicable to him, unless otherwise directed,by a
police officer.
(b) Pedestrians shall be subject to traffic and pedestrian control signals
provided in Sections 1-306 and 1-307 of this Chapter, but at all other places
pedestrians shall be accorded the privileges and shall be subject to the
restrictions stated in this Division.
1-1002 Pedestrians' right-of-way at crosswalks
(a) When traffic control signals are not in place or not in operation the
driver of a vehicle shall yield the right of way, slowing down or stopping
if need be to so yield, to'a pedestrian crossing the roadway within a cross-
walk when the pedestrian is upon the half of the roadway upon which the
vehicle is traveling, or when the pedestrian is approaching so closely from the
opposite half of the roadway as to be in danger.
(b) Whenever any vehicle is stopped at a marked crosswalk or at any unmarked
crosswalk at an intersection to permit a pedestrian to cross the roadway, the
driver of any other vehicle approaching from the rear shall not overtake and
pass such stopped vehicle.
(c) Whenever stop signs or flashing red signals are in place at an intersec-
tion or at a plainly marked crosswalk between intersections, pedestrians shall
have the right-of-way over drivers of vehicles as set forth in Section 1-904.
(d) Pedestrians right-of-way on sidewalks. The driver of a vehicle emerging
from or entering an alley, building, private road or driveway shall yield the
right-of-way to any pedestrian approaching on any`sidewalk or any sidewalk
area extending across such alley, building entrance, road or driveway.
1-1003 Crossing at other than crosswalks.
(a) Every pedestrian crossing a roadway at any point other than within a marked
crosswalk or within an unmarked crosswalk at an intersection shall yield the
right-of-way to all vehicles upon the roadway.
(b) Any pedestrian crossing a roadway at a point where a pedestrian tunnel or
overhead pedestrian crossing has been provided shall yield the right-of-way to
all vehicles upon the roadway.
(c) Notwithstanding the foregoing provisions of this Section every driver of a
vehicle shall exercise due care to avoid colliding with any pedestrian upon any
roadway and shall give warning by sounding the horn when necessary and shall
exercise proper precaution upon observing any child or any obviously confused
or incapacitated person upon a roadway.

1-1004 Blind persons - Right-Of-Way
Any blind person who is carrying in a raised or extended position a cane or
walking stick, which is white in color or white tipped with red, or who is
being guided by a dog, shall have the right-of-way in crossing any street
or highway, whether or not traffic on such street or highway is controlled
by traffic signals, anything in this Ordinance to the contrary notwithstan-
ding. The driver of every vehicle approaching the place where a blind per-
son, so carrying such a cane or walking stick or being so guided, is Gros-
sing a street or highway shall bring his vehicle to a full stop and before
proceeding shall take such precautions as may be necessary to avoid injury
to the blind person. The provisions of this Section shall not apply to a
blind person who is not so carrying such a cane or walking stick or who is
not guided by a dog, but the other provisions of this Ordinance relating to
pedestrians shall then be applicable to such person. However, the failure of
a blind person to so use or carry such a cane or walking stick or to be
guided by a guide dog when walking on streets, highways or sidewalks shall
not be considered evidence of contributory negligence.
1-1005 Pedestrians to use right half of crosswalks
Pedestrians shall move, whenever practicable, upon .the right half of cross-
walks.
1-1006 Pedestrians soliciting rides or business
(a) No person shall stand in a roadway for the purpose of soliciting a ride
from the driver of any vehicle.
(b) No person shall stand on or in the proximity of a roadway for the pur-
pose of soliciting employment, business, or contributions from the occupant
of any vehicle.
(c) No person shall stand on or in the proximity of a roadway for the pur-
pose of soliciting the watching or guarding of any vehicle while parked or
about to be parked on a street or highway.
1-1007 Pedestrians walking on highways.
(a) Any person walking along and upon improved highways shall keep on the left
of the paved portion, or on the left shoulder thereof, and upon meeting a vehicle
when walking on such paved portion shall step off to the left.
(b) Where sidewalks are provided, it is unlawful for any pedestrian to walk
along and upon an adjacent roadway except at a crosswalk.
(c) It is unlawful for any pedestrian who is under the influence of intoxicating
liquors to be upon any highway of this Village.

SPECIAL STOPS REQUIRED
1-1204 Stop and yield signs
(a) Preferential right-of-way at an intersection may be indicated
by stop signs or yield siqns as authorized in Section 1-302
of this Ordinance.
(b) Except when directed to proceed by a police officer or traffic
control signal, every driver of a vehicle approaching a stop
intersection indicated by a stop sign shall stop before enter-
ing the crosswalk, shall stop at a clearly marked stop line,
but if none, then at the point nearest the intersecting road-
way before entering the intersection.
(c) The driver of a vehicle approaching a yield sign if required
for safety to stop shall stop before entering the crosswalk
on the near side of the intersection or, in the event there
is no crosswalk, at a clearly marked .stop line, but if none,
then at the point nearest the intersecting roadway, where
the driver has a view of approaching traffic on the intersec-
ting roadway.
1-1205 Emerging from alley, building, provate road or driveway.
The driver of a vehicle emerging from an alley, building, private
road or driveway within an urban area shall stop such vehicle imme-
diately prior to driving into the sidewalk area extending across
such alley, building entrance, road or driveway, or in the event
there is no sidewalk area, shall stop at the point nearest to street
to be entered where the driver has a view of approaching traffic
thereon, and shall yield the right-of-way to any pedestrian as may
be necessary to avoid collision, and upon entering roadway shall
yield the right-of-way to all vehicles approaching on such
roadway.
DIVISION XIII
STOPPING, STANDING AND PARKING
1-1301 Stopping, standing or parking
(a) Upon any highway or street, no person shall stop, park or leave standing
any vehicle, whether attended or unattended, upon the roadway when it is
practicable to stop, park or so leave such vehicle off such part of the road-
way, but in every event an unobstructed width of the roadway opposite a standing
vehicle shall be left for the free passage of other vehicles and a clear view
of such stopped vehicle shall be available from a distance of 200 feet in each
direction upon such highway.
(b) The Village with respect to highways under its jurisdiction or for the main-
tenance of which it is responsible may place signs prohibiting or restricting
the stopping, standing or parking of vehicles on any highway where in its opinion
such stopping, stanidng or parking is dangerous to those using the highway or
whi7:e the stopping, standing or parking of vehicles would unduly interfere with
the free movement of traffic thereon. Any such regulations. adopted by the Village
regarding the stopping, standing or parking of vehicles upon any specified street,
streets or highways become effective at the time of the erection of appropriate
signs indicating such regulations.
_ (c) This Section does not apply to the driver of any vehicle which is disabled
while on the roadway in such manner and to such extent that it is impossible to
avoid stopping and temporarily leaving such disabled vehicle in such position.
However, at least one door of any motor vehicle permitted to stand unattended on
the roadway shall be left unlocked.
1-1302 Officers authorized to remove illegally stopped vehicles.
(a) Whenever any police officer finds a vehicle standing upon a highway in viola-
tion of any of the provisions of this Ordinance such officer is authorized to move
such vehicle, or require the driver or other person in charge of the vehicle to
move the same, to a position off the paved or improved or main-traveled part
of such highway.
(b) Any police officer is hereby authorized to remove or cause to be removed to
a place of safety at the expense of the owner any unattended, abandoned or dis-
abled vehicle left standing upon any highway, bridge, causeway, or elevated struc-
ture or within a tunnel underpass or subway in such a position or under such cir-
cumstances as to obstruct the normal movement of traffic, or any vehicle left
unattended on any street or highway in this village for a period of 24 hours or
more. The same authority is also granted regarding any vehicle found Upon any
highway when:
1. Report has been made that such vehicle has been stolen or taken without
the consent of its owner, or
2. The person or persons in charge of such vehicle are unable to provide
for its custody or removal , or
3. When the person driving or in control of such vehicle is arrested for an
alleged offense for which the officer is required by law to take the
person arrested before a proper Judicial official without unnecessary
delay.
1-1303 Stopping, standing or parking prohibited in specified places
(a) Except when necessary to avoid conflict with other traffic, or in compli-
ance with law or the directions of a police officer or official traffic control
device, no person shall:

1 . Stop, stand or park a vehicle:
a. On the -roadway side of any vehicle stopped or parked at the
edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within 30 feet of
points on the curb immediately opposite the ends of a safety
zone, unless a different length is indicated by signs or markings.
f. Alongside or opposite any street excavation or obstruction when
stopping, standing or parking would obstruct traffic;
g. Upon any bridge or other elevated structure or within a highway
tunnel, underpass or subway;
h. At any place where official signs prohibit stopping.
i. Along the side of any of the streets or highways within the portions
thereof hereinafter designated on "Schedule VII" hereof, which by
this reference is made a part hereof.
2. Stand or park a vehicle, whether occupied or not, except momentarily to
pick up or discharge passengers:
a. In front of a public or private driveway;
b. Within 15 feet of a fire hydrant;
c. Within 20 feet of a crosswalk at an intersection;
d. Within 30 feet upon the approach to any flashing signal, stop sign,
yield sign, or traffic control signal located at the side of a road-
way.
e. Within 20 feet of the driveway entrance to any fire station and on the
side of a street opposite the entrance to any fire station within 75
feet of such entrance. (when properly sign-posted).
f. At any place where official signs prohibit standing.
3. Park a vehicle, whether occupied or not, excepttemporarily for the pur-
pose of and while actually engaged in loading or unloading merchandise
or passengers:
a. At any place designated a fire lane, or in Schedule XV.
b. At any place where official signs prohibit parking.
c. When four inches of snow falls within any two hour period.
(b) No person other than a police officer, as provided in Section 1-1302 of
this Ordinance, shall move a vehicle into any such prohibited area or away
from a curb such distance as is unlawful or start or cause to be started the motor
of any motor vehicle, or shift, change, or move the levers, brake starting device,
gears or other mechanism of a parked motor vehicle to a position other than that
in which it was left by the owner or driver of such vehicle, or attempt to do so.
-1304 Angle parking-One-way roadways
(a) On streets, angle parking may be permitted by ordinance on thatportion of
the street under the jurisdiction and control of the Village. Where angle par-
king is not so permitted, every vehicle stopped or parked upon a roadway where
there is an adjacent curb shall be so stopped or parked with the right-hand wheels of
such vehicle parallel with and within 12 inches of the right-hand curb.
(b) Except when otherwise provided by ordinance, every vehicle stopped or parked
upon a one-way roadway shall be so stopped or parked parallel to the curb or edge
of the roadway, in the direction of authorized traffic movement, with its right-
hand wheels within 12 inches of the right-hand curb or edge of the roadway, or
its left-hand wheels within 12 inchesof the left-hand curb or edge of the roadway.
1-1305 Lessors of visitor vehicle -- Duty upon receiving notice of violation of this
Ordinance-or' local parking regulation.
Every person in whose name a vehicle is registered pursuant to law and who leases
such vehicle to others, after receiving written notice of a violation of this
Ordinance or a parking regulation of a local authority involving such vehicle, shall
upon request provide such police officers as have authority of the offense, and the
court having jurisdiction thereof, with a written statement of the name and address
of the lessee at the time of such offense and the identifying number upon the regi-
stration plates of such vehicle.

1-1311 Street cleaning
It shall be unlawful to park any vehicle on any public street or portion thereof
in the Village at any time when such street is being cleaned or snow removed. '
Signs indicating such cleaning shall be posted before such work is done.
1-1312 Time limit parking
It shall be unlawful to park any vehicle for a period of time in excess of the
amount of time designated by ordinance and so posted.
1-1313 Loading zone
It shall be unlawful for the driver of a vehicle to stand a passenger vehicle for
a period of time longer than is necessary for the loading or unloading of passen-
gers, in any place designated by the President and Board of Trustees as a loading
zone and marked as such, or in any of the following designated places:
1. At any place not to exceed seventy-five-feet along the curb before
the entrance to any motel or hotel at any time.
2. At any place not to exceed seventy-five feet along the curb line
before the entrance to a public building between eight o'clock AM
and six o'clock PM except on a Sunday.
3. Directly in front of the entrance to any theatre at any time that the
theater is open.
1-1314 All night parking
No person shall park any vehicle between the hours of 2:OOAM and 6:OOAM of any
day, except physicians on emergency calls, on any public streets in the munici-
pality.
1-1315 Cab stands and bus stands
No vehicle other than a licensed taxicab shall be parked in any area designated by
ordinance as a cab stand; and no vehicle other than a bus shall be parked in a
place so designated as a bus loading zone.
1-1316 Parking motor vehicles on private property
It shall be unlawful to park any motor vehicle on any private property without the
consent ofthe owner of th=_property.
1-1317 Vehicles for sale
It shall be unlawful to park any vehicle upon any street for the purpose of dis-
playing it for sale, or to park any vehicle upon any street from which vehicle
merchandise is peddled or sold.
1-1318 Parking on municipally owned or leased property
Parking is prohibited at the following places:
1 . Upon municipally owned or leased property except alleys and streets so
designated by posted signs as being for public parking, unless the vehicle
displays an authorized Village parking emblem registered and issued to
village employees by the Village Clerk.
2. Upon municipally owned or leased property designated by posted signs as
"Visitors Parking" except while actually having or carrying on bona fide busi-
ness with the Village during the time the vehicle is parked within said desig-
nated area.

1-1319 Municipal Parking Permits
Municipal parking permits may be issued to Village residents authorizing the par-
king of private vehicles in the municipally owned or leased properties described
in Schedule XIV and made a part of this Ordinance.
1. Such permits shall be deemed properly displayed when affixed to the
rear window of the vehicle.
2. These permits shall be issued by the Village Clerk with or without fees
and for time intervals as determined from time to time by the Board of
Trustees.
3. It shall be unlawful for any privately owned vehicle to be parked in
said areas without proper display of a valid Municipal Parking Permit.
1-1320 Procedure in handing parking violation
The police department is authorized to place violation notices on every car
parked in violation of this Division of this ordinance and to cause summon-
ses or warrants or a notice to appear to be issued to commence prosecution
against violators, except that the police department need not cause such pro-
ceedings to commence against any violation of the provisions of Sections 1-1303,
1-1312, 1-1304, or 1-1313 of this Division who appears at the Oak Brook Village
Hall and pays the sum of $5.00 to the Village Clerk no later than thirty days
after the time of the violation as it is indicated on the violation notice
issued by the police department. If payment of the sum of $5.00 is not made
within a thirty day period after the time of the violation, then the sum of
$10.00 must be paid within the next thirty day period or the police department
is directed to issue the appropriate summonses or warrants or notices to appear
and proceed with the matter in the same manner as other violations of this
Ordinance.

DIVISION XIV
MISCELLANEOUS LAWS
1-1401 Unattended motor vehicles
No person driving or in charge of a motor vehicle shall permit it to stand
unattended without first stopping the engine and removing the ignition key,
and when standing upon any perceptible grade, without effectively setting
the brake and turning the front wheels to the curb or side of the highway.
1-1402 Limitations on backing.
(a) The driver of a vehicle shall not back the same unless such movement
can be made with safety and without interfering with other traffic.
(b) The driver of a vehicle shall not back the same upon any controlled-
access highway.
1-1403 Riding on motorcycles.
The operator of a motorcycle shall ride only astride the permanent and regular
seat or saddle attached thereto, and the operator shall not permit more than one
other person to ride thereon nor shall such other person ride on the motorcycle
unless it is designed to carry 2 people, in which event the passenger shall also
ride astride the permanent and regular seat or saddle if it is designed for 2
persons, or astride another seat or saddle firmly attached to the rear of the
operator; however any seat or saddle designed for a passenger must be equipped
with permanent handgrips and, in addition, the motorcycle must be equipped with
footrests adjusted to fit such passenger. A sidecar may be attached to a motor-
cycle in which additional persons may ride.
1-1404 Special equipment for persons riding motorcycles
The operator of a motorcycle and every passenger thereon shall be protected by
glasses, go gles or a transparent shield. The Illinois Department of Transpor-
tation shall, pursuant to law, determine the standards for this equipment.
These standards shall establish requirements based upon those set forth in
Vehicle Equipment Safety Commission Regulation VESC-8, "Minimum Requirements for
Motorcyclists" Eye Protection".
'-1405 Required equipment on motorcycles
(a) No person shall operate any motorcycle with handlebars more than 15 inches
in height above that portion of the seat or saddle occupied by the operator.
(b) Any motorcycle carrying a passenger, other than in a sidecar or enclosed
cab, shall be equipped with permanent handgrips on the seat or saddle carrying
such passenger, and with footrests adjusted to fit such passenger.
1-1406 Obstruction of driver's view or driving mechanism
(a) No person may drive a vehicle when it is so loaded, or when there are in
the front seat such number of persons, as to obstruct the view of the driver
to the front or sides of the vehicle or as to interfere with the driver's con-
trol over the driving mechanism of the vehicle.
(b) No passenger in a vehicle may ride in such position as to interfere with
the driver's view ahead or to the sides, or to interfere with his control
over the driving mechanism of the vehicle.
(c) No passenger on a school bu's may ride or stand in a position as tointer-
fere with the driver's view ahead or to the side or to the rear, or to inter-
fere with his control of the driving mechanism of the bus.

1-1407 Opening vehicle doors.
No person shall open the door of a vehicle on the side available to moving
traffic unless and until it is reasonably safe to do so, and can be done
without interfering with the movement of other traffic nor shall any person
leave a door open on the side of a vehicle available to moving traffic for
a period of time longer than necessary to load or unload passengers.
1-1408 Riding in house trailers.
No person or'persons shall occupy a house trailer while it is being moved upon
a public highway.
1-1410 Coasting prohibited
(a) The driver of any motor vehicle traveling upon a down grade shall not
coast with the gears or transmission of such vehicle in neutral.
(b) The driver of a motor vehicle of the second division when traveling upon
a down grade shall not coast with the clutch disengaged.
1-1411 Following fire apparatus prohibited
The driver of any vehicle other than one on official business shall not follow
any fire apparatus traveling in response to a fire alarm closer than 500 feet
or drive into or park such vehicle within the block where fire apparatus has
stopped in answer to a fire alarm.
1-1412 Crossing fire hose
No vehicle shall be driven over any unprotected hose of a fire department when
laid down on any street, private road or driveway to be used at any fire or
alarm of fire, without the consent of the fire department official in command.
1-1412.1 Driving upon sidewalk
No person shall drive any motor-driven vehicle upon a sidewalk or sidewalk area
except upon a permanent or duly authorized temporary driveway, or for routine
maintenance, utility or emergency service, or for special delivery or pick-up
involving goods or customer services:
,-1413 Putting glass, etc. , on highway prohibited
(a) No person shall throw or deposit upon any highway any glass bottle, glass,
nails, tacks, wire, cans, or any other substance likely to injure any person, ani-
mal, or vehicle upon such street or highway.
(b) Any person who drops, or permits to be dropped or thrown upon any street or
highway any destructive or injurious material shall immediately remove the same
or cause it to be removed.
(c) Any person removing wrecked or damaged vehicles from a street or highway shall
remove any injurious substance dropped upon the highway from such vehicle.
(d) No driver of any vehicle will cause anv substance as mud, dirt or stones to
be tracked and deposited upon any paved surface of the street or highway. Any
person who violates this sub-section (d) shall be liable for cleaning such debris
from the roadway in addition to any other fine or penalty for violation of this
Ordinance.

1-1414 Approaching, overtaking, and passing school bus
(a) The driver of a vehicle upon a highway upon meeting or overtaking from
either direction, any school bus which has stopped on the highway for the
purpose of receiving or discharging any school children shall stop the vehicle
before reaching the school bus when there is in operation on the school bus
a visual signal as specified in Section 2-213 of this Ordinance and the driver
shall not proceed until the school bus resumes motion or the driver of the vehi-
cle is signaled by the school bus driver to proceed or the visual signals are no
longer actuated.
(b) Every school bus when used for the transportation of school children must
comply with the color requirements established by the Superintendent of Public
Instruction and shall bear upon the front and rear thereof plainly visible signs
containing the words "SCHOOL BUS" in letters not less than 8 inches in height
and in addition shall be equipped with visual signals meeting the requirements
of Section 2-213 of this Ordinance which shall be actuated by the driver of the
school bus immediately preceding the point at which the school bus stops for
the purpose of loading or discharging passengers. Such visual signals shall be
actuated by the driver continuously during not less than the last 100 feet tra-
veled by the school bus. Such visual signals must remain actuated when children
are loading or unloading from a school bus which is stopped on a roadway. At no
other time shall these visual signals be actuated.
(c) The driver of a vehicle upon a highway of which the roadways for traffic
moving in opposite directions are separated by a strip of ground which is not
surfaced or suitable for vehicular traffic need not stop his vehicle upon meeting
or passing a school bus which is on the opposite roadway; and need not stop his
vehicle when driving upon a controlled access highway when a school bus is stop-
ped in a loading zone adjacent to the surfaced or improved part ofthe controlled
access highway where pedestrians are not permitted to cross such controlled
access highway.
(d) When a school bus is being operated upon a highway for purposes other than
the actual transportation of children either to or from school or in connection
with any school activity, all signs thereon indicating "SCHOOL BUS" shall be
covered or concealed.
1-1415 School buses - Stopping, loading and discharging passengers on highways having
four or more lanes.
A school bus traveling on a highway having 4 or more lanes for vehicular traf-
fic shall stop for the loading or discharging of passengers only on the right
side of the highway and when so stopped shall load or discharge only those
passengers whose residences are located to the right of the highway. The
routes of school buses shall be so arranged that no child shall be required
to cross such a 4 or more lane highway to board a school bus or to reach his
residence after leaving the bus.
This Section shall not apply when children are escorted by competent persons
designated by the school authorities or by law enforcement officers.
1-1416 Obstructing person in highways
(a) No person shall wilfully and unnecessarily hinder, obstruct or
delay, nor shall wilfully and unnecessarily attempt to delay, hinder or
obstruct any other parson in lawfully driving or traveling along or upon
any highway within this Village nor shall offer for barter or sale merchan-
dise on said highway so as to interfere with the effective movement of traffic.
1-1417 Travel regulated
It shall be unlawful for any person to drive or cause to be driven a vehicle
of any description in or upon any portion of the highway immediately after
the same has been dragged and before such portion of the highway shall have
partially dried out or frozen; provided, that nothing in this Section shall apply
in those instances where it is impossible to drive with safety at one side of the
road, injurious to the work accomplished by use of the road drag or where a vehicle
does not make a rut nearer than nine (9) feet from the center of the dragged
portion of the road.

1-1418 Farm tractor operation regulated
No person shall operate a farm tractor on a highway unless such tractor is
being used as an implement of husbandry in connection with farming operations.
For the purpose of this Section, use of a farm tractor as an implement of
husbandry in connection with farming operations shall be deemed to include
use of such tractor in connection with the transportation of agricultural
products and of farm machinery, equipment and supplies as well as transpor-
tation of such tractors in connection with the obtaining of repairs thereto,
and the towing of a registered truck not more than 8,000 pounds for use as
return transportation after the tractor is left at the place of work or
repair.
1-1420 Funeral processions
(a) Funeral processions have the right-of-way at intersections when vehicles
comprising such procession have their headlights lighted, subject to the fol-
lowing conditions and exceptions;
(1) Operators of vehicles in a funeral procession shall yield the right-
of-way upon the approach of an authorized emergency vehicle giving an
audible or visible signal;
(2) Operators of vehicles in a funeral procession shall yield the right-
of-way when directed to do so by a traffic officer;
(3) The operator of the leading vehicle in a funeral procession shall
comply -with stop signs and traffic control signals but when the leading
vehicle has proceeded across an intersection in accordance with such sig-
nal or after stopping as required by the stop sign, all vehicles, regard-
less of the sign or signal and the leading vehicle and the vehicles in
procession shall proceed with due caution.
(b) The operator of a vehicle not in the funeral procession shall not drive
his vehicle in the funeral procession except when authorized to do so by a
traffic officer or when such vehicle is an authorized emergency vehicle giv-
ing audible or visible signal.
(c) Operators of vehicles not a part of a funeral procession may not form
a procession or convoy and have their headlights lighted for the purpose
of securing the right-of-way granted by this Section to funeral processions.
(d) The operator of a vehicle not in a funeral procession may overtake and
pass the vehicles in such procession if such overtaking and passing can be
accomplished without causing a traffic hazard or interfering with such pro-
cession.
(e) The lead vehicle in the funeral procession may be equipped with a flas-
hing amber light which may be used only when such vehicle is used as a lead
vehicle in such procession. Vehicles comprising a funeral procession may
utilize funeral pennants or flags or windshield stickers to identify the
individual vehicles in such a procession.
1-1421 Conditions for operation - Ambulance
No person shall operate an ambulance, which for purposes of this Ordinance
shall include any motor vehicle primarily designed and used for conveyance
of sick or injured persons, in a manner not conforming to a provision of
the motor vehicle laws and regulations of this Village as such provision
applies to motor vehicles in general, except in compliance with the fol-
lowing conditions:
1. The person operating the ambulance shall be either responding to a
bona fide emergency call or specifically directed by a licensed physi-
cian to disregard traffic laws in operating the ambulance during and
for the purpose of the specific trip or journey that is involved.
2. The ambulance shall be equipped with a siren producing an audible
signal of an intensity of 100 decibels at a distance of 50 feet from
said siren, and with a lamp emitting an oscillating, rotating or flas-
hing red beam directed in part toward the front of the vehicle and
containing a power rating of at least 100 amps;

J. The aforesaid siren and lamp shall be in full operation at all times
during such trip or journey;and
4. Whenever the ambulance is operated at a speed in excess of 40 miles
per hour, the ambulance shall be operated in complete conformance with
every other motor vehicle law and regulation of this Village in which the
ambulance is operated, relating to the operation of motor vehicles, as
such provision applies to motor vehicles in general , except laws and
regulations pertaining to compliance with official traffic-control devi-
ces or to vehicular operation upon the right half of the roadway.
1-1422 Violation Penalty
A person who operates an ambulance in violation of Section 1-1421 shall be
liable for the penalty prescribed by the aoplicable Ordinance or regulation
of this Village with which he failed to conform in violation of this Ordi-
nance notwithstanding any provision of such Ordinance or regulation exemp-
ting therefrom the driver of an authorized emergency vehicle when respon-
ding to an emergency call.
1-1428 Clinging to Vehicles
It shall be unlawful for any person on any street riding a bicycle, motor-
cycle, sled, or any toy vehicle to cling to or attach himself or his vehicle
to any moving motor vehicle or wagon.
1-1429 "U" Turn
It shall be unlawful for the operator of any vehicle to turn such vehicle so
as to proceed in the opposite direction or to make a "U Turn. Such prohibi-
tion shall be indicated by appropriate signs. The named street and/or intersection
hereafter described shall be designated and sign posted as "No U Turn" and are
listed on Schedule X and by reference made a part hereof.
1-1430 Frightening horses
No person in a motor vehicle or operating a motor vehicle shall frighten or
cause to frighten any horse, and at a signal from a person in charge of
the frightened horse the driver of the motor vehicle shall bring his motor
vehicle to a stop in a safe position and maintain said position until said
horse has passed.

ARTICLE II
EQUIPMENT OF VEHICLES
DIVISION I
GENERAL PROVISIONS
2-101 Scope and effect of equipment requirements
(a) It is unlawful for any person to drive or move or for the ownerto cause or
knowingly permit to be driven or moved on any highway any vehicle or combina-
tion of vehicles which is in such unsafe condition as to endanger any person
or property, or which does not contain those parts or is not at all times
equipped with such lamps and other equipment in proper condition and adjust-
ment as required in this Ordinance which is equipped in any manner in viola-
tion of this Ordinance or for any person to do any act forbidden or fail to
perform any act required under this Ordinance.
(b) The provisions of this Ordinance with respect to equipment on vehicles
shall not apply to implements of husbandry, road machinery, road rollers or
farm tractors or to farm-wagon type trailers having a fertilizer spreader
attachment permanently mounted thereon, having a gross weight of not to
exceed 10,000 pounds and used only for the transportation of bulk fertilizer
or to farm-wagon type tank trailers of not to exceed 1200 gallons capacity,
used during the liquid fertilizer season as field-storage "nurse tanks"
supplying the fertilizer to a field applicator and moved on highways only for
bringing the fertilizer from a local source of supply to farm or field or
from one farm or field to another.
DIVISION II
LIGHTS AND LAMPS
2-201 When lighted lamps are required.
(a) When upon any highway in this Village every motorcycle shall at all times
exhibit at least one lighted lamp, showing a white light, commonly known as a
driving lamp, visible for at least 500 feet in the direction the motorcycle is
proceeding. All other motor vehicles shall , during the period from sunset to
sunrise, or at any other time when visibility is so limited as to require the
use of lights for safety, exhibit 2 such lighted driving lamps showing white
lights, or lights of a yellow or amber tint, visible for at least 500 feet in
the direction the motor vehicle is proceeding. Parking lamps may be used in
addition to but not in lieu of any such driving lamps. Every motor vehicle,
trailer, or semi-trailer shall also exhibit at least 2 lighted lamps, commonly
known as tail lamps, which shall be mounted on the left rear and right rear of
the vehicle so as to throw a red light visible for at least 500 feet in the re-
verse direction, except that a motorcycle or a truck tractor or road tractor
manufactured before January 1 ,1968 need be equipped with only one such lamp.
(b) Either a tail lamp or a separate lamp shall be so constructed and placed
as to illuminate with a white light a rear registration plate when required
and render it clearly legible from a distance of 50 feet to the rear. Any
tail lamp or tail lamps together with any separate lamp or lamps for illumi-
nating a rear registration plate, shall be so wired as to be lighted whenever
the driving lamps or auxiliary driving lamps are lighted.
2-202 Clearance, identification and side marker lamps
(a) Every motor vehicle of the second division, the length of which together
with any trailer or trailers in tow thereof, is more than 25 feet or the width
of which is more than 80 inches exclusive of mirrors, bumpers and other

required safety devices while being operated on the highways of this Village
during the period-from sunset to sunrise, shall display on the front of the
vehicle 2 yellow or amber lights, one one each upper front corner of the
vehicle, which shall be plainly visible at a distance of a least 500 feet;
also on the rear thereof in a horizontal line, 3 red lights plainly visible
at a distance of not less than 500 feet; also on the front of the body of that
vehicle near the lower left hand corner one yellow or amber tinted reflector
and near the lower right hand corner one yellow or amber tinted reflector;
also red reflectors on the rear of the body of that vehicle, not more than 12
inches from the lower left hand and right hand corners. All motor vehicles, of
the second division more than 20 feet long, and all trailers and semitrailers
except trailers and semitrailers having a gross weight of 3,000 pounds or less
including the weight of the trailer and maximum load while being operated on
the highways of this Village, during the period from sunset to sunrise, shall
display on each side of the vehicle at approximately the one-third points of
the length of the same, at a height not exceeding 5 feet above the surface of
the road, and reflecting on a line approximately at right angles to the center
line of the vehicle, 2 amber tinted reflectors. Provided, however, that on
motor vehicles equipped with acetylene headlights, approved reflectors, con-
forming as to color and location, may be used in lieu of the 2 yellow or amber
lights and the 3 red lights required under this Section.
(b) Every trailer and semitrailer having a gross weight of 3,000 pounds or less
including the weight of the trailer and maximum load, towed either by a motor
vehicle of the first division or a motor vehicle of the second division shall be
equipped with 2 red reflectors, which will be visible when hit by headlight
beams 200- feet away at night, on the rear of the body of such trailer, not more
than 12 inches from the lower left hand and lower right hand corners.
(c)' Every vehicle designated in paragraph (a) or (b) of this Section that is
manufactured after December 31, 1973, shall, at the places and times specified
in paragraph (a) or (b) of this Ordinance display reflectors and clearance,
identification, and side marker lamps in conformance with the specifications
prescribed by the Department.
2-203 Lamps on parked vehicles.
(a) During the period from sunset to sunrise e/ery motorcycle or motor vehi-
cle which is standing on any highway shall display a parking light on the
front and at the rear of the same. However, the Village may by Ordinance,
under rules and regulations it may prescribe, designate any part or parts
of any street, or other highway under it's jurisdiction, as parking places
in which motorcycles and motor vehicles may be parked without having their
lamps lighted, as otherwise required by this Ordinance.
(b) Any lighted driving lamps upon a parked vehicle shall be depressed or
dimmed.
2-204 Lamp or flag on projecting load
Whenever the load upon any vehicle extends to the rear 4 feet or more beyond
the bed or body of such vehicle there shall be displayed at the extreme rear end
of the load, at the times specified in Section 2-201 hereof, a red light or lan-
tern plainly visible from a distance of at least 500 feet to the sides and rear.
The red light or lantern required under this Section shall be in addition to
the red rear light required upon every vehicle. At any other time there shall
be displayed at the extreme rear end of such load a red flag or cloth not less
than 12 inches square.
2-205 Lamps on other vehicles and equipment
Every vehicle, including animal drawn vehicles, referred to in paragraph (b)
of Section 2-101, not specifically required by the provisions of this Ordinance
to be equipped with lamps or other lighting devices, shall at all times speci-
fied in Section 2-201 of this Ordinance be equipped with at least 2 lamps dis-
playing a red light visible from a distance of not less than 1 ,000 feet to
the rear of such vehicle.
The preceding paragraph does not apply to antique vehicles. An antique vehi-
cle shall be equipped with lamps of the same type originally installed by the
manufacturer as original equipment and in working order.

2-205.1 Implements of husbandry or slow-moving vehicles - Display of amber signal lamp.
Every animal drawn vehicle, farm tractor, implement of husbandry and special mobile
equipment, except when used for road construction or maintenance with the limits of
a construction or maintenance project where traffic control devices are used in com-
pliance with the applicable provisions of the manual and specifications adopted un-
der Section 1-301 of the Illinois Vehicle Code, when operated on a highway during
a time when lighted lamps are required by Section 2-201 of this Ordinance, shall
display to the rear at least one flashing amber signal lamp mounted as high as
practicable and of sufficient intensity to be visible for a distance of at least
500 feet in normal sunlight; provided, that only the rearmost vehicle of a combi-
nation of vehicles coupled together need display such lamp.
2-206 Lamps and other equipment on bicycles
(a) Every bicycle, when is use during the period when lighted lamps are required
under Division 2-201 of this Ordinance shall be equipped with the following: on
the front with a lamp which shall be emitting a white light visible from a dis-
tance of at least 500 feet to the front and with a clear reflex reflector on the
front visible to the front conforming to specification prescribed by the Depart-
ment, and on the rear and visible to the rear with a red reflex reflector confor-
ming to specifications prescribed by the Department. A lamp emitting a red light
visible to the rear may also be used. No person shall sell a new bicycle that is
not equipped with a red reflex relector on the rear conforming to specifications
prescribed by the Department and that is not equipped with a clear reflex reflec-
tor conforming to specifications prescribed by the Department on the front of the
bicycle.
(b) Every bicycle shall be equipped with a brake which will enable the operator
to make the braked wheels skid on dry, level , clean pavement.
(c) No person shall operate a bicycle unless it is equipped with a bell or other
device capable of giving a signal audible for a distance of at least 100 feet,
except that a bicycle shall not be equipped with nor shall any person use any siren
or whistle upon a bicycle.
(d) The parent of any child and the guardian of any ward shall not authorize or
knowingly permit any such child or ward to violate any provisions of this Ordinance.
(e) No person shall sell a new bicycle or pedal for use on a bicycle that is not
equipped with a reflex reflector conforming to specifications prescribed by the
Department, on each pedal , visible from the front and rear of the bicycle during
darkness from a distance of 200 feet.
(f) No Person shall sell or offer for sale a new bicycle that is not equipped with
side reflectors. Such reflectors shall be visible from each side of the bicycle
from a distance of 500 feet and shall be red to the rear of the center of the bicy-
cle and amber to the front of the center of the bicycle. Such reflectors shall
also conform to specification prescribed by the Department. No persons shall sell
or offer for sale bicycle side reflectors that do not conform to specification pre-
scribed by the Department.
2-207 Spot lamps and auxiliary driving lamps
(a) Any motor vehicle may be equipped with not to exceed one spot lamp and
every lighted spot lamp shall be so aimed and used upon approaching another vehicle
that no part of the high-intensity portion of the beam will be directed to the
left of the prolongation of the extreme left side of the vehicle nor more than
100 feet ahead of the vehicle.
(b) Any motor vehicle may be equipped with not to exceed three auxiliary driving
lamps mounted on the front at a height not less than 12 inches nor more than 42
inches above the level surface upon which the vehicle stands.
(c) The restrictions of subsection 2-207 (a) and 2-207(b) of this Ordinance shall
not apply to authorized emergency vehicles.
2-208 Signal lamps and signal devices
(a) Every vehicle other than an antique vehicle displaying an antique plate operated
in this Village shall be equipped with a stop lamp or lamps on the rear of the vehicle
which shall display a red or amber light visible from a distance of not less than 500
feet to the rear in normal sunlight and which shall be actuated upon application of
the service (foot) brake, and which may but need not be incorporated with other
rear lamps. During times when lighted lamps are not required, an antique vehicle
may be equipped with a stop lamp or lamps on the rear of such vehicle of the same
type originally installed by the manufacturer as original equipment and in working
order. However, at all other times, such antique vehicle must be equipped with
stop lamps meeting the requirements of Division 2-208 of this Ordinance.
(b) Every motor vehicle other than an antique vehicle displaying an antique plate
shall be equipped with an electric turn signal device which shall indicate the inten-
tion of the driver to turn to the right or to the left in the form of flashing lights
located at and showing to the front and rear of the vehicle on the side of the vehicle
toward which the turn is to be made. The lamps showing to the front shall be mounted
on the same level and as widely spaced laterally as practicable and, when signaling
shall emit a white or amber light, or any shade of light between white and amber.
The lamps showing to. the rear shall be mounted on the same level and as widely
spaced laterally as practicable and, when signaling, shall emit a red or amber
light. An antique vehicle shall be equipped with a turn signal device of the same
type originally installed by the manufacturer as original equipment and in working
order.
(c) Every trailer and semitrailer shall be equipped with an electric turn signal
device which indicates the intention of the driver in the power unit to turn to "
the right or to the left in the form of flashing red or amber lights located at the
rear of the vehicle on the side toward which the turn is to be made and mounted on
the same level and as widely spaced laterally as practicable.
(d) Turn signal lamps must be visible from a distance of not less than 300 feet
in normal sunlight.
(e) Motorcycles and motor-driven cycles need not be equipped with electric turn
signals. Antique vehicles need not be equipped with turn signals unless such were
installed by the manufacturer as original equipment.
2-209 Additional lighting equipment
(a) Any motor vehicle may be equipped with not more than 2 side cowl or fender
lamps which shall emit an amber or white light without glare.
(b) Any motor vehicle may be equipped with not more than one running board cour-
tesy lamp on each side thereof which shall emit a white or amber light without
glare.
(c) Any motor vehicle may be equipped with one or more back-up lamps either
separately or in combination with other lamps; but any such back-up lamp or lamps
shall not be lighted when the motor vehicle is in forward motion.
2-210 Use of head lamps
(a) Whenever the driver of any vehicle eluipped with an electric driving head
lamp or head lamps is within 500 feet of another vehicle approaching from the
opposite direction, the driver shall dim or drop such head lamp or head lamps.
(b) The driver of any vehicle equipped with an electric driving head lamp or
head lamps shall dim or drop such head lamp or head lamps when there is another
vehicle traveling in the same direction less than 300 feet to the front of him.

2-211 Number of driving lamps required or permitted
(a) At all times specified in Division 2-201, at least 2 lighted driving lamps
shall be displayed, one one each side of the front of every motor vehicle other
than a motorcycle, except when such vehicle is parked subject to the regulations
governing lights on parked vehicles.
(b) Whenever a motor vehicle equipped with driving lamps as herein required
is also equipped with any auxiliary driving lamps or a spot lamp or any other
lamp on the front thereof projecting a beam of an intensity greater than 300
candlepower, not more than a total of 4 of any such lamps on the front of a
vehicle shall be lighted at any one time when upon a highway.
2-212 Special restrictions on lamps
(a) Except as provided in Sections 2-213 and 2-215
1. No person shall drive or move any vehicle or equipment upon any high-
way with any lamp or device thereon displaying a red light visible from
directly in front thereof.
2. Subject to the restrictions in Section 1-804 paragraph (d) of this
Ordinance, flashing lights are prohibited on motor vehicles except as a
means for indicating a right or left turn or thepresence of a vehicular
traffic hazard requiring unusual care in approaching, overtaking or
passing.
2-213 Special lighting equipment on school buses
Every school bus used for the transportation of school children to and from
school , in addition to any other equipment and distinctive markings required
by this Ordinance shall be equipped with signal lamps mounted as high as and
as widely spaced laterally as practicable, which shall be capable of displaying
to the front 2 alternately flashing red lights located at the same level , and
to the rear 2 alternately flashing red lights located at the same level , and
these lights shall have the sufficient intensity to be visible at 500 feet in
normal sunlight.
2-214 Special lighting equipment on mail delivery vehicles
If a mail delivery vehicle is equipped with special signal lamps, there shall
be displayed to the front 2 such alternately flashing amber lamps located at
the same level and mounted as high and as widely spaced laterally as practi-
cable and to the rear 2 alternately flashing amber lamps located at the same
level and mounted as high and as widely spaced laterally as practicable. Such
lamps shall be of sufficient intensity to be visible at 500 feet in normal sun-
light and shall be controlled so that they will only be used to indicate to
other traffic that a stop is being made for the purpose of picking up or deli-
vering U.S. Mail.
2-215 Oscillating, rotating or flashing lights on motor vehicles
Except as otherwise provided in this Ordinance (a) Red oscillating rotating
or flashing lights, whether lighted or unlighted, are prohibited except on:
1. Law enforcement vehicles of the State or Federal Government.
2. Law enforcement vehicles owned by local authorities.
3. A vehicle operated by a police officeror County Coroner and designated or
authorized by local authorities in writing, as a law enforcement vehicle; however
such designation or authorization shall be carried in the vehicle.
4. Vehicles of local fire departments and fire fighting vehicles of the
State or Federal Government; and
5. Vehicles which are designed as ambulances, furthermore, such lights shall
not be lighted except while responding to an emergency call for the purpose
of conveying sick or injured persons;
(b) Amber oscillating, rotating or flashing lights, whether lighted or un-
lighted, are prohibited except on:
1 . Second division vehicles designed for towing or hoisting disabled vehicles;
furthermore such lights shall not be lighted except when such vehicles are

actually being used for such purposes.
2. Motor vehicles or equipment of the State of Illinois, local authorities
and contractors; furthermore, such lights shall not be lighted except while
such vehicles are engaged in maintenance or construction operations within
the limits of construction projects.
3. Vehicles or equipment used by engineering or survey crews; furthermore,
such lights shall not be lighted except while such vehicles are actually
engaged in work on a highway;
4. Vehicles of public utilities and municipal department; furthermore, such
lights shall not be lighted except while such vehicles are engaged in mainte-
nance or construction operations within the limits of construction projects;
5. Oversized vehicle or load moving under permit issued by the Department
under Section 15-301 of Chapter 95-1/2 I.R.S.
6. The front and rear of motorized equipment owned and operated by the State
of Illinois or any political subdivision thereof, which is designed and used
for removal of snow and ice from highways and
7. Such other vehicles as may be authorized by local authorities.
(c) Blue oscillating, rotating or flashing lights whether lighted or unligh
ted, are prohibited except on;
1. The front of any motor vehicle owned or fully operated by a volunteer
fireman, paid fireman, part-paid fireman, or call fireman while responding
to a fire call; and
2. Police Department vehicles in cities having a population of 500,000 or more
inhabitants.
(d) All oscillating, rotating or flashing lights referred to in this Division
shall be of sufficient intensity, when illuminated, to be visible at 500 feet
in normal sunlight.
2-216 Operation of oscillating, rotating or flashing lights
Oscillating, rotating or flashing lights located on top of police vehicles in
this Village shall be lighted whenever a police officer is in pursuit of a
violator of a traffic law or regulation.

DIVISION III
BRAKES
2-301 Brakes
(a) Brake equipment required
-1. Every motor vehicle, other than a motor-driven cycle and an antique
vehicle displaying an antique plate, when operated upon a highway shall be
equipped with brakes adequate to control the movement of and to stop and
hold such vehicle, including 2 separate means of applying the brakes, each
of which means shall be effective to apply the brakes to at least one wheel
on a motorcycle and at least 2 wheels on all other first division and second
division vehicles. If these 2 separate means of applying the brakes are
connected in any way, they shall be so constructed that failure of any one
part of the operating mechanism shall not leave the motor vehicle without
brakes.
2. Every motor-driven cycle when operated up on a highway shall be equipped
with at least one brake which may be operated by hand or foot.
3. Every antique Vehicle shall be equipped with the brakes of the same type
originally installed by the manufacturer as original equipment and in working
order.
4. Every trailer or semitrailer of a gross weight of 3,000 pounds or more,
when operated upon a highway must be equipped with brakes adequate to con-
trol the movement of, to stop and to hold such vehicle, and designed so as
to be operable by the driver of the towing vehicle from its cab. Such
brakes must be so designed and connected that in case of an accidental break-
away of a towed vehicle 5,000 pounds or more, the brakes are automatically
applied.
5. Every motor vehicle, trailer, pole trailer or semitrailer, sold in this
Vil1ageor operated upon the highways shall be equipped with service brakes
upon all wheels of every such vehicle, except any motor-driven cycle, and
except that any trailer, pole trailer or semitrailer of less than 3,000
pounds gross weight need not be equipped with brakes and except that any
trailer or semitrailer with gross weight of 3,000 pounds but under 5,000
pounds need be equipped with brakes on only one wheel on each side of the
vehicle. Any motor vehicle and truck tractor having 3 or more axles need not
have brakes on the front wheels, except when such vehiclesare equipped with
at least 2 steerable axles, the wheels of one such axle need not be equipped
with brakes. However, a vehicle that is more that 30 years of age and which
is driven on the highways only in going to and returning from an antique auto
show or for servicing or for a demonstration need be equipped with 2 wheel
brakes only.
(b) Performance ability of brakes.
1. The service brakes upon any motor vehicle or combination of vehicles
operating on a level surface shall be adequate to stop such vehicle or vehi-
cles when traveling 20 miles per hour within a distance of 30 feet when upon
dry asphalt or concrete pavement surface free from loose material.
2. Under the above conditions the hand brake shall be adequate to stop such
vehicle or vehicles, except any motorcycle, within a distance of 55 feet and
the hand brake shall be adequate to hold sich vehicle or vehicles stationary
on any grade upon which operated.
3. Under the above conditions the service brakes upon an antique vehicle
shall be adequate to stop the vehicle within a distance of 40 feet and the
hand brake adequate to stop the vehicle within a distance of 55 feet.
4. All braking distances specified in this Ordinance apply to all vehicles
mentioned, whether such vehicles are unloaded or are loaded.
5. All brakes shall be maintained in good working order and shall be so ad-
justed as to operate as equally as practicable with respect to the wheels on
opposite sides of the vehicle.

2-302 Brake fluid
No person shall sell, offer for sale or distribute brake fluid for use on
motor vehicles for repair purposes unless such fluid conforms to specifica-
tions prescribed by the Department.
DIVISION IV
TIRES
2-401 Restriction as to tire equipment
No metal tired vehicle, including tractors, motor vehicles of the second
division, traction engines and other similar vehicles, shall be operated
over any improved highway of this Village, if such vehicle has on the
periphery of any of the road wheels any block, stud, flange, cleat, ridge,
lug or any projection of metal or wood which projects radially beyond the
tread or traffic surface of the tire. This prohibition does not apply
to pneumatic tires with metal studs between November 15 of any year and
April 1 o the following year or to track type motor vehicles when that
part of the vehicle coming in contact with the road surface does not
contain any projections of any kind likely to injure the surface of the
road; however, tractors, traction engines, and similar vehicles may be
operated which have upon their road wheels V-shaped, diagonal or other
cleats arranged in such a manner as to be continuously in contact with
the road surface, provided that the gross weight upon such wheels per
inch of width of such cleats in contact with the road surface, when
measured in the direction of the axle of the vehicle, does not exceed
800 pounds. Studded tires may be used between November 15 of any year and
April 1 of the following year and only on single tire vehicles with a
rated capacity of not more than 10,000 pounds gross vehicle weight on
which there are wheelwells or other items of a similarly protective nature,
whether permanently or temporarily attached thereto.
All motor vehiclesaid other vehicles in tow thereof, or thereunto atta-
ched,operating upon any roadway, shall have tires of rubber or some mate-
rial of equal resiliency. Solid tires shall be considered defective and
shall not be permitted to be used if the rubber or other material has been
worn or otherwise reduced to a thickness of less than three-fourths of an
inch or if such tires have been so worn or otherwise damaged as to cause
undue vibration when the vehicle is in motion or to cause undue concentra-
tion of the wheel load on the surface of the road. The requirements of this
Section do not apply to agricultural tractors or traction engines or to agri-
cultural purposes in tow thereof, or to road rollers or road building machi-
nery operated at a speed not in excess of 10 miles per hour. All motor vehi-
cles of the second division,operating upon any roadway shall have pneumatic
tires, unless exempted herein.
Nothing in this Ordinance shall be deemed to prohibit the use of tire chains
of reasonable proportion upon any vehicle when required for safety because
of snow, ice or other conditions tending to cause a vehicle to skid.
2-405 Operating condition of passenger car tires
(a) Definition. The term ".passenger car tire" as used in this Section means
any tire of a size designation and type listed in Federal Motor Vehicle Safety
Standard 109, as amended, for use on passenger cars manufactured after 1948.
(b) Promulgated Rules and Regulations. The Illinois Secretary of Transporta-
tion shall promulgate rules concerning unsafe operating conditions of passen-
ger car tires. The rules shall be capable of being employed by uniformed law
enforcement officers for visual inspection of tires mounted on vehicles, inclu-
ding visual comparison with simple measuring scales or gauges. The rules shall
include precepts and standards for determining unsafe conditions, including the
determination of effective depths of tread design grooves, and shall be based
upon, to the extent that it is reasonable and practical , all provisions set
forth in paragraph (d) of this Section_

(c) Use of Unsafe Tire No person or organization shall drive or move or
cause to be driven or to be moved on the public streets or highways of this
Village any vehicle equipped with one or more passenger car tires considered
to be unsafe under the provisions ofparagraph (d) of this Section or the
rules promulgated under paragraph (b) ofthis Section. This restriction, how-
ever, shall not apply to a person or organization towing or moving a wrecked,
damaged, disabled or impounded vehicle to a repair, collection, or storage
point either,with a driver in the towed vehicle or by means of a vehicle
(wrecker) designed for this special use.
(d) Criteria for Unsafe Passenger Car Tires. A passenger car tire shall be
considered to be unsafe if it has:
1 Any part of a ply or cord exposed; or
2. A tread or sidewall crack, cut, snag, or other surface interruption'
deep enough to expose a ply or cord; or
3. Any bulge, knot, or separation; or
4. Tread wear indicators flush with the iread outer surface in any 2 or
more adjacent tread grooves at 3 locations around the circumference
of the tire; or
5. A depth of tread less than 2/32nds (1/16th) of an inch measured in
any 2 or more adjacent tread-grooves at 3 locations essentially
equally spaced around the circumference of the tire, at least one
of which in the judgment of the inspecting officer is a location at
which the tread is thinnest, exclusive of tie bars or tread wear in-
dicators, provided that with regard to vehicles offered for sale
or lease, a depth of tread less than 3/32nds of an inch shall be
deemed to be unsafe; or
6. A marking which indicates that the tire is not intended for use on
public streets or highways, such as "not for highway use", or "for
racing purposes only", or "unsafe for highway use"; or
7. Been regrooved or recut below the original tread design depth, except
special regroovable tires or taxicab tires, which have extra under-
tread rubber and are identified as such; or
8. Other conditions, or markings, or lack of markings that may be reason-
ably demonstrated to identify the tire as unsuitable for highway use,
including inflation or load conditions seriously incompatible with the
tire size, construction, or other pertinent markings.
(e) Sale, Lease, or Installation of Tire. No person or organization shall sell
or lease, or offer for sale or lease, or mount or install, or cause to be
mounted or to be installed for use on the public streets or highways of this
Village any passenger car tire considered to be unsafe under paragraph (d) of
this Section or under rules promulgated under paragraph (b) of this Section.
A person or organization offering a vehicle for sale or lease shall , prior
to its being driven or moved on a public street or highway, correct any unsafe
tire condition.
(f) Compliance and Enforcement 1. Any police officer, upon reasonable cause
to believe that a person or organization has acted or is acting in violation of
the provisions of paragraph (c) or paragraph (e) of this Section shall require
the driver, owner, or other appropriate custodian of the vehicle to submit
the tires on the vehicle to an inspection. The driver shall stop at a desig-
nated location and permit the tires to be inspected or shall move the vehicle
to a location that is reasonably convenient and is suitable for the inspection
when, in the judgment, of the officer, such actions are essential to an effi-
cient and safe inspection of the tires.
2-406 Violation
Whoever violates any of the provisions of this Ordinance shall be guilty of
a misdemeanor.

DIVISION DIVISION V
GLASS, WINDSHIELDS AND MIRRORS
2-502 Mirrors.
Every motor vehicle, operated singly or when towing another vehicle shall
be equipped with a mirror having at least 3 square inches of reflecting
surface and so located as to reflect to the driver a view of the highway
for a distance of at least 200 feet to the rear of such motor vehicle.
2-503 Windshields must be unobstructed and equipped with wipers.
(a) No person shall drive any motor vehicle with any sign, poster or
other nontransparent material upon the front windshield, sidewings, or side
or rear windows of such vehicle which materially obstructs, obscures or
impairs the driver's clear view of the highway or any intersecting highway.
(b) No person shall drive any motor vehicle with any objects placed or
suspended between the driver and the front windshield or between the driver
and the rear window which obstructs the driver's clear view of the highway.
(c) The windshield on every motor vehicle shall be equipped with a device
for cleaning rain, snow or other moisture from the windshield, which device
shall be so constructed as to be controlled or operated by the driver of
the vehicle.
(d) No object, stationary or mobile, shall be placed on or suspended from
the rearview mirror, front windshield, rear window or any other part of the
inside of a motor vehicle except (l) religious or lodge statues not exceeding
6 inches in height and (2) wearing apparel which is suspended behind the
driver and in a manner so as not to obstruct the driver's clear view of the
highway.
(e) No person shall drive any motor vehicle when the windshield or rear
window is in such defective condition or repair as to directly impair the
driver's vision to the front or rear.
(f) No person shall drive any motor vehicle when snow or ice on the wind-
shield or rear view mirror materially obstructs, obscures or impairs the
driver's clear view of the highway.
DIVISION VI
MISCELLANEOUS REQUIREMENTS
2-600 Definitions.
For the purpose of this Division, the following words shall have the meaning
ascribed to them as follows: -
Muffler: Every device consisting of a series of chambers or baffle plates
or other mechanical design for the purpose of receiving exhaust gas from an
internal combustion engine or turbine wheels for the purpose of receiving
exhaust gas from a diesel engine, both of which are effective in reducing
noise.
Bumper: Every device or system of devices protruding from and attached to the
front and rear of a motor vehicle which has been designed to be used to
absorb the impact of a collision.

Suspension system: The system of devices consisting of but not limited to
springs, spring shackles, shock absorbers, torsion bars, frame or any other
supporting members used to attach the body of a motor vehicle to its axles.
2-601 Horns and warning devices.
(a) Every motor vehicle when operated upon a highway shall be equipped with
a horn in good working order and capable of emitting sound audible under
normal conditions from a distance of not less than 200 feet, but no horn
or other warning device shall emit an unreasonable loud or harsh sound or a
whistle. The driver of a motor vehicle shall when reasonably necessary to
insure safe operation give audible warning with his horn, but shall not other-
wise use such horn when upon a highway.
(b) No vehicle shall be equipped with nor shall any person use upon a
vehicle any siren, whistle, or bell, except as otherwise permitted in this
subsection. Any authorized emergency vehicle as defined in Article l of this
Ordinance may be equipped with a siren, whistle, or bell , capable of emitting
sound audible under normal conditions from a distance of not less than 500
feet, but such siren, whistle or bell, shall not be used except when such
vehicle is operated in response to an emergency call or in the immediate
pursuit of an actual or suspected violator of the law in either of which
events the driver of such vehicle shall sound such siren, whistle or bell ,
when necessary to warn pedestrians and other drivers of the approachthereof.
(c) No bicycle shall be equipped with nor shall any person use upon a bicycle
a siren or whistle.
2-602 Mufflers, prevention of noise.
Every motor vehicle driven or operated upon the highways of this Village
shall at all times be equipped with an adequate muffler or exhaust system
in constant operation and properly maintained to prevent any excessive or
unusual noise. No such muffler or exhaust system shall be equipped with a
cutout, bypass, or similar device. No person shall modify the exhaust system
of a motor vehicle in a manner which will amplify or increase the noise of
such vehicle above that emitted by the muffler originally installed on the
vehicle and such original muffler shall comply with all the requirements of
this Article.
2-603 Seat safety belts.
(a) No person shall sell any 1965 or later model motor vehicle of the first
division that is titled or licensed by the Secretary of State unless the
front seat of such motor vehicle is equipped by two sets of seat safety belts.
(b) No person shall operate any 1961 or later model vehicle of the first
division that is titled or licensed by the Secretary of State unless the
front seat of such motor vehicle is equipped with two sets of seat safety
belts.
(c) As used in this Section, "seat safety belts"means a set of belts or
harness meeting the specifications established by the Department and installed
in such manner as to prevent or materially reduce the movement of the person
using the same in the event of collision or upset of the vehicle.

2-604 Television receivers.
(a) No motor vehicle operated on the highways of this Village shall be
equipped with television-type receiving equipment so located that the viewer
or screen is visible from the driver's seat.
(b) This section does not prohibit the use of television-type receiving
equipment used exclusively for safety or traffic engineering studies.
2-606 Tow-trucks--Identification-Equipment-Insurance
(a) Every tow-truck, except those owned by government agencies shall have
displayed on each side thereof, a sign with letters not less than 2 inches
in height, contrasting in color to that of the background, stating the
name, address and telephone number of the owner or operator thereof.
(b) Every tow-truck shall be equipped with:
(1) One or more brooms and shovels
(2) One or more trash cans at least 18 inches in height; and
(3) One fire extinguisher of the dry chemical or carbon•:.dioxide
type with an aggregate rating of at least 4-B, C units, and
bearing the approval of a laboratory qualified by the Division of Fire
Prevention for this purpose.
(c) Every owner or operator and driver of a tow-truck shall comply with
Section 1-1413 of this Ordinance and shall remove or cause to be removed
all glass and debris deposited upon any street or highway by the disabled
vehicle being serviced, and shall in addition, spread dirt or sand upon
that portion of any street or highway where oil or greas-e has been deposited
by the disabled vehicle being serviced.
(d) Every tow-truck operator shall in addition provide an indemnity bond
or insurance policy which shall indemnify or insure the tow-truck operator
for his liability for loss or damage to any disabled vehicle towed or stored
by the tow-truck operator in an amount not less than $5,000 for any one
accident or claim. Any such bond or policy shall be issued only by a bonding
or insuring firm properly qualified to do business as such in the State of
Illinois, and a certificate of such bond or policy shall be carried in the
cab of each tow-truck.
2-606.1 Bumpers.
(a) It shall be unlawful to operate any vehicle of the first division
or any vehicle registered as a recreational vehicle on any highway of this
Village unless such vehicle is equipped with both a front and rear bumper.
The bumper height shall not be modified to vary more than 3 inches from the
original manufactured bumper height for that vehicle when measured from a
level surface of the highway to the lower edge of the bumper. Nothing in
this Section shall prevent the installation of manufactured bumper guards.
(b) This Section shall not apply to motor vehicles designed or modified
primarily for off-highway racing purposes while such vehicle is in tow or
to motorcycles or motor driven cycles, nor to an antique vehicle, when
registered as such, when the original design did not include bumpers.
2-607 Suspension systems.
(a) It shall be unlawful to operate a motor vehicle on any highway of
this Village when the suspension system has been modified from the original
manufactured design by lifting the body from the chassis in excess of 3
inches or to cause the horizontal line from the front to the rear bumper to
vary over 3 inches in height when measured from a level surface of the highway
to the lower edge of the bumper.

(b) Nothing in this Section shall prevent the installation of manu-
factured heavy duty equipment to include shock absorbers and overload
springs, nor shall anything contained in this Section prevent a person to
operate a motor vehicle on any highway of this Village with normal wear .
of the suspension system if normal wear does not affect the control or
safe operation of the vehicle. This Section shall not apply to motor
vehicles designed or modified primarily for off-highway racing purposes
while such vehicles are in tow or to motorcycles or motor driven cycles.

DIVISION VII
SPECIAL REQUIREMENTS FOR VEHICLES OF THE SECOND DIVISION
L 01 Tractors, traction engines and motor trucks Operation on highways - Turning
on highways during farming operations - Violations
No tractor, traction engine, motor truck or other similar vehicle shall be
operated across over or along any public highway of this Village which has
been oil-treated, if any such vehicle has on the periphery of any of the road
wheels any block, stud, flange, cleat, ridge, lug or any projection of metal
or wood which projects radially beyond the tread or traffic surface of the tire;
except that this prohibition shall not apply to tractors or traction engines
equipped with what is known as crawler type tractors, when the same does not
contain any projections of any kind likely to injure the surface of the road,
nor to tractors, traction engines and similar vehicles which have upon their
road wheels V-shaped, diagonal or other cleats arranged in such a manner as to
be continuously in contact with the road surface. In no event shallthe oil
mat surface of any oil-treated public road be used as an area or space for
turning any tractor or other farm machinery in carrying on or performing any
farming operations upon the adjacent land. Provided, that nothing in this
Section contained shall prohibit the operation of tractors, tractions engines
or motor trucks across any oil-treated road in order to reach adjacent lands
or the operation of any such vehicles upon the treated portion of such oil-
treated roads if there is no untreated portion thereof over which they may
be operated or the operation of any such vehicles on oil-treated roads if
in passing along said road they travel over the portion of said road which does
not constitute the oil mat surface created by said oil treatment or the use
of flexible tine chains on any tractor, traction engine, motor truck or other
similar vehicle being operated upon any such oil-treated road.
2-702 Certain vehicles to carry flares or other warning devices.
(a) No person shall operate any motor vehicle of thesecond division or any motor
vehicle towing a house trailer upon any highway outside an urban district at any
time unless there is carried in such vehicle the following equipment, except as
provided in paragraph (b) of this Section:
1. At least 3 liquid burning flares, or 3 red electric lanterns or 3 portable
red emergency reflectors, each of which is capable of being seen and distingui-
shed at a distance of not less than 500 feet when lighted lamps are required, pro-
vided that emergency reflectors meeting the requirements of Federal Motor Vehicle
Safety Standard No. 125 shall be deemed acceptable as regards visibility and
color; and
2. At least 3 red burning 15-minute fusees unless red electric lanterns or por-
table red emergency reflectors are carried; and
3. At least 2 red cloth flags, not less than 12 inches square, with standards to
support flags or in lieu thereof, 2 portable emergency reflectors meeting the
requirements of Federal Motor Vehicle Safety Standard No. 125.
(b) No person shall operate at the time and under the conditions stated in para-
graph (a) of this Section any motor vehicle used for the transportation of explo-
sives, any cargo tank truck used for the transportation of flammable liquids or
compressed gases or any motor vehicle using compressed gas as a fuel unless there
is carried in such vehicle 3 red electric lanterns or 3 portable red emergency
reflectors meeting the requirementsof paragraph (a) of this Section, and such vehi-
cle shall not carry any flares, fusees or signals produced by flame.
(c) Whenever any motor vehicle of the second division or any motor vehicle towing
a house trailer is disabled upon the roadway of any highway or the shoulder thereof
outside an urban district or on any controlled access highway within an urban
district at any time when lighted lamps are required, the driver of such vehicle
shall display the following warning devices upon the highway during the time the
vehicle is so disabled, except as provided in paragraph (d) of this Section;

1 . A lighted fusee, a lighted red electric lantern or a portable red emergency
reflector shall be immediately placed at the traffic side of the vehicle in the
direction of the nearest approaching traffic. However, the driver of such vehi-
cle upon learning of the disability may simultaneously flash the 2 front and 2
rear turn signals as a vehicular traffic warning and continue such flashing until
the portable signals have been placed as required by this Section and during
the time such portable emergency signals are being picked up for storage prior to
the movement of the vehicle.
2. As soon thereafter as possible, but in any event within the burning period
of the fusee (15 minutes), the driver shall place 3 liquid-burning flares, or
3 lighted red electric lanterns or 3 portable red emergency reflectors on the
roadway or shoulder of the highway in the following order;
One approximately 100 feet from the disabled vehicle in the center
of the lane or shoulder occupied by such vehicle and toward traffic
approaching in that lane; and
One approximately 100 feet in the opposite direction from the dis-
abled vehicle and in the center ofthe traffic lane or shoulder occu-
pied by such vehicle; and
One at the traffic side of the disabled vehicle not less than 10 feet
to the rear or forward thereof in the direction ofthe nearest approa-
ching traffic. If a lighted red electric lantern or a portable red
emergency reflector has been placed at the traffic side of the
Vehicle in accordance with paragraph (c) (1) of this Section, it may
be used for this purpose.
(d) Whenever any vehicle referred to in this Section is disabled within 500 feet
of a curve, hill crest or other obstruction to view, the warning signal in that
direction shall be so placed as to afford ample warning to other users of the
highway, but in no case less than 100 feet nor more than 500 feet from the dis-
abled vehicle.
(e) Whenever any vehicle of a type referred to in this Section is disabled upon
any roadway or shoulder of a divided highway during the time that lighted lamps
are required, the appropriate warning devices prescribed in paragraph (a) (1)
and (2) of this Section shall be placed as follows:
One at a distance of approximately 200 feet from the vehicle in the center
of the lane or shoulder occupied by the stopped vehicle and in the direc-
tion of traffic approaching in thatlane; and
One at a distance of approximately 100 feet from the vehicle in the center
of the lane or shoulder occupied by the vehicle and in the direction of
traffic approaching in that lane; and
One at the traffic side of the vehicle and approximately 10 feet from the
vehicle and approximately 10 feet from the vehicle in the direction of the
nearest approaching traffic.
(f) Whenever any vehicle of a type referred to in this Section is disabled upon the
roadway of any highway or the shoulder thereof outside an urban district or on any
controlled access highway within an urban district at any time when the display
of fusees, flares, red electric lanterns or portable red emergency reflectors
are not required, the driver of the vehicle shall display 2 red-cloth flags or
2 portable emergency reflectors meeting the requirements of Federal Motor Vehicle
Safety Standard No. 125 upon the roadway or shoulder in the lane of traffic occu-
pied by the disabled vehicle inthe following order:
One at a distance of approximately 100 feet incdvance of the vehicle; and
One at a distance of approximately 100 feet in the rear of the vehicle.
(g) Whenever any vehicle of a type referred to in this Section is disabled
upon any roadway or shoulder of a divided highway during the time that lighted
lamps are not required, the driver of such vehicle shall display 2 red-cloth
flags or 2 portable emergency reflectors meeting the requirements of Federal
Motor Vehicle Safety Standard No. 125 upon the roadway or shoul.der in the center
of the lane of traffic occupied by the disabled vehicle in the following order:
One at a distance of approixmately 200 feet to the rear of the vehicle; and
One at a distance of approixmately 100 feet to the rear of the vehicle.

(h) Whenever any motor vehicle used for the transportation
of explosives, or any cargo tank truck used for the transportation of any
flammable liquid or compressed flammable gas or any motor vehicle using compressed
gas as a fuel is disabled upon a highway of this State at any time and place men-
tioned in paragraph (c) of this Section, the driver of such vehicle shall immedi-
ately display 3 red electric lanterns or portable emergency reflectors placed in
the following order:
One at the traffic side of the vehicle and approximately 10 feet from the
vehicle in the direction of the nearest approaching traffic and
One at a distance of approximately 100 feet to the front of the disabled
vehicle in the center of thelane of traffic or shoulder occupied by such
vehicle; and
One at a distance of approximately 100 feet to the rear of the disabled
vehicle in the center of the lane of traffic or shoulder occupied by
such vehicle. Flares, fusees or signals produced by flame shall not be
used as warning devices for disabled vehicle of the type mentioned in
this paragraph_
(i) The flares, fusees red electric lanterns, portable red emergency reflectors
and flags to be displayed as required in this Section shall comply with the
requirements of paragraphs (a) and (b) of this Section applicable thereto..
2-'03 Road oil vehicles -Dripping on certain highways forbidden
No person shall operate, on a durable all-weather highway of a type other than
gravel or crushed stone, any vehicle Used for thepurpose of applying road oil,
liquid asphalt or similar material to road surfaces unless such vehicle is so
equipped as to absolutely prevent such material from dripping on such highway
nor shall such material be allowed to drip on any such highway.
2-704 Vehicles transporting explosives
Any person operating any vehicle transporting any explosive as a cargo or part of
a cargo upon a highway shall at all times comply with the provisions of this
Section.
(a) Such vehicle shall be marked or placarded on each side and the rear with the
word "Explosives" in letters not less than 4 inches high, or there shall be dis-
played on the rear of such vehicle a red flag not less than 24 inches square marked
with the word "Danger in white letters 6 inches high.
(b) Every such vehicle shall be equipped with not less than two fire extinguishers
filled and ready for immediate use, and placed at a convenient point on the vehicle
used.
2-704.1 Vehicles transporting radioactive material
Highway vehicle used for transport of packages bearing Radioactive Yellow-III labels
as defined in the Code of Federal Regulations, Title 49, Chapter 1, Paragraph 173.399
(a) must be placarded by the carrier, or by the shipper for sole use vehicles contain-
ing full loads of low specific activity materials. Placards printed "RADIOACTIVE"
with black letters four inches high and 5/8 inch width of stroke on a yellow back-
ground must be applied on the front, rear and on each side of the vehicle.
2-705 Vehicles transporting flammable liquids when lights required - Marked with reflec-
torized paint.
No person shall operate upon the highways of this Village any second division motor
vehicle customarily used in cargo transportation of flammable liquids or explosives
during the hours when lighted lamps are required under Division 2-201 of this Ordinance
unless such vehicle is marked or placarded in reflectorized paint on each side and
rear with the words "Flammable "Explosives or "Gasoline" in letters not less
than 4 inches high.

2-706 Fire apparatus - Safety belts
No fire apparatus equipped to carry firemen on the outside of such vehicle on the
sides, or rear, or both, shall be operated without first installing on the fire
apparatus on the sides and rear thereof a sufficient number of safety belts and
safety belt connections to protect the maximum number of firemen who can occupy
the sides and rear of such apparatus while responding to alarms of fire. The
municipality shall cause inspection of such safety equipment at least semi-annually.
2-707 Prohibition Liability insurance
No school bus or motor vehicle owned by or used for hire by and in connection with
the operation of private or public schools, day camps, summer camps or nursery
schools or in charter operations shall be operated if it is occupied by more passen-
gers than recommended by the manufacturer thereof if said vehicle is manufactured as
a passenger vehicle; if said vehicle is manufactured for use other than passenger,
then it shall not accommodate more passengers than provided for by the manufacturer
in passenger vehicles of like style or rating.
No school bus or motor vehicle owned by or used for hire by and in connection with
the operation of private or public schools, day camps, summer camps or nursery schools
shall be operated for such purposes unless the owner thereof shall carry a minimum
of personal injury liability insurance in the amount of $25,000 for any one person
in any one accident, and subject to said limit for one person, $100,000 for two or
more persons injured by reason of the operation of said vehicle in any one accident.
2-708 Operator protective frames on tractor-mower combinations
No tractor unit over 16 engine horsepower designed for mowing or tractor-mower combi-
nation unit over 16 engine horsepower owned or leased by the Village shall be oper-
ated for the purpose of mowing vegetation on highway right-of-way unless the tractor
of such unit is equipped with an operator protective frame conforming to the specifi-
cations prescribed by the Department and with a seat safety belt.
The Department shall establish performance specifications for the operator protective
frame.
The operator protective frame may be incorporated into a cab which design shall con-
form to the specifications established by the Department.
The seat safety belt must meet the requirements provided in Section 2-603 of this
Ordinance.
2 Slow-moving vehicle emblem
(a) Every animal drawn vehicle, farm tractor, implement of husbandry and special
mobile equipment when operated on a highway must display a slow-moving vehicle
emblem mounted on the rear except as provided in paragraph (b) of this Section.
Special mobile equipment is exempt when operated within the limits of a construc-
tion or maintenance project where traffic control devices are used in compliance
with the applicable provisions of the manual and specifications adopted under
Section 1-301 of the Village Traffic Ordinance.
(b) Every vehicle or unit described in paragraph (a) of this Section when oper-
ated in combination on a highway must display a slow-moving vehicle emblem as
follows.
1 . Where the towed unit or any load thereon partially or totally obscures the
slow-moving vehicle emblem on the towing unit, the towed unit shall be equipped
with a slow-moving vehicle emblem. In such cases the towing unit need not dis-
play the emblem.
2. Where the slow-moving vehicle emblem on the towing unit is not obscured by
the towed unit or its load, then either or both may be equipped with the requi-
red emblem, but it shall be sufficient if either displays it.

3. A registered truck towed behind a farm tractor in conformity with the provi-
sions of Section 1-1418 of the Village Traffic Ordinance must display a slow-
moving vehicle emblem in the manner provided in paragraph (c) while being towed
on a highway if the emblem on the towing vehicle is partially or totally obscured.
(c) The slow-moving vehicle emblem required by paragraphs (a) and (b) of this
Section must meet the specifications and mounting requirements established by
the Department. Such specifications and mounting requirements shall be based
on the specifications adopted by the American Society of Agricultural Engineers and
published by that body as ASAE S 276.2 dated March, 1968. No advertising or other
marking shall appear upon the emblem.
(d) A slow-moving vehicle emblem is intended as a safety identification device and
shall not be displayed on any vehicle nor displayed in any manner other than as
described in paragraphs (a), (b) and (c) of this Section.
2-710 Rear fender splash guards
It is unlawful for any person to operate any motor vehicle of the second division,
except a truck tractor, to which this Section is applicable upon any highway of this
Villageunless such vehicle is equipped with rear fender splash guards of either the
contour type or the flap type which comply with the specifications provided in this
Section for the type of splash guards used on the vehicle, and which are so attached
as to prevent the aplashing of mud or water upon the windshield of other motor vehi-
cles.
(a) Specification for contour type splash guards. When contour type rear fender
splash guards are used, they shall contour the wheel in such a manner that the rela-
tionship of the inside surface of any such splash guard to the tread surface of the
tire or wheel shall be relatively parallel, both laterally and across the wheel , at
least throughout the top 90 degrees of the rear 180 degrees of the wheel surface;
provided however, on vehicles which have a clearance of less than 5 inches between
the top of the tire or wheel and that part of the body of the vehicle directly above
the tire or wheel when the vehicle is loaded to maximum legal capacity, the curved
portion of the splash guard need only extend from a point directly behind the
center ofthe rear axle and to the rear of the wheel surface upwards to within at
least 2 inches of the bottom line of the body when the vehicle is loaded to maximum
legal capacity. There shall be a downward extension of the curved surface which
shall end not more than 12 inches from the ground when the vehicle is loaded to
maximum legal capacity. This downward extension. shall be part of the curved sur-
face, but it need not contour the wheel. Such contour type splash guards shall be
wide enough to cover the full tread width of the tire or tires being protected and
shall be installed not more than 6 inches from the tread surface of the tire or wheel
when the vehicle is loaded to maximum legal capacity. The splash guard shall have
a lip or flange on its outside edge to minimize side throw and splash. The lip or
flange shall extend toward the center of the wheel , and shall be perpendicular to
and extend not less than 2 inches below the inside or bottom surface line or plane
of the guard. Such contour type splash guards may be constructed of either a rigid
or flexible material , but shall be attached in such a manner that, regardless of
movement either by the splash guards or the vehicle, the splash guards will retain
their general parallel relationship to the tread surface of the tire or wheel under all
ordinary operating conditions.
(b) Specifications for flap type splash guards. When flap type splash guards are use
they shall be wide enough to cover the full tread width of the tire or tires being
protected; shall be so installed that they extend from the underside of the vehicle
in a vertical plane behind the rear wheels to within 12 inches of the ground, when
the vehicle is in forward motion such splash guard will not deviate or move backward
from the vertical plane by an angle of more than 30 degrees measured from the verti-
cal plane and so that when the forward motion of the vehicle causes such splash
guard to deviate from the vertical plane, the bottom of such flap type splash guard wil
not bemore than 15 inches from the ground,when the vehicle is loaded to maximum
legal capacity. Such flap type splash guard may be constructed of either a rigid
or flexible material.
(c) Exemptions. This Section shall not apply to vehicles the construction or
design or which does not require such splash guards, nor to vehicles in-transit
and capable only of using temporary splasr guards prescribed by the Department
nor to pole trailers.

ARTICLE III
DIVISION I
REGULATION OF CERTAIN CLASSES OR TYPES OF VEHICLES
3-101 Trucks prohibited on certain streets
It shall be unlawful to operate a truck upon any street where truck operation is
prohibited by ordinance and where such signs of prohibition are posted, except
that a truck may be driven on such street for not more than the minimum distance
necessary for the purpose of making deliveries or picking uploads. "Schedule XIII",
hereof, by this reference made a part hereof, lists all streets on which truck
traffic is prohibited.
3-102 Limited Load Streets
A maximum gross weight limit of 24,000 pounds is hereby established for all motor
vehicles traveling on the streets listed in Schedule VIII, hereof which is made
a part of this Ordiannce.
It shall be unlawful to operate a vehicle in excess of this weight on these streets
except for the purpose of making a local delivery or pick up of individual pieces
of merchandise at a piece of property on the street concerned in which case the
vehicle may be driven on such street for not more than the minimum distance neces-
sary for that purpose. Local delivery as used here in shall mean an occasional
delivery or pick up of individual pieces of merchandise only and shall not include
delivery or pick up of full truck loads of materials or merchandise. Where deli-
very or pick up of full loads of material ormerchandise which would impare a gross
weight in excess of 24,000 pounds is desired, a permit may be granted by the Vil-
lage Engineer designating the permitted load, route to be used in going to and from
the area and any other special precautions necessary to be followed to protect the
paving structure of the streets being traversed.
Fees for such permits shall be as established by resolution of the President and
Board of Trustees of the Village.
Pick up and permit procedure are also applicable to Section 3-101 of this Ordinance.
3-103 Motor Driven Cycles
(a) It is unlawful for any person to do any act forbidden or fail to perform any
act required in this Section.
(b) The parent of any child and the guardian of any ward shall not authorize or
knowingly permit any such child or ward to violate any of the provisions of this
ordinance.
(c) These regulations applicable to motor driven cycles shall apply whenever a
motor driven cycle is upon any street or highway.
1 . No person shall exercise any degree of physical control of a motor driven
cycle on any street or highway within the corporate limits of this Village
unless such person has a valid driver's license issued under theprovisions
of the State of Illinois Driver's License Act.
(d) It is unlawful for any person to drive upon private property, without the
written consent of the owner or lessee thereof.

3-104 Snowmobiles
It shall be unlawful for any person to drive or operate any snowmobile in the
following ways:
(a) At a rate of speed too fast for conditions and the fact that the speed of
the snowmobile does not exceed the applicable maximum speed limit allowed
does not relieve the driver from the duty to decrease speed as may be necessary
to avoid colliding with any person or vehicle or object.
(b) In a careless, reckless or negligent manner.
(c) While under the influence of intoxicating beverages or narcotics or danger-
ous drugs.
(d) At anytime without at least one lighted 'headlamp and one lighted tail lamp
on the snowmobile.
(e) In any tree nursery or planting in a manner which damages or destroys growing
stock.
(f) On private property, without the written consent of theowner or lessee thereof.
(g) The owner, lessee, or occupant of premises owes no duty to keep the premises
safe for entry or use by others for snowmobiling, or to give warning of any unsafe
conditions on such premises.
(h) It is unlawful for any person to drive or operate any snowmobile on a street
or highway within the Village limits except as follows:
1. On streets or highways other than tollways, interstate highways and
Limited access highways, snowmobiles may make a direct crossing provided:
(a) The crossing is made at an angle of approximately ninety (90) degrees
to the direction of the highway and at a place where no obstruction pre-
vents a quick and safe crossing; and
(b) The snowmobile is brought to a complete stop before crossing a high-
way; and
(c) The operator yields the right-of-way to all oncoming traffic which
constitutes a hazard.
2. On highways or streets other than State highways, tollways, interstate
highways and limited access highways snowmobiles may be operated not less
than fifteen (15) feet from the roadway and in the same direction as traffic.
3. On highways or streets other than State highways, tollways, interstate
highways and limited-access highways, snowmobiles may be operated on road-
ways when it is necessary to cross a bridge or culvert or when it is imprac-
ticable to gain immediate access to an area adjacent to a highway where a
snowmobile is to be operated.
(i) It is unlawful for any person without a valid motor vehicle driver's license
to operate a snowmobile as provided in the above section dealing with streets and
highways.

REGULATIONS FOR BICYCLES ' -
,,-101 Effect of Regulations
(a) It is a misdemeanor for any person to do any act forbidden
or fail to perform any act required in this article.
(b) The parent of any child and the guardian of any ward shall
not authorize or knowingly permit any such child or ward to
violate any of the provisions of this ordinance.
(c) These regulations applicable to bicycles shall apply when-
ever a bicycle is operated upon any highway or upon any path
set aside for the exclusive use of bicycles subject to those
exceptions stated herein.
4-102 Traffic Laws Apply to Persons Riding Bicycles
Every person riding a bicycle upon a roadway shall be gran-
ted all of the rights and shall be subject to all of the
duties applicable to the driver of a vehicle by the laws
of this State declaring rules of the road applicable to
vehicles or by the traffic ordinances of this village
,applicable to the driver of a vehicle, except as to special
regulations in this article and except as to those provi-
sions of laws and ordinances which by their very nature have
no application.
4-103 Obedience to Traffic-Control Devices
(a) Any person operating a bicycle shall obey the instructions
of official traffic-control signals, signs and other control
devices applicable to vehicles, unless otherwise directed by
a police officer.
(b) Whenever authorized signs are erected indicating that no
right or left or "U" turn is permitted, no person operating
a bicycle shall disobey the direction of any such sign, ex-
cept where such person dismounts from the bicycle to make
any such turn, in which event such person shall obey the
regulations applicable to pedestrians.
4-104 Riding on Bicycles
(a) A person propelling a bicycle shall not ride other than
astride a permanent and regular seat attached thereto.
(b) No bicycle shall be used to carry more persons at one time
than the number for which it is designed and equipped .
4-105 Riding on Roadways and Bicycle Paths
(a) Every person operating a bicycle upon a roadway shall ride
as near to the right side of the roadway as practicable
exercising due care when passing a standing vehicle or one
proceeding in the same direction.
(b) Persons riding bicycles upon the roadway shall not ride more
than two abreast except on paths or parts of roadways set
aside for the exclusive use of bicycles .
(c) Wherever a usable path for bicycles has been provided adja-
cent to a roadway bicycle riders shall use such path and
shall not use the roadway.
(d) All motorized vehicles are prohibited on any posted bicycle path.

4-106 Speed
No person shall operate a bicycle at a speed greater
than is reasonable and prudent under the conditions
then existing .
4-107 Emerging from Alley or Driveway
The operator of a bicycle emerging from an alley, drive-
way or building shall upon approaching a sidewalk or the
sidewalk area extending across any alleyway, yield the
right of way to all pedestrians approaching on said side-
walk or sidewalk area , and upon entering the roadway shall
yield the right of way to all vehicles approaching on said
roadway.
4-108 Carrying Articles
No person operating a bicycle shall carry any package,
bundle or article which prevents the rider from maintaining
adequate control of the bicycle, for the safety of rider and pedestrians
in the area.
i09 Parking
No Person shall park a bicycle upon a street other than
upon the roadway against the curb or upon the sidewalk
in a rack to support the bicycle or against a building
or at the curb, in such a manner as to afford the least
obstruction to pedestrian traffic.
4-110 Riding on Sidewalks
(a.) No person shall ride a bicycle upon a sidewalk within a
business district.
(b) The Chief of Police is authorized to erect signs on any
sidewalk or roadway prohibiting the riding of bicycles
thereon by any person and when such signs are in place,
no person shall operate a bicycle in such designated areas.
4 Ill Lamps and other Equipment on Bicycles
(a) Every bicycle when in use at nighttime shall be equipped
with a Tamp on the front which shall emit a white light
visible from a distance of at least five hundred (500)
feet to the front and with a red reflector on the rear of
a type which shall be visible from all distances to three
hundred (300) feet to the rear when directly in front of
lawful upper beams of headlamps on a motor vehicle. A
lamp emitting a red light visible from a distance of five
hundred (500) feet to the rear may be used in addition to
the red reflector.
(b) No person shall operate a bicycle unless it is equipped
with a bell or other device capable of giving a signal
audible for a distance of at least one hundred (100) feet,
except that a bicycle shall not be equipped with nor shall
any person use upon a bicycle any siren or whistle.

REGULATION OF TRAFFIC IN SHOPPING CENTER

REGULATION OF TRAFFIC
5-101 Whereas, Article II Section 11-209 of Chapter 95-1/2, Illinois Revises Sta-
tutes, 1973, and Section 1-1-7 of Chapter 24, Illinois Revised Statutes,
authorizes municipalities to enter into a contract with the owners of real
estate on which a shopping center is located for the purpose of establishing
traffic regulations within the parking areas and the Oak Brook Center, Inc.,
is located within the Village of Oak Brook and a contract pursuant to the
aforesaid statutory provisions has been entered into, the regulations per-
taining thereto are imposed in accordance with "Schedule XII" attached
hereto and by this reference made a part hereof.
ARTICLE VI
PENALTY
DIVISION I
6-101 Penalty
Any person, firm or corporation violating any provision of this Ordinance
shall be fined not less than five dollars nor more than five hundred dollars
for each offense, unless otherwise so stated in this Ordinance.
6-102 Arrests
Any person arrested for a violation of any provision of this Ordinance shall
be released upon proper bail being furnished as required by law_
6-103 Prima Facie Proof
The =act that an automobile which is illegally.operated or parked:is-*gistered
in the name of a person shall be considered prima facie proof that such person
was n control of the automobile at the time of such violation.
ARTICLE VII
VALIDITY
DIVISION I
7-101 Conflicting Ordinance
All orcinances and parts of ordinances in conflict herewith, to the extent of such
conflict are hereby repealed.

7-102 Validity
If any part of parts of this Ordinance shall be held invalid for any
reason whatsoever, such decision shall not affect the validity of the
remaining part or parts of this Ordinance-

as if fully set forth in the pertinent sections of this Ordinance.

5-201 Speed Restrictions
E It shall be unlawful to drive any motor vehicle on any street or
j drive in the Oak Brook Shopping Center at a speed in excess of
!€ twenty (20) miles per hour.
' 5-202 Parking Rules
It shall be unlawful within the Oak Brook Shopping Center to per-
S mit any vehicle to stand at any time in any of the following places
(a) At any curb except at a loading zone so designated by sign.
(b) At any place where the vehicle would block the use of a
driveway.
(c) On any sidewalk or parkway.
(d) At any place where official signs prohibit parking.
(e) At any place designated a fire lane.
(f) The police department and all members thereof are hereby
authorized to remove and tow away or have removed and tow
away by commercial towing service, any car or other vehicle
illegally parked in any place where such parked vehicle create
or constitutes a traffic hazard, blocks the use of a fire hy-
drant or obstructs or may obstruct the movement of any emer-
gency vehicle.

Cars so towed away shall be stored on any Village property or
in a public garage or parking lot and shall be restored to
the owner or operator thereof after payment of the expense
incurred by the Village in removing and storing such vehicles.
(g) Appropriate signs shall be posted in all areas where parking i
limited or prohibited, indicating such limitations or prohi-
bitions.
5-203 Loading zone - Service area
It shall be unlawful for the driver of a vehicle to stand a passen-
ger vehicle for a period of time longer than is necessary for the
loading or unloading of passengers or freight in any place desig-
nated as a loading zone or service area and marked as such.
5-204 Yield right-of-way
Any drive or street within the Oak Brook Shopping Center designated
as a yield right-of-way street and so posted is hereby declared to
a yield right-of-way street.
The driver of a vehicle in obedience to a yield right?of-way sign
shall reduce the speed of his vehicle and shall yield the right-of-
way to other vehicles which have entered the intersecting street or
drive either from the right or left or which are approaching so
closely on such intersection as to constitute a hazard; but said
driver having so yielded may proceed at such time as a safe inter-
val occurs.
5-205 Appropriate signs shall be posted to show all yield right-of-way
streets or drives.

5-206 Stop streets
The driver of a vehicle shall stop in obedience to a stop sign at
an intersection where a stop sign is erected pursuant to this ordi-
nance, at one or more entrances thereto, and shall proceed cautious
yielding to the vehicles not so obligated to stop which are within
the intersection or approaching so close as to constitute an imme-
diate hazard, unless traffic at such intersection is controlled by
a police officer on duty, in which event the directions ofthe
police officer shall be complied with.
5-207 Appropriate signs shall be posted to show all stop intersections.

It shall be unlawful for any driver of any vehicle to disobey the instruc-
tions of any traffic control signal light at the following intersections
to-wit:
