G-218 - 04/26/1977 - AGREEMENT - Ordinances ORDINANCE NO. N ORDINANCE AMENDING CHAPTER 9 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS, AND PROHIBITINQ DAMAGE TO PROPERTY WHEREAS, acts of vandalism causing damage to real or personal property within the Village of Oak Brook have increased and such acts threaten the value of property and welfare of residents of the Village of Oak Brook; and WHEREAS, it is in the best interests of the Village that such acts be prosecuted by the Village as a local offense and that penalties be imposed which are related to the nature of the act; and WHEREAS, numerous acts of vandalism have been committed by minors who upon a finding of guilty should be subject to penalties therefor. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as follows: SECTION 1: The provisions of the preamble hereinbefore set forth hereby are restated herein as though herein fully set forth. SECTION 2: That Chapter 9 of the Code of Ordinances of the Village of Oak Brook, Illinois, of ­.. `_ >971 be and is hereby amended by adding a new Section 9- as follows (a) Definitions 1. "Person" shall include any individual, firm, partnership, association, corpora- tion, company or organization of any kind. d 2. "Property" shall include any real estate including improvements thereon, and tangible personality. (b) Violation: It shall be a violation of this Ordinance for any Person to knowingly damage any property of another person without his consent. (c) Penalty: Any person convicted of any violation of this Ordinance shall be fined not more than Five Hundred Dollars ($500. 00) for each offense. SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication as by statute in such cases made and provided. This Ordinance shall be published in pamphlet form. SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict. SECTION 5: If any section, subsection, sentence, clause, or phrase of this. Ordinance -is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
