AN ORDINANCE AMENDING ORDINANCE NO. G-140, AS AMENDED, THE
SUBDIVISION REGULATIONS ORDINANCE OF THE VILLAGE OF OAK
BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS
WHEREAS, the Plan Commission of the Village of Oak Brook
has reviewed the provisions of Ordinance No. G-140, as amended, the Sub-
division Regulations Ordinance; and
WHEREAS, the Plan Commission considers the controls on
subdivision gateways to be insufficient; and
WHEREAS, the Plan Commission has held a public hearing ,
pursuant to statutory notice to consider what restrictions should be placed on
subdivision gateways; and
WHEREAS, the Plan Commission has recommended certain
amendments to the President and Board of Trustees of the Village of Oak
Brook; and
WHEREAS, the President and Board of Trustees deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties,
Illinois, that
SECTION 1: The provisions of the preamble hereinabove set forth are hereby
restated herein as though herein fully set forth.
SECTION 2: Article IV, Section 2A of Ordinance No. G-140, as amended, is
hereby amended by the addition of subsection 32.a. as follows:
32.a. SUBDIVISION GATEWAY-- A structure,
guard house, monument or landscaping arranged
in such a fashion as to identify a subdivision.and
provide an entranceway for the subdivision
SECTION 3: Article V, Section 3. C. of Ordinance No. G-140, as amended, is
hereby amended by the addition of subsection 10. as follows:
10. The proposed location and design of any sub-
division gateway.
SECTION 4: Article VI, Section 2. E. of Ordinance No. G-140, as amended, is
hereby amended by the addition of subsection 2. as follows:
2. Complete plans and specifications of any sub-
division gateway prepared by a registered pro-
fessionai architect and based upon the conditions
of approval of the preliminary plans and specifi-
cations. The applicant will have obtained
approval from all governmental agencies having
jurisdiction over or rights in the property on
which such subdivision gateway is proposed to
be located, other than the Village of Oak Brook,
prior to submission of said final plat to the Plan
Commission. Plans and specifications shall be
approved by the Village Engineer, Building
Commissioner, and other public officials having
jurisdiction and such approval certified on the
final plat.
SECTION 5. Article VII, Section 3 of Ordinance No. G-140, as amended, is
hereby amended by the addition of subsection L. as follows:
L. Subdivision Gateways
a. May be located in the right-of-way of a
street providing access_ to a subdivision (herein-
after referred to as an "access street") and on
the right-of-way of the collector street into
which such street connects, provided that the
subdivision gateway does not extend more than
60 feet from the center line of the access street
at the point where said center line intersects
right-of-way of said collector street and that said
_ subdivision gateway is located on the right-of-way
between the roadway and the subdivision. The
subdivision gateway may be located on the access
street right-of-way provided it conforms to all
applicable ordinances, rules and regulations of
the Village.
b. Must be located 12 feet or more from the back
of the curb or edge of the pavement, if there is no
curb, of the above described streets, except that
portions thereof not more than 42 inches above the
center line grade of said street may be located not
less than 7 feet from the back of the curb or edge
of the pavement, if there is no curb, of the above
described street.
c. Must be 3 feet or more from the nearest lot line
of the nearest buildable lot.
d. Structures shall be not more than 15 feet in
height.
e. Shall provide an acceptable sight distance and
safe pathway for pedestrian and bicycle access as
determined by the Village Engineer. Such path-
ways shall be at least 6 feet wide on one or both
sides of the above described street.
f. May be located on a median in the access street
provided the portion on such median is not more
than 42 inches above the center line grade of the
said street.
g. May have lettering not exceeding 12 inches in
height attached thereto identifying the subdivision.
h. May include guardhouses and bays if such struc-
tures are not located in a right-of-way and provide
adequate stacking of vehicles, screening and adequate
sight-distance as. determined by the Village Engineer.

i. Must be maintained by the developer or suc-
cessur homeowners pursuant to covenants running
with the land acceptable to the Village Board. The
developer or homeowners shall be responsible for
all costs or increases in costs, incurred by public
utilities or public bodies in carrying out their
public duties, if such costs, or increases in costs,
result from the existence of said subdivision
gateway.
j. May be removed by the Village at the developers'
or homeowners' expense upon thirty (30) days notice
if said subdivision gateway is not being maintained
to the satisfaction of the Village Board. The cost
of such removal shall constitute a lien against the
land in the subdivision for the benefit of the Village.
k. If illuminated, should be illuminated so that
passing traffic can readily identify these entrances
as an aid in judging turning movements, as opposed
to high intensity lighting.
SECTION 6: This Ordinance shall be in full force and effect from and after its j
passage and approval as by statute in such cases made and provided. This
Ordinance shall be published in pamphlet form.
jSECTION 7: All ordinances, rules, and.regulations of the Village of Oak Brook
I which are in conflict with the provisions of this Ordinance are hereby repealed
to the extent of the conflict and only as they apply to the territory hereinbefore
described.
SECTION 8: If any section, subsection, sentence, clause or phrase of this Ordi-
nance is for any reason held to be invalid, such determination shall not affect
the validity of any remaining portion of this Ordinance.
