AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDI-
NANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS; ESTABLISHING
THE SAME; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES
NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED;
PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDI-
NANCES; PROVIDING A PENALTY FOR THE VIOLATION THEREOF;
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, Illinois, as follows:
SECTION 1: That this ordinance, consisting of Chapters 1 through
13, inclusive, is hereby adopted and enacted as the "Code of Ordinances,
Village of Oak Brook, Illinois, " and shall be treated and considered as a
new and original comprehensive ordinance which shall supersede all
other general and permanent ordinances enacted by the President and
Board of Trustees on or before May 25, 1976, except such as by refer-
ence thereto in this Ordinance or Code or an ordinance passed by the
President and Board of Trustees after May 25, 1976, are expressly
saved from repeal or continued in force and effect for any purpose, or
such as are referred to in the following section hereof.
SECTION 2: That the repeal provided for in Section 1 hereof shall
not affect any of the following:
(a) Any ordinance or resolution promising or guaran-
teeing the payment of money for the Village, or
authorizing the issuance of any bonds of the
Village or any evidence of the Village's indebted-
ness, or any contract or obligation assumed by
the Village;
(b) Any administrative ordinances or resolutions of
the Village Board of Trustees not in conflict or
inconsistent with the provisions of such Code;
(c) Any right or franchise granted by any ordinances
of the Village;
(d) Any ordinance dedicating, naming, establishing,
locating, relocating, opening, paving, widening,
vacating, etc. ., any street or public way in the
Village;
(e) Any appropriation ordinances;
(f) Any ordinances levying or imposing taxes;
(g) Any zoning ordinance or any amendment thereto;
(h) Any ordinance establishing or prescribing grades
in the Village;
(i) Any ordinance providing for local improvements
and making assessments therefor;
(j) Any ordinance extending or contracting the bound-
aries of the Village;
(k) Any building ordinance and amendments thereto;
(1) Any electrical ordinances, and any amendments
thereto;
(m) Any plumbing ordinance and any amendments
thereto;
(n) Any ordinance prescribing the number, classifi-
cation or compensation of any Village officer or
employee, not inconsistent herewith;
(o) Such repeal shall not be construed to revive any
ordinance or part thereof that has been repealed
by a subsequent ordinance which is repealed by
this ordinance.
SECTION 3: That all ordinances enacted by the President and Board
of Trustees after May 25, 1976 and before the adoption of such Code which
amended or repealed ordinances the provisions of which have been included
in such Code shall be deemed to have amended or repealed the affected
provisions of such Code.
E SECTION 4: That any and all additions or amendments to such Code,
when passed in such form as to indicate the intention of the President
and Board. of Trustees to make the same a part thereof, shall be deemed
to be incorporated in such Code so that reference to the "Code of Ordi-
nances, Village of Oak Brook, Illinois," shall be understood and intended
to include such additions and amendments.
SECTION 5: That a copy of such Code shall be kept on file in the
Office of the Village Clerk, preserved in looseleaf form. It shall be the
express duty of the Village Clerk, or someone authorized by her, to
insert in their designated places all amendments or ordinances which
indicate the intention of the President and Board of Trustees to make the
same a part of such Code when the same have been printed or reprinted
in page form, and to extract from such Code all provisions which may
from time to time be repealed by the President and Board of Trustees.
This copy of such Code shall be available for all persons desiring to
examine the same and shall be considered the Official Code of Ordi-
nances of the Village of Oak Brook, Illinois.
SECTION 6: Whenever in such Code any act is prohibited or is made
or declared to be unlawful, or whenever in such Code the doing of any
act is required or the failure to do any act is declared to be unlawful,
where no specific penalty is provided therefor, the violation of any such
provision of such Code shall be punished by a fine of not more than five
hundred dollars ($500. 00). Each day any violation of any provision of
this Code shall continue shall constitute a separate offense.

SECTION 7: That in case of the amendment of any section of such
Code for which a penalty is not provided, the general penalty as provi-
ded in Section 6 of this ordinance and Section 1-8 of such Code shall
apply to the section as amended or in case such amendment contains
provisions for which a penalty, other than the aforementioned general
penalty is provided in another section in the same chapter, . the penalty
so provided in such other section shall be held to relate to the section
so amended, unless such penalty is specifically repealed therein.
SECTION 8: That it shall be unlawful for any person, firm or
corporation in the Village to change or amend by additions or dele-
tions, any part or portion of such Code, or to insert or delete pages
or portions thereof, or to alter or tamper with this Code in any
manner whatsoever which will cause the law of the Village of Oak Brook
to be misrepresented thereby. Any person, firm or corporation
violating this section shall be punished as provided in Section 1-8 of the
Code of Ordinances of the Village of Oak Brook, Illinois.
SECTION 9: All ordinances, rules and regulations of the Village of
Oak Brook which are in conflict with the provisions of this Ordinance
are hereby repealed to the extent of the conflict.
SECTION 10: If any section, sub-section, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid, such
determination shall not affect the validity of any remaining portion
of this Ordinance.
SECTION 11: This Ordinance shall be in full force and effect from
and after its passage, approval and publication as by statute in such case
made and provided. This Ordinance shall be published in pamphlet form.
