AN ORDINANCE GRANTING A VARIATION TO SECTION X, C. 3.
OF ORDINANCE NO. G-60, AS AMENDED, THE ZONING ORDI-
NANCE OF THE VILLAGE OF OAKBROOK, DU PAGE AND COOK
COUNTIES, ILLINOIS TO THE TERRITORY COMMONLY KNOWN
AS 1909 SPRING ROAD, OAK BROOK, ILLINOIS
WHEREAS, the owner of the territory hereinafter described
has petitioned the Corporate Authorities of the Village of Oak Brook,
DuPage and Cook Counties, Illinois, for a variation to the rules and
regulations of the Zoning Ordinance of the Village relating to the
ORA-2 District so as to permit construction of additional floor area
on the subject territory; and
WHEREAS, a public hearing to consider testimony on said
petition was held, pursuant to statutory public notice, before the
Zoning Board of Appeals of the Village of Oak Brook on November 4
and December 8, 1976; and
WHEREAS, the said Zoning Board of Appeals, after said public
hearing, has recommended that the requested variation be granted
subject to certain conditions; and
WHEREAS, the Corporate Authorities of the Village of Oak
Brook deem the passage of this Ordinance to be in the best interest
and in furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, as follows:
SECTION 1: The provisions of the preamble hereinabove set forth
are hereby restated herein as though herein fully set forth.
SECTION 2: The provisions of Section X, C. 3. of Ordinance No. G-60,
as amended, the Zoning Ordinance of the Village of Oak Brook, are
hereby varied to permit a floor area ratio of .3414 to the subject
territory described below, upon the following terms and conditions:
(a) The additional floor area shall be used for the
purposes set forth in the petition requesting
the variation granted herein.
(b) The petitioner shall provide the berming, land-
scaping and shielding as set forth in the hearing
before the Zoning Board of Appeals and contained
in the record thereof.
SECTION 3: The territory to which the above variance is granted is
legally described in Exhibit A attached hereto which by this reference
is incorporated herein as though herein fully set forth.

SECTION 4: This Ordinance shall be in full force and effect from and
after its passage and approval as by statute in such cases made and pro-
vided. This Ordinance shall be published in pamphlet form.
SECTION 5: All ordinances, rules, and regulations of the Village of
Oak Brook which are in conflict with the provisions of this Ordinance
are hereby repealed to the extent of the conflict and only as they apply
to the territory hereinbefore described.
SECTION 6: If any section, subsection, sentence, clause, or phrase
of this Ordinance is for any reason held to be invalid, such determin-
ation shall not affect the validity of any remaining portion of this Ordinance.

Minutes - December 8, 1976
Item 3 - Oak Brook Hotel Company Variation
Mr. Richard Benware, 205 South Washington, Wheaton, was present to represent
the Oak Brook Hotel Company.
He briefly reviewed the proposed plan. He stated that they were seeking a
variation to allow 7-8,000 feet additional to the Hyatt House to allow for
the construction of office area and an enclosed patio for reception area.
He indicated that at the last meeting, there were questions as to if they
could establish a hardship - he referred the board to the letter written
on November 24, 1976 from himself.
Mr. Lavery commented that he believed the applicant had met the hardship
standards prescribed in Ordinance G-60.
Mr. Baroni questioned the building department if a review had been made of the
calculations of the area. Mrs. Lakosil responded that there had been a review
made.
Mr. Fraser asked if testimony from the homeowners had been met with. Mr. Benware
stated that they were committed in writing to Timber Trails Homeowners and that
berming would take place.
Mr. Muschler asked Mr. Bianucci if the Zoning Board of Appeals was in a position
to grant a variation. Mr. Bianucci referred the question to the Building
Department. They indicated that a variation would be in order.
Mr. Baroni called for those in the audience wishing to respond for the application.

Mr. Baroni then called for those in the audience wishing to speak against the
application. No one responded.

To recommend that the variation be granted as requested for findings

Gentlemen:
In considering our request which will permit the construction
of additional facilities for the Oak Brook Hyatt House, we
ask that you take note of rationale set forth below in
determining that there is a hardship.
1. THE PROPERTY IN QUESTION CANNOT YIELD REASONABLE RETURN:
In the original development plans for the property, the
entire F.A.R. allowable was and is necessary to make the
investment viable with the growing demands of the business
community.
2. PLIGHT OF OWNER DUE TO UNIQUE CIRCUMSTANCES:
(a) Our original building permit was based on floor area
ratio determined against the gross land mass. (To
center lines of both Spring & Harger Roads. )
(b) Clarification is required as our floor area ratio
is now presumably determined against net land mass.
This has caused the hotel to become non-conforming
as to F.A.R.
(c) We are the only hotel in an ORA 2 zone with B-2 use
that is bound on two sides by roads and on the third
by a creek. This prevents expansion of land mass.
(d) There is restrictive zoning on adjacent property.

total land area to be figured to the centerlines of Spring Road and Harger
Road, 15.383 acres (670,084 square feet) .

OAK BROOK HOTEL CO. - Review Village Board Decision
Mr. Benware was present representing the Oak
Brook Hotel Company.
The question was raised by the Plan Commission
as to why this matter was again before the Plan Commission.
Trustee Art Philip stated that the plan that
they are now referring to is different from the one
approved by the Plan Commission and that the Village
Board requested that the Plan Commission review the
revised site plan. It was noted that the Village
Board had voted to approve the Plat of Resubdivision,
conditioned upon further review by the Plan Commission
of the site plan.
Mr. Benware stated that he had the plat of
subdivision with him and that he was waiting for the
necessary signatures of the Village. Mr. Carmignani
stated that Mr. Balling will review with him the
necessary requirements as spelled out in the Subdivision
Control Ordinance and when all these requirements
are met, Mr. Balling will advise the staff.
Mr. Benware stated that he would contact Mr. Balling
tomorrow.

for the past eight (8) years and my office has been in Oak Brook
for the past seven (7) years.
I have also been a customer of the Oak Brook Hyatt House since
it opened and have been a member of the Spring Oak Club for over
two years.
It is my understanding that the Oak Brook Hotel Company (owners
and operators of the Oak Brook Hyatt House) have on file with
the Zoning Board of Appeals and with the Village Board of
Trustees, a petition asking for a variance to their ORA-2 zon-
ing, to increase their building area so that a ballroom can be
constructed in the Natoma Gardens area and office space in the.
"low roof" area at the front of the hotel. I also understand
that the hearing in connection with same is set for November 3,
1976 at 7: 30 P.M. , before the Zoning Board of Appeals and on
November 9, 1976 at 7:30 P.M, , before the Village Board of
Trustees.
It is my further understanding that if the Oak Brook Hotel
Company's petition is denied, that they plan to close the Spring

Dear Spring Oak Club '•te:nber:
The owners of this prop 'rty for some time, n0',a .Dave attempted to
secure concurrence from the Village of Oak Brook which would
permit the construction of an additional ballroom. Our business
is primarily geared to corporations and associations which
require meeting room facilities for groups numbering 30 to 250
persons. Frankly, from the date this hotel opened we have
needed what we call a "break-out" room, a room comparable in
size to our Natoma ballroom, which ideally would be located
directly across the hallway in the Natoma Gardens.
The Village in September 1975 agreed to an expansion program
for the hotel which would have permitted construction of the
ballroom, additional office space , and a legitimate theatre.
The agreement was tied to our acquisition of the acreage
directly west and across Spring Road from the hotel , and our
willingness to participate in. the cost of re-locating and
widening Spring Road, north of Harger Road, This was not a
variation. The agreement simply allowed us to combine two
parcels of land into one lot for the purpose of expanding our
floor area ratio capability. The Village in July of 1976
advised they would not permit our expansion program, unless
and until contracts were let on the road construction, which
is at the minimum, two years hence, and perhaps not at all.
This was a, significant chance of position from that expressed
in the written agreement between the Village and the hotel
owners. At the time of the July 1976 notification, final
architectural drawings for the ballroom ,-;ere complete as were
preliminary drawings for the balance of the facilities.
It seemed prudent to cooperate with the Village. Therefore the
theatre complex is being developed west of the hotel and across
Spring Road. We must have the new ballroom and office space as
part of the existing facility. We are considering two options,
the second of which requires your assistance.
Option 1. Eliminate the health club and indoor swimming
pool, in favor of utilizing this 4200 square
feet for a meeting room and office space.
We do not favor this plan but will be forced
to implement it because of business cemancs,
unless the second option becomes possible.
Option 2 , Construct the ballroom in the Natoma Gardens
area and the offices in our " low roof" area,
at the front of the hotel .

The Oak Brook Hyatt House operates an athletic club which I and
approximately 250 other local business and professional men rely
on to provide facilities for physical conditioning and relaxation.
It is my understanding that the hotel owners may convert the club
into a banquet and meeting room because of a need for additional
space of this type. This would be a great loss to those of us who
use the club and I would like to see this avoided if at all possible.

The Hyatt House requires an additional 4, 000 square feet. If a
zoning variance could be granted to the Hyatt House, I understand
that they would •construct a new meeting room and thereby preserve
the athletic club.
I realize that you have an obligation to all of the members of the

years and have been waiting many years for the opportunity for a

been able to relieve a lot of stress. I have also lost over 45
pounds and it has been a tremendous opportunity for me and my family
to utilize this health club. We have been notified that it may be
necessary for the Hyatt House to close this facility in order to
gain more space for the functions of the hotel. I would like to
encourage you to consider a variation to the zoning considerations
so that the health club may be retained. I feel that this club

I am writing in reference to a zoning variation being requested
by the Oak Brook Hyatt House.
As one of the original "inhabitants" and major employers in
the Oak Brook business coim=ity for 15 years, we at Donnelley
have been extremely happy with the environment of the community.
For a long time, one of the only types of facilities that was
not available for the Oak Brook businessman was an athletic club
or a place to go and make some attempt at keeping physically
fit. About 4 years ago, the Oak Brook Hyatt House
provided such a facility in the form of the Spring .Oak Club. This
has been a much-used club for many members of the Oak Brook
business community. However, more space is needed by the hotel
to provide for their regular rmney-making activities. That space
is going to have to come at the expense of the Spring Oak Club
since that is the only available low revenue producing space
that the hotel has left.
If, however, the zoning variance that the hotel is seeking is
approved, the club would remain in existence. The approval, as
I understand it, would amount to a very small incase in the
percentage of land being occupied by the entire Hyatt House
structure. Although I realize that tight zoning requirements
have been at least partially responsible for the excellent
working conditions that we all enjoy, I would ask that you
give strong consideration to this particular request. It affects
many individuals at many different companies. We all would
certainly appreciate your efforts and consideration along this
line.

careful vigilance you gentlemen have shown in reviewing each
new zoning request has played a major role in shaping Oak Brock
into a model community. zo I ask not that you suspend any of
the zoning; codes in this instance, nor slacken your vigilance, but
only that you restudy the proposal to see if in any way the

Ever since coming to Oak Brook, I found it to be an excellent community
to work in. It offers the professional and sociological environments
required to house corporate functions. Our company headquartered in
this fine community basically for these reasons. We have found the
community to offer activities that make some of the strenuous aspects of
the job more tolerable. One of the situations is the Spring Oak Club
housed at the Hyatt House. Recently we found out that the aforementioned
club will cease operations because of a negative response to an expansion
(4,000 square feet) proposal.
Our ccampany utilizes the Spring Oak Club to the extent that it is a daily
routine that serves the above purpose. I appreciate your point of view,
wanting to preserve your community for its inhabitants. This is admirable.

Gentlemen:
Our company chose to relocate in Oak Brook in 1969 ,
because we recognized it to be the finest suburban business
community available to meet our particular needs. This
includes excellent banks and hotels, easy access to our
interstate expressways, and many other amenities too numerous
to mention.
One thing that we found to be of great use to us
is the Spring Oak .Club in the Hyatt House Hotel. Our
firm has three members in the club and make daily use of
its facilities. We now have been advised by the management
of the Hotel that our club will be closed by the end of
this year due to the need of additional space requirements
for meeting rooms. They advised us that they have been
turned down by the zoning committee to build the additional
space that they require on the existing structure.
We would like to appeal to you for a restudy of the
Hyatt House request for this permit, so as the Spring Oak
Club can continue as a needed facility to the business
community of Oak Brook.

Dear Ken:
As you know from previous conversations, we have had, the Timber Trails
Property Owners Assocation and the residents it represents have always
been most concerned over the location of the Hyatt House Hotel. This
concern is based on two points. First, its location, contiguous to
residential areas. We feel that a structure of this size is against the
general policy set forth in the Village Comprehensive Plan, calling for
buffering between commerical and residential areas. In no way does The
Plan contemplate a structure of such mass looking down on single family
residents. We feel the village made a serious mistake in permitting
such a structure on this site while it has rejected efforts to do this
sort of thing in other locations. The Villages handling of the recent
Drake Hotel Expansion Request we feel was an example of a more responsible
and consistant application of village policy and philosophy.
Our second area of concern is that in approving construction on this
site a substantial amount of Salt Creek flood plain was filled-in with
no apparent effort made to compensate for such action. It is our feeling
that both of these decisions on the part of the village were contrary to
basic principles of sound, responsible urban planning.

Feeling as we do you can understand our concern when just recently the
Village appeared to be willing to do just about anything it could
including the moving of Spring Road to facilitate even more massive
construction on this obviously inappropriate site. It now appears
however, that Hyatt House management (Oak Brook Hotel Corp.) has recog-
nized that due to severe outside agitation by radical Housing groups,
the timetable for construction of the changed roadway offered by the
village, will probably be delayed to a point that is unacceptable to
them. It is our understanding that they have now voluntarily decided
to:
1. Limit construction on the present site to that
which would be done within the outside walls of the
existing structure.
2. Any new construction (the theatre) will be done on the
West side of Spring Road without the road being moved.
We feel that this is a much more logical solution to the problem. We
are only disappointed that it does not represent the firm stand that
should have been taken by the village in the first place.
Assuming our understanding of the final construction plans, as outlined
above, are accurate, some of our present concerns are first, that ab-
solutely no more of the flood plain be filled in for any reason in
conjunction with this project and secondly, that some concrete steps be
taken to insure that the additional traffic generated by the theatre be
channelled out to Highway 83 and be kept off of the Frontage Road
(Roosevelt Road) that runs North of Timber Trails.
We are asking for and would certainly appreciate the cooperation of all
involved agencies of the Village in implementing these requests.
