AN ORDINANCE AMENDING CHAPTER 9 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK, ILLINOIS, AND PROHIBITING THE
POSSESSION OF CANNABIS

WHEREAS, the Corporate Authorities of the Village of Oak Brook,
Du Page and Cook Counties, Illinois, have become aware of the widespread
illegal possession and use of cannabis within the Village of Oak Brook; and
3 WHEREAS, said Corporate Authorities recognize that the current
state of scientific and medical knowledge concerning the effects of cannabis makes
it necessary to acknowledge:the physical, psychological and social damage which
is incumbent upon its use; and
WHEREAS, said Corporate Authorities recognize the need to
provide an effective means of controlling such illegal. possession and use of
cannabis within the Village of Oak Brook; and
WHEREAS, said Corporate Authorities recognize that the unlawful
possession of small amounts of cannabis can be more effectively controlled and
the procedures thereto attendant more effectively administered on a Local basis;
and
WHEREAS, said Corporate Authorities deem the passage of this
Ordinance to be in the best interest and in furtherance of the general health and
welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as
follows
SECTION 1: The provisions of the preamble hereinbefore set forth are hereby
restated herein as though herein fully set forth.
\ SECTION 2:. That Chapter 9 of the Code of Ordinances of the Village of Oak
Brook, Illinois, of 7 7 be and is hereby amended by adding a new
Section 9-4, as follows:
9--ft Possession of Cannabis
(a) Cannabis Defined:
"'Cannabis' includes marihuana, hashish and other
substances which are identified as including any
parts of the plant Cannabis Sativa, whether growing
or not; the seeds thereof, the resin extracted from
any part of such plant; and any compound, manufac-
ture, salt, derivative, mixture or preparation of
such plant, its seeds or resin, including tetrahydro-
cannabinol (THC) and all other cannabinol derivatives,
including its naturally occurring or synthetically
produced ingredients, whether produced directly or
indirectly by extraction, or independently by means
of chemical synthesis or by a combination of
extraction and chemical synthesis; but shall not in-

�. clude the mature stalks of such plant, fiber
produced from such stalks, oil or cake made
from the seeds of such plant, any other
compound, manufacture, salt, derivative,
mixture, or preparation of such mature stalks
(except the resin extracted therefrom), fiber,
oil or cake, or the sterilized seed of such plant
which is incapable of germination. "
(b) Violation:
It shall be a violation of this Ordinance for any ,
person knowingly to possess not more than 30
grams of any substance containing cannabis.
(c) Penalty:
Any person convicted of any violation of the
provisions of this Ordinance shall be fined not
more than Five Hundred Dollars ($500. 00)
for each offense. Y
SECTION 3: This Ordinance shall be in full force and effect from and after its
passage, approval and publication as by statute in such cases made and provided.
This Ordinance shall be published in pamphlet form.
SECTION 4: All ordinances, rules, and regulations of the Village of Oak B%_- -)k
which are in conflict with the provisions of this Ordinance are hereby repea. -d
to the extent of the conflict.
SECTION 5: If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not affec
the validity of any remaining portion of this Ordinance.
