AN ORDINANCE GRANTING VARIATIONS TO SECTION VII D, 8,
b and c OF ORDINANCE NO. G-60, AS AMENDED, THE ZONING
ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND
COOK COUNTIES, ILLINOIS TO THE TERRITORY COMMONLY
KNOWN AS 3500 NORTH MADISON STREET, OAK BROOK, ILLINOIS
WHEREAS, the owner of the territory hereinafter described
has petitioned the Corporate Authorities of the Village of Oak Brook,
DuPage and Cook Counties, Illinois, for variations to the rules and
regulations of the Zoning Ordinance of the Village relating to the R-2
District so as to permit construction of an addition to a residence
which encroaches on the required side and rear yards; and
WHEREAS, a public hearing to consider testimony on said
petition was held, pursuant to statutory public notice, before the Zoning
Board of Appeals of the Village of Oak Brook on December 7, 1976; and
a
WHEREAS, the said Zoning Board of Appeals, after said public
hearing, has recommended that the requested variation be granted; and
WHEREAS, the Corporate. Authorities of the Village of Oak Brook
deem the passage of this Ordinance to be in the best interest and in
furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, as follows:
SECTION 1 The provisions of the preamble hereinabove set forth
are hereby restated herein as though herein fully set forth.
SECTION 2: The provisions of Section VII, D. 8, b and c of Ordinance
No. G-60, as amended, the Zoning Ordinance of the Village of Oak
Brook, are hereby varied to permit an addition to th-- :north side of the
existing frame residence on the territory described below, with a
resulting side yard of not less than nine feet (91) and a rear yard of
not less than sixteen feet (161), to the north and west sides of the addi-
tion respectively.
SECTION 3: The territory to which the above variance is granted
is legally described as. follows:
Lots 1, 2, 3, 4, 5 and 6 in Block 3 in River Bluff
addition to Hinsdale, a subdivision in Sections 35
and 36, Township 39 North, Range 11 East of the
Third Principal Meridian, according to the plat
thereof recorded September 3, 1895 in Book 5 of
Plats, Page 21, as Document No. 59511 in DuPage
County, Illinois, and the East half of the vacated
alley lying adjacent to and West of the West line of
said Lots 1, 2, 3, 4, 5 and 6
SECTION 4: The aforesaid variation is granted based on the hardship
demonstrated by the owner and the finding by the Zoning Board of Appeals
that the variation will not alter the essential character of the neighbor-
hood.
SECTION 5: This Ordinance shall be in full force and effect from and
after its passage and approval as by statute in such cases made and
provided. This Ordinance shall be published in pamphlet form.
SECTION 6: All ordinances, rules, and regulations of the Village of
Oak Brook which are in conflict with the provisions of this Ordinance
are hereby repealed to the extent of the conflict, and only as they apply
to the territory hereinbefore described.
SECTION 7: If any section, subsection, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid, such determin-
ation shall not affect the validity of any remaining portion of this
Ordinance.
